On some solutions for implementing the socio-economic plan for 2002

Implementation of the socio-economic plan for 2002

             

After more than three months of implementation of the 2002 plan, the national economy has faced many difficulties and significant challenges both domestically and internationally. However, with the high efforts and determination of ministries, localities, and production and business establishments, along with the close guidance of the Government and the Prime Minister, many mechanisms, policies, and measures introduced at the beginning of the year have been effectively implemented. As a result, there have been positive changes in several areas: industry continues to maintain a high growth rate; total social investment capital has reached a satisfactory level, especially state budget investment and residential investment; services have developed, state budget revenue has reached a satisfactory level... Although the results achieved in the first quarter of 2002 were lower than those of the same period in 2001 and the targets set for the whole year 2002, this is a great effort that needs to be further promoted in the coming time.

Alongside these positive changes, the socio-economic situation remains very difficult: export turnover is low and has decreased significantly compared to the same period in 2001; agricultural production is facing many major challenges, particularly prolonged drought and more severe damage than previous years, serious forest fires; industrial production in some major industrial centers has not yet stabilized; some social sectors have not improved significantly, people's lives in disaster-stricken areas still face many difficulties.

The remaining tasks in the coming months are extremely heavy. To overcome the above shortcomings and limitations, aiming to complete the socio-economic development targets for 2002 well and create momentum for the implementation of the five-year plan from 2001 to 2005, the Government requests ministries, sectors, and localities to thoroughly understand and effectively implement the groups of solutions approved by the National Assembly, while urgently implementing additional management measures for the 2002 socio-economic plan as follows:

 

I. Promote structural transformation of the economy:

Promoting the structural transformation of the economy is considered a group of solutions that are urgent in the short term and strategic in the long term. To promote the structural transformation of the economy, it is necessary to implement many synchronized solutions. In the short term, we need to focus on implementing the following solutions:

1. Planning work for economic structural transformation must start from the requirements of the domestic and international markets, the strengths and weaknesses of our products in each stage, thereby determining the roadmap to enhance competitiveness for each product in different regions. Planning must be regionalized, not simply based on administrative management levels, and must be adjusted promptly to meet changing market demands. According to the planning already determined, relevant agencies need to concentrate on organizing the implementation of the planning, quickly develop investment programs linked to enterprises and production households according to a suitable structure, promoting the transformation of the economic structure.

2. Continue to implement the agricultural economic structural transformation as stipulated in Resolution No. 05/2001/NQ-CP dated May 24, 2001 of the Government on supplementing some management measures for the 2001 economic plan and adjusting the contents prescribed in Resolution No. 09/2000/NQ-CP dated June 15, 2000 of the Government on some policies and guidelines for economic structural transformation and consumption of agricultural products.

Accelerate the progress of implementing the project to plant 5 million hectares of forests, combined with the program to plant raw materials for 1 million tons of pulp and paper based on planning linking paper and pulp factories with raw material regions.

Develop animal husbandry with a faster growth rate than crop cultivation, meeting domestic demand and exports, including meat, milk, and leather. The Ministry of Industry shall coordinate with the Ministry of Agriculture and Rural Development and related ministries and localities to promptly complete the planning proposal for developing dairy processing plants linked to raw material regions in accordance with Decision No. 167/2001/QĐ-TTg dated October 26, 2001 of the Prime Minister on some measures and policies to develop dairy farming in Vietnam during the 2001-2010 period to submit to the Prime Minister.

Aquaculture is another strength that can and should grow rapidly. The Ministry of Fisheries shall take the lead, together with the Ministry of Agriculture and Rural Development, to review and arrange suitable coastal areas for aquaculture, converting unstable and low-yield rice fields to aquaculture. The Ministry of Fisheries shall develop specific investment programs or guide all economic sectors to invest in developing shrimp and fish seedlings; guide aquaculture techniques, disease prevention, and control.

Along with reviewing and adjusting existing policies, supplementing new policies to encourage the structural transformation of agriculture in line with planning and plans, the Ministry of Agriculture and Rural Development shall direct the construction and summary of high-efficiency models of structural transformation for widespread application.

The Ministry of Agriculture and Rural Development shall urgently develop a proposal for equipment for forest protection and fire prevention to have sufficient capacity when incidents occur.

3. Transform the industrial structure towards increasing the proportion of manufacturing industry, especially high-tech industries, export-oriented industries, and industries serving agricultural development and rural economy such as textiles, footwear, machinery manufacturing, food processing, and agricultural products... Encourage the development of raw material regions to provide stable and long-term raw materials for processing industries.

Requirements for the electronics, information technology, telecommunications, and mechanical industries, export-oriented industries, especially the textile and leather industries, are not only to increase production volume but also to enhance the value created domestically in the total product value.

Implement projects for the development of the electricity, coal, oil and gas extraction and processing industries to ensure balanced and safe energy development. Rapidly increase mechanical manufacturing capacity, particularly for machinery serving agriculture, forestry, and fisheries. Selectively develop mining, metallurgy, chemical, fertilizer, and construction material facilities. Actively respond to the needs for national defense industry development.

Ministries, People's Committees of provinces and centrally governed cities (hereinafter referred to as provinces and cities) shall direct production units to enhance competitiveness through restructuring, technological innovation, and improved management levels. Industry-managing ministries must work with business associations and state-owned corporations to develop production plans for each product category, with specific measures to strengthen key and competitive products that directly contribute to economic growth, while also providing appropriate support to businesses and products lagging behind neighboring countries in terms of quality and price.

4. Vigorously transform service sectors towards concentrating investment in services with quick capital recovery and significant contributions to the state budget such as tourism, financial banking services, air transport, postal and telecommunications services. Mobilize all resources from both the state and society to develop and improve the quality of services that meet comprehensive human development needs like education, healthcare, and sports. Expand public life and family activity services.

5. Strengthen the guidance and management of ministries over key economic regions, especially planning, investment (Ministry of Planning and Investment); science, technology, and environment (Ministry of Science and Technology and Environment); vocational training (General Vocational Training Administration, Ministry of Labor, Invalids and Social Affairs); enhance cooperation and linkage between provinces and cities within key economic regions and those outside, forming some association organizations to promote regional economic development.

The Government and the whole society actively support difficult areas, particularly the northern mountains, Central Highlands, and the Mekong Delta, through economic and social development programs linked to poverty reduction and job creation initiatives.

Prioritize solving water supply for residents and livestock; strive to ensure sufficient water sources for agricultural production; promote the implementation of water resource construction projects to increase water storage capacity during the rainy season, regulate water supply during the dry season. Drought mitigation must be combined with forest fire prevention and typhoon protection. Flood control should go hand in hand with forest fire prevention and typhoon protection.

Ministries together with local authorities, especially in the Mekong Delta and central coastal regions, adjust production planning, infrastructure systems, and residential areas, focusing on preventing riverbank and seashore erosion to proactively prevent typhoons and floods; organize safe anchorage points for fishermen when typhoons occur. Create conditions for people in the Mekong Delta to have stable and secure lives, minimizing relocation, maintaining travel, study, and medical care during floods.

6. Ministries, provincial and municipal People's Committees, and State-Owned Enterprise Group 91 must urgently develop overall plans for restructuring, reforming, and enhancing the efficiency of state-owned enterprises, focusing on directing and implementing the restructuring of enterprise groups, accelerating the shareholding of state-owned enterprises in accordance with the spirit of the Central Resolution No. 3 (Session IX) and the Government's Action Program. Properly implement policies for surplus labor due to enterprise restructuring as stipulated in Decree No. 41/2002/NĐ-CP dated April 11, 2002, of the Government to help workers find new jobs. The determination of the value of state-owned enterprises should proceed with the competent authority deciding to establish a Valuation Council or select auditing companies or economic organizations with valuation functions to directly sign contracts to determine the value of enterprises.

Ministries and localities need to create favorable conditions regarding finance, land, market, seeds, technology, and vocational training for cooperative and cooperative societies to make new progress, supporting and supplementing household economies and farm economies; for small and medium-sized enterprises, private businesses, and foreign-invested enterprises to diversify forms and industries, truly becoming important contributors to wealth creation, employment generation, and enhancing the competitiveness of the economy.

Ministries and local authorities should proactively and positively implement the Central Resolution No. 5 (Session IX), striving to implement well the principle "All people compete to excel in economics, each household enriches itself, the community foundation, and the country."

II. Increase investment development and stimulate consumption:

1. Ministries and provinces/cities review investment programs and projects funded by the state budget to allocate concentrated and focused investments according to plan targets. Ensure adequate counterpart funds for ODA projects to guarantee implementation according to signed agreements, especially those scheduled for completion in 2002 and 2003. Allocate funds only when new projects have completed all required investment procedures. Ministries and localities must direct project sponsors to promptly carry out bidding and subsequent steps to ensure new projects start on schedule.

Localities with large revenues from land-for-project mechanisms, bonus revenue sharing, certain retained and additional revenues... must allocate funds for technical and social infrastructure investment projects and technological upgrades of ongoing investment projects, based on strictly following current investment procedures.

The ministries and localities that have been permitted by the Prime Minister to extend investment capital for basic construction projects from the 2001 plan to 2002 must urgently complete the remaining workload; at the same time, they are responsible for implementing the capital sources supplemented in the 2002 plan pursuant to Decision No. 216/2002/QĐ-TTg dated March 25, 2002, and Notification No. 17 BKH/TH dated April 5, 2002, of the Ministry of Planning and Investment for some urgent projects and tasks in 2002.

2. The Ministry of Finance continues to advance funds for project sponsors to implement transitional projects and important projects to ensure continuous construction according to schedule. The supervisory authority of the project sponsor is responsible for monitoring progress and overseeing the proper use of advanced funds. Financial agencies shall not advance funds or settle accounts for projects that do not comply with current regulations on investment management and construction.

3. Ministries and localities organize the review and approval of projects within their delegated authority of the Prime Minister for Group A projects listed in approved planning schemes or investment policies without preparing a pre-feasibility study report but directly prepare a feasibility study report.

The Chairman of the Management Board of General Corporation 91 is tasked with approving feasibility reports for Group B and C projects managed by General Corporation 91 that are included in planning schemes or approved by competent authorities in the five-year plan, regardless of the source of investment, and bears full responsibility for ensuring sufficient funding to implement the projects according to schedule.

Project investors must fully calculate all works related to land clearance (area to be cleared, number of people requiring resettlement, other assets of individuals, organizations, and the State... that need to be relocated) to serve as the basis for adequate investment requirements, with appropriate implementation plans closely aligned with the project schedule. The Chairman of the People's Committee of provinces and cities shall establish compensation price frameworks and make specific compensation decisions consistent with national price frameworks., They shall organize and direct land clearance before implementing the projects.

5. Projects belonging to Groups B and C, which are not required to undergo international bidding, are allowed to apply the designated tendering method for consultancy and design packages; competitive bidding may be applied for: construction and installation packages once technical designs and budgets have been approved, and equipment procurement packages when all technical parameters are available. The project investor shall independently decide and bear full legal responsibility for all aspects related to designated tendering and competitive bidding.

Projects using 100% domestic capital are not required to go through international bidding, except for parts of equipment and high-tech products that our country cannot produce and must import from abroad. In necessary cases, such projects are allowed to hire consulting experts and supervisors both domestically and internationally or purchase technology for domestic production.

6. The Ministry of Planning and Investment shall take the lead and coordinate with relevant ministries in the second quarter of 2002 to summarize and evaluate implemented programs and solutions aimed at stimulating investment and consumption; carefully examine strengths and weaknesses in each sector, and develop an overall and synchronized program to stimulate investment and consumption in the future to achieve the goal of rapidly transforming the economic structure, prioritizing the development of industries and products with competitive potential, and regions and areas that can leverage existing advantages; encouraging investment attraction.

7. The Ministry of Planning and Investment shall take the lead and coordinate with relevant ministries to continue creating favorable conditions and resolving issues related to land, finance, credit, labor wages, training support, science and technology, information, and trade promotion to boost the development of the private economy towards continuously improving efficiency and competitiveness, increasing investment in production sectors, and cooperating with each other and with other economic components.

8. By the end of the second quarter of 2002, the Government will issue a Decree amending Decree No. 36/CP dated April 24, 1997, regarding the establishment of Industrial Zones, Export Processing Zones, and High-Tech Zones. The Ministry of Planning and Investment will research and build pilot projects to implement new forms of attracting foreign direct investment such as capital management companies, limited liability companies, and investment funds; and the division of responsibilities, levels, and coordination in state management of foreign investment to submit to the Government for issuance in the third quarter of 2002.

By the end of the second quarter of 2002, ministries assigned the task must complete the issuance of guiding documents to implement Decree No. 90/2001/NĐ-CP dated November 23, 2001, of the Government on assistance for the development of small and medium enterprises and Decision No. 132/2000/QĐ-TTg dated November 24, 2000, of the Prime Minister on certain policies to encourage the development of rural trades.

9. Localities should use local budgets to support investment in building market networks, primarily central markets in towns, districts, and cities, specialized agricultural product markets, and centralized wholesale markets in economic zones.

10. The state budget will provide support through the Development Support Fund to invest in infrastructure and assist projects aimed at modernizing salt production technology to increase productivity, quality, and ensure sufficient supply to meet domestic demand. The Ministry of Finance will coordinate with relevant ministries to submit principles of support and guidance for implementation to the Prime Minister starting in the second quarter of 2002.

11. Domestic enterprises producing and circulating machinery and materials for agriculture and fisheries can borrow state investment development credit to implement or support deferred payment, installment, agency, and two-way contract sales methods with farmers. The Ministry of Finance will coordinate with relevant ministries to submit principles of support and guidance for implementation to the Prime Minister starting in the second quarter of 2002.

State-owned commercial banks must intensify medium- and long-term lending; at the same time, closely cooperate with the Development Support Fund to expand post-investment interest rate support loan formats.

13. To prevent immediate speculation on buying and reselling housing and land in violation of the law, causing a "fever" in housing prices at many localities, especially in urban areas, the Government assigns the Ministry of Construction to review mechanisms and policies, propose measures to stabilize the housing market to the Prime Minister. Provinces and cities must strictly check and handle violations of buying and transferring agricultural land use rights and changing the purpose of agricultural land use to residential construction in violation of current laws and approved planning; immediately review housing construction projects, take measures to deal with and promptly stop the situation where developers cut land, sell small plots of land, and transfer land use rights in violation of the law; manage construction according to planning, end unauthorized construction; projects that have been approved but not implemented according to schedule and in violation of regulations and planning must be corrected or their investment permits revoked, decisions on land allocation and land leasing revoked.

14. Provincial People's Committees need to urgently develop housing development programs, unify this policy with the Provincial Party Committee and People's Council to make it an important and regular task in their economic and social development plans. Focus on directing the work of planning residential areas based on economic and social development planning and overall urban and rural development planning; manage construction according to planning, end unauthorized construction. Urban areas must develop housing according to projects and consider high-rise apartment construction as the main solution to improve living conditions for residents, making them more convenient and civilized.

15. In cities, alongside new housing construction, efforts should be concentrated on renovating and rebuilding dilapidated and unsafe communal housing and those lacking basic amenities. Provinces in the Mekong Delta region must focus on completing the program to build community clusters and housing in areas frequently flooded, while also implementing specific measures to ensure stable accommodation and safety for people in areas often hit by storms, landslides, and other difficult regions.

16. Localities establish Housing Development Funds, concentrating revenues (from the sale of state-owned housing under Decree No. 61/CP dated July 5, 1994 of the Government, revenue from land allocation, savings mobilization for housing purchase, and other possible sources) for enterprises to borrow for housing construction.

17. Provincial People's Committees base on specific needs and conditions to organize the restructuring of housing and land funds, consolidate and strengthen housing management forces and the real estate market.

III. Strengthen and enhance the effectiveness of export and import work:

1. Based on strategic export and import goals and socio-economic development during the 2001-2005 period, Ministries, centrally-administered municipalities, and enterprises, particularly State-Owned Enterprises 90 and 91, urgently develop annual export programs for the 2002-2005 period. These programs must be linked to commodity supply planning and industrial cluster construction planning to support rapid and sustainable development, new product development where industries, regions, and enterprises have advantages, and market demand. The Ministry of Trade coordinates with relevant ministries to assist localities and enterprises in implementing these tasks.

2. Provinces and cities establish Export Promotion Support Funds to support enterprises in developing markets, prioritizing key export markets; to reward exports for certain products, especially those with potential for development in the locality. The Ministry of Finance leads, coordinating with the Ministry of Trade to guide the establishment of such funds based on local budgets, using surplus revenue and other legitimate financial resources to implement export promotion support policies.

3. Provinces and cities use local budgets, combining with enterprise resource mobilization and appropriate policies to support the construction of basic infrastructure for warehouses, wharfs, Product Introduction Trade Centers; trade advisory services, investment, and disseminating domestic and international market information. Activities of these centers are organized on the principle of self-financing.

4. The Ministry of Finance leads, coordinating with the Government Price Control Board, the Ministry of Trade, and related ministries to inspect and review input service costs for exported goods (storage fees, port fees); various types of fees (port, loading and unloading, maritime services, banking services, road tolls, postal and telecommunications services, customs duties...), by June 2002, propose reasonable reductions in these costs to the Prime Minister.

5. The Ministry of Finance leads, coordinating with the Ministry of Agriculture and Rural Development, the Ministry of Trade, and the Government Price Control Board to develop production insurance mechanisms for some agricultural products, initially for those with large export values, to be submitted to the Prime Minister by June 2002.

6. The Ministry of Finance leads, together with the Export-Import Support Fund, to summarize experiences in export credit support over the past period, coordinating with the State Bank of Vietnam to develop a proposal to establish an Export-Import Bank to support loans for export production, deferred payment, installment payments, etc., to be submitted to the Prime Minister by September 2002.

7. The General Department of Customs continues to improve and simplify customs procedures, increase the number of export items exempt from inspection; study improvements in data provision systems to ensure accuracy and timely submission to the Ministry of Trade and related ministries for analysis, evaluation, and prompt solutions to export-import work.

8. In June 2002, the Ministry of Trade shall take the lead and coordinate with relevant ministries to amend and supplement the Border Trade Regulations, including border markets.

The Ministry of Planning and Investment shall take the lead and coordinate with relevant ministries and localities to summarize and evaluate the implementation of mechanisms and policies for Border Economic Zones in order to consider and propose additional preferential mechanisms and policies that meet the production, business, and economic development requirements of Border Economic Zones.

9. The Government encourages enterprises to enter into contracts for the purchase of products with farmers. Enterprises that sign agricultural product purchase contracts at the beginning of the crop season with farmers will be prioritized to participate in government trade contracts and will have their financial difficulties due to fluctuations in agricultural product prices when implementing signed agricultural product purchase contracts with farmers considered and resolved. The Ministry of Finance, the Ministry of Trade, the Ministry of Agriculture and Rural Development, and the State Bank of Vietnam shall provide guidance for implementation in the second quarter of 2002.

10. For goods subject to specialized management in export and import, ministries shall review the management mechanism and list of goods... to make appropriate adjustments and strictly implement the principles stipulated in Decision No. 46/2001/QĐ-TTg dated April 4, 2001, of the Prime Minister on export and import management during the period from 2001 to 2005.

11. Add handicrafts, plastic goods, and mechanical products to the List of goods eligible for export incentives based on export value as specified in Directive No. 31/2001/CT-TTg dated December 13, 2001, of the Prime Minister on promoting and enhancing the effectiveness of export and import activities in 2002. The Ministry of Finance shall take the lead and coordinate with the Ministry of Trade to establish incentive levels in favor of goods with high added value and those that create many jobs for workers.

In May 2002, the Ministry of Finance shall announce specific incentive levels for each product so that enterprises can proactively implement them. The export incentive mechanism shall apply from January 1, 2002, including for exports made under the trade contract mechanism to repay debts.

12. Continue to implement the mechanism of exempting quota export fees and customs duties for exported goods until the end of December 2002, especially for new export programs or market penetration.

13. Prioritize the import of advanced materials, equipment, and technology to enhance the efficiency and competitiveness of the economy and enterprises. Encourage domestic production of raw materials, spare parts, components, etc., to replace imports. Minimize the import of consumer goods. Strictly control the import of automobiles and two-wheeled vehicle parts.

IV. On finance and banking:

1. Party committees and authorities at all levels shall focus on directing the work of state budget revenue management in 2002, focusing on directing specialized forces to strengthen management to prevent revenue loss, smuggling, and tax evasion, particularly regarding import and export taxes. Focus on inspecting and combating fraudulent practices in the process of refunding VAT to seize state funds; strictly handle violations.

2. The Ministry of Finance shall continue to improve the procedures for refunding VAT to enterprises and issue regulations in June 2002 to correct the deduction of VAT for exported agricultural, forestry, and aquatic products; guide the collection of VAT for imported fertilizers and plant protection chemicals in accordance with the characteristics of these two types of goods; provide detailed guidance on tax incentives in the field of processing or producing export goods for satellite enterprises mentioned in Article 2 of Decision No. 908/2001/QĐ-TTg dated July 26, 2001, of the Prime Minister, to be implemented immediately in May 2002; study and submit to the National Assembly for unified application of a single corporate income tax rate for foreign-invested enterprises and domestic enterprises with the same export turnover.

3. Strengthen efforts to practice thrift and combat waste in state budget expenditure management. Heads of budget-using units shall be responsible for unauthorized expenditures and wasteful spending. Financial agencies and the State Treasury shall fully perform their tasks in supervising budget management and usage; they shall be responsible for paying unauthorized expenditures exceeding prescribed limits; strengthen the supervision of mass organizations...

4. Projects and construction works funded by the state budget and procurement activities of state-owned enterprises must prioritize purchasing domestically produced assets (including materials, equipment, transportation means, and goods) with equivalent technical conditions and quality to imported goods. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance to issue guidelines and supervise the implementation.

5. Implement the expansion of personnel quotas and management expenses for administrative state agencies. Ministries and localities shall organize the implementation of the financial system applicable to self-financing public institutions according to Decree No. 10/2002/NĐ-CP dated January 16, 2002, of the Government.

6. In May 2002, the Ministry of Finance shall cooperate with the Ministry of Trade and relevant ministries to study improvements to the subsidy system for market development and trade promotion, and submit proposals to the Prime Minister to allocate the entire 2002 budget for market development and trade promotion to key programs, especially those promoting new export products or entering new markets.

7. The Ministry of Finance shall take the lead and coordinate with relevant ministries and sectors to study and submit to the Prime Minister proposals for amending and supplementing issues related to land prices; regulating income through land prices after state investment in infrastructure; collecting fees, charges, and financial policies related to housing development activities aimed at creating conditions to encourage economic components to participate in housing construction. The Ministry of Construction shall take the lead and coordinate with relevant ministries and sectors to review and amend current regulations on housing and residential land to stabilize housing and land prices, better meet people's needs for improved living conditions, ensuring that users of housing benefit from the maximum state incentives, especially cadres, workers, civil servants, low-income individuals, and particularly the poor and residents in difficult areas. Strict measures and methods must be established to deal severely with investors who exploit state incentives for speculative profit-making purposes, to be submitted to the Government in the second quarter of 2002.

8. Exempt all bank loan interest for households in the Central Highlands provinces borrowing to care for coffee gardens during the 2001-2002 crop year. The State budget will compensate for this interest.

9. The State Bank of Vietnam shall direct commercial banks to continue lending funds to implement investment credit projects approved by the banks and currently under implementation. For new projects appraised by the Development Support Fund, loans shall be provided according to current regulations.

V. Cultural and Social Issues:

1. Poverty Alleviation and Employment:

a) Ministries and localities shall focus on directing the implementation of National Target Programs, Program 135, guiding and inspecting construction works funded by these programs to ensure they align with their objectives and are effective, effectively addressing poverty reduction in areas with many difficulties and slow development; implementing effectively economic and social development programs in northern mountainous provinces, Central Highlands provinces, and Mekong Delta provinces; while guiding and inspecting the construction and use of facilities; reviewing and screening to remove communes that have achieved their targets from the programs.

b) People's Committees at all levels must develop plans, solutions, and assign officials to specifically direct sustainable poverty reduction, prevent re-poverty; mobilize organizations, associations, and communities to help each other alleviate poverty within their jurisdictions; direct the establishment and expansion of effective poverty alleviation models suitable for specific local conditions.

c) The Ministry of Labor, Invalids and Social Affairs shall urgently complete the planning of vocational training school networks, publish it as a basis for implementation, and develop specific plans and measures to improve vocational training quality; coordinate with relevant ministries to submit to the Government a Decree on employment consistent with the amended Labor Code; coordinate with localities to improve the quality of job service center operations.

d) The Ministry of Labor, Invalids and Social Affairs shall continue to implement the rectification of labor export work, expand markets, reorganize labor export enterprises, improve the quality and competitiveness of labor export activities, particularly focusing on training labor for export; issue strict measures to handle violations by labor export enterprises and breaches of contracts by workers during their time abroad seriously.

đ) Ministries shall cooperate with provincial and municipal people's committees to concentrate on directing the implementation of employment support programs, prioritizing job placement for surplus labor in state-owned enterprise restructuring, unemployed workers in urbanized areas, and simultaneously study and propose reasonable interest rates for loans from the National Employment Support Fund.

2. Education and Training, Science and Technology:

a) The Ministry of Education and Training shall take the lead and coordinate with localities to consolidate and promote illiteracy eradication and primary education普及率;稳步实施九年义务教育;组织教师培训,准备教材、教学设备和校舍,动员各种资金来源并创造有利条件,在全国范围内广泛推广2002-2003学年一年级和六年级的新课程和教科书;特别关注偏远地区、少数民族聚居区。

b) The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs, relevant agencies, and provinces and cities to organize the implementation of the first phase of the Education Development Strategy 2001-2010 and the network planning of universities and colleges approved by the Prime Minister, focusing on educational quality, strengthening government management effectiveness, and taking concrete measures to curb and address widespread additional teaching and learning, irregularities in admissions, and strictly handling cases violating regulations and malpractices.

c) The Ministry of Education and Training shall concentrate on effectively implementing the reform of university, college, and secondary specialized school admissions in 2002, aiming for fairness, efficiency, reduced costs, and stress for the public.

d) The Ministry of Science, Technology, and Environment shall take the lead and coordinate with relevant ministries and localities to reform the management mechanism for science and technology to establish and develop a science and technology market, promote the socialization of science and technology activities, closely link scientific research with training and production and business, directly contributing to improving product quality and the competitiveness of goods and the national economy; intensify pollution control and environmental protection efforts in major cities, industrial zones, and craft villages.

3. Culture and Society:

a) The Ministry of Culture and Information shall coordinate with the Vietnam Fatherland Front to direct the implementation of the "All People United to Build a Cultural Life" movement, combined with efforts to combat social evils; coordinate with relevant ministries and localities to organize inspection campaigns to intensify the struggle against illegal cultural products and harmful cultural services, strictly handling violations.

b) The Ministry of Health, together with relevant ministries, will focus on perfecting proposals for reforming mechanisms, policies, medical fee systems, and healthcare services for the poor, to be submitted to the Prime Minister in the second quarter of 2002.

c) The Sports Committee shall cooperate with relevant ministries to develop specific plans to effectively prepare for and serve the 22nd Southeast Asian Games in 2003.

d) The Ministry of Finance shall coordinate with the Government Organizational and Cadre Management Board and relevant ministries to supplement and concretize socialization mechanisms and policies for each field (land, capital, credit benefits...), to be submitted to the Government in the third quarter of 2002 as a basis for ministries, sectors, and localities to develop specific plans to promote socialization in education, health, culture, and sports; while enhancing state management and improving the quality of activities in each field.

đ) Ministries and People's Committees at all levels must regularly inspect and supervise compliance with laws and regulations regarding the operations and finances of non-state units, promptly rectifying and strictly handling units that violate rules to ensure that socialized activities achieve their set goals.

4. Traffic accident prevention and social evil eradication:

a) The Ministry of Transport and the Ministry of Public Security shall coordinate with localities, particularly large cities, to decisively implement measures to prevent and reduce traffic accidents, strengthen traffic discipline; improve the quality of driver training and licensing; in major cities, quickly re-plan infrastructure and transportation systems; strictly handle violations of traffic safety regulations.

b) The Ministry of Public Security shall lead, coordinating with relevant ministries to firmly and persistently carry out crime prevention and eradication work, launching crackdowns on various types of crimes, especially organized crime groups and drug-related offenses.

c) People's Committees at all levels, in coordination with the Vietnam Fatherland Front, the Ministry of Public Security, and relevant ministries, shall mobilize the strength of mass organizations and the entire community to decisively eliminate social evil gathering points and small-scale drug trafficking in their respective areas; particularly defining clear responsibilities and specific policies for grassroots authorities and forces directly involved. For drug prevention and control, a comprehensive four-pronged approach must be implemented: blocking supply sources, controlling spread, persistent treatment linked to labor and job creation, and post-rehabilitation management.

d) The Ministry of Labor, Invalids, and Social Affairs shall direct localities to urgently establish rehabilitation centers and treatment facilities for sex workers and drug users according to the Anti-Drug Law, ensuring that most addicts are admitted to these centers and implementing the principle of preventing spread.

VI. Discipline and Administrative Order:

Discipline and administrative order must be reflected in the issuance of regulatory legal documents, in the organization and implementation of such documents, and in the responsibility of heads of administrative agencies and the inspection and handling of violations.

1. Discipline in Issuing Regulatory Legal Documents:

Strictly adhere to the principle: Decrees of the Government detailing the implementation of Laws and Ordinances must be drafted and submitted along with the draft Law or Ordinance. Government and Prime Minister's documents must be sufficiently detailed to be enforceable immediately upon effectiveness. Minimize the issuance of Circulars. If necessary, guidelines should be clearly stipulated in Government or Prime Minister's documents, prepared alongside the draft document submitted to the Government or Prime Minister. If lacking, it is considered an incorrect procedure, and the Government Office has the right to return the document and request the submitting agency to supplement it.

Ministries, equivalent ministries, provincial people's committees must strictly comply with issuing regulatory legal documents within their authority, ending the situation where ministry documents are inconsistent with National Assembly Laws, Government Decrees, and Prime Minister's Decisions. Regulatory legal documents of ministries, equivalent ministries, and provincial people's committees must be signed by the Minister, Chairman of the provincial people's committee. Rectify and strengthen the inspection and review of subordinate agencies' document issuance under their jurisdiction. Agencies issuing documents inconsistent with National Assembly Laws, Government Decrees, and Prime Minister's Decisions must issue corrective or abolishing documents for inconsistent content, and resolutely handle those responsible for issuing incorrect documents according to their authority.

2. Discipline in Implementing Regulatory Legal Documents:           

Upon receiving documents from higher-level administrative agencies, heads of lower-level administrative agencies must plan the implementation, clearly assign tasks, responsibilities, and authorities to specialized units and civil servants, publicly inform organizations and citizens about the implementation plan for supervision, and during implementation, lower-level agencies have the right to propose difficulties and obstacles to higher-level agencies, still fully and correctly performing assigned tasks without making statements or actions contrary to regulations and directives from higher-level agencies.

The head of the state administrative agency shall be jointly liable for the serious violation of laws by subordinate officials when performing their duties or for the prolonged disorder and laxity within the agency, which negatively affects public opinion and causes dissatisfaction.

In cooperative relations, strictly adhere to the principle that one matter should be assigned to one leading agency to implement, with related agencies having the responsibility to cooperate. The leading agency of the project must clearly express its viewpoint on all issues of the project when seeking opinions from related agencies and bear full responsibility for preparing the project both in content and time according to regulations.

The Minister, Head of an agency equivalent to a Ministry, and Head of a government-affiliated agency must fully take responsibility before the Prime Minister for registering and preparing projects assigned in the Government's Work Program (annually, quarterly, and monthly), considering this as a key task for improving discipline and order, especially in the operation of the central administrative machinery.

3. Responsibilities of the head of the administrative agency and inspection and handling of violations:

The head of the administrative agency shall directly be responsible before the people and higher-level administrative agencies regarding the order, discipline, and administrative conduct in his/her unit. Strengthen supervision, inspection, and implementation of detailed guidance from higher-level administrative agency heads to subordinates and from leadership to staff members in executing policies and tasks assigned. Departmental leaders and local authorities must resolutely reduce and improve the content of meetings, dedicate more time and effort to grassroots levels, directly inspect, grasp situations, and guide the execution of tasks by subordinates. Initially, focus on several areas of concern such as resolving citizens' complaints and denunciations, inspecting enterprises, managing state land, and basic construction investment.

The Prime Minister will directly direct the resolution of some prominent cases occurring in certain central agencies and localities concerning the responsibility of the head of the state administrative agency.

Within his/her authority, the Prime Minister will apply strict disciplinary measures against Heads of government-affiliated agencies, Chairpersons of provincial and municipal People's Committees; submit to the National Assembly and the President appropriate measures to deal with Ministers and Heads of agencies equivalent to Ministries when serious or prolonged violations of laws and administrative discipline occur in their sectors or regions, causing public dissatisfaction or deliberately failing to comply with the Prime Minister's directives.

Ministers, Heads of agencies equivalent to Ministries, Heads of government-affiliated agencies, and Chairpersons of provincial and municipal People's Committees must directly resolve prominent cases involving violations of laws and administrative discipline, severe infringements upon the rights and interests of citizens and businesses, and disregard for rules and regulations. Once conclusions about misconduct are reached, appropriate measures must be promptly taken and publicly announced through mass media.

4. Urgently implement some urgent tasks to continue perfecting the new institutional system and ensure measures to strengthen discipline and order in state administrative agencies:

a) Ministry of Justice:

+ Submit to the Prime Minister before September 2002 the results of a comprehensive review of legal normative documents and develop plans to amend, supplement, systematize, and codify these documents to address loopholes and contradictions that can be exploited or applied arbitrarily, ensuring the consistency and unity of the legal system.

+ Fully implement the system of checking the issuance of legal normative documents by ministries, agencies equivalent to ministries, provincial and municipal People's Councils, and People's Committees; recommend the Prime Minister to handle, within his/her authority, documents issued contrary to the Constitution, laws, and higher-level state agencies' documents.

+ Collaborate with the Supreme People's Court to build a proposal to improve the role and capacity of administrative courts in resolving administrative disputes. This work must be completed before October 2002.

b) Government Organizational and Cadre Affairs Board:

+ Study and amend regulations defining the functions, tasks, powers, and responsibilities of ministries, agencies equivalent to ministries, and government-affiliated agencies according to the Law on the Organization of the Government 2001 and the overall program for administrative reform from 2001 to 2010, to submit to the Government immediately after the National Assembly decides on the organizational structure of the Government for the next term, aiming to fundamentally address overlapping and redundant functions and tasks, creating new changes in division of labor and coordination in the administrative machinery.

+ Collaborate with the State Audit Office to review legal provisions related to the specific duties, powers, and responsibilities of civil servants in performing their duties to perfect the civil service system; report and submit to the Prime Minister before June 30, 2002, the results of the review and recommendations for amending and supplementing provisions that have not been defined or are unreasonable.

+ Submit to the Government for consideration and decision specific documents detailing the provisions of the Civil Servant Ordinance, Anti-Corruption Ordinance, and other legal normative documents regarding the duties, powers, and responsibilities of civil servants in performing their duties, particularly joint liability of civil servants who are heads of agencies and units for the performance of duties by subordinate civil servants, to be submitted to the Government before October 2002.

c) The Office of the Government: assists the Government and the Prime Minister in overseeing the issuance of legal regulatory documents by ministries, ministerial-level agencies, and provincial and municipal authorities within their respective jurisdictions and in accordance with Government regulations. It checks the implementation of legal regulatory documents and administrative decisions of the Prime Minister at ministries, ministerial-level agencies, and local levels. It monitors and checks the implementation of the Government's work programs and those of each ministry and sector. It promptly reports to the Government and the Prime Minister on any violations of administrative discipline at ministries and localities.

d) The State Inspectorate builds a proposal for reforming and strengthening inspection and supervision activities of the state administration system concerning institutional mechanisms, organizational structures, and civil servants, to be submitted to the Government for consideration and decision-making by May 2002.

đ) Ministers, Heads of ministerial-level agencies, and Heads of government-affiliated agencies shall, based on their functions, responsibilities, and authority as prescribed, immediately proceed with the consolidation of their machinery, rectify inspection and supervision activities of their ministries and sectors; select civil servants with good qualities and expertise in their fields to engage in inspection work so that this activity truly serves as a tool to help them promptly and strictly identify and address any legal violations by civil servants.

5. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of people's councils at all levels must directly lead the implementation and planning of measures to rectify administrative discipline and order. In the short term, they should select certain issues, areas, or agencies and units that are particularly pressing or showing signs of decline in administrative discipline and order, and develop focused plans to address these issues thoroughly; they should organize monthly reviews and evaluations of the implementation of these measures in their respective sectors and localities and report to the Prime Minister.

This Resolution takes effect from the date of signing.

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial and municipal people's councils are responsible for organizing the implementation of this Resolution./.
