Article 1. Now hereby promulgates together with this Decision the "Charter for Specialized Secondary Schools".

Article 2. This Decision takes effect fifteen days from the date of signature; all previous regulations contrary to this Decision shall be abolished.

The Secondary Education Department shall be responsible for guiding the implementation of this Charter.

Article 3. The Head of the Office of the Ministry, the Director of the Secondary Education Department, the Heads of units related to the Ministry of Education and Training; the Rectors of universities having specialized secondary school classes; the Directors of provincial Departments of Education and Training and the Principals of specialized secondary schools are responsible for implementing this Decision./.

 

REGULATIONS

Specialized Secondary School
(Issued together with Decision No. 05/2002/QD-BGDDT, dated March 11, 2002 of the Minister of Education and Training)

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Charter stipulates the organization, educational activities, and management work of specialized secondary schools.

2. Specialized secondary schools must comply with the Charter of Secondary Schools and the provisions of this Charter.

3. Specialized secondary school classes within universities must comply with corresponding provisions of this Charter.

Article 2. Position and Tasks

1. Specialized secondary schools are established at the secondary level for students who have outstanding academic results to develop their talents in certain subjects while ensuring comprehensive general education.

2. In addition to the tasks specified in the Charter of Secondary Schools, specialized secondary schools also have the following tasks:

a) To nurture and develop students' talents in a specific subject called the specialized subject; at the same time, ensure the full implementation of the comprehensive secondary education plan and curriculum.

b) To organize scientific research activities suitable for students' level and psychological development.

Article 3. Principles of Organization

1. Specialized secondary schools are organized according to the general principles already stipulated in the Charter of Secondary Schools.

2. Each year, specialized secondary schools recruit new outstanding students and transfer those who no longer meet the requirements to regular secondary schools and classes.

Article 4. Forms of Organization

Specialized secondary schools are established in the following forms:

1. Specialized secondary schools under provinces and centrally-administered cities (hereinafter referred to as specialized secondary schools under provinces).

2. Specialized secondary schools under national universities, regional universities, and teacher training universities (hereinafter referred to as specialized secondary schools under universities).

Article 5. Preferential Policy

1. Teachers and school management staff shall enjoy preferential policies as prescribed in Decree No. 35/2001/NĐ-CP dated July 9, 2001 of the Government on policies for teachers and educational management staff working at specialized schools and in areas with particularly difficult economic and social conditions.

2. Specialized high schools shall be prioritized in staffing with qualified and competent teachers, in equipping facilities and equipment according to national standard secondary school criteria; they may receive assistance from domestic and foreign economic and social organizations.

3. Depending on local conditions and circumstances, the People's Committee of the province may implement additional preferential policies to encourage and support teachers and students at specialized high schools.

4. In addition to the preferential provisions stipulated in this Regulation, specialized high schools shall operate under the current financial regime like ordinary high schools.

Chapter II

ORGANIZATION AND SCHOOL MANAGEMENT

Article 6. Establishment and Dissolution

1. The establishment of provincial specialized high schools shall be proposed by the Director of the Department of Education and Training; the Chairman of the Provincial People's Committee shall decide on establishment after consultation with the Ministry of Education and Training.

2. The Vietnam National University in Hanoi, the Vietnam National University in Ho Chi Minh City, the Hanoi National Pedagogical University, the Ho Chi Minh City National Pedagogical University, regional universities, and the Vinh University are permitted to establish specialized high schools in accordance with the following regulations:

The university director or college president (hereinafter referred to as the principal) shall propose; the Chairman of the People's Committee of the province (where the university is located) shall decide on establishment after consultation with the Ministry of Education and Training.

3. The authority that decides on establishment is also the authority that decides on suspension of operations and dissolution of the school according to the procedures prescribed in Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government.

Article 7. Conditions and Procedures for Establishment

In addition to the conditions and procedures stipulated in the Charter of Secondary Schools, the establishment of specialized high schools must meet the following additional conditions:

1. There must be a cadre of managers and teachers with sufficient qualifications to teach according to the specialized high school curriculum;

programme of general secondary education for gifted students;

2. There must be necessary facilities and equipment as prescribed for national standard secondary schools;

3. There must be a stable source of admissions and accommodation for boarding students from distant areas.

Article 8. Classes in Specialized High Schools

1. Only one class per specialized subject shall be established in each grade 10, 11, and 12.

2. Each specialized class shall have between 30 and 35 students, studying a single specialized subject curriculum.

3. Depending on specific local conditions or university conditions, specialized high schools may have some or all of the following specialized classes:

a) Mathematics,

b) Computer Science,

c) Physics,

d) Chemistry,

đ) Biology,

e) Literature,

g) History,

h) Geography,

i) English,

k) Russian,

l) French.

3. Non-specialized classes may exist within specialized high schools. The number of non-specialized classes shall not exceed 30% of the total number of specialized classes in the school. Non-specialized classes shall be organized according to the Charter of Secondary Schools.

Article 9. Management and Direction

1. Provincial specialized high schools are directly managed and directed by the Department of Education and Training.

2. Specialized high schools affiliated with universities are directly managed and directed by the university's rector regarding organization, teaching staff, facilities, finance, and are directed by the local Department of Education and Training regarding curriculum implementation, teaching plans, graduation exams, issuance of graduation certificates, and admissions to universities, colleges, and vocational schools.

Chapter III

EDUCATIONAL ACTIVITIES OF

SPECIALIZED HIGH SCHOOLS

Article 10. Admissions to the First Grade

1. Admission Plan:

a) For provincial specialized high schools:

The Department of Education and Training is responsible for establishing the admission plan, scheme, quota, and proposed examination date, which must be approved by the Chairman of the Provincial People's Committee.

b) For specialized high schools affiliated with universities: The university rector approves the admission plan and sets the examination date.

2. Admission Quota:

a) For provincial specialized high schools: The provincial People's Committee assigns the annual quota.

b) For specialized high schools affiliated with universities (or existing specialized high school classes): The Ministry of Education and Training decides after consultation with the provincial People's Committee where the school is located.

3. Admission Method: Examination.

At least two months before the examination date, the Departments of Education and Training and universities with specialized high schools must widely announce the admission through written notices and mass media.

4. Subjects:

Mathematics, Vietnamese Language, and the specialized subject.

If the specialized subject is Mathematics or Vietnamese Language, students must take two tests in each subject: a regular test and a specialized test as prescribed.

5. Subject Coefficients:

Mathematics, Vietnamese Language: Coefficient 1.

Specialized Subject: Coefficient 2.

6. Examination Time:

Each subject examination time is 150 minutes, excluding question distribution time.

7. Admission Conditions: In addition to general admission regulations, students applying for admission to specialized high schools must meet the following conditions:

a) For subjects registered for specialized classes, students must have an average score of 8.0 or higher in Mathematics, Physics, Chemistry, Biology, Computer Science, and 7.0 or higher in Literature, History, Geography, Russian, English, and French throughout grade 9.

b) Students must have a satisfactory or better final grade from junior high school.

8. Additional Encouragement Points (only applicable for admissions to provincial specialized high schools):

Students who win awards in the provincial grade 9 subject competition will receive additional points when admitted to grade 10 specialized high school if the award-winning subject matches the specialized subject they are applying for. The additional points are as follows:

+ First Prize: 2 points.

+ Second Prize: 1.5 points.

+ Third Prize: 1 point.

9. Admission Criteria:

a) The admission score for grade 10 specialized high school is the total of the weighted scores of the examination papers and any additional encouragement points.

The admission score is calculated to two decimal places without rounding.

b) Students who complete all three examination papers, do not violate examination rules, and do not receive less than 2 points on any paper, with a minimum of 6.5 points in the specialized subject and an average of 5.0 or higher across all examination papers, will be considered for admission.

c) The number of students admitted must comply with the quota for each specialized class.

10. Admission Principles:

a) Admit students based on their admission scores from highest to lowest until the quota is filled for each specialized class.

b) If students have the same total score, those with priority status and good conduct records will be admitted first.

c) When admitting students according to these principles, if the quota is not met, the principal of the specialized high school has the responsibility to report to relevant authorities to seek approval to resolve the issue.

11. Approval of Successful Applicants:

a) The Department of Education and Training reviews and approves the list of successful applicants for provincial specialized high schools.

b) The university rector reviews and approves the list of successful applicants for specialized high schools affiliated with universities.

12. Re-examination: During the admission examination for provincial specialized high schools and specialized high schools affiliated with universities, all students can request a re-examination of their scores. Students requesting a re-examination must submit an application to the authorized body according to the regulations of the Department of Education and Training Director or the university rector.

13. Admission to Non-specialized Grade 10 Classes:

Students who achieve scores close to the lowest admission score for grade 10 specialized classes will be admitted to non-specialized grade 10 classes in specialized high schools, in descending order until the quota is filled.

14. The Department of Education and Training Director and the university rector establish examination committees, invigilators, graders, and re-examiners, and organize examinations according to the regulations for junior and senior high school graduation examinations.

15. After completing the admission process, the Departments of Education and Training and universities with specialized high schools must prepare reports and send them to the Ministry (General Secondary Education Department), including:

a) Summary report of the admission examination,

b) List of successful applicants.

Article 11. Supplementary Recruitment and Transfer from Specialized Classes

1. Conditions for Organizing Supplementary Recruitment: Supplementary recruitment shall only be conducted when there are students who must be transferred out of specialized classes and when it is deemed necessary for the 11th and 12th grades.

2. The Director of the Department of Education and Training (for specialized high schools under provincial jurisdiction) or the Rector of the university (for specialized high schools under university jurisdiction) decides annually on supplementary recruitment or non-recruitment based on the proposal of the Principal of the specialized high school.

3. Eligibility and Conditions for Application:

a) Eligible Applicants: Students currently enrolled in the 10th or 11th grade, but not in specialized classes within the school.

b) Conditions: Must meet both of the following conditions

- Ranked as having good conduct and excellent academic performance throughout the entire 10th (or 11th) grade,

- Achieved an average score of 8.0 or higher in the subject intended for the specialized class entrance examination throughout the year.

4. The entrance examination subjects are specialized subjects.

5. Students will be placed on the list for supplementary recruitment if they achieve a score of 6.5 or higher in the entrance examination.

6. Recruitment follows a principle of selecting candidates from highest to lowest scores until the required number of additional admissions is reached. In case of equal scores, consideration will be given to the average score in the specialized subject, and the average score in other subjects (higher scores are ranked first, lower scores are ranked last).

7. Regulations regarding test preparation, examination supervision, and grading for supplementary recruitment examinations are stipulated by the Director of the Department of Education and Training or the Rector of the university based on this Regulation.

8. Supplementary recruitment does not allow for re-examination.

9. Students must be transferred from specialized classes to non-specialized classes if they meet either of the following conditions:

- Ranked as having weak academic performance,

- Achieved an average score below 3.5 in the specialized subject.

Article 12. Study Plan and Curriculum

1. Along with implementing the common teaching plan and curriculum for non-specialized subjects at high schools, specialized high schools must implement a separate teaching plan and curriculum for each specialized subject and class as issued by the Ministry of Education and Training.

2. In addition to activities prescribed in the High School Charter, specialized high schools must organize for students to participate in scientific research activities, seminars, and scientific experiments according to their specialized subjects.

The time allocated for practicing scientific research activities should not exceed two sessions per week.

Article 13. Evaluation, Classification, and Promotion

The process of testing, grading academic performance, ranking conduct, and promoting students in specialized high schools is carried out according to regulations for regular high school students, along with specific provisions guided by the Ministry of Education and Training.

Article 14. Graduation Examination and Issuance of Graduation Certificate

Conditions for graduation examination, examination content, and issuance of graduation certificates for specialized high school students are implemented according to those for regular high school students.

Article 15. Transfer to Another School

Students from specialized high schools under provincial or university jurisdiction who wish to transfer to study in another province, city, or university must be considered for admission to regular high schools or non-specialized classes within specialized high schools. If they wish to study in specialized classes of specialized high schools, they must take the entrance examination according to the regulations of this Regulation and local or university regulations.

Chapter IV

DUTIES AND RIGHTS OF MANAGEMENT STAFF, TEACHERS, AND STUDENTS

AND STUDENTS

Article 16. Duties and rights of the principal and deputy principal

1. Utilize funds, assets, infrastructure, and equipment effectively; fully leverage the capabilities and intellect of teachers and students in teaching, learning, and activities, particularly for specialized subjects.

2. Enjoy benefits stipulated under current regulations for management staff of specialized high schools and other preferential benefits (if any) provided by local authorities or universities.

3. Select teachers to teach at the school and propose transfers for those teachers who fail to meet the requirements for teaching at specialized high schools.

Article 17. Duties and rights of teachers

1. Teachers of specialized subjects at specialized high schools, in addition to fulfilling all duties and rights of teachers as prescribed in Articles 29 and 30 of the current High School Charter, shall also have the following duties:

a) Directly nurture and develop students' talents in specialized subjects;

b) Organize and guide students in specialized subjects to engage in scientific research studies appropriate to their level and psychological development.

2. Teachers of other subjects shall perform duties as prescribed in Articles 29 and 30 of the High School Charter.

3. Teachers at specialized high schools shall enjoy allowances, current policies for teachers, and preferential benefits as stipulated in Clause 1 of Article 5 of this Regulation.

4. Annually, teachers who do not meet the conditions to teach at specialized schools shall be provided opportunities by the Department of Education and Training (or the university managing the specialized high school) to transfer to non-specialized classes or to teach at other high schools.

Article 18. Duties and rights of students

1. Fulfill comprehensive educational requirements for secondary school students.

2. Actively and proactively in learning, striving to excel in specialized subjects.

3. Actively participate in extracurricular activities, general political and social activities of the school; participate in scientific activities organized by the school or assigned by teachers, in accordance with individual capabilities for each specialized subject.

4. Be provided conditions regarding: residential accommodation, utilization of infrastructure, equipment, and library facilities for learning purposes.

5. Students eligible for preferential policies as stipulated in Article 32 of Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government shall be considered for tuition fee exemptions; students achieving excellent results shall be considered for scholarships and awards according to state, local, and university regulations./.
