CIRCULAR
Regarding guidance on lending to producers and enterprises that have signed contracts for the purchase of agricultural products pursuant to Decision No. 80/2002/QĐ-TTg dated June 24, 2002 of the Prime Minister

Pursuant to Clause 3 Article 3 and Clause 4 Article 8 of Decision No. 80/2002/QĐ-TTg dated June 24, 2002 of the Prime Minister on policies encouraging the consumption of agricultural products through contracts, the Governor of the State Bank guides commercial banks to implement lending, apply mechanisms securing loans with assets formed from borrowed funds, by credit guarantee, and interest rates for lending to producers and enterprises that have signed contracts for the purchase of agricultural products as follows:
1. Commercial banks shall intensify domestic capital mobilization, take advantage of foreign financial support, ensure sufficient capital to lend to producers and enterprises that have signed contracts for the purchase of agricultural products according to the forms prescribed in Article 2 of Decision No. 80/2002/QĐ-TTg of the Prime Minister:
- Producers, including: cooperatives, farm households, farm owners, representatives of farm households producing agricultural, forestry, aquaculture, and salt products who have signed contracts for the purchase of agricultural products with enterprises purchasing agricultural products;
- Enterprises under various economic sectors that have signed contracts for the purchase of agricultural products and salt with producers.
2. Commercial banks shall provide loans to producers and enterprises that have signed contracts for the purchase of agricultural products according to the commercial credit mechanism and implement the following measures:
a. Actively approach and assess the loan needs of producers and enterprises; for feasible and effective production, business plans, and investment projects, promptly sign credit contracts and disburse loan funds according to the progress of the contract implementation, consistent with the seasonal nature and needs of producers and enterprises.
b. Loan procedures and documents must be legally sound and simplified to facilitate producers and enterprises in borrowing for production, procurement, and sale of agricultural products according to signed contracts.
c. The pledge and mortgage of assets by producers and enterprises, and third-party asset guarantees for producers and enterprises shall be carried out according to the current mechanisms applicable at the time of lending. In cases where producers and enterprises borrow without asset collateral (credit guarantee) and secured loans with assets formed from borrowed funds are applied as follows:
- For farm households, farm owners, and representatives of farm households producing agriculture, forestry, aquaculture, and salt products borrowing up to VND 20 million for the production of agricultural products, or less than VND 50 million for the production of aquaculture seed, no collateral is required; cooperatives and enterprises borrowing less than VND 50 million for the production of aquaculture seed also do not require collateral. This lending is implemented according to the provisions in the following documents: Resolution No. 11/2000/NQ-CP dated July 31, 2000, Decision No. 103/2000/QĐ-TTg dated August 25, 2000, Circular No. 10/2000/TT-NHNN1 dated August 31, 2000, and document No. 934/CV-NHNN1 dated September 25, 2000 of the Governor of the State Bank.
- Commercial banks shall consider and select to lend without asset collateral to producers and enterprises with effective production and business plans according to the provisions in Article 20 of Decree No. 178/1999/NĐ-CP dated December 29, 1999, Item 6 Part III of Resolution No. 11/2000/NQ-CP dated July 31, 2000, Section I Chapter IV of Circular No. 06/2000/TT-NHNN1 dated April 4, 2000, and Item 2 Section I of Circular No. 10/2000/TT-NHNN1 dated August 31, 2000 of the Governor of the State Bank.
- Producers who are poor households can borrow from the Poverty Alleviation Bank without collateral and from commercial banks with credit guarantees from political-social organizations according to the provisions in Part III Chapter IV of Decree No. 178/1999/NĐ-CP dated December 29, 1999.
- Producers and enterprises can mortgage assets formed from borrowed funds according to the provisions in Clause 2 Article 14 of Decree No. 178/1999/NĐ-CP dated December 29, 1999 to borrow short-term, medium-term, and long-term funds if such assets meet the conditions stipulated in Clause 2 Article 15 of the Decree.
3. On lending interest rates
a. Commercial banks shall apply lending interest rates to producers and enterprises according to agreed rates, consistent with market supply and demand for capital and their customer policies.
b. Reduce lending interest rates for producers and enterprises according to the current regulations of the Government and the State Bank of Vietnam:
- Producers and enterprises in Region III mountainous areas, islands, and areas with concentrated Khmer populations borrowing from state-owned commercial banks shall have their interest rates reduced by 30% compared to normal lending rates.
- Producers and enterprises in Region II mountainous areas borrowing from state-owned commercial banks shall have their interest rates reduced by 15% compared to normal lending rates.
- Producers and enterprises in Region II mountainous areas within the scope of the extremely difficult communes program in the provinces of Gia Lai, Kon Tum, Dak Lak, and Lam Dong as specified in Decision No. 1232/1999/QĐ-TTg dated December 24, 1999 and Decision No. 42/2001/QĐ-TTg dated March 26, 2001 of the Prime Minister borrowing from state-owned commercial banks shall have their interest rates reduced by 30% compared to normal lending rates.
4. Commercial banks shall promptly grasp agricultural production, processing, and sales projects supported by local budgets for interest rate subsidies according to the guidelines of the Ministry of Finance to have a basis for assessing the ability to repay principal and interest, creating favorable conditions for producers and enterprises to borrow and fulfill signed contracts.
5. Implementation
a. This circular takes effect 15 days after its date of issuance.
b. Heads of units under the State Bank, Governors of provincial branches of the State Bank, Chairmen of Management Boards and General Directors (Directors) of commercial banks are responsible for implementing this circular./.
