Guidelines for certain contents of implementing the National Target Program

 for New Rural Development in the period 2016-2020

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural DevelopmentngThe Director of the Livestock Service,

Pursuant to Decision No. 41/2016/QĐ-No.g dated October 10, 2016 of the Prime Minister promulgating the management and operation regulations for national target programs;Family Planning) for consideration and resolution./.manage and direct the implementation of national target programs;

Implementing Decision No. 398/QĐ-TTg dated11 Marchamendn 2016 of the Prime Minister approving the implementation plan for Resolution No. 100/2015/QH13 dated November 12/11/2015 on approving the investment policy for national target programs in the period 2016-2020;

The Minister of Information and Communication issues this Circular to amend and supplement some articles of Circular No. 06/2022/TT-BTTTT dated June 30, 2022 of the Minister of Information and Communication guiding the implementation of the Communication and Information Poverty Reduction Project under the National Target Program on Sustainable Poverty Reduction for the period of 2021-2025.1600/QĐ-TTg dated16 August 2016 of the Prime Minister approving the National Target Program for New Rural Development in the period 2016-2020;

The Minister of Agriculture and Rural Development issues this Circular guiding certain contents of implementing the National Target Program for New Rural Development in the period 2016-2020.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. Scope of Application: This Circular guides certain contents of implementing the National Target Program for New Rural Development in the period 2016-2020 as prescribed in Decision No. 1600/QĐ-TTg dated August 16, 2016 of the Prime Minister (hereinafter referred to as the New Rural Development Program) within the territory of all communes nationwide; the process of monitoring and evaluating the implementation of the New Rural Development Program.

Article 2. Applicability: This Circular applies to all communes nationwide, agencies, organizations, and individuals related to the implementation of the New Rural Development Program.

Article 2. Implementation Principles

1. Implementation principles according to Article 3 of Chapter I of the Management and Operation Regulations for National Target Programs issued together with Decision No. 41/2016/QĐ-TTg dated October 10, 2016 of the Prime Minister.

2. Tight integration between the New Rural Development Program and the National Target Program for Sustainable Poverty Reduction, the Program for Restructuring Agricultural Production, and other ongoing national target programs and projects in rural areas; aligning with local socio-economic development plans and being consistent with approved rural development master plans.

Article 3. Procedure for preparing plans to implement the New Rural Development Program at commune level

The procedure for preparing plans to implement the New Rural Development Program at commune level shall be carried out in accordance with the provisions of Article 6 of Chapter II of the Management and Operation Regulations for National Target Programs issued together with Decision No. 41/2016/QĐ-TTg dated October 10, 2016 of the Prime Minister and Circular No. 01/2017/TT-BKHĐT dated February 14, 2017 of the Ministry of Planning and Investment guiding the procedures for preparing commune-level investment plans for implementing national target programs. The Prime Minister and Circular No. 01/2017/TT-BKHĐT dated February 14, 2017 of the Ministry of Planning and Investment guide the process of preparing commune-level investment plans to implement national target programs.

Chapter II

IMPLEMENTATION OF PROGRAM CONTENTS

Article 4. Review and adjust supplementary production planning in conjunction with agricultural restructuring

The review and adjustment of production planning in commune-level rural development master plans in conjunction with agricultural restructuring at district, regional, and provincial levels shall be implemented in accordance with the regulations of the Ministry of Agriculture and Rural Development and Circular No. 02/2017/TT-BXD dated March 1, 2017 of the Ministry of Construction guiding rural construction planning.

Article 5. Development of economic and social infrastructure

1. Improving the irrigation system within agricultural fields

a) Investment in building irrigation systems within agricultural fields must ensure compliance with approved irrigation plans and related plans; adhere to current technical standards and regulations on investment and construction;

b) Prioritize water conservancy projects through majority community consensus, apply design processes involving community participation and supervision to enhance project quality and effectiveness;

c) Link investment in irrigation systems within agricultural fields with the construction of internal field roads, plantations, land exchanges, and suitable field designs for regions to facilitate advanced farming methods and meet requirements for restructuring agricultural production;

d) Apply advanced technologies and promote water conservation in the construction of irrigation systems within agricultural fields.

2. Completing facilities to ensure water supply for residents

a) Investment in water supply projects must align with rural water supply plans and investment, repair, upgrade, and expansion plans for rural water supply facilities from 2016-2020, as approved by competent authorities;

c) Invest in water supply projects through socialized and public-private partnership models in plain areas and densely populated regions with favorable socio-economic conditions;

d) Construct small-scale household water supply facilities for poor households, near-poor households, and policy families; build new, repair, and upgrade clean water supply facilities for rural schools (kindergartens, primary schools, middle schools, high schools) and village health stations.

Article 6. Implementation of the Science and Technology Program to Serve New Rural Area Construction

The effective implementation of the Science and Technology Program to Serve New Rural Area Construction shall be carried out in accordance with Decision No. 45/QD-TTg dated January 12, 2017 of the Prime Minister approving the Science and Technology Program to Serve New Rural Area Construction from 2016-2020 (amending and supplementing Decision No. 27/QD-TTg dated January 5, 2012 of the Prime Minister).

Article 7. Developing Value Chain Production Linkages Connecting Production with Product Consumption

1. Implementing Entities

a) Enterprises (production, processing, trading);

b) Cooperatives, cooperative unions (hereinafter referred to as Cooperatives);

c) Farms, households, individuals.

a) Establish new value chain linkages connecting production with product consumption; support the formation of linkages between enterprises and traders with cooperatives and residents.

b) Strengthen and upgrade existing value chain linkages connecting production with product consumption in localities, focusing on establishing stable raw material bases; support the application of synchronized production techniques under quality management requirements; improve processing, manufacturing capabilities, and market development.

3. Implementation Process: Follow the guidance manual for production development issued by the Ministry of Agriculture and Rural Development.

The content of reforming agricultural production organization shall be implemented in accordance with Decree No. 193/2013/ND-CP dated November 21, 2013 of the Government detailing certain provisions of the Law on Cooperatives; Decision No. 2261/QD-TTg dated December 15, 2014 of the Prime Minister approving the Program to support cooperative development during the period of 2015-2020 and related guiding documents; Decision No. 445/QD-TTg dated March 21, 2016 of the Prime Minister approving the Pilot Project "Improving and expanding new cooperative models in the Mekong Delta region during the period of 2016-2020," focusing on implementing the following contents:

1. Organizing propaganda, training, and capacity building to thoroughly understand the Party's policies and the State's laws on cooperative economy; reforming training methods for cooperative management cadres towards practical training, emphasizing the dissemination of experiences from effective domestic cooperative models.

2. Developing programs and plans for cooperative economic development that are suitable to the socio-economic conditions and specific production and business characteristics of each locality.

3. Supplementing and improving the organizational structure of state management at all levels concerning cooperative economy, enhancing training to improve the capacity of state management cadres in this field.

4. Directing the completion of the transition and re-registration of cooperatives according to the Law on Cooperatives 2012.

The content of rural industry development shall be implemented in accordance with the provisions of Decree No. 66/2006/NĐ-CP dated July 7, 2006 of the Government on rural industry development and related guiding documents.

1. The implementation of the National Strategy on clean water supply and sanitation in rural areas until 2020 shall be carried out in accordance with Decision No. 104/2000/QĐ-TTg dated August 25, 2000 of the Prime Minister approving the National Strategy on clean water supply and sanitation in rural areas until 2020.

2. Solid waste collection and treatment, centralized and decentralized domestic wastewater collection and treatment; construction and improvement of ecological ponds and lakes in residential areas; planting, caring for, and improving green tree systems: Shall be implemented in accordance with Circular No. 55/2014/TT-BNNPTNT dated December 31, 2014 of the Ministry of Agriculture and Rural Development guiding the implementation of some environmental protection activities under the National Target Program on New Rural Development during the period of 2010-2020.

Article 11. Enhancing Capacity for New Rural Development

1. Training and Capacity Building Targets

a) Group of central and provincial-level cadres responsible for new rural development

Central-level cadres include: cadres from departments and bureaus down to those working in ministries, sectors, and central-level mass organizations assigned tasks to implement the New Rural Development Program, cadres of the Central Office for New Rural Development Coordination;

Provincial-level cadres responsible for new rural development (commonly referred to as provincial level) include: members of the Provincial Steering Committee for New Rural Development; cadres of provincial departments and sectors, and mass organizations assigned tasks to implement the New Rural Development Program; cadres of the Provincial Office for New Rural Development Coordination;

County-level cadres (commonly referred to as county level) include: members of the County Steering Committee for New Rural Development; heads and deputies of county departments, bureaus, and mass organizations; cadres of the County Office for New Rural Development Coordination.

b) Group of village-level cadres responsible for new rural development

Members of the Village Steering Committee for New Rural Development, Management Board for New Rural Development, and Community Supervision Board;

Village cadres and civil servants specializing in new rural development; party and mass organization cadres at the village level; cadres strengthened by superiors to the village; potential cadres within the village planning scope;

Secretary of the village party branch, village head;

Members of the Village Development Board;

Cooperative cadres; team leaders of cooperative groups; farmstead owners; exemplary farmers serving as core members in the village.

c) Other relevant targets

Cadres managing, researching, and teaching at research institutes and schools;

Cadres at communication agencies (newspapers, radio, television...);

Individuals and organizations with needs (enterprises, banks, non-governmental organizations, etc.).

2. Duration and Content of Training and Capacity Building

a) Duration of Training and Capacity Building

The maximum number of days and the number of trainees per course shall be determined by localities based on actual needs.

The content of training and capacity building shall follow the topics in the framework program issued by the Ministry of Agriculture and Rural Development.

In addition to the specialized topics already established by the Ministry of Agriculture and Rural Development, localities may consider supplementing additional topics in training courses based on practical needs and available resources. Specific programs for each course must be based on the framework program and tailored to the target audience, actual needs, and local characteristics. Training and capacity building sessions can be held multiple times to provide knowledge suited to the specific characteristics of the trainees.

Article 12. Communication on New Rural Development

1. Implementing Entities

Officials implementing the New Rural Development Program under the Ministry of Agriculture and Rural Development and staff from the Central Office for New Rural Development at all levels.

Rural residents, enterprises, cooperatives, and other beneficiaries from the New Rural Development Program.

2. Implementation Content

a) Building a framework and guiding communication content

Developing a framework plan and guiding communication content, annual propaganda plans of the Central Office for New Rural Development and provincial-level New Rural Development Coordination Offices. These include specific implementation plans for coordinating with relevant agencies in communication and propaganda activities.

Strengthening cooperation between New Rural Development Coordination Offices at all levels and political, social, economic organizations both domestically and internationally.

Promoting good and creative practices, efforts made by difficult communes to achieve positive results, especially those places with challenging conditions but effective solutions in mobilizing social resources for new rural development;

Promoting areas that have met standards, methods, and approaches to improve quality after meeting criteria; exemplary production models applying advanced technical processes recognized; production linkage models following value chains;

Reflecting difficulties, shortcomings, negative manifestations during the implementation of the New Rural Development Program, and suggestions to address these difficulties;

Enhancing the quality of information and propaganda about new rural development on electronic news pages of member agencies of the Steering Committee at all levels;

Organizing regular press conferences with communication units to provide information on achievements and results of new rural development implementation.

Designing a logo for the New Rural Development Program to serve as its identity;

Organizing some contests on the theme of new rural development to create a common identity for the program;

Implementing some promotional measures using appropriate languages for ethnic minority groups, overseas Vietnamese communities, and international organizations in Vietnam.

d) Producing and distributing promotional publications on new rural development, including: professional materials, yearbooks, documentary films, reports, leaflets, brochures.

đ) Strengthening competition activities and honoring outstanding individuals and collectives

Promoting competitive movements and timely rewards for outstanding examples in new rural development. Coordinating to honor outstanding collectives and individuals who have made significant contributions to new rural development nationwide.

e) Enhancing the capacity of officials at all levels implementing new rural development in communication and propaganda work

Developing a distance learning system through the electronic portal of the New Rural Development Program.

Chapter III

MONITORING, EVALUATING, AND SUPERVISING THE IMPLEMENTATION OF THE NEW RURAL DEVELOPMENT PROGRAM

Article 13. Monitoring the Implementation of the New Rural Development Program

1. The monitoring index system for the implementation of the New Rural Development Program

a) The monitoring index system includes indices reflecting output results, responsibility for monitoring, summarizing, and reporting (details in Appendix I attached to this Circular).

b) Based on the monitoring index system attached to this Circular, localities shall consider supplementing indices reflecting output results that are suitable with practical conditions and requirements for monitoring the implementation of the New Rural Development Program at the locality level.

c) For the monitoring index systems of national target programs for the period 2012-2015 which have been approved and promulgated by competent authorities but were incorporated into the New Rural Development Program during the period 2016-2020, they shall be implemented according to the guidance of the agencies in charge of the components of the program, ensuring consistency and meeting the general requirements of the monitoring index system of the New Rural Development Program.

2. Reports on the monitoring of the implementation of the New Rural Development Program

a) The report on the plan to implement the New Rural Development Program shall be carried out in accordance with Point a Clause 3 Article 16 Chapter V of the Management and Operation Regulations for National Target Programs, issued together with Decision No. 41/2016/QĐ-TTg dated October 10, 2016 of the Prime Minister.

b) The report on the allocation of central budget plans to implement the New Rural Development Program shall be carried out in accordance with Point b Clause 3 Article 16 Chapter V of the Management and Operation Regulations for National Target Programs, issued together with Decision No. 41/2016/QĐ-TTg dated October 10, 2016 of the Prime Minister. The annual report on the allocation of central budget plans to implement the New Rural Development Program shall be submitted using Model No. 01 in Appendix II attached to this Circular.

c) Annual report on the implementation results of the New Rural Development Program

The People's Committee of communes shall prepare reports (using Model No. 04 in Appendix II attached to this Circular) and submit them to the People's Committee of the district before June 15 of the same year for the mid-year report; before January 31 of the planning year for the annual report.

The People's Committee of county-level units shall prepare reports (using Model No. 03 in Appendix II attached to this Circular), along with the updated monitoring index system containing information within their monitoring responsibilities, and submit them to the People's Committee of the province before June 30 of the same year for the mid-year report; before February 15 of the planning year for the annual report.

The People's Committee of provinces shall prepare reports (using Model No. 03 in Appendix II attached to this Circular), along with the updated monitoring index system containing information within their monitoring responsibilities, and submit them to the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Agriculture and Rural Development before July 20 of the same year for the mid-year report; before March 31 of the planning year for the annual report.

Ministries and central agencies in charge of the components of the New Rural Development Program shall prepare reports (using Model No. 02 in Appendix II attached to this Circular), along with the updated monitoring index system containing information within their monitoring responsibilities, and submit them to the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Agriculture and Rural Development before July 20 of the same year for the mid-year report; before March 31 of the planning year for the annual report.

The Ministry of Agriculture and Rural Development shall compile and submit these reports to the Ministry of Planning and Investment, the Ministry of Finance before August 15 of the same year for the mid-year report; before April 30 of the planning year for the annual report.

d) Online Reporting System for the New Rural Development Program

The online reporting system for the New Rural Development Program shall be built by the Ministry of Agriculture and Rural Development on the website http://bctt.nongthonmoi.gov.vn.

Data uploaded to the online reporting system of the New Rural Development Program must be approved by authorized persons at the commune, district, and provincial levels, following the guidelines of the Ministry of Agriculture and Rural Development.

The People's Committees of communes, districts, and provinces shall specifically assign departments and staff responsible for updating data and using the system.

Article 14. Inspection of the New Rural Development Program Implementation

1. The Ministry of Agriculture and Rural Development, agencies assigned to lead the components of the content, and agencies with management authority over the New Rural Development Program shall inspect the entire process of implementing the New Rural Development Program according to their functions and tasks.

2. People's Committees at all levels shall inspect the entire process of implementing the New Rural Development Program within the scope of local management.

3. The content of the inspection of the New Rural Development Program shall be carried out in accordance with Clause 2, Article 17 of Chapter V of the Regulation on Management and Implementation of National Target Programs, issued together with Decision No. 41/2016/QĐ-TTg dated October 10, 2016 of the Government Prime Minister.

4. Procedure for inspecting the New Rural Development Program

a) Draft and submit for approval the Inspection Plan;

b) Form the Inspection Team (if necessary);

c) Notify the Inspection Plan and request preparation of documents for inspection purposes. The minimum preparation time for the inspected entity is 20 days from the date of receipt of the document requesting the preparation of documents;

d) Conduct the inspection. The maximum duration for on-site inspection by the Inspection Team is 20 days;

đ) Summarize and report the inspection results. The maximum duration for summarizing and reporting the inspection results is 20 days;

e) Announce the inspection results and conclude the inspection. The maximum duration for this is 10 days from the date of receipt of the Inspection Team's report.

Article 15. Evaluation of the New Rural Development Program Implementation

1. The content of the evaluation of the New Rural Development Program shall be carried out in accordance with Clause 1 and 2, Article 18 of Chapter V of the Regulation on Management and Implementation of National Target Programs, issued together with Decision No. 41/2016/QĐ-TTg dated October 10, 2016 of the Government Prime Minister.

2. Organization of the evaluation of the New Rural Development Program Implementation

a) The Ministry of Agriculture and Rural Development, agencies leading the components of the New Rural Development Program shall be responsible for organizing the evaluation of the New Rural Development Program according to the provisions of Clause 1 of this Article and send it to the Ministry of Planning and Investment, the Ministry of Finance.

b) People's Committees at all levels shall be responsible for organizing the evaluation of the New Rural Development Program Implementation within the scope of local management according to the provisions of Clause 1 of this Article.

3. Procedure for conducting the evaluation of the New Rural Development Program Implementation

a) Draft and submit for approval the Evaluation Plan;

b) Form the Evaluation Team (if necessary), hire consulting units for evaluation (if necessary).

c) Notify the Evaluation Plan and request preparation of documents for evaluation purposes.

d) Prepare detailed evaluation plans.

đ) Collect and analyze data.

e) Report evaluation results.

g) Announce evaluation results.

Chapter IV

IMPLEMENTING PROVISIONS

Article 16. Effective Date

1. This Circular takes effect from April 15, 2017.

2. Specific documents cited in this Circular will be applied according to new documents issued when the new regulating documents come into force.

3. During implementation, if there are emerging issues or difficulties, relevant agencies, units, organizations, and individuals should reflect them to the Ministry of Agriculture and Rural Development for study, amendment, and supplementation to ensure appropriateness./.
