Pursuant to the Law on Product Quality dated November 21, 2007;Pursuant to the Radio Frequency Law;

Pursuant to the Law on Information Technology dated June 29, 2006;
The Minister of Information and Communications hereby issues this Circular regulating the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications.
Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to the proposal of the Director of the Science and Technology Department,
Article 1. This Circular stipulates the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of Products and Goods Group 2).
Article 1. Scope of Regulation
Article 2. This Circular applies only to products and goods described in the List of Products and Goods Group 2.
Article 3. Organizations and individuals engaged in production and business of products and goods listed in the List of Products and Goods Group 2 in Vietnam.
Article 2. Applicability

Article 3. List of Products and Goods Group 2
a) "List of specialized information technology and telecommunications products and goods that must be certified for conformity and declared for conformity" is specified in Appendix I of this Circular.
b) "List of specialized information technology and telecommunications products and goods that must be declared for conformity" is specified in Appendix II of this Circular.
Article 5. The Ministry of Information and Communications shall review, amend, and supplement the List of Products and Goods Group 2 periodically, in accordance with state management policies.
Article 6. Principles of product and good quality management in Group 2
Clause 1. The management of product and good quality in the List of Products and Goods Group 2 shall be carried out according to the regulations of the Ministry of Information and Communications on certification for conformity, declaration for conformity, and quality inspection for specialized information technology and telecommunications products and goods and corresponding technical standards.
Clause 2. Products and goods in the List of Products and Goods Group 2 that integrate functions of other products and goods in the List of Products and Goods Group 2 must fully certify for conformity and declare for conformity all applicable technical standards for integrated products and goods.
Clause 3. In case new technical standards are amended, supplemented, or replace existing technical standards in the List of Products and Goods Group 2, the new technical standards shall apply.
Clause 4. In case there is a difference between the provisions of technical standards and this Circular regarding certification for conformity and declaration for conformity, the provisions of this Circular shall prevail.
Article 7. Effective date and replacement of previous regulations
Article 5. Effectiveness and Responsibility for Implementation
Clause 1. This Circular takes effect from September 1, 2019, and replaces Circular No. 04/2018/TT-BTTTT dated May 8, 2018, issued by the Minister of Information and Communications on the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications.
Clause 2. Certificates of Conformity and Notifications of Acceptance of Declarations of Conformity issued before the effective date of this Circular and still within their validity period shall continue to be applied until the effective date of new technical standards replacing the standards mentioned in the Certificates of Conformity and Notifications of Acceptance of Declarations of Conformity.
Clause 3. During the application of technical standards and testing, organizations and individuals have the responsibility to promptly reflect any difficulties and follow the guidance of the Ministry of Information and Communications (Science and Technology Department).
Clause 4. In case disputes arise regarding the determination of HS codes for imported goods that are products and goods with potential to cause safety hazards within the scope of adjustment of this Circular, the Ministry of Information and Communications will coordinate with the Ministry of Finance (General Customs Department) to resolve them uniformly.
Clause 5. The Director of the Office, Heads of the Science and Technology Department, Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular./.
