Circular No. 05/2022/TT-BGTVT abolishes certain provisions related to the issuance, reissuance, and revocation of permits for international road transport as stipulated in Circulars issued by the Minister of Transport.

Circular

Repeal certain provisions related to issuance, reissuance, and revocation of permits for international road transport information issued by the Minister of Transport pursuant to Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing certain articles and implementing mechanisms of the Law on Legislative Acts;

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Decree No. No. 12/2017/ND-CP No. 154/2020/ND-CP

Decree No. dated May 14, 2016 of the Government detailing certain articles and protecting the Law on Legislative Acts; dated February 10, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Decree No. No. 119/2021/ND-CP December 31, 2020 of the Government amending and supplementing several provisions of Decision No. No. 12/2017/ND-CP dated December 24, 2021 of the Government regarding procedures and formalities for issuing, reissuing, and revoking permits for international road transport through border crossings;

Decree No. At the proposal of the Director of the Department of International Cooperation and the General Director of the Vietnam Highway Administration; The Minister of Transport hereby issues this Circular to repeal certain provisions related to issuance, reissuance, and revocation of permits for international road transport information issued by the Minister of Transport.

Article 1. Repeal certain Articles, Clauses, phrases, and Appendices of Circulars guiding implementation of certain provisions of the Agreement on Facilitating the Movement of Persons and Goods Across Borders in the Greater Mekong Subregion

1. Repeal certain Articles, phrases, and Appendices of Circular No. 29/2009/TT-BGTVT dated November 17, 2009 of the Minister of Transport guiding implementation of certain provisions of the Agreement on Facilitating the Movement of Persons and Goods Across Borders in the Greater Mekong Subregion as follows:

a) Repeal Clause 4, Article 4, Article 6, Article 7, Appendix 2, Appendix 5, Appendix 6, Appendix 7, Appendix 8, and Appendix 9;

b) Repeal the phrase "The model national identification mark of Vietnam is specified in Appendix 2 attached hereto" in Clause 2, Article 4. 2. Repeal Item 1, Item 2, Item 3, Item 4, Item 6, Item 7 of Article 1 and Appendices 1, 2, 3, 4, 5 of Circular No. 89/2014/TT-BGTVT dated December 31, 2014 of the Minister of Transport amending and supplementing certain provisions of Circular No. 29/2009/TT-BGTVT dated November 17, 2009 of the Minister of Transport guiding implementation of certain provisions of the Agreement on Facilitating the Movement of Persons and Goods Across Borders in the Greater Mekong Subregion. Article 2. Repeal certain Articles, Clauses, phrases, and Appendices of Circulars guiding implementation of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China

1. Repeal certain Articles, Clauses, phrases, and Appendices of Circular No. 23/2012/TT-BGTVT dated June 29, 2012 of the Minister of Transport guiding implementation of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China as follows:

a) Repeal Article 8, Article 9, Article 10, Article 11, Article 12, Article 13, Article 14, Article 15, Article 16, Article 17, Appendix I, Appendix V, Appendix VI, Appendix VII, Appendix VIII, Appendix IX, Appendix X, Appendix XI, Appendix XII, Appendix XIII, Appendix XIVa, Appendix XIVb, Appendix XIVc, Appendix XIVd, Appendix XIVđ, Appendix XIVe, Appendix XIVg;

b) Repeal the phrase "as specified in the model at Appendix I of this Circular" in Clause 2, Article 3. 2. Repeal Item 4, Item 5, Item 6, and Item 7 of Article 1, Item 3 of Article 2 of Circular No. 29/2020/TT-BGTVT dated October 30, 2020 of the Minister of Transport amending and supplementing certain provisions of Circular No. 23/2012/TT-BGTVT dated June 29, 2012 of the Minister of Transport guiding implementation of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China. December 31, 2014, of the Minister of Transport amending and supplementing certain Articles of the Circular 2. Repeal Item 1, Item 2, Item 3, Item 4, Item 6, Item 7 of Article 1 and Appendices 1, 2, 3, 4, 5 of Circular No. 89/2014/TT-BGTVT dated December 31, 2014 of the Minister of Transport amending and supplementing certain provisions of Circular No. 29/2009/TT-BGTVT dated November 17, 2009 of the Minister of Transport guiding implementation of certain provisions of the Agreement on Facilitating the Movement of Persons and Goods Across Borders in the Greater Mekong Subregion.  November 17, 2009, of the Minister of Transport guiding the implementation of certain provisions of the Agreement on Facilitating Cross-border Transport of Persons and Goods among the Countries of the Greater Mekong Subregion.

Article 2. Repeal certain Articles, Clauses, phrases, and appendices of the Circulars of the Minister of Transport guiding the implementation of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China.

1. Repeal certain Articles, Clauses, phrases, and appendices of Circular No. 23/2012/TT-BGTVT June 29, 2012, of the Minister of Transport guiding the implementation of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China as follows:

a) Repeal Article 8, Article 9, Article 10, Article 11, Article 12, Article 13, Article 14, Article 15, Article 16, Article 17, and Appendix I, Appendix V, Appendix VI, Appendix VII, Appendix VIII, Appendix IX, Appendix X, Appendix XI, Appendix XII, Appendix XIII, Appendix XIVa, Appendix XIVb, Appendix XIVc, Appendix XIVd, Appendix XIVđ, Appendix XIVe, Appendix XIVg;

b) Repeal the phrase "according to the model provided for in Appendix I of this Circular" in Clause 2, Article 3.

2. Repeal Account 4, Account 5, Account 6, and Account 7 of Article 1, and Account 3 of Article 2 of Circular No. 29/2020/TT-BGTVT October 30, 2020, of the Minister of Transport which amended and supplemented certain Articles of Circular No. 23/2012/TT-BGTVT June 29, 2012, of the Minister of Transport guiding the implementation of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China.

Article 3. Repeal certain Articles, Clauses, Phrases, and Appendices of Circular No. 88/2014/TT-BGTVT dated December 31, 2014 issued by the Minister of Transport guiding the implementation of certain provisions of the Agreement and Protocol to implement the Agreement on facilitating the movement of motor vehicles across the border between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic. 88/2014/TT-BGTVT December 31, 2014, of the Minister of Transport guiding the implementation of certain provisions of the Agreement and Protocol implementing the Agreement on Facilitating the Passage of Motor Vehicles Across Borders between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic.

1. Repeal Clause 1 of Article 4, Article 9, Article 10, Article 11, Article 12, Article 13, Article 14, Article 15, Article 16, Article 17, Article 18, Article 19, and Appendix 2, Appendix 3, Appendix 4, Appendix 5, Appendix 6a, Appendix 6b, Appendix 7a, Appendix 7b, Appendix 8, Appendix 9, Appendix 10, Appendix 11, Appendix 12, Appendix 13, Appendix 14, Appendix 15, Appendix 16, Appendix 17.

2. Delete the phrase "The model of national distinguishing sign of Vietnam prescribed in Appendix 2 of this Circular" from Article 6.

Article 4. Repeal certain Articles, Accounts, and Appendices of Circulars issued by the Minister of Transport guiding the implementation of certain provisions of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

1. Repeal Clause 1 of Article 5, Article 2 of Article 7, Article 10, Article 11, Article 12, Article 13, Article 14, Article 15, Article 16, Article 17, Article 18, Article 19, Article 20, and Appendix 2, Appendix 3, Appendix 4, Appendix 5, Appendix 6A, Appendix 6B, Appendix 6C, Appendix 7A, Appendix 7B, Appendix 8, Appendix 9, Appendix 10, Appendix 11, Appendix 12, Appendix 13, Appendix 14, Appendix 15, Appendix 16, Appendix 17 of Circular No. 39/2015/TT-BGTVT dated July 31, 2015 issued by the Minister of Transport guiding the implementation of certain provisions of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia. 39/2015/TT-BGTVT July 31, 2015, of the Minister of Transport guiding the implementation of certain provisions of the Agreement and Protocol implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

2. Repeal Account 3 and Account 4 of Article 1 of Circular No. 47/2019/TT-BGTVT dated November 28, 2019 issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 39/2015/TT-BGTVT dated July 31, 2015 issued by the Minister of Transport guiding the implementation of certain provisions of the Agreement and Protocol on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia. 47/2019/TT-BGTVT November 28, 2019, of the Minister of Transport amending and supplementing certain Articles of Circular No. 39/2015/TT-BGTVT July 31, 2015, of the Minister of Transport guiding the implementation of certain provisions of the Agreement and Resolution implementing the Agreement on Road Transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

Article 5. Repeal certain Articles, Clauses, Phrases, and Appendices of Circular No. 63/2013/TT-BGTVT dated December 31, 2013 issued by the Minister of Transport guiding the implementation of certain provisions of the Memorandum between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic, and the Socialist Republic of Vietnam on road transport operations as follows:

1. Repeal certain Articles, Clauses, phrases, and appendices of Circular No. 63/2013/TT-BGTVT December 31, 2013, of the Minister of Transport guiding the implementation of certain provisions of the Memorandum of Understanding between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic, and the Socialist Republic of Vietnam on Road Transport as follows:

a) Repeal Clause 1, Account 2, and Account 5 of Article 3, Account 1 of Article 4, Article 7, Article 8, Article 9, Article 10, Article 11, Article 12, Article 13, and Appendix IV, Appendix V, Appendix VI, Appendix VII, Appendix VIII, Appendix IX, Appendix X;

b) Delete the phrase "The model of national distinguishing sign of Vietnam prescribed in Appendix IV of this Circular" from Article 6.

2. Repeal Account 1, Account 2, Account 3, and Account 4 of Article 1 of Circular No. 20/2020/TT-BGTVT dated September 17, 2020 issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 63/2013/TT-BGTVT dated December 31, 2013 issued by the Minister of Transport guiding the implementation of certain provisions of the Memorandum between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic, and the Socialist Republic of Vietnam on road transport. 20/2020/TT-BGTVT September 17, 2020, of the Minister of Transport amending and supplementing certain Articles of Circular No. 63/2013/TT-BGVT dated December 31, 2013, of the Minister of Transport guiding the implementation of certain provisions of the Memorandum between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic, and the Socialist Republic of Vietnam on Road Transport.

1. This Circular takes effect from May 25, 2022.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of Vietnam General Administration, the Directors of Provincial Departments of Transport, Construction Departments of provinces and centrally governed cities, heads of agencies, organizations, and individuals related to this Circular commit to its implementation./.
