Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Based on the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;
Pursuant to Conclusion No. 25-KL/TW dated December 30, 2021 of the Politburo on the prevention and control of the COVID-19 pandemic (2022-2023);
At the proposal of the Minister of Health;
The Government promulgates this Decree amending and supplementing certain articles of Decree No. 56/2011/NĐ-CP of the Government dated July 4, 2011 on the regime of professional allowances for public officials and civil servants working in public health care institutions (hereinafter referred to as Decree No. 56/2011/NĐ-CP).
Article 1. Supplement Clause 7 to Article 3 of Decree No. 56/2011/NĐ-CP as follows:
"7. The level of professional allowance for civil servants in preventive medicine and primary health care shall be applied from January 1, 2022 to December 31, 2023:
"a) A 100% allowance rate shall apply to civil servants who regularly and directly perform preventive medical work (including border health quarantine); perform medical work at commune health stations, district general outpatient clinics, maternity homes, district health centers, provincial-level city health centers, central city health centers, and district hospitals, provincial-level city hospitals, central city hospitals.
b) During the period when the professional allowance for civil servants in preventive medicine and primary health care is applied as stipulated in Clause 7 hereof, the provisions at point c Clause 2 and the provisions for civil servants regularly and directly performing preventive medical work at Clause 4 of Article 3 shall not be applied."
Article 2. Implementation
1. Public health care institutions shall base their determination of financial needs for implementation in 2022 and 2023 on the provisions of this Decree; the source of funds for implementation shall follow the provisions of Article 4 of Decree No. 56/2011/NĐ-CP of the Government dated July 4, 2011. In cases where they request state budget support for implementation costs, public health care institutions shall submit reports on financial needs and plans for using various sources of funds, including state budget support, to the competent management authority and the first-level budget unit for review and approval, and send them to the finance authority at the same level no later than March 31, 2023 to seek approval for supplementary state budget estimates for 2023 according to regulations.
2. The Ministry of Finance and People's Committees of provinces and centrally-administered cities shall be responsible for allocating funds according to the分级任务如下:
3. The management, use, and settlement of funds shall be carried out in accordance with the provisions of the State Budget Law. The unit is responsible for the accuracy of the data proposed for state budget support in accordance with the law.
Article 3. Effectiveness and Responsibility for Implementation
1. This Decree takes effect from the date of issuance.
2. From January 1, 2024 onwards, the level of job-based allowances for preventive health workers and primary health care workers shall be implemented in accordance with the provisions of Clauses 1 to 6 of Article 3 of Decree No. 56/2011/NĐ-CP, and any subsequent amendments, supplements, or replacements thereof (if any).
3. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, and related organizations and individuals are responsible for implementing this Decree.
