CIRCULAR
Regulations on standards and conditions for promotion to higher ranks of teaching positions for staff members in public universities and teacher training colleges dated November 15, 2010; Law amending and supplementing certain articles of the Civil Servants Law and the Public Service Staff Lawdated November 25, 2019;
Pursuant toLaw on Civil Servants Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training; Decree No. 115/2020/NĐ-CPDecree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020 on recruitment, utilization, and management of public service staff;
On the basis of Law on Education June 14, 2019;
The Minister of Education and Training issues this Circular stipulating standards and conditions for promotion to higher ranks of teaching positions for staff members in public universities and teacher training colleges. This Circular stipulates standards and conditions for promotion to higher ranks of teaching positions for staff members in public universities and teacher training colleges, including public college teacher training institutions that offer Early Childhood Education at the college level (hereinafter referred to collectively as teacher training colleges).
On the basis of 1. Article 3. Standards and conditions for promotion to the rank of Associate Professor (Class II), code V.07.01.02
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Teaching staff members in public universities who wish to register for consideration for promotion to the rank of Associate Professor (Class II), code V.07.01.02 must meet the following standards and conditions:
Article 2. Applicability
1. There is a need for the position within the public university, with a vacant position corresponding to the rank of the teaching staff member being promoted, and the competent authority has appointed them to participate in the promotion examination.
2. Currently holding the rank of Lecturer (Class III), code V.07.01.03.
Chapter II
3. Having been rated as having satisfactorily completed their duties or better in the most recent year preceding the year they are applying for promotion to the rank of Associate Professor (Class II), code V.07.01.02; possessing good political qualities and professional ethics; not being within the period of disciplinary action; not being during the period of implementing regulations related to disciplinary measures according to the Party's and legal provisions.
4. Meeting the minimum time requirement for holding the rank of Lecturer (Class III), code V.07.01.03; meeting the standards regarding education, training, and professional competence for the rank of Associate Professor (Class II), code V.07.01.02 as stipulated in Clause 2 and Clause 3, Article 6 of Circular No. 40/2020/TT-BGDĐT dated October 26, 2020 of the Minister of Education and Training on job title codes, standards, appointment, and salary grading for teaching staff in public universities, and amended and supplemented by Circular No. 04/2022/TT-BGDĐT dated March 4, 2022 of the Minister of Education and Training amending and supplementing certain articles of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 on job title codes, standards, appointment, and salary grading for teaching staff in public college teacher training institutions and Circular No. 40/2020/TT-BGDĐT dated October 26, 2020 on job title codes, standards, appointment, and salary grading for teaching staff in public universities.
Teaching civil servants in public higher education institutions may register to be considered for promotion to the rank of Associate Professor (Class II), code V.07.01.02, when meeting the following criteria and conditions:
1. The public higher education institution has a need, with vacant positions corresponding to the rank of the teaching civil servant's position being promoted, and is authorized by the competent authority to register for the promotion examination.
2. Currently holding the rank of Lecturer (Class III), code V.07.01.03.
3. Having been rated as having satisfactorily completed their tasks or better in the most recent working year preceding the year they apply for promotion to the rank of Associate Professor (Class II), code V.07.01.02; possessing good political qualities, professional ethics; not within the disciplinary action period; not during the time implementing disciplinary regulations according to the Party and the law.
4. Meeting the minimum required years of service in the rank of Lecturer (Class III), code V.07.01.03; satisfying the training level, development standards, and professional competence criteria for the rank of Associate Professor (Class II), code V.07.01.02 as stipulated in Clause 2 and Clause 3, Article 6 of Circular No. 40/2020/TT-BGDĐT dated October 26, 2020 issued by the Minister of Education and Training on job title codes, qualification standards, appointment, and salary grading for teaching civil servants in public higher education institutions, and amended and supplemented by Circular No. 04/2022/TT-BGDĐT dated March 4, 2022 issued by the Minister of Education and Training amending and supplementing some articles of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 on job title codes, qualification standards, appointment, and salary grading for teaching civil servants in public teacher colleges and Circular No. 40/2020/TT-BGDĐT dated October 26, 2020 on job title codes, qualification standards, appointment, and salary grading for teaching civil servants in public higher education institutions.
Article 4. Criteria and conditions for considering promotion to the rank and position of Senior Lecturer (Class I), code V.07.01.01
Teaching civil servants in public higher education institutions may register to be considered for promotion to the rank and position of Senior Lecturer (Class I), code V.07.01.01 if they meet the following criteria and conditions:
1. The public higher education institution has a need, has vacant positions corresponding to the rank and position of the teaching civil servant being promoted, and is authorized by the competent authority to participate in the promotion period.
2. Currently holding the rank and position of Associate Professor (Class II), code V.07.01.02.
3. Being rated at least as having satisfactorily completed their tasks in the immediate preceding working year before applying for promotion to the rank and position of Senior Lecturer (Class I), code V.07.01.01; possessing good political qualities, professional ethics; not within the disciplinary action period; not during the implementation period of regulations related to disciplinary actions according to the Party's and State's laws.
4. Meeting the minimum required time in service for the rank and position of Associate Professor (Class II), code V.07.01.02; meeting the training level, development standards, and professional capacity criteria for the rank and position of Senior Lecturer (Class I), code V.07.01.01 as stipulated in Clause 2, Clause 3 of Article 7 of Circular No. 40/2020/TT-BGDĐT and amended and supplemented by Circular No. 04/2022/TT-BGDĐT.
Chapter III
CRITERIA AND CONDITIONS FOR CONSIDERING PROMOTION OF TEACHING CIVIL SERVANTS IN TEACHER COLLEGES
Article 5. Criteria and conditions for considering promotion to the rank and position of Principal Teacher College Lecturer (Class II), code V.07.08.21
Teaching civil servants in teacher colleges may register to be considered for promotion to the rank and position of Principal Teacher College Lecturer (Class II), code V.07.08.21 if they meet the following criteria and conditions:
1. The teacher college has a need, has vacant positions corresponding to the rank and position of the teaching civil servant being promoted, and is authorized by the competent authority to participate in the promotion period.
2. Currently holding the rank and position of Teacher College Lecturer (Class III), code V.07.08.22.
3. Being rated at least as having satisfactorily completed their tasks in the immediate preceding working year before applying for promotion to the rank and position of Principal Teacher College Lecturer (Class II), code V.07.08.21; possessing good political qualities, professional ethics; not within the disciplinary action period; not during the implementation period of regulations related to disciplinary actions according to the Party's and State's laws.
4. Meeting the minimum required time in service for the rank and position of Teacher College Lecturer (Class III), code V.07.08.22; meeting the training level, development standards, and professional capacity criteria for the rank and position of Principal Teacher College Lecturer (Class II), code V.07.08.21 as stipulated in Clause 2, Clause 3 of Article 5 of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 issued by the Minister of Education and Training on the code, criteria, appointment, and salary grading for teaching civil servants in public teacher colleges and amended and supplemented by Circular No. 04/2022/TT-BGDĐT.
Article 6. Standards and conditions for considering promotion to the senior lecturer position (Class I), code V.07.08.20 at higher education teacher training colleges.
Teachers at higher education teacher training colleges may apply for consideration for promotion to the senior lecturer position (Class I), code V.07.08.20 when they meet the following standards and conditions:
1. The teacher college has a need, has vacant positions corresponding to the rank and position of the teaching civil servant being promoted, and is authorized by the competent authority to participate in the promotion period.
2. Currently holding the position of principal lecturer (Class II), code V.07.08.21.
3. Having been rated as having satisfactorily completed their tasks or better in the immediately preceding year of work before applying for promotion to the senior lecturer position (Class I), code V.07.08.20; possessing good political qualities and professional ethics; not being within the period of disciplinary action; not being in a period related to disciplinary regulations according to the Party and laws.
4. Meeting the minimum time requirement for holding the position of principal lecturer (Class II), code V.07.08.21; meeting the training level, supplementary training, and professional capacity standards for the senior lecturer position (Class I), code V.07.08.20 as stipulated in Clause 2 and Clause 3 of Article 6 of Circular No. 35/2020/TT-BGDĐT and amended and supplemented by Circular No. 04/2022/TT-BGDĐT.
Chapter IV
IMPLEMENTATION
Article 7. Implementation Provisions
2. Circular No. 01/2023/TT-BGTVT dated March 7, 2023 of the Minister of Transport guiding the preparation, approval, and publication of the project list; methods and criteria for evaluating tender documents and proposal documents in bidding to select investors for specialized transportation service works on expressways shall cease to be effective from the date this Circular takes effect.
2. Circular No. 31/2021/TT-BGDĐT dated November 10, 2021, issued by the Minister of Education and Training, which sets out the standards and conditions for examination or consideration for promotion; the content, form, and determination of successful candidates during the promotion examination for the positions of teachers at higher education teacher training colleges and public higher education institutions, shall cease to be effective from the date this Circular takes effect.
Article 8. Responsibility for Implementation
1. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and centrally governed cities, Heads of public higher education institutions, Principals of higher education teacher training colleges, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall follow the new documents.
3. During the implementation process, if there are any difficulties, please report to the Ministry of Education and Training for guidance or review and resolution./.
