Amending and supplementing certain articles of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 issued by the Minister of Education and Training on job code, occupational standards, appointment, and salary grading for public college teachers in teacher training colleges; Circular No. 40/2020/TT-BGDĐT dated October 26, 2020 issued by the Minister of Education and Training on job code, occupational standards, appointment, and salary grading for public university teachers; Law amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and capacity building for civil servants, public officials, and employees; Decree No. 89/2021/NĐ-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and capacity building for civil servants, public officials, and employees;

After receiving the unified opinion of the Ministry of Home Affairs in Document No. 146/BNV-CCVC dated January 12, 2022;

The Minister of Education and Training issues this Circular to amend and supplement certain articles of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 issued by the Minister of Education and Training on job code, occupational standards, appointment, and salary grading for public college teachers in teacher training colleges; Circular No. 40/2020/TT-BGDĐT dated October 26, 2020 issued by the Minister of Education and Training on job code, occupational standards, appointment, and salary grading for public university teachers. Article 1. Amending and supplementing certain articles of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020 issued by the Minister of Education and Training on job code, occupational standards, appointment, and salary grading for public college teachers in teacher training colleges

1. Amending and supplementing Point c Clause 2 Article 4, Point c Clause 2 Article 5, Point c Clause 2 Article 6 as follows:

"c) Having a certificate of training according to the occupational standards of college teacher."

2. Supplementing Article 10a following Article 10 as follows:

"Article 10a. Transitional provisions

 On the basis of Law on Civil Servants 1. Public college teachers who have been appointed to the occupational position of public college teacher in teacher training colleges according to the law before the effective date of this Circular shall be deemed to meet the occupational standards of public college teacher in teacher training colleges stipulated in this Circular corresponding to the occupational position already appointed.Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020 on recruitment, utilization, and management of public service staff;

On the basis of Law on Education June 14, 2019;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

On the basis of 2. Public college teachers who have obtained a certificate of training according to the occupational standards of the occupational position of public college teacher in teacher training colleges or in public universities according to the law before June 30, 2022 shall be deemed to meet the requirement for a certificate of training according to the occupational standards of college teacher; at the same time, they may use it when participating in examinations or evaluations for promotion to higher occupational positions and are not required to undergo the training program according to the occupational standards of college teacher stipulated in this Circular." dated September 1, 2017, of the Government on training and improving cadres, civil servants, and public officials; Decree No. 89/2021/NĐ-CP dated October 18, 2021, of the Government amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017, of the Government on training and improving cadres, civil servants, and public officials;

On the basis of 1. This Circular applies to teaching staff members in public universities and teacher training colleges who register to be considered for promotion to higher ranks of teaching positions and related organizations and individuals. of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

After receiving the unified opinion of the Ministry of Home Affairs in Circular No. 146/BNV-CCVC dated January 12, 2022;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues the Circular amending and supplementing certain articles of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020, of the Minister of Education and Training stipulating the code number, job title standards, appointment, and salary grading for teaching public officials in public teacher training colleges; Circular No. 40/2020/TT-BGDĐT dated October 26, 2020, of the Minister of Education and Training stipulating the code number, job title standards, appointment, and salary grading for teaching public officials in public higher education institutions.

Article 1. Amending and supplementing certain articles of Circular No. 35/2020/TT-BGDĐT dated October 1, 2020, of the Minister of Education and Training stipulating the code number, job title standards, appointment, and salary grading for teaching public officials in public teacher training colleges.

1. Amending and supplementing Point c Clause 2 Article 4, Point c Clause 2 Article 5, Point c Clause 2 Article 6 as follows:

"c) Having a certificate for training according to the job title standards for college teacher."

2. Supplementing Article 10a following Article 10 as follows:

"Article 10a. Transitional provisions

1. Public officials who have been appointed to the job title of teaching public officials in public teacher training colleges according to the law before the effective date of this Circular shall be deemed to meet the job title standards for teaching public officials in public teacher training colleges stipulated in this Circular corresponding to the job title already appointed.

2. Public officials who have obtained a certificate for training according to the job title standards for the rank of teaching public officials in public teacher training colleges or in public higher education institutions according to the law before June 30, 2022 shall be deemed to meet the requirement for a certificate for training according to the job title standards for college teachers; at the same time, they may use it when participating in examinations or being considered for promotion to a higher job title without having to undergo the training program for college teachers stipulated in this Circular."

1. Amending and supplementing Point b Clause 2 Article 5, Point b Clause 2 Article 6, Point b Clause 2 Article 7 as follows:

"b) Having a training certificate according to the occupational title standard for university lecturers."

2. Supplementing Article 11a following Article 11 as follows:

"Article 11a. Transitional Provisions

1. Civil servants who have been appointed to the occupational title of teaching civil servant in public higher education institutions in accordance with the law before the effective date of this Circular shall be deemed to meet the occupational title standard requirements for teaching civil servants in public higher education institutions stipulated in this Circular corresponding to the occupational title they have been appointed.

2. Civil servants who have obtained a training certificate according to the occupational title standard for teaching civil servants in public higher education institutions in accordance with the law before June 30, 2022 shall be deemed to meet the requirement for a training certificate according to the occupational title standard for university lecturers; at the same time, such certificates may be used when participating in examinations or promotions to higher occupational titles without having to undergo the training program according to the occupational title standard for university lecturers prescribed in this Circular."

This Circular takes effect from December 25, 2025/.

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial People's Committees under central city administrations, Principals of teacher colleges, Heads of public higher education institutions, and related agencies, organizations, and individuals are responsible for implementing this Circular.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.

Article 4. Effective date

1. This Circular takes effect from April 19, 2022.

2. In case of difficulties during implementation, please report to the Ministry of Education and Training for guidance or consideration and resolution./.
