CIRCULAR

Regulations on Economic and Technical Standards for Forest Surveys

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Forestry Law dated November 15, 2017;

Pursuant to Decree No. 156/2018/NĐ-CP dated November 16, 2018 of the Government detailing the implementation of certain provisions of the Forestry Law;

At the proposal of the Director of the Forest Protection Department;

The Minister of Agriculture and Rural Development issues this Circular on economic and technical standards for forest surveys.

Article 1. Scope of Regulation

This Circular stipulates economic and technical standards for forest surveys, including:

1. Surveying forest area;

2. Surveying forest stock;

3. Surveying forest structure;

4. Surveying forest growth;

5. Surveying forest regeneration;

6. Surveying non-timber forest products;

7. Site survey;

8. Surveying scattered trees;

9. Surveying forest ecosystem diversity;

10. Surveying forest plant diversity;

11. Surveying forest vertebrate animal diversity;

12. Surveying forest insects and forest pests;

13. Surveying forest biomass and carbon stock;

14. Surveying and evaluating forests according to cycles.

Article 2. Applicability

1. This Circular applies to organizations, individuals, and community residents involved in forest surveys funded by state budget.

2. It is encouraged to apply the economic and technical standards set forth in this Circular for forest surveys funded by sources other than the state budget.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Economic and technical standards for forest surveys refer to the levels of labor consumption, materials, and machinery equipment for tasks within forest surveys.

2. Adjustment factor (K) is the coefficient used to calculate and adjust labor consumption levels when factors forming economic and technical standards for forest surveys change.

3. Travel distance is the distance traveled without using motorized road transport or motorized inland waterway vessels to reach the location for conducting forest surveys.

Article 4. General Provisions on Economic and Technical Standards

1. Based on specific conditions and technical measures, apply the adjustment factor (K) to calculate the necessary labor consumption for each task when drafting proposals and budgets.

2. The application of economic and technical standards must comply with requirements stipulated in criteria, standards, regulations, and technical guidelines issued by competent state authorities.

3. Costs and coefficients applied in forest surveys:

a) Rank salary as prescribed; travel allowance; hazardous and dangerous job allowance; social insurance; health insurance; unemployment insurance; trade union fee;

b) Difficulty coefficient is the factor used to adjust actual field labor rates when workers perform tasks at different levels of difficulty at the site;

c) Labor technical stoppage due to weather conditions for field technical workers.

4. Costs for survey machinery and equipment shall not exceed 5% of labor costs.

5. Costs for materials, utilities, and communication shall not exceed 5% of labor costs.

6. Economic and technical standards for various types of forest surveys are detailed in the Appendix attached to this Circular.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Forest Protection Department shall organize guidance, dissemination, promotion, and implementation of economic and technical standards for forest surveys stipulated in this Circular.

2. Provincial People's Committees shall direct specialized agencies to organize dissemination, promotion, and implementation of economic and technical standards stipulated in this Circular at local level.

Article 6. Effectiveness

1. This Circular takes effect from June 22, 2024.

2. Decision No. 487/QĐ-BNN-TCCB dated February 26, 2007 of the Minister of Agriculture and Rural Development on labor standards in forest planning and survey work ceases to be effective from the date this Circular takes effect.

3. Programs and projects applying economic and technical standards for forest surveys approved before the date this Circular takes effect may continue until completion. In cases where programs and projects approved need adjustment after this Circular takes effect, they shall apply the economic and technical standards for forest surveys stipulated in this Circular.

Article 22. Where legal documents cited for application in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the amended, supplemented, or replaced documents.

5. During the implementation of this Circular, if there are difficulties or obstacles, entities, organizations, and individuals are requested to promptly report to the Ministry of Agriculture and Rural Development for consideration and resolution.
