CIRCULAR
AMENDMENT AND SUPPLEMENTATION OF CERTAIN CIRCULARS IN THE FIELD OF FISHERY EXPLOITATION
Pursuant to Decree No. 35/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Fisheries Law dated November 21, 2017;
At the proposal of the Director of the Fisheries and Aquaculture Inspection Department;
The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain Circulars in the field of fishery exploitation. Article 1. Amending and supplementing certain Articles of Circular No. 21/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development on recording, submitting reports, fishing logs; announcing designated ports for confirming the origin of fishery products from fishing; list of fishing vessels engaged in illegal fishing; confirming raw materials, certifying the origin of fishery products from fishing, which have been amended and supplemented certain provisions according to Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing certain Circulars in the field of fisheries.
2. Replacing the phrase "Fisheries General Department" in Article 6, Article 8, Article 9, Article 13, Article 14, Article 15, Article 16, Article 17, and Article 21 of the Appendices with the phrase "Fisheries and Fishery Surveillance Service".
3. Replacing the phrase "Quality Management Bureau of Forestry, Aquaculture and Fisheries" in Article 9, Article 13, Article 15, and Article 21 with the phrase "Quality Control, Processing and Market Development Bureau".
4. Replacing the phrase "Regional Quality Management Center for Forestry, Aquaculture and Fisheries" in Clause 5 of Article 15 with the phrase "Regional Quality Control, Processing and Market Development Center".
5. Replacing Model No. 01, Model No. 02 of Appendix I issued together with Circular No. 21/2018/TT-BNNPTNT, which has been amended and supplemented certain provisions according to Circular No. 01/2022/TT-BNNPTNT, with Model No. 01, Model No. 02 of the Appendix issued together with this Circular.
6. Replacing Model No. 03, Model No. 04 of Appendix I issued together with Circular No. 21/2018/TT-BNNPTNT with Model No. 03, Model No. 04 of the Appendix issued together with this Circular.
Article 2. Amending and supplementing certain Articles of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development on regulations regarding fishing vessel surveyors; recognizing inspection facilities for fishing vessels; ensuring technical safety of fishing vessels and fishery surveillance vessels; registering fishing vessels and fishery service vessels; deregistering fishing vessels and marking fishing vessels, which have been amended and supplemented certain provisions according to Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture and Rural Development amending and supplementing certain Circulars in the field of fisheries.
1. Amending and supplementing Point c Clause 4 of Article 20 as follows:
"c) Group three: Consists of two letters: "TS" for fishing vessels; consists of three letters: "NTS" for aquaculture support vessels; consists of three letters: "BTB" for marine conservation support vessels; consists of three letters: "ĐQL" for co-management activity support vessels in fishery resource protection."
2. Replacing Model No. 06.DKT of Appendix VII issued together with Circular No. 23/2018/TT-BNNPTNT with Model No. 05 of the Appendix issued together with this Circular.
Fishing logs, purchase and transfer logs, fishing reports, exploration and search reports for fishery resources, crew registers of fishing vessels issued before the effective date of this Circular shall continue to be used until their expiration date as recorded in the logs, reports, and registers.
Article 3. Transitional Provisions
Article 3. This Circular takes effect from July 18, 2025.
Article 4. Effective date
1. During implementation, if any issues arise or difficulties occur, organizations and individuals shall promptly report to the Fisheries and Fishery Surveillance Service for consolidation and reporting to the Minister of Agriculture and Rural Development for consideration and decision.
