Guidelines on reporting additional income outside salaries for administrative and public service agencies and units
Implementing Article 5 of Decree No. 06/CP dated January 21, 1997 of the Government regarding the responsibility of the Minister, Head of Government-affiliated agency, Chairman of the People's Committee of provinces and centrally governed cities to direct competent agencies to organize inspections of additional income outside salaries according to state regulations at independent administrative and public service agencies and units with their own seals, the Ministry of Labor - Invalids and Social Affairs, the Civil Service Organization Board, and the Ministry of Finance provide guidelines on reporting additional income outside salaries as follows:
All agencies and units within the scope defined in point 2 below must report information on additional income outside salaries (based on rank, grade, position, and salary allowances) as prescribed by this Circular, regardless of whether they have such income or not.
1. Requirements:
The data reported on additional income or lack thereof outside salaries is for the year 1996 and up to the month of the report in 1997.
2. Reporting entities include:
Administrative and public service agencies and units with independent budgets, having their own seals, and receiving personnel quotas and salaries from the State budget.
3. Additional income outside salaries that must be reported includes:
Income derived from sources permitted by the State such as: tuition fees; medical fees; taxes; anti-evaporation measures; programs, projects; scientific research proposals, applied research...
Income derived from sources allowed by the head of the agency or unit due to the results of service activities, production, business operations, leasing premises, acting as agents earning commissions organized by the agency or unit, or through the regulation of affiliated enterprises and other forms of income generation of the agency or unit.
Regular monthly additional income derived from the aforementioned sources is calculated in monetary terms and averaged monthly for the year 1996 and for each month of 1997 up to the reporting date.
4. Procedures and formalities for preparing reports:
Independent agencies and units with their own seals prepare reports according to Model No. 1 attached to this Circular and submit them to the directly managing superior agency and bear responsibility for the accuracy of the reported data.
Superior management agencies check the reported data of subordinate agencies and units, compile comprehensive reports according to Model No. 2, and submit them to the ministries, sectors, or provincial people's committees directly managing them and bear responsibility for the accuracy of the reported data of subordinate agencies and units.
Ministries, councils, sectors, and centrally governed provincial-level authorities check the reported data of subordinate units, compile comprehensive reports according to Model No. 2, and submit them to the Ministry of Labor - Invalids and Social Affairs, the Civil Service Organization Board, and the Ministry of Finance (one copy sent through the Inter-Ministerial Working Group established by the National Wage Steering Committee Decision) and bear responsibility for the accuracy of the reported data of subordinate agencies and units.
Heads of ministries, ministerial-level agencies, government-affiliated agencies, and Chairmen of provincial people's committees directly manage the organization and civil service agencies to coordinate with functional agencies to guide and direct subordinate agencies and units to implement the reporting of additional income outside salaries as stipulated in this Circular.
- Directing the Department of Information and Communications to advise on management, plan formulation, and implementation after approval by the Provincial People's Committee;
Reports must be promptly prepared and submitted to the Inter-Ministry no later than April 1997.
The Inter-Ministry will organize inspections of the reported data of agencies and units as prescribed by the Government.
This Circular takes effect from January 1997.
During implementation, if there are any difficulties, please reflect them to the Inter-Ministry for consideration and resolution./.
