Regulations on organizing and ensuring telecommunications to serve the work of directing and managing disaster prevention and control
Circular No. 17/2012/TT-BTTTT dated January 5, 2012, issued by the Minister of Information and Communications, stipulates the organization and assurance of telecommunications to serve the work of directing and managing disaster prevention and control, which took effect from December 20, 2012, and was amended and supplemented by:

The Minister of Information and Communications issues this Circular stipulating the organization and assurance of telecommunications to serve the work of directing and managing disaster prevention and control[1].
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the organization and assurance of telecommunications to serve the work of directing and managing disaster prevention and control of the Government, the Central Steering Committee for Disaster Prevention and Control[2] (abbreviated as the Central Steering Committee for DPC[3])[4] to the Provincial Steering Committee for Disaster Prevention and Control and Search and Rescue[5](abbreviated as the Provincial Steering Committee for DPC&SR
Article 2. Applicability
) of ministries, agencies at the ministerial level, and centrally administered cities.
Article 3. Explanation of Terms
1. Organizations and individuals directly related to the organization and assurance of telecommunications to serve the work of directing and managing disaster prevention and control. Organizing and ensuring telecommunications to serve the work of directing and managing disaster prevention and control
2.[6] means mobilizing, organizing, and using public postal and telecommunications networks, dedicated telecommunications networks to meet the needs of telecommunications serving the work of directing and managing disaster prevention and control. Dedicated telecommunications network serving the work of directing and managing disaster prevention and control
The network includes:
a) Fixed satellite telecommunications system;
b) Mobile satellite telecommunications system;
c) Radio telecommunications system;
is a telecommunications network established by the State to serve the Government, the Central Steering Committee for Disaster Prevention and Control, local authorities in organizing and ensuring telecommunications to implement the work of directing and managing disaster prevention and control. The dedicated telecommunications network serving the work of directing and managing disaster prevention and control includes:
d) Special-purpose vehicles for communication services;
e) Other telecommunications systems as prescribed by the Ministry of Information and Communications.

1.[7] Ensuring telecommunications for disaster prevention and control with the highest priority, safety, reliability, and speed. Prioritize the use of local networks to deploy activities for directing and managing disaster prevention and control.
1. Ensuring communication information for natural disaster prevention and response with the highest priority, safety, reliability, and speed. Prioritize the use of local networks to implement command and control activities in natural disaster prevention and response.
3.[8] Exploiting and utilizing the dedicated telecommunications network serving the work of directing and managing disaster prevention and control in accordance with its purpose and effectively.
4.[9] The funding for deploying operations, management, and exploitation of the dedicated telecommunications network serving the work of directing and managing disaster prevention and control shall be implemented in accordance with current regulations.
Chapter II. ORGANIZATION AND ASSURANCE OF TELECOMMUNICATIONS TO SERVE THE WORK OF DIRECTING AND MANAGING DISASTER PREVENTION AND CONTROL
Article 5. Organization and assurance of communication information under normal conditions and before natural disastersCommunication information from the Government headquarters, the National Steering Committee for Natural Disaster Prevention and Control to the Provincial Steering Committees for Natural Disaster Prevention and Control of Ministries, agencies at the ministerial level, provinces, centrally governed cities shall be mainly ensured through the use of public mobile and fixed terrestrial telecommunications network services (telephone, fax, Internet, video conferencing, etc.), postal networks serving Party and State agencies, and public postal networks.
Communication services for directing and managing natural disaster prevention and control in normal conditions and prior to natural disasters shall be organized as follows:
1.[10] Article 5, Clause 2. When moving outside the premises mentioned in Clause 1 of this Article, communication information shall be mainly ensured through the use of public mobile terrestrial telecommunications network services.
Article 5, Clause 3. Communication information for government working groups and the Chairman of the National Steering Committee for Natural Disaster Prevention and Control
when necessary, shall be mainly ensured through the use of telecommunication equipment systems on dedicated vehicles for communication purposes.[11] In areas affected by natural disasters that directly cause loss of communication and disruption of public telecommunications network information, the organization and assurance of communication information to serve command and control of natural disaster prevention and control work shall be organized as follows:[12].
Article 6. Organization and Assurance of Communication During Natural Disasters
1. In areas affected by natural disasters that do not impact the operation of public postal and telecommunications networks, the organization and assurance of communication shall be carried out according to the provisions of Article 5 of this Circular.
2.[13] Article 6, Point a. Communication information from the Government headquarters, the National Steering Committee for Natural Disaster Prevention and Control to the headquarters of the Provincial Steering Committees for Natural Disaster Prevention and Control of provinces, centrally governed cities, and counties affected by natural disasters shall be mainly ensured through the use of satellite mobile telecommunications systems, fixed satellite telecommunications systems, and radio telecommunications systems.
Article 6, Point b. When moving outside the premises mentioned in Point a of Clause 2 of this Article, communication information shall be mainly ensured through the use of satellite mobile telecommunications systems and radio telecommunications systems.
Article 6, Point c. Communication information for government working groups and the Chairman of the National Steering Committee for Natural Disaster Prevention and Control shall be ensured through the use of satellite mobile telecommunications systems and radio telecommunications systems on dedicated vehicles for communication purposes.
Article 7, Clause 1. In areas affected by natural disasters that do not cause damage affecting the operation of public postal and telecommunications networks, the organization and assurance of communication information shall be implemented according to the provisions of Article 5 of this Circular.
Article 7. Organization and Assurance of Communication During the Post-Disaster Recovery Phase
Article 7, Clause 2. In areas affected by natural disasters that cause damage directly causing loss of communication and disruption of public telecommunications network information, the organization and assurance of communication information shall be implemented according to the provisions of Clause 2 of Article 6 of this Circular.
2.[14] Article 7, Clause 3. In areas damaged by the aftermath of natural disasters, after the public postal and telecommunications networks have been restored to normal operation, the organization and assurance of communication information shall be implemented according to the provisions of Article 5 of this Circular.
Article 8. Responsibilities of the Ministry of Information and Communications
Chapter III. RESPONSIBILITIES OF AUTHORITIES, ORGANIZATIONS, AND ENTERPRISES
Implement state management functions for the assurance of communication information to serve command and control of natural disaster prevention and control work and the operation of the dedicated telecommunications network for command and control of natural disaster prevention and control work.
1.[15] Article 8, Clause 2. Specify quality standards and service rates for telecommunications services of the specialized telecommunications network for natural disaster prevention and control.
Article 8, Clause 3. Directly direct the Provincial Steering Committees for Natural Disaster Prevention and Control
The Ministry of Information and Communications, postal and telecommunications enterprises, and related agencies and units shall build and implement plans to ensure communication information to serve command and control of natural disaster prevention and control and search and rescue operations annually.[16] The Provincial Steering Committee for Natural Disaster Prevention and Control of the Ministry of Information and Communications shall urge, guide, inspect, and direct the organization and implementation of activities of the dedicated telecommunications network for command and control of natural disaster prevention and control; duty rostering, handling reports, compiling situations, and directing organizational communication information to serve command and control of natural disaster prevention and control and post-disaster recovery.
4.[17] Article 8a.
Responsibilities of the Telecommunications Administration[18] Article 8a, Clause 1. Advise the Ministry's leadership to direct telecommunications enterprises and related agencies and units to build and implement plans to ensure communication information to serve annual command and control of natural disaster prevention and control and search and rescue operations.
Article 8a, Clause 2. Direct telecommunications enterprises to enhance the capacity of the public telecommunications network and the quality of telecommunications services to ensure communication information to serve command and control of natural disaster prevention and control.
Article 8b.
Responsibilities of the Central Post Office[19] Article 8b, Clause 1. Organize the operation and exploitation of the radio telecommunications system; manage and operate dedicated vehicles for communication purposes ready to serve the assurance of communication information for command and control of natural disaster prevention and control for government working groups and the National Steering Committee for Natural Disaster Prevention and Control upon request of the Government Office, the National Steering Committee for Natural Disaster Prevention and Control, and the Ministry of Information and Communications.
Article 8b, Clause 2. Coordinate and organize the provision of online television services to serve the Government and the National Steering Committee for Natural Disaster Prevention and Control when organizing online meetings to direct natural disaster prevention and control work to provinces and centrally governed cities.
Article 8b, Clause 3. Coordinate with designated enterprises to maintain and manage the public postal network and the postal network serving Party and State agencies to ensure communication information to serve the Government's command and control of natural disaster prevention and control and search and rescue operations, the Chairman of the National Steering Committee for Natural Disaster Prevention and Control, and the National Committee for Disaster Response and Search and Rescue.
Article 8b, Clause 4. In case of necessity, the Central Post Office shall propose the Ministry of Information and Communications to direct the mobilization of infrastructure of postal and telecommunications enterprises to connect communication information to serve the Government's and the National Steering Committee for Natural Disaster Prevention and Control's command and control of natural disaster prevention and control.
Article 8b, Clause 5. Coordinate with relevant units to build regulations on cooperation in receiving information and organizing communication information to serve command and control of natural disaster prevention and control and search and rescue operations.
5. Coordinate with relevant units to establish regulations on cooperation in receiving information and organizing information services for disaster prevention and control directives and operations.
Article 9. Responsibilities of Provincial Departments of Information and Communications
1.[20] Direct and guide postal and telecommunications enterprises within their jurisdiction to develop and implement plans and schemes ensuring communication services for disaster prevention and response directives and management by provincial People's Committees and Provincial Steering Committees for Disaster Prevention and Control:
a) Take the lead in directing and coordinating postal and telecommunications enterprises within their jurisdiction to ensure communication services for disaster prevention and response directives and management for all levels of government and government working groups when disasters occur.
b) Advise provincial People's Committees and Provincial Steering Committees for Disaster Prevention and Control on equipping communication methods that fully meet the needs of communication services for disaster prevention and response management at the local level.
c) Create favorable conditions and support telecommunications enterprises within their jurisdiction in building communication infrastructure to serve disaster prevention and response management tasks.
Article 10. Responsibilities of Postal and Telecommunications Enterprises
1. Develop and implement plans and schemes for disaster prevention and response for their postal and telecommunications networks.
2. Organize and ensure communication services in areas affected by disasters according to the requirements of the Provincial Steering Committee for Disaster Prevention and Control and the Provincial Department of Information and Communications to serve disaster prevention and response management tasks.[21] 3. Proactively support Vietnam Post and Telecommunications Corporation and Military Industry and Telecommunications Corporation in fulfilling tasks to ensure safe communication services for disaster prevention and response management, disaster aftermath mitigation, and search and rescue operations.
4. Regularly and promptly report on the status of their postal and telecommunications networks and the provision of communication services for disaster prevention and response management to the Provincial Steering Committee for Disaster Prevention and Control, the Ministry of Information and Communications, and Provincial Departments of Information and Communications.[22] Responsibilities of Vietnam Post and Telecommunications Corporation
In addition to the general responsibilities stipulated in Article 10 of this Circular, Vietnam Post and Telecommunications Corporation also has the following responsibilities:[23] 1. Ensure communication services for disaster prevention and response management for the Government, National Steering Committee for Disaster Prevention and Control, and all levels of government through public telecommunications networks and dedicated disaster prevention and control information networks safely, reliably, and quickly.
Article 11.[24] a) Develop and implement organizational plans to ensure communication services for dedicated disaster prevention and control information networks.
b) Coordinate with the Central Post Office to be ready to provide mobile communication services for government working groups upon request from the Government Office, the National Steering Committee for Disaster Prevention and Control, and the Ministry of Information and Communications.
c) Closely cooperate with other telecommunications enterprises and private telecommunications network owners to effectively utilize dedicated disaster prevention and control information networks and ensure the highest safety for communication services for disaster prevention and response management.
2. Develop, approve, and implement operational regulations for dedicated disaster prevention and control information networks.
3. Direct and manage subsidiaries in localities to organize communication services for disaster prevention and response management and search and rescue operations according to the requirements of the Provincial Steering Committee for Disaster Prevention and Control and the Provincial Department of Information and Communications.
4. Report annually and promptly to the Ministry of Information and Communications on the operation of dedicated disaster prevention and control information networks as required.
2. Establish, approve, and implement operational regulations for specialized communication networks for disaster prevention and control.
3. Direct and manage member units at localities to organize information services for disaster prevention and control directives and operations according to the requirements of the Steering Committee for Disaster Prevention and Control and Search and Rescue and the Department of Information and Communications at the locality.
4. Report to the Ministry of Information and Communications annually and as required on the activities of the specialized communication network for disaster prevention and control.
Article 12. Responsibilities of the Military Industry-Telecommunications Group[25]
In addition to the general responsibilities stipulated in Article 10 of this Circular, the Military Industry-Telecommunications Group shall also have the following responsibilities:[26] also has the following responsibilities:
1. Ensuring telecommunications information for disaster prevention, mitigation, and search and rescue operations of armed forces as required by the Ministry of National Defense.
2. Cooperating and supporting the provision of telecommunications information for disaster prevention and mitigation operations and ensuring telecommunications information for search and rescue operations as required by the National Steering Committee for Disaster Response and Search and Rescue.[27].
3.[28] Implementing tasks to ensure the safety of telecommunications information for command and control operations related to disaster prevention and mitigation as required by the Government, the National Steering Committee for Disaster Prevention and Control, and local authorities at all levels.
12b.[29] Responsibilities of Vietnam Post Corporation
In addition to the general responsibilities stipulated in Article 10 of this Circular, Vietnam Post Corporation shall also have the following responsibilities:
1. Ensuring postal telecommunications information for command and control operations related to disaster prevention and mitigation and search and rescue operations of the Government, the National Steering Committee for Disaster Prevention and Control, and the National Steering Committee for Disaster Response and Search and Rescue through the postal network serving Party and State agencies; public postal network according to the requirements of the Office of the Government, the National Steering Committee for Disaster Prevention and Control, the National Steering Committee for Disaster Response and Search and Rescue, and the Ministry of Information and Communications.
2. Coordinating with the Central Postal Administration to operate and maintain the postal network serving Party and State agencies to ensure postal telecommunications information for command and control operations related to disaster prevention and mitigation and search and rescue operations.
3. Directing and managing affiliated units in localities to organize information services for command and control operations related to disaster prevention and mitigation and search and rescue operations as required by the Provincial Steering Committee for Disaster Prevention and Control and the Department of Information and Communications in the locality."
Chapter IV.IMPLEMENTATION[30]
Article 13. This Circular takes effect from December 20, 2012.
Article 14. The Head of the Office, the Director of the Telecommunications Department, the Heads of Ministries and Agencies under the Ministry, the Directors of Departments of Information and Communications of provinces and centrally governed cities, the General Directors of Vietnam Post and Telecommunications Corporation, the General Directors of the Military Industry-Telecommunications Group[31], the General Directors, and the Directors of postal and telecommunications enterprises and other relevant organizations and individuals are responsible for implementing this Circular.
During implementation, if any difficulties arise, they should be reported promptly to the Ministry of Information and Communications for consideration and resolution./.

[29] This clause was added pursuant to Clause 15, Article 1 of Circular No. 17/2019/TT-BTTTT dated December 10, 2019, issued by the Minister of Information and Communications to amend and supplement certain provisions of Circular No. 17/2012/TT-BTTTT dated January 5, 2012, issued by the Minister of Information and Communications on organizing and ensuring telecommunications services for directing and managing disaster prevention and control work, which took effect from January 28, 2020.
[30] Article 3 of Circular No. 17/2019/TT-BTTTT dated December 10, 2019, issued by the Minister of Information and Communications to amend and supplement certain articles of Circular No. 17/2012/TT-BTTTT dated January 5, 2012, issued by the Minister of Information and Communications, concerning the organization and assurance of communication services for the purpose of directing and managing disaster prevention and control work, which took effect from January 28, 2020, is stipulated as follows:
"Article 3. Implementation Provisions
1. This Circular takes effect from January 28, 2020.
2. Within sixty days from the date this Circular takes effect, organizations and individuals participating in the management, operation, and exploitation of dedicated telecommunications networks serving the work of directing and managing disaster prevention and control shall develop implementation plans for this Circular.
3. The Director of the Office, the Director of the Telecommunications Department, the Director of the Central Post Department, the Heads of agencies and units under the Ministry, the Directors of Provincial Departments of Information and Communications under central cities and provinces, the General Directors of Vietnam Posts and Telecommunications Group, Military Industry and Telecommunications Group, Vietnam Post Corporation, General Directors and Directors of postal and telecommunications enterprises, and other related organizations and individuals are responsible for implementing this Circular.
4. In the course of implementation, if any difficulties arise, organizations and enterprises are requested to promptly report them to the Ministry of Information and Communications (Central Post Department) for guidance or review and amendment./.”
