Article 1: Now hereby promulgates with this Decision the "Examination Regulations for Graduation from Secondary School Equivalency and High School Equivalency."
Article 2: These Regulations shall take effect fifteen days from the date of signing.
These Regulations replace the "Examination Regulations for Graduation from Secondary School Equivalency and High School Equivalency" issued together with Decision No. 17/1998/QĐ-BGD&ĐT dated April 10, 1998, of the Minister of Education and Training.
Article 3: The Chairmen of the People's Committees of provinces and centrally governed cities, the Heads of the Office of the Ministry of Education and Training, the Directors of the Departments of Organization and Cadres, Planning and Finance, Continuing Education, the Inspector General of the Ministry, the Directors of Departments of Education and Training, and the Directors of Centers for Continuing Education under the General Staff of the Ministry of National Defense are responsible for implementing this Decision.

Graduation Examinations for Secondary School Equivalency and High School Equivalency

PART I
GENERAL PRINCIPLES
Article 1:
Graduation examinations for Secondary School Equivalency and High School Equivalency are evaluations by the State of the learning outcomes and discipline of students according to training objectives after completing a level of study.
Article 2:
All examination organization activities must ensure requirements of safety, seriousness, accuracy, and fairness so that the examination results reflect the true academic level of candidates and the quality of teaching and learning at schools and Continuing Education Centers.
Chapter II
Scores from the graduation examination subjects
Article 3:
1. Graduation examinations for High School Equivalency are organized uniformly nationwide, in each province and centrally governed city, twice a year. The examination dates are specified annually by the Ministry of Education and Training.
2. Graduation examinations for Secondary School Equivalency are organized uniformly in each province and centrally governed city, twice a year. The examination dates are determined and announced by the Departments of Education and Training at the beginning of each school year.
Article 4:
The examination content covers the current Secondary School Equivalency Program and High School Equivalency Program, according to each level of study.
Article 5:
The subjects of graduation examinations for Secondary School Equivalency and High School Equivalency are defined by the Ministry of Education and Training and announced on March 31 each year.
Article 6:
The examination questions and marking guidelines for High School Equivalency graduation examinations are the responsibility of the Examination Question Selection and Compilation Committee of the Ministry of Education and Training and are uniformly used throughout the country.
The examination questions and marking guidelines for Secondary School Equivalency graduation examinations are the responsibility of the Examination Question Compilation Committees of the Departments of Education and Training and are uniformly used within each province and centrally governed city.
Chapter III
ELIGIBILITY FOR EXAMINATION, EXAMINATION FILE
Article 7:
Vietnamese citizens and foreigners residing in Vietnam who meet the following conditions will be eligible to take the examinations:
1. Having completed the current Secondary School Equivalency or High School Equivalency program of the Ministry of Education and Training for the respective level of study they wish to take the examination for.
a/ If studying at Continuing Education Centers or equivalency schools, in the final year of study, the academic performance should not be rated as poor. If the student is subject to conduct evaluation, they must also meet the condition of having a conduct rating of at least average.
Not missing more than 45 class sessions in the final year of study.
b/ If self-studying:
Must submit a registration form for self-study to the Department of Education and Training before the start of the school year and obtain approval from the Department.
In each semester, each subject must be assessed through written tests and graded at least twice.
The average grade for each subject throughout the year must be at least 5.
2. Having graduated from secondary school for the High School Equivalency graduation examination, having graduated from primary school for the Secondary School Equivalency graduation examination.
3. Not being subject to disciplinary action prohibiting examination participation.
4. Registering for the examination with complete and valid application materials as stipulated in Article 8.
Article 8:
The candidate’s application materials include:
1- Application form for examination registration (according to the prescribed format).
2- Student record book or assessment sheet for self-study candidates (original).
3- Four photographs measuring 3cm x 4cm (one photo attached to the application form, one photo attached to the examination card, two photos submitted to the Examination Board).
4- Primary school graduation certificate or certificate of completion for candidates taking the Secondary School Equivalency graduation examination. Secondary school graduation certificate (General or Equivalency) or certificate of completion for candidates taking the High School Equivalency graduation examination.
5- Relevant documents concerning additional points for examination eligibility based on regulations stipulated in Article 10. Documents submitted after the examination date will not be considered for additional point eligibility.
Article 9:
1. Every candidate has the right to participate in the first or second examination session of each school year if they meet the examination eligibility criteria.
2. After each examination session, if a candidate meets all examination subject requirements but does not pass and is not subject to disciplinary action resulting in invalidation of examination results, the subjects achieving a score of 5 or higher will be retained (called retained scores) for the next immediate examination session only.
3. Candidates with retained scores may take the examination in two ways:
a) By taking all examination subjects required in one examination session.
b) Or only taking the subjects without retained scores from the previous immediate examination session, including subjects that were not required in the previous session but are required in this session as defined by the Ministry.
Chapter IV
CONDITIONS FOR GRADUATION AND GRADING OF GRADUATION
Article 10:
Candidates falling under any of the following categories shall be granted an additional point to their examination scores for graduation assessment:
Ethnic minorities,
War invalids,
Invalids receiving benefits equivalent to war invalids,
Heroes,
Children of martyrs,
Children of persons awarded the title of Hero,
Children of Mothers of Vietnam's Heroic Military,
Children of war invalids,
Children of invalids receiving benefits equivalent to war invalids,
Age 35 years or older on the day of the examination,
Holders of foreign language certificates at level A or higher,
Holders of computer skills certificates at level A or higher,
Holders of vocational qualification certificates.
Students who win awards (first, second, third place) in the final grade subject competition organized by the Department or Ministry.
Students who win awards (first, second, third place) in physical education, sports, and arts competitions organized by the Education and Training sector in collaboration with relevant sectors at provincial level or higher during the final grade year.
Each category mentioned above shall be granted an additional point. If a candidate falls under multiple categories, they shall only be granted a maximum of three additional points to their total examination score for graduation assessment.
Article 11:
To be recognized as having completed Secondary Vocational School or Upper Secondary Vocational School, candidates must meet one of the following two conditions:
a) Participate in all subjects prescribed in one examination session, achieving an average score of five or higher across all subjects, with no subject score below two.
b) The average score of retained points and retest scores of all subjects must reach five or higher. No retest score can be below two.
For candidates participating in all prescribed subjects, if there are retained points for certain subjects, the higher of the retained point and the retest score will be selected for graduation assessment.
Article 12:
1. Candidates recognized as having completed Secondary Vocational School shall be issued a SECONDARY SCHOOL GRADUATION CERTIFICATE (Vocational Program).
2. Candidates recognized as having completed Upper Secondary Vocational School shall be issued an UPPER SECONDARY SCHOOL GRADUATION CERTIFICATE (Vocational Program).
Article 13:
GRADING OF GRADUATION:
1. Graduates of Secondary Vocational School and Upper Secondary Vocational School shall be graded as excellent, good, and average based on the following criteria:
a- Excellent grade:
Final grade academic performance achieves an excellent grade.
Average score of the graduation examination must be eight or higher, with no score below seven.
For candidates whose conduct grades are evaluated, their final grade conduct grade must achieve an excellent grade.
b- Good grade:
Final grade academic performance achieves a good grade or higher.
Average score of the graduation examination must be seven or higher, with no score below six.
For candidates whose conduct grades are evaluated, their final grade conduct grade must achieve a good grade or higher.
c- Average grade: All remaining cases that meet the graduation requirements.
2. Candidates who use retained points for graduation assessment shall be graded as average.
Chapter V
MANAGEMENT AND DIRECTIVE OF THE EXAMINATION PERIOD
Article 14:
The Ministry of Education and Training shall be responsible for:
1. Issuing Examination Regulations and guiding documents for organizing the examination period.
2. Compiling examination questions and guiding the grading of Upper Secondary Vocational School graduation examinations.
3. Directing and inspecting the management and organization of the examination period by provincial People's Committees and the General Staff of the Vietnam People's Army.
4. Approving graduation lists submitted by Departments of Education and Training and the Educational Office.
Article 15:
Provincial People's Committees are responsible for:
1. Directing the Department of Education and Training to strictly implement Examination Regulations and guiding documents for organizing examinations issued by the Ministry of Education and Training.
2. Assigning tasks and directing districts, counties, towns, and related sectors to create favorable conditions for the examination period.
3. Issuing decisions to establish the Provincial Examination Steering Committee and Inspection Team, and the Printing Board for Upper Secondary Vocational School examination papers.
Article 16:
The Department of Education and Training is responsible to the provincial People's Committee and the Ministry of Education and Training for the entire work of directing and managing examinations in the locality, specifically:
1. Directing Continuing Education Centers, Cultural Supplement Schools, and District Education and Training Offices to perform tasks such as preparing examination files, facilities, equipment, and working conditions for examination boards.
2. Inspecting the examination file review process conducted by District Education and Training Offices, Continuing Education Centers, and Cultural Supplement Schools.
3. Submitting proposals to the provincial People's Committee to issue decisions establishing the Provincial Examination Steering Committee and Inspection Team, and the Printing Board for Upper Secondary Vocational School examination papers.
4. Issuing decisions to establish the Examination Question Compilation Board for Secondary Vocational School graduation examinations, examination boards, grading boards, and re-examination boards for Upper and Secondary Vocational School examinations.
5. Receiving Upper Secondary Vocational School examination papers from the Ministry, organizing printing and distribution to each examinee during the examination period.
6. Creating student lists according to alphabetical order A, B, C... in the Score Recording Table for examination boards.
7. Organizing the compilation, printing, and distribution of examination papers to each examinee during the Secondary Vocational School graduation examination period.
8. Directing, supervising, and inspecting examination boards.
9. Reviewing and recognizing examination results.
10. Issuing graduation certificates to graduates of Secondary Vocational School and Upper Secondary Vocational School, issuing replacement certificates for lost certificates, and issuing temporary graduation certificates. Graduation certificates and replacement certificates are issued only once.
11. Sending reports to the Ministry as required and archiving examination files.
The Educational Office is responsible to the General Staff and the Ministry of Education and Training for the entire work of directing and managing examinations in the military as a Department of Education and Training.
Article 17:
District, County, and Town Education and Training Offices are responsible for:
1- Receiving and inspecting examination files of candidates.
2- Preparing examination venues, facilities, equipment, and working conditions for examination boards.
3- Posting announcements and guidance regarding the examination period and examination results for candidates under their jurisdiction.
4- Storing part of the Secondary Vocational School graduation examination files delegated by the Department of Education and Training.
5- Returning examination files and announcing examination results to candidates.
Article 18:
Continuing Education Centers and Cultural Supplement Schools are responsible for:
1- Complete the training program, organize review sessions for trainees, and confirm the cultural knowledge level of self-study candidates when assigned responsibility by the Department of Education and Training.
2- Guide trainees to prepare examination application files. Receive and examine examination candidate files when assigned responsibility by the Department of Education and Training.
3- Compile a list of candidates alphabetically by letters A, B, C...
4- Organize study sessions on examination regulations and examination rules for staff, teachers, and trainees.
5- Closely coordinate with the Department of Education and Training to properly organize the examination period.
6- Store the Name and Score Recording Sheet.
Chapter VI
DIRECTING AND MONITORING BOARD FOR THE EXAMINATION
Article 19:
1. Annually, the Ministry of Education and Training shall issue a decision to establish a Directing and Monitoring Board for the National Examination of the Ministry consisting of:
The Chairperson: Deputy Minister of Education and Training;
Several Vice-Chairpersons: Heads and Deputy Heads of the Department of Continuing Education and other relevant agencies under the Ministry;
Several Members: Specialists from the Department of Continuing Education and other relevant agencies under the Ministry of Education and Training.
2. The tasks and authorities of the Directing and Monitoring Board for the National Examination of the Ministry are:
Direct, inspect, and supervise the organization of examinations in localities and in the military.
Suspend examinations or invalidate examination results at locations that violate examination regulations and guidelines issued by the Ministry for organizing examinations.
Suspend the participation of examination committee members, security personnel, service staff, and lower-level Directing and Monitoring Board members in examination work if they violate examination regulations and guidelines or lack the capability to perform their duties.
Request the Department of Education and Training to establish a Review Committee when the marking by the Examination Marking Committee is inaccurate.
Recommend the Minister to commend units and individuals with outstanding achievements or to impose disciplinary actions on units and individuals who violate examination regulations.
The direction, inspection, and supervision of examinations in localities or in the Military may be carried out by a member or a team of members of the Directing and Monitoring Board.
Article 20:
1. Annually, the Department of Education and Training shall submit a proposal to the People's Committee of the province or city to issue a decision to establish a Directing and Monitoring Board for the Provincial or Municipal Examination consisting of:
The Chairperson: Director or Deputy Director of the Department;
Several Vice-Chairpersons: Heads or Deputy Heads of specialized departments.
Several Members: Specialists from specialized departments and some management staff of Continuing Education Centers, Supplementary Cultural Schools, representatives of related departments.
2. The tasks and authorities of the Directing and Monitoring Board for the Provincial or Municipal Examination are:
Direct and inspect the preparation for examinations by Departments of Education and Training, Continuing Education Centers, Supplementary Cultural Schools, and Examination Committees regarding the implementation of examination regulations and guidelines for organizing examinations.
Recommend the Department Director to suspend the participation of examination committee members, security personnel, and service staff in examination work if they violate examination regulations or lack the capability to perform their duties.
Recommend the Department Director not to recognize the examination results of certain candidates, examination rooms, or examination committees if there are serious violations of examination regulations.
Recommend the Department Director to commend or impose disciplinary actions on those involved in examination work.
The execution of tasks and authorities of the Provincial or Municipal Directing and Monitoring Board may be carried out by a member or a team of members within the Provincial or Municipal Directing and Monitoring Board.
Article 21:
Examination inspection is the exercise of state inspection rights over the implementation of policies and examination regulations of the Education and Training sector by organizations and individuals related to the examination to ensure the safety, seriousness, accuracy, and fairness of the examination. The organization of examination inspections is regulated by the Minister of Education and Training and operates independently from the organizations established under this regulation.
The Directing and Monitoring Board and Examination Committees shall cooperate and create conditions for examination inspectors to carry out their tasks.
Chapter VII
EXAMINATION SELECTION AND QUESTION COMMISSION
Article 22:
All matters concerning the selection and creation of examination questions for each examination period are entrusted to the Examination Selection and Question Commission.
The tasks of the Commission are:
1. Draft official examination questions and backup questions along with marking guidelines.
2. Organize typing, printing, or loading computer disks, coding, and distributing examination questions and marking guidelines to localities.
Article 23:
1. The Minister of Education and Training decides to establish the Examination Selection and Question Commission for the National Examination of Secondary School Completion based on the following principles:
a) The Chairman of the Commission is a Deputy Minister of Education and Training.
b) The Vice-Chairman of the Commission is the Head or Deputy Head of the Department of Continuing Education.
c) The Secretary of the Commission is specialists familiar with examination work from the Department of Continuing Education.
d) The Members of the Commission are officers directing or researching Continuing Education or teachers selected by the Ministry of Education and Training.
2. The Director of the Department of Education and Training decides to establish the Examination Question Commission for the National Examination of Primary School Completion based on the following principles:
a) The Chairman of the Commission is the Director or Deputy Director of the Department of Education and Training.
b) The Vice-Chairman of the Commission is the Head or Deputy Head of the Department of Continuing Education or a specialized department of the Department of Education and Training.
c) The Secretary of the Commission is a specialist familiar with primary school supplementary education examination work from the Department of Education and Training.
d) The Members of the Commission are departmental directors or teachers selected by the Director of the Department of Education and Training.
Article 24:
1. The composition of the Examination Selection and Question Commission includes: Chairman, Vice-Chairmen, Secretary, Members, and technical staff for computer operations, typing, and printing.
2. The tasks and authorities of the members of the Commission:
a) The Chairman of the Commission:
Conduct all activities of the Council.
Decide on the selection and approval of examination questions, guide marking.
Organize the distribution of examination questions and guidance for marking to localities.
Reward and enforce disciplinary measures or propose superiors to reward and enforce disciplinary measures against members of the Council.
b) Vice Chairman of the Council:
Assist the Chairman in administrative work, be responsible to the Chairman for the tasks assigned or delegated by the Chairman.
c) Secretary of the Council: Assist the Chairman and Vice Chairmen:
Draft common documents;
Prepare material conditions and working tools for the Council.
d) Members:
Select and set examination questions, guide marking for the subjects assigned, ensuring accuracy within the scope of the curriculum.
đ) Computer technical staff, typists and printers of examination questions:
Type accurately according to the manuscript, print clearly or load computer disks precisely, safely, and in sufficient quantity.
Article 25:
Principles and procedures for the Council's operations:
1. Concentrate and isolate from the time the Council convenes until the end of the last subject exam period.
2. The Chairman of the Council is the sole person deciding on Council matters. The Chairman directly or through Vice Chairmen manages the work of Council members.
3. Examination questions, marking guidelines, and issues related to examination questions of the subjects, including the content of Council meetings must be kept confidential from the start of Council work until the end of the last subject exam period.
4. All members of the Council must work strictly in accordance with the procedural regulations for Council operations stipulated by the Ministry of Education and Training.
Chapter VIII
EXAMINATION QUESTION PRINTING COUNCIL
Article 26:
All organizational work for printing examination questions and marking guidelines for the Graduation Supplementary Secondary School Examination is entrusted to the Examination Question Printing Council of the Department of Education and Training.
The tasks of the Examination Question Printing Council are:
1. Receive and store floppy disks containing examination questions and marking guidelines.
2. Proceed to decode, print examination questions for each candidate, envelope, seal, and transfer to each Examination Supervision Council for the Graduation Supplementary Secondary School Examination.
Article 27:
1. Composition of the Examination Question Printing Council includes: Chairman, Vice Chairman, and Members.
2. Appointment criteria for members of the Council:
The Chairman of the Council is the Director or Deputy Director of the Department of Education and Training.
The Vice Chairman of the Council is the Head (or Deputy) of the Continuous Education Department or the specialized department tasked with supervising the Supplementary Secondary School Education.
Members can be subject specialists of the aforementioned departments or computer operators. The number of Members is determined by the Director of the Department of Education and Training based on the workload of the Council.
Article 28:
Tasks and authorities of each member of the Examination Question Printing Council are:
1. Chairman of the Council:
Direct all activities of the Council.
Decide on the number of examination questions to be printed for each subject.
Be responsible to superiors for the confidentiality of examination questions.
Propose the Examination Selection and Setting Council of the Ministry to resolve issues regarding decoding and using computers to print examination questions.
Propose superiors to reward and enforce disciplinary measures against members of the Council.
2. Vice Chairman of the Council: assist the Chairman in administrative work and be responsible to the Chairman for the tasks assigned or delegated by the Chairman.
3. Members:
Implement the Examination Selection and Setting Council of the Ministry's instructions on decoding examination questions and marking guidelines.
Proceed to print examination questions clearly, in the correct quantity as assigned by the Chairman.
Proceed to envelope, seal examination questions according to confidentiality regulations.
Transfer examination questions to each Examination Supervision Council.
Be responsible to the Chairman of the Council for the confidentiality of examination questions.
Article 29:
Principles and procedures for the Council's operations:
1. The Chairman of the Council directs all Council activities. The Chairman directly or through the Vice Chairman manages the work of Council members.
2. Members of the Examination Question Printing Council and security personnel must not have parents, spouses, children, or full siblings participating in that examination period.
3. Work concentratedly and isolated from the time the sealed floppy disk containing examination questions is opened until the end of the last subject exam.
4. The time to start printing examination questions is decided by the Director of the Department of Education and Training based on the number of candidates, examination locations, organization and transportation conditions for printing and transferring examination questions...
5. The number of examination papers for each subject of each Examination Supervision Council equals the number of candidates plus one paper for the Chairman of the Council.
6. Decoding, printing, and enveloping subject tasks can only be carried out in the machine room. In one machine room, only one subject can be printed and enveloped sequentially.
Chapter IX
EXAMINATION SUPERVISION COUNCIL
Article 30:
All organizational work for candidates taking the examination at a test site during the examination period is undertaken by an Examination Supervision Council.
The tasks of the Examination Supervision Council are:
1. Receive and check the examination registration files of candidates handed over by the Department of Education and Training, manage these files during the examination period.
2. Inspect and receive examination venues, material conditions, and working tools.
3. Receive, store, and use examination questions according to guidelines.
4. Organize management and supervision of candidates taking examinations according to the examination schedule, examination rules, and examination regulations.
5. Collect examination papers submitted by candidates, process sealing of examination papers and files, store, and hand over fully to the Examination Marking Council.
Article 31:
Authorities of the Examination Supervision Council are:
1. Not accept examination venues if they do not meet the necessary conditions for the examination to proceed according to the examination regulations and guiding documents of the Ministry.
2. Not allow candidates to take the examination if their registration files do not comply with the examination regulations and guiding documents.
3. Suspend part or all of the examination within the Council's jurisdiction if serious violations of the examination regulations are found, and there are no conditions to ensure that the examination results reflect the true academic level of most candidates. This right may only be exercised after reporting to the Director of the Department of Education and Training and the local government without resolution.
4. Enforce disciplinary measures against candidates who violate examination rules.
5. Propose superiors to enforce disciplinary measures against Council members who violate examination regulations and organizing documents for the examination.
6. Suggest that competent educational authorities commend units or individuals who perform well in serving the examination period.
Article 32:
1. The Examination Board consists of: Chairperson, Deputy Chairpersons, Secretary, and Examiners.
2. Appointment criteria for members of the Council:
The Chairperson of the Board is the Principal, Vice Principal of a secondary school, or Director, Deputy Director of a Continuing Education Center; or an officer in charge of the Department or District Education-Training Office with management capability, professional qualifications, and thorough knowledge of examination procedures and regulations.
Deputy Chairpersons of the Board are officers and teachers with management capability, professional qualifications, and thorough knowledge of examination procedures.
The Secretary of the Board is an officer or teacher who has previously served as an examiner for supplementary courses, possesses thorough knowledge of examination procedures, can construct necessary tables and records truthfully, and keep accurate minutes.
Examiners are teachers with a sense of responsibility, thorough knowledge of examination procedures, and sufficient professional qualifications to meet the requirements of the Board.
Article 33:
Principles for establishing the Examination Board:
1. The number of Examination Boards is determined by the Director of the Department of Education-Training based on:
Ensuring strict supervision by the Department of Education-Training;
Having adequate conditions and means for the Board to work and ensure safety during the examination period;
Having sufficient management staff meeting the standards stipulated in Article 32;
Convenience for candidates' travel and living arrangements.
2. The number of examination rooms in each Board depends on the number of candidates and must ensure that each room does not exceed 25 candidates.
3. Appointments to the Board must ensure:
Not assigning individuals whose learners are participating in the examination at that Board.
Each examination room must have at least two examiners, excluding those outside the room. The number of external examiners is determined by the Department of Education-Training and the Bureau of Schools according to the specific requirements of each Board but must ensure a minimum of one external examiner for every three rooms.
In the Examination Board, for each subject, there must be at least one teacher teaching that subject at the corresponding level of education.
Article 34:
Duties and powers of each member of the Board:
1. The Chairperson of the Board is responsible to the Director of the Department of Education-Training:
Directing all activities of the Board;
Guiding members of the Board to understand and implement examination regulations and organizational guidelines for the examination period issued by various levels of educational management.
Organizing training for candidates on examination rules;
Reviewing and deciding on disciplinary measures against those violating examination regulations, examination rules, and organizational guidelines for the examination period issued by the Ministry and the Department of Education-Training.
Deciding whether to accept or reject examination venues, and continuing or suspending the examination period when incidents listed in Article 31 occur, after consulting opinions from Board members.
Deciding not to allow candidates to take the examination if they do not have the required documentation.
Submitting all sealed examination papers and candidate files to the Marking Board.
2. Deputy Chairpersons assist the Chairperson in administrative tasks and are responsible to the Chairperson for the assigned tasks.
3. The Secretary assists the Chairperson in drafting documents, preparing necessary tables, recording minutes of meetings, and events during the Board's operations.
4. Examiners are responsible for:
Organizing, guiding, inspecting, and supervising candidates to comply with rules within their designated area;
Handing out printed examination questions to candidates.
Collecting submitted papers, checking the number of papers and pages, and submitting them fully to the Chairperson or a person authorized by the Board Chairperson.
Preparing minutes and recommending disciplinary actions against candidates who violate examination regulations.
Performing other necessary tasks assigned by the Chairperson to support examination duties.
Article 35:
Security and service personnel for the examination period are directly managed by the Chairperson and are responsible for their assigned tasks to ensure the examination proceeds seriously and safely. These personnel may not participate in tasks reserved for Board members and may not enter examination rooms while candidates are taking the test.
Article 36:
Principles and procedures for the Council's operations:
1. The Chairperson, Deputy Chairpersons, and Secretary must be present at the examination venue before the examination day, at a time determined by the Director of the Department of Education-Training and the Bureau Chief of the Bureau of Schools, to perform the following tasks:
Inspecting local preparation for the examination, accepting examination venues, facilities, and equipment for organizing the examination.
Accepting and inspecting examination files, confirming the final eligibility of candidates, and posting lists of candidates.
Resolving necessary examination matters, unifying signals, methods of conducting the examination, and assigning specific tasks to each Board member.
2. Examiners in the Board must be present at the examination venue at least one day before the examination to convene the Board, study relevant documents and regulations related to the examination, and perform some of the Board's tasks.
3. Before each session, the entire Board must convene to disseminate tasks for that session, assign responsibilities to each Board member for that session.
4. After each session, immediately seal the examination papers of that session in front of the entire Board and draw lessons from the session.
5. After completing the last subject, convene the Board to:
Evaluate the organization of the examination period;
Recommend commendations and disciplinary actions;
Witness and confirm the sealing of examination papers and candidate files, sign the Board's summary minutes.
Chapter X
MARKING BOARD
Article 37:
All work evaluating individual candidate results falls under the authority of the Marking Board.
The tasks of the Marking Board are:
1. Accepting all examination papers and examination supervision files handed over by Examination Boards and preserving them during the marking period.
2. Inspecting and accepting examination venues, facilities, and working equipment of the Board.
3. Marking all candidate examination papers according to the marking guide prepared by the Question Setting and Marking Committee.
4. Recording marks on the name and mark sheet and compiling a list of successful candidates.
5. Providing an overall evaluation of the examination questions and the quality of candidate responses. Offering suggestions on examination questions, marking guides, and examination organization work.
6. Submit all examination papers and test papers fully to the Department of Education and Training or the School Administration Bureau under the General Staff Department.
7. Comply with the requirements of the Examination Board and Examination Supervision Team to ensure compliance with the regulations stipulated in the Examination Regulations and other guiding documents for organizing the examination period.
Article 38:
Powers of the Examination Board:
1. Refuse to accept a workplace if it is deemed not to meet the conditions and means necessary for accurately and fairly assessing the examination results and ensuring the safety of the Examination Board.
2. Not grade the examination papers of candidates who have violated the examination regulations and have been recorded in the report by the Examination Board requesting that their papers not be graded.
3. Prepare a report requesting the Director of the Department of Education and Training to invalidate the results of identical examination papers indicating that candidates have copied from each other during the examination.
4. Not recognize graduation for candidates:
Whose examination papers are not graded as mentioned above;
Whose examination files are not valid;
Who do not meet the examination eligibility criteria.
Article 39:
1. The composition of the Examination Board includes: Chairperson, Deputy Chairpersons, Secretary, and Examiners.
2. Appointment criteria for members of the Council:
a) The Chairperson of the Board is the Director of the Continuing Education Center, the Principal of the Supplementary Cultural Education School, or the Basic Level Secondary School (for the supplementary secondary school graduation examination), or the High School Level (for the supplementary high school graduation examination).
b) The Deputy Chairperson of the Board is a management staff member at least at the level of Deputy Principal of a secondary school or Deputy Director of a Continuing Education Center, possessing professional qualifications and being well-versed in examination procedures.
c) The Secretary of the Board is staff members or teachers proficient in examination procedures, capable of recording minutes and compiling tables and charts for the Board.
d) The Head and Deputy Head of the grading team must be teachers who have taught the final grade class for at least two years and have previously graded supplementary secondary school graduation examinations.
đ) Examiners are teachers who have previously taught the final grade class.
Article 40:
Duties and powers of each member of the Examination Board:
a) The Chairperson of the Board has the following duties and powers:
Directing all activities of the Board;
Preside over meetings of the Board;
Be responsible for numbering, cutting, returning examination papers, and managing the marking process, identifying candidates eligible for graduation and those not eligible for graduation.
Review and conclude disciplinary actions against individuals who violate the Examination Regulations and other guiding documents for organizing the examination period;
Propose commendations for members with outstanding achievements and candidates graduating with excellent grades.
Request examiners to re-mark candidates' papers when they notice that the examiner has marked incorrectly despite guidance on marking. Suspend the marking work of an examiner if they deliberately mark incorrectly despite requests to re-mark.
b) The Deputy Chairperson of the Board assists the Chairperson in managing some tasks of the Board and is responsible to the Chairperson for the assigned tasks.
c) The Secretary of the Board is responsible to the Chairperson for drafting documents, compiling tables and charts as prescribed, and recording minutes of Board meetings.
d) The Head and Deputy Head of the grading team are responsible for:
Studying in advance and organizing for examiners in the team to study the Examination Grading Guidelines selected by the Board and the examination questions;
Assist the Chairperson in distributing and collecting examination papers among examiners in the grading team.
Supervise the marking process within the marking team and directly mark some candidates' papers.
Assist the Chairman of the Examination Board in inspecting and supervising the marking work of the examiners.
d) The examiner is responsible for evaluating and scoring the assigned papers in accordance with the marking guidelines. In case two examiners cannot agree on the score, they shall seek the opinion of the Team Leader. If they do not agree with the Team Leader's opinion, they shall refer the matter to the joint marking team.
Article 41:
Principles and procedures for the Council's operations:
1. The Chairman and Deputy Chairmen must be present at the marking venue beforehand to perform certain tasks reserved for the Board Leadership. The specific time is determined by the Director of the Department of Education and Training based on the number of papers that the Board needs to mark.
The Team Leader and Deputy Team Leaders must be present one day before the examiners to study the marking guidelines and prepare for the marking work of their teams.
2. The Team Leader directs the team to study and strictly follow the marking guidelines. If there are unresolved questions or errors found in the text within the team, they must request the Chairman to seek guidance from the Steering Committee and Examination Monitoring Team, and absolutely must not make changes to the marking instructions and grading criteria on their own.
3. Before assigning papers to the examiners, the team must jointly mark ten papers to ensure all members thoroughly understand the marking guidelines. When scoring these jointly marked papers, clearly note "jointly marked paper" along with the signatures of the Team Leader and one examiner.
4. Except for the jointly marked papers, each paper must be independently marked by two examiners who record separate scores according to the test code. After both examiners have completed marking each paper, the Team Leader will return the papers to those two examiners to reconcile and record the final score, both in writing and numerically, and sign together. The score of the paper should be recorded in red ink. If the two examiners wish to change the score, they must cross out the original score, write the new score both numerically and in writing, and sign to confirm the score change.
5. The total score of a paper is the sum of the scores of each section. The lowest possible score for each section is 0.25. The overall score of a paper is an integer or decimal number ranging from 0 to 10, with the decimal part being either 0 or 5.
6. Apart from the Review Board, no one has the authority to change the score of a paper that has been agreed upon by two examiners.
7. Papers can only be returned to the candidates after all papers have been fully marked. It is strictly prohibited for the marking board to re-mark and change the scores of papers that have already been returned.
8. Recording the scores of papers on the name and score sheet of each examination room is carried out by a group of examiners, including one reader, one recorder, and one checker. If there are mistakes, the scorer must cross out the incorrect score, write the correct score next to it, and note the reason for the correction in the remarks section. At the end of each score sheet, clearly state the names of the reader, recorder, and checker, the total number of score modifications, and have all three sign.
In cases where the name and score sheets are created using computers, there must still be one reader, one disk inserter, and one checker. At the end of each score sheet, clearly state the names of the reader, inserter, and checker, and have all three sign.
Chapter XI
APPEAL BOARD
Article 42:
1. Candidates have the right to request a review of their papers when the score of the paper is more than two points lower than the average score of the subject in their final class.
2. Applications for review must be submitted to the Department of Education and Training within ten days from the date of publicizing the examination results.
3. The Director of the Department of Education and Training decides on the review of the papers based on the guidelines from the Ministry and the specific content stated in the candidate's application. Cases where a review is not granted must be clearly notified to the applicant.
Article 43:
The entire review process of the papers by the marking board falls under the jurisdiction of the Review Board.
Article 44:
The Director of the Department of Education and Training issues a Decision to establish the Review Board when any of the following situations occur:
1. There is an application for review as stipulated in Article 42.
2. The Director of the Department of Education and Training finds that the marking does not comply with the marking guidelines established by the Examination Selection and Question Paper Compilation Board.
3. The Ministry's Examination Steering and Monitoring Team requests it.
Article 45:
The composition of the Review Board includes:
1. The Chairman of the Review Board is the Director or Deputy Director of the Department of Education and Training.
2. The Deputy Chairman of the Review Board is the Head of the Continuing Education Department or the Head of a specialized department of the Department of Education and Training.
3. The Secretary of the Review Board is a specialist responsible for supplementary education examination work at the Department of Education and Training.
4. The examiners are teachers who are well-versed in the subject matter and consistently demonstrate fairness and accuracy during the marking process.
Individuals accused of violating the Examination Regulations may not participate in the Review Board.
Article 46:
The duties, powers, principles, and working procedures of the Review Board are the same as those prescribed for the Examination Marking Board.
The Chairman of the Board is responsible for re-numbering the examination papers to maintain the confidentiality of the candidates' names.
The Review Board will adjust the scores of the examination only if the re-marked score differs from the previous marked score by one point or more.
Article 47:
The review process must begin before the fifteenth day from the date of announcing the examination results and must be completed within ten days. The review results must be publicly announced after approval by the Ministry of Education and Training.
Chapter XII
REVIEW AND RECOGNITION OF EXAMINATION RESULTS,
Article 48:
The Director of the Department of Education and Training and the Director of the School Administration Bureau are responsible for reviewing and recognizing the examination results of the Supplementary Secondary School Graduation Marking Board.
The Director of the Department of Education and Training and the Director of the School Administration Bureau are responsible for preliminarily reviewing the examination results of the Supplementary High School Graduation Marking Board. The examination results are officially announced after approval by the Ministry of Education and Training.
Examination results must be publicly posted at the district, county, or city education and training office or at the Continuing Education Center or Cultural Supplemental School.
Article 49:
Responsibilities and authorities of the Director of the Department of Education and Training in preliminary review and recognition of examination results:
1. Responsibilities:
Verify the list of graduates proposed by the Examination Board.
Sign to recognize the list of graduates and issue graduation certificates to candidates after approval by the Ministry.
2. Authorities:
Cancel the results of the Supplementary Secondary School Graduation Examination.
Cancel the results of individual candidates or examination rooms in the Supplementary High School Graduation Examination.
Propose to the Ministry of Education and Training to cancel the results of a Supplementary High School Graduation Examination Board.
Article 50:
The report on the examination results sent to the Ministry by the Department of Education and Training includes:
1. For the Supplementary High School Graduation Examination, it includes:
A summary report on the examination supervision work of the Department of Education and Training and the School Administration Bureau, accompanied by various statistical data;
Name and score sheets of candidates, along with the list of graduates.
Decisions on the establishment of examination boards for printing test papers, supervising examinations, grading tests, the Steering Committee, and Examination Inspection Team;
Minutes of the Examination Supervision Board;
Summary minutes of the Examination Grading Board and minutes of subject grading teams;
Other related minutes concerning the Secondary School Completion Supplementary Education final examination period;
The Appeal File (if any) includes: decision on the establishment of the appeal board, summary minutes, list of graduates after the appeal process, and other related minutes;
2. For the Supplementary Secondary School Graduation Examination:
Report on the organization of the examination period and examination results;
Decision on the establishment of the Examination Question Setting Board;
A set of examination questions and marking guidelines;
3. Deadline for submission:
All the above files must be at the Ministry (Department of Continuing Education) no later than twenty-five days from the last examination day;
All appeal files (if any) must be at the Ministry (Department of Continuing Education) no later than fifty days from the last examination day;
Article 51:
Archiving examination files:
1. Departments of Education and Training, Military Schools archive:
a) Indefinitely;
Name and score recording sheets,
Graduates' list,
Graduation certificate issuance books.
b) For three years:
Decisions on the establishment of Secondary School Completion Supplementary Education Examination Boards;
Candidates' complaint files;
Disciplinary files.
c) For one year:
Decision on the establishment of the Examination Question Setting Board for Secondary School Completion Supplementary Education;
Examination questions and marking guidelines (including envelopes containing examination questions);
Various minutes;
Candidates' examination papers;
Other types of files.
2. Storage time limit: Calculated from the last examination date of each examination period.
3. Candidates' application files for the examination are returned to District Education and Training Departments, Continuing Education Centers, or supplementary schools to return to candidates after completing all examination tasks.
Chapter XIII
REWARD AND DISCIPLINE
Article 52:
During the execution of duties, those involved in examination work who overcome difficulties, complete their assigned tasks well, and contribute to detecting and preventing violations of examination regulations and organizing examination documents will be rewarded.
Forms of reward include:
1. Being awarded a Certificate of Merit by Departments of Education and Training, Military Schools.
2. Being awarded a Commendation Certificate by Provincial People's Committees, City People's Committees, or the General Staff of the Vietnam People's Army.
3. Being awarded a Commendation Certificate by the Ministry of Education and Training.
Article 53:
When executing duties, those involved in examination work who violate examination regulations, causing adverse effects on the organization of the examination period and examination results, will be disciplined.
Forms of discipline include:
1. Reprimand.
2. Warning.
3. Demotion in rank, demotion in technical grade, reduction in salary, transfer to other work.
4. Forced termination of employment or prosecution before the law.
Article 54:
The application of disciplinary measures under Article 53 depends on the nature, degree of fault, and consequences caused by such faults.
1. The form of reprimand is applied in cases where the fault is due to lack of responsibility but has not caused significant harm:
Not being present at the Examination Board at the specified time.
Engaging in personal matters during supervision.
In cases where copying examination questions is required, the invigilator copies incorrectly, omits questions, or fails to detect errors or omissions in the copying process, causing difficulties for candidates in answering questions, but not to the extent that a reserve question needs to be taken.
2. The form of warning is applied in cases where the fault causes relatively serious harm to examination results:
Losing examination files, causing a candidate to lose the right to take the examination or lose their examination paper, making it impossible for the Examination Board to determine the candidate's result.
Marking examination papers inaccurately compared to the marking guidelines of the Examination Question Setting Board.
In areas still using handwritten examination questions for the Secondary School Completion Supplementary Education final examination, if the invigilator copies incorrectly, omits questions, or the person responsible for checking the copying does not detect errors or omissions, forcing candidates to take reserve questions.
Removing examination questions from the examination room.
Allowing candidates to bring prohibited materials into the examination room, looking at others' papers, or copying each other's answers during the examination.
Incorrectly adding up scores, leading to distortion of candidates' examination results.
Refusing to comply with the Examination Board's assignments.
3. The form of demotion in rank or reduction in salary is applied in cases where violating examination regulations and organizing examination documents causes significant harm to the examination period.
Providing answers to candidates during the examination.
Setting examination questions incorrectly or outside the prescribed curriculum, requiring a retake.
Leaking examination questions, causing severe harm to the examination period.
4. The form of forced termination of employment or prosecution before the law is applied in cases where intentionally violating examination regulations and organizing examination documents causes severe harm to examination results:
Intentionally altering examination scores to allow candidates to graduate.
Accepting bribes to allow candidates to graduate.
Intentionally leaking examination questions, causing severe harm to the examination period.
Assaulting examination staff, causing disorder and security issues in the examination area.
In all these cases, the direct management level of the person violating discipline must immediately suspend their work at the Examination Board and recommend higher authorities to impose disciplinary action.
Article 55:
Forms of discipline applicable to candidates include:
1. Invigilators reprimanding candidates in the examination room.
2. Chairperson of the Examination Supervision Board:
Warning the entire group of candidates in the Examination Board.
Prohibiting candidates from continuing to sit for remaining subjects.
Requesting the Examination Grading Board not to grade the examination paper.
3. Chairperson of the Examination Grading Board decides not to grade the examination paper.
4. Director of the Department of Education and Training decides:
Canceling the examination results of one paper or the entire examination period.
Disqualifying from sitting for one to three subsequent examination periods.
Recommending prosecution before the law.
When applying disciplinary measures from warning upwards, the Director of the Department of Education and Training must inform the managing agency or unit or family of the disciplined person.
Article 56:
The application of the above disciplinary measures against candidates is based on the degree of fault and the harm caused by such faults. Specifically:
1. Reprimanding candidates in the examination room; Chairperson of the Examination Supervision Board warning the entire group of candidates in the Examination Board in the following cases:
Having been reminded twice but still helping another candidate with their paper.
Having been reminded twice but still asking another candidate for help with their paper.
2. Canceling examination results in the following cases:
Possessing prohibited materials in the examination room during the examination period, even if not used.
Bringing or receiving pre-written solutions or scratch paper from others, even if not used.
Having identical papers indicating copying from each other during the examination.
Intentionally failing to submit the examination paper, submitting another person's answer sheet or scrap paper as one's own examination paper.
The answer sheet shows a lack of seriousness (containing disrespectful remarks towards examination staff).
3. Canceling the examination results or disqualifying from taking the examination or prosecuting before the law:
Disrupting security and order, causing chaos in the examination area, seriously affecting the conduct and results of the examination.
Inciting others to quarrel, threaten, or insult examination staff, causing disorder and disrupting order in the examination area.
Insulting or assaulting examination staff and examination guards.
Engaging in destructive actions that prevent the examination from proceeding.
Falsifying examination registration documents.
Having someone take the examination on one's behalf or taking the examination for someone else.
Article 57:
Those responsible for reviewing examination results who intentionally alter graduation results, depending on the severity, nature, and consequences, the Minister of Education and Training, the Chairman of the People's Committee of the province or city, or the Chief of General Staff of the Vietnam People's Army will decide disciplinary measures ranging from reprimand to dismissal or recommend prosecution before the law./.
