MINISTER OF EDUCATION AND TRAINING
Pursuant to Government Decree No. 43/2000/NĐ-CP dated August 30, 2000 detailing and guiding the implementation of certain provisions of the Education Law;
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;
At the proposal of the Director of the Department of Continuing Education;
DECISION:
Article 1: Now hereby promulgates with this Decision the "Examination Regulations for Graduation from Secondary School Equivalency and High School Equivalency Programs."
Article 2: These Regulations shall take effect fifteen days after the date of signing.
These Regulations replace the "Examination Regulations for Graduation from Secondary School Equivalency and High School Equivalency Programs" issued together with Decision No. 57/QD dated February 3, 1990, by the Minister of Education, and Decision No. 962/GD-ĐT dated March 20, 1997, by the Minister of Education and Training on amending and supplementing certain provisions of the Examination Regulations for Graduation from Secondary School Equivalency and High School Equivalency Programs issued together with Decision No. 57/QD dated February 3, 1990.
Article 3: The Chairpersons of the People's Committees of provinces and centrally governed cities, the Heads of the Office of the Ministry of Education and Training, the Directors of the Departments of Organization and Cadres, Planning and Finance, Continuing Education, the Inspector General of the Ministry, the Directors of Provincial Departments of Education and Training, and the Chiefs of the Educational Institutions Bureau under the General Staff Headquarters are responsible for implementing this Decision.
REGULATION
GRADUATION EXAMINATION FOR SECONDARY SCHOOL EQUIVALENCY AND HIGH SCHOOL EQUIVALENCY PROGRAMS
(Issued together with Decision No. 17/1998/QĐ-BGD&ĐT dated April 10, 1998, of the Minister of Education and Training)
PART I
PURPOSES AND BASIC REQUIREMENTS OF THE EXAMINATION
Article 1
The Graduation Examination for Secondary School Equivalency and High School Equivalency Programs is a state assessment of the learning outcomes and discipline of students according to the training objectives after completing the curriculum of a given educational level.
Article 2
All examination organization activities must ensure safety, seriousness, accuracy, and fairness so that the examination results reflect the true academic level of candidates and the quality of teaching and learning at schools.
PART II
DATE OF EXAMINATION, CONTENT, SUBJECTS, AND TEST QUESTIONS
Article 3
1. The Graduation Examination for High School Equivalency Programs is organized uniformly nationwide, in each province and centrally governed city, twice a year. The examination date is specified in the annual schedule, as determined by the Ministry of Education and Training.
2. The Graduation Examination for Secondary School Equivalency Programs is organized uniformly in each province and centrally governed city, twice a year. The examination date is set by the Provincial Department of Education and Training and announced to learners at the beginning of the school year.
Article 4
The examination content covers the current Secondary School Equivalency Program Curriculum and the High School Equivalency Program Curriculum, according to each educational level.
Article 5
The subjects for the Graduation Examination for Secondary School Equivalency and High School Equivalency Programs are determined by the Ministry of Education and Training and announced at least sixty days before the examination date.
Article 6
Test questions and marking guidelines for the Graduation Examination for High School Equivalency Programs are prepared by the Examination Question Selection Committee of the Ministry of Education and Training and are used uniformly throughout the country.
Test questions and marking guidelines for the Graduation Examination for Secondary School Equivalency Programs are prepared by the Examination Question Preparation Committee of each Provincial Department of Education and Training and are used uniformly within their respective jurisdictions.
CHAPTER III
ELIGIBILITY AND REGULATIONS FOR PARTICIPATING IN THE EXAMINATION
, Clause 1, Clause 2 Article 7a of this Regulation.
Vietnamese citizens and foreigners residing in Vietnam who meet the following conditions will be eligible to take the examinations:
1. Completion of the current Secondary School Equivalency Program Curriculum or High School Equivalency Program Curriculum of the Ministry of Education and Training for the relevant educational level for which the candidate wishes to participate in the examination.
a. If studying at Continuing Education Centers or Equivalency Schools, in the final year of the program, the candidate must not be rated as poor in academic performance. If the candidate is subject to conduct evaluation, they must also meet the condition of being rated at least average in conduct.
Not missing more than 45 class sessions in the final year of study.
b. If self-studying:
Must register for self-study with the Provincial Department of Education and Training before the start of the school year and obtain approval from the Department.
Each subject must be assessed and graded at least twice during each examination period.
The average grade for each subject throughout the year must be at least 5.
2. Having completed Secondary School (General or Equivalency).
3. Not having been disciplined with a "Prohibition from Taking Examinations."
4. Registering for the examination, paying the full examination fee, and submitting complete and valid application documents as stipulated in Article 8.
Article 8
The candidate’s application materials include:
1. Application form for participation in the examination (as prescribed).
2. Academic record or self-study assessment sheet (original).
3. Four photographs measuring 3cm x 4cm (one photo attached to the application form, one photo attached to the examination card, two photos submitted to the Examination Committee).
4. Secondary School Diploma (General or Equivalency) or Certificate of Graduation for candidates participating in the High School Equivalency Graduation Examination.
5. Relevant documents related to bonus points for graduation examination eligibility according to the provisions of Article 11, if applicable.
Article 9
1. Every candidate has the right to participate in the first or second examination session of each school year if they meet the examination eligibility criteria.
2. After each examination attempt, if a candidate does not pass all required subjects in one examination period and is not penalized with cancellation of examination results, the subjects passed with a score of five or higher will be retained (called retained scores) for the next immediate examination period only.
3. Candidates with retained scores may take the examination in two ways:
a. Or taking all required subjects in one examination period.
b. Or only taking subjects without retained scores from the previous immediate examination period, including subjects that were not required in the previous examination but are required in this examination period as determined by the Ministry.
PART IV
GRADUATION REQUIREMENTS AND GRADUATION RANKING
Article 10
To be recognized as having completed Secondary School Completion or Secondary School Equivalency, candidates must meet one of the following conditions:
a. Participate in all subjects specified in one examination session, with an average score of five points or higher for all subjects, and no subject score below two.
b. The average score of retained points and retest subjects must be five points or higher. No retest subject score may be below two.
Article 11
Candidates falling under any of the following categories shall be granted an additional point to their examination scores for graduation assessment:
Ethnic minority.
Personally a war invalid.
Personally honored with the title of Hero.
Child of烈士子女。
Child of individuals honored with the title of Hero or child of Mothers of Vietnam's Heroism.
Child of a war invalid.
Age forty years or older on the day of the exam.
Hold a certificate in foreign language or computer skills at level A or above as stipulated by the Ministry of Education and Training.
Holders of vocational qualification certificates.
Students who win awards (first, second, third place) in the final grade subject competition organized by the Department or Ministry.
Students who win awards (first, second, third place) in physical education, sports, or arts exams organized by the Department of Education and Training in collaboration with relevant departments at provincial level or higher during their twelfth-grade year.
Each category mentioned above will be awarded an additional point. If a candidate belongs to two or more categories, they will only receive an additional two points added to their total exam scores for graduation assessment.
Article 12
1. Candidates recognized as having completed Secondary School Equivalency will be issued a Secondary School Certificate (Equivalency System).
2. Candidates recognized as having completed Secondary School Completion will be issued a High School Diploma (Equivalency System).
Article 13
GRADING OF GRADUATION:
1. Candidates who pass Secondary School Completion on their first attempt will be ranked as excellent, good, or average based on the following criteria:
a. Excellent:
Twelfth-grade academic performance rated as excellent.
Average score of graduation exam must be eight point five or higher, with no subject score below seven.
For candidates evaluated on conduct, their twelfth-grade conduct rating must be excellent.
b. Good:
Twelfth-grade academic performance rated as good or better.
Average score of the graduation examination must be seven or higher, with no score below six.
For candidates evaluated on conduct, their twelfth-grade conduct rating must be good or better.
c. Average: All remaining cases that meet graduation requirements.
2. Candidates required to retake the Secondary School Completion exam will be ranked as average.
CHAPTER V
EXAMINATION SELECTION AND QUESTION COMMISSION
Article 14
The entire process of selecting candidates and setting exam questions for each exam session is entrusted to the Examination Question Setting Council.
The tasks of the Commission are:
1. Draft official examination questions and backup questions along with marking guidelines.
2. Organize typing, printing, or loading computer disks, coding, and distributing examination questions and marking guidelines to localities.
Article 15
1. The Minister of Education and Training decides to establish the Secondary School Completion Examination Question Setting Council according to the following principles:
a. The Chairperson shall be assumed by a Deputy Minister.
b. The Vice-Chairperson shall be assumed by a Director or Deputy Director of the Department of Continuing Education.
c. The Secretary of the Council shall be assumed by staff members knowledgeable about examination work from the Department of Continuing Education.
d. Members of the Council must be leading or research staff in Continuing Education.
2. The Director of the Department of Education and Training shall submit to the People's Committee of the province or city for decision to establish the Secondary School Equivalency Graduation Exam Question Setting Council according to the following principles:
a. The Chairperson shall be assumed by a Deputy Director of the Department of Education and Training.
b. The Vice-Chairperson shall be assumed by the Head or Deputy Head of the Department of Continuing Education of the Department of Education and Training.
c. The Secretary of the Council shall be assumed by a staff member knowledgeable about equivalency cultural exams from the Department of Education and Training.
d. Members of the Council must be department heads or teachers with expertise in the current equivalency program.
Article 16
1. The composition of the Examination Selection and Question Commission includes: Chairman, Vice-Chairmen, Secretary, Members, and technical staff for computer operations, typing, and printing.
2. Duties and powers of council members:
a. Chairperson of the Council
Conduct all activities of the Council.
Decide on the selection and approval of examination questions, guide marking.
Organize the distribution of examination questions and guidance for marking to localities.
Reward and enforce disciplinary measures or propose superiors to reward and enforce disciplinary measures against members of the Council.
b. Vice-Chairman of the Council:
Assist the Chairperson in administrative tasks, responsible to the Chairperson for delegated tasks.
c. Council Secretary: Assist the Chairperson and Vice-Chairpersons:
Draft common documents;
Prepare material conditions and working tools for the Council.
d. Members:
Select or set exam questions and guide grading for assigned subjects, ensuring accuracy within the scope of the curriculum.
e. Technical computer personnel, typists, and printers:
Type accurately according to the manuscript, print clearly or load computer disks precisely, safely, and in sufficient quantity.
Article 17
The Examination Question Setting Council operates according to the following principles:
1. Concentrate and isolate from the time the Council convenes until the end of the last subject exam period.
2. The Chairman of the Council is the sole person deciding on Council matters. The Chairman directly or through Vice Chairmen manages the work of Council members.
3. For each set of exam questions, apart from the drafters of the question set, only the Chairperson, Vice-Chairperson, and technical computer personnel, typists, and printers are informed.
4. Exam questions, marking guidelines, and related issues concerning the subject, including the content of council meetings, must be kept confidential from the start of council operations until the end of the last exam session.
5. All council members must adhere strictly to the procedural regulations and internal rules of the council as stipulated by the Ministry of Education and Training.
Chapter VI
EXAMINATION QUESTION PRINTING COUNCIL
Article 18
The entire process of duplicating, printing exam questions and marking guidelines for Secondary School Completion is entrusted to the Exam Question Duplication Council of the Department of Education and Training.
The tasks of the Examination Question Printing Council are:
1. Receive and store floppy disks containing examination questions and marking guidelines.
2. Conduct decryption, duplication, and printing of exam questions for each candidate, package them, seal them, and transfer them to each Secondary School Completion Exam Supervision Council.
Article 19
1. The Exam Question Duplication Council consists of: Chairperson, Vice-Chairperson, and members.
2. Appointment criteria for members of the Council:
The Chairperson of the Council shall be assumed by a Leader of the Department of Education and Training.
The Vice-Chairperson of the Council is the Head (or Deputy Head) of the Department of Continuing Education or the specialized department responsible for directing secondary school equivalency programs.
Members can be subject specialists from these departments or computer operators proficient in using computers. The number of members is determined by the Director of the Department of Education and Training based on the workload of the Council.
Article 20
Tasks and authorities of each member of the Examination Question Printing Council are:
1. Chairman of the Council:
Article 1 ||| Chair the entire operation of the Council.
Decide on the number of examination questions to be printed for each subject.
Be responsible to superiors for the confidentiality of examination questions.
Propose to the Council that the Ministry select and prepare examination questions to address certain issues related to decoding and computer printing of examination questions.
Propose superiors to reward and enforce disciplinary measures against members of the Council.
2. Deputy Chair of the Council: assist the Chair of the Council in administrative work and be responsible to the Chair for tasks delegated by the Chair.
3. Members:
Implement well the guidelines of the Council on selecting and preparing examination questions from the Ministry regarding the decoding of examination questions and marking instructions.
Proceed to print examination questions clearly, in the correct quantity as assigned by the Chairman.
Proceed to envelope, seal examination questions according to confidentiality regulations.
Transfer examination questions to each Examination Supervision Council.
Be responsible to the Chairman of the Council for the confidentiality of examination questions.
4. Each Examination Question Printing Council consists of two parts:
The part directly interacting with the examination questions: operating computers, decoding, printing, sealing subject envelopes, directly managed by a Deputy Chair.
The part not directly interacting with the examination questions: completing the remaining steps of the examination question printing process such as sealing general envelopes, organizing transportation to examination councils.
Article 21
Material and equipment for printing examination questions:
1. Equip all necessary devices and materials for printing examination questions such as computers, printers, photocopiers, printing paper, ink, envelopes...
2. Arrange a safe location for printing examination questions with sufficient working conditions including main rooms such as: Computer room, intermediate room, security room.
These rooms must be arranged conveniently for printing examination questions and maintaining confidentiality.
The area where the Examination Question Printing Council is located must ensure safety, isolation, far from fences, and far from traffic for easy protection.
Article 22
The Examination Question Printing Council operates according to the following principles:
1. The Chair of the Council decides all matters of the Council. The Chair of the Council directly or through the Deputy Chair manages the work of members of the Council.
2. Members of the Examination Question Printing Council and security personnel must be individuals without close relatives participating in the examination that year.
3. Those who have the task of directly interacting with examination questions must be completely isolated from those without such tasks from the moment the floppy disk containing the examination questions is unsealed until the last subject is completed.
4. The time for printing examination questions is decided by the Director of the Department of Education and Training based on the number of examinees, examination council locations, organization and transportation conditions for printing examination questions...
5. The number of examination papers for each subject of each Examination Supervision Council equals the number of candidates plus one paper for the Chairman of the Council.
6. Decoding, printing, and enveloping subject tasks can only be carried out in the machine room. In one machine room, only one subject can be printed and enveloped sequentially.
Chapter VII
EXAMINATION SUPERVISION COUNCIL
Article 23
All organizational work for candidates taking the examination at a test site during the examination period is undertaken by an Examination Supervision Council.
The tasks of the Examination Supervision Council are:
1. Receive and inspect files handed over by District Education and Training Departments or Continuing Education Centers, Cultural Supplement Schools; manage these files during the examination period.
2. Inspect and receive examination venues, material conditions, and working tools.
3. Receive, store, and use examination questions according to guidelines.
4. Organize management and supervision of candidates taking examinations according to the examination schedule, examination rules, and examination regulations.
5. Collect papers submitted by examinees, complete sealing procedures for examination papers and files, store and hand over them fully to the examination marking council.
"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country."
Authorities of the Examination Supervision Council are:
1. Not accept examination venues if they do not meet the necessary conditions for the examination to proceed according to the examination regulations and guiding documents of the Ministry.
2. Not allow candidates to take the examination if their registration files do not comply with the examination regulations and guiding documents.
3. Suspend part or all of the examination within the Council's jurisdiction if serious violations of examination regulations are found, and there are no conditions to ensure that the examination results reflect the true academic level of most examinees. This right can only be exercised after reporting to the Director of the Department of Education and Training and local authorities and obtaining approval.
4. Not accept requests from any level that do not comply with examination regulations.
5. Enforce discipline and propose higher authorities to enforce discipline against those who violate examination regulations and examination organization guidance documents.
6. Suggest that competent educational authorities commend units or individuals who perform well in serving the examination period.
Article 25
1. The Examination Board consists of: Chairperson, Deputy Chairpersons, Secretary, and Examiners.
2. Appointment criteria for members of the Council:
The Chair of the Council must be management staff from secondary schools, Continuing Education Centers, or education department or district education department staff with adequate management capabilities, professional qualifications, and a thorough understanding of examination procedures and regulations.
The Deputy Chair of the Council must be capable officers or teachers with management skills, professional expertise, and a thorough understanding of examination procedures.
The Secretary of the Board is an officer or teacher who has previously served as an examiner for supplementary courses, possesses thorough knowledge of examination procedures, can construct necessary tables and records truthfully, and keep accurate minutes.
Examiners must be officers or teachers with a sense of responsibility, a thorough understanding of examination procedures, and professional qualifications sufficient to meet the requirements of the Council.
Article 26
Principles for establishing the Examination Board:
1. The number of examination councils in the province is determined by the Department of Education and Training based on:
Ensuring strict supervision by the Department of Education and Training;
Having adequate conditions and means for the Board to work and ensure safety during the examination period;
Management staff of the Council meeting the capability standards;
Convenience for candidates' travel and living arrangements.
2. The number of examination rooms in each Council depends on the number of examinees and must ensure that each room does not exceed 25 examinees.
3. Appointments to the Board must ensure:
Not assigning individuals whose learners are participating in the examination at that Board.
Each examination room must have at least 2 invigilators, excluding external invigilators. The number of external invigilators is determined by the Department of Education and Training according to the specific needs of each Council.
In the examination council, for each subject, there must be at least one teacher teaching that subject at the corresponding educational level to supervise the examinees' test papers.
Article 27
Duties and powers of each member of the Board:
1. The Chair of the Council is responsible to the Director of the Department of Education and Training:
Directing all activities of the Board;
Helping members of the Council understand and implement examination regulations and examination organization guidance documents issued by educational management levels.
Organizing training for examinees on examination rules;
Considering and deciding disciplinary measures for those who violate examination regulations, examination rules, and examination organization guidance documents issued by the Ministry and the Department of Education and Training.
Deciding whether to accept or reject examination venues, and continuing or suspending the examination when situations listed in Article 24 occur, after consulting with Council members.
Deciding not to allow candidates to take the examination if they do not have the required documentation.
Handing over all sealed examination papers to the examination marking council as stipulated by the Department of Education and Training.
2. The Deputy Chair assists the Chair in administrative work and is responsible to the Chair of the Council and the Director of the Department of Education and Training for tasks assigned by the Chair of the Council.
3. The Secretary of the Council is responsible for assisting the Chair of the Council in drafting documents, creating necessary tables, recording minutes of meetings and events occurring during the Council's operations.
4. Examiners are responsible for:
Organize, guide, inspect, and supervise examinees to strictly follow rules in the designated areas assigned by the Chair of the Council; - Distribute printed examination papers to examinees.
Collect papers submitted by examinees, check the completeness of each paper and its pages, and submit them fully to the Chair or a person authorized by the Chair of the Council. - Prepare minutes and propose disciplinary actions against examinees who violate examination regulations.
Performing other necessary tasks assigned by the Chairperson to support examination duties.
Article 28
Examination security and service staff are directly managed by the Chair of the Council, responsible for their assigned tasks to ensure the examination proceeds seriously and safely. Security and service staff are absolutely prohibited from participating in tasks reserved for Council members and are not allowed to enter examination rooms while examinees are taking tests.
Article 29
Working procedures of the Council:
1. The Chairperson, Vice-Chairperson, and Secretary shall be present at the examination venue three days prior to the examination for:
Inspecting local preparation for the examination, accepting examination venues, facilities, and equipment for organizing the examination.
Accepting and inspecting examination files, confirming the final eligibility of candidates, and posting lists of candidates.
Resolving necessary examination matters, unifying signals, methods of conducting the examination, and assigning specific tasks to each Board member.
2. The examiners within the Examination Board shall be present at the examination venue at least one day before the examination date to convene the Examination Board, study relevant documents and regulations related to the examination period, and perform certain tasks of the Examination Board.
3. Prior to each examination session, all members of the Examination Board must gather to disseminate necessary tasks for that session and assign responsibilities to each member of the Examination Board for that particular session.
4. After each session, immediately seal the examination papers of that session in front of the entire Board and draw lessons from the session.
5. After completing the last subject, convene the Board to:
Evaluate the organization of the examination period;
Recommend commendations and disciplinary actions;
Witness and confirm the sealing of examination papers and candidate files, sign the Board's summary minutes.
Article 30.
All work evaluating individual candidate results falls under the authority of the Marking Board.
The tasks of the Marking Board are:
1. Receive all examination papers and examination supervision files handed over by the Examination Boards and keep them during the marking period.
2. Inspecting and accepting examination venues, facilities, and working equipment of the Board.
3. Mark all candidates' examination papers according to the marking guidelines issued by the Examination Board.
4. Prepare a list recording the names, scores of examination papers, and the list of successful candidates.
5. Providing an overall evaluation of the examination questions and the quality of candidate responses. Offering suggestions on examination questions, marking guides, and examination organization work.
All opinions above shall be documented and sent back to the Ministry.
6. Submit all examination marking files and examination papers to the Department of Education and Training, the School Service Bureau - General Staff Headquarters.
7. Comply with the requirements of the examination inspection committee members to ensure compliance with the examination regulations and organizational guidance documents for the examination period.
Article 31
Powers of the Examination Board:
1. Refuse to accept a workplace if it is deemed not to meet the conditions and means necessary for accurately and fairly assessing the examination results and ensuring the safety of the Examination Board.
2. Do not mark the examination papers of candidates who violate examination regulations and have been recorded by the Examination Board as not to be marked, and those papers showing signs of cheating or lack of seriousness, including disrespectful remarks towards examination staff. 3. Do not recognize graduation for candidates:
Whose examination papers are not graded as mentioned above;
Whose examination files are not valid;
Who do not meet the examination eligibility criteria.
Article 32
Structure of the Examination Marking Board:
1. The Examination Marking Board consists of the Chairperson, Vice-Chairpersons, Secretary, and examiners.
2. Appointment criteria for members of the Board:
a. The Chairperson of the Board must be a management cadre from the Director of Continuing Education Centers, Principal of Cultural Supplement Schools or Primary Basic Level Schools (for the Secondary School Completion Supplementary Examination), or secondary level (for the Secondary School Completion Supplementary Examination), possessing sufficient professional expertise, vocational skills, and leadership capability for the Board.
b. The Vice-Chairperson of the Board must be a management cadre from Deputy Principals or Deputy Directors of Continuing Education Centers and above, having professional qualifications, capabilities, and mastery of examination procedures, capable of effectively managing part of the Board's work.
c. The Secretary of the Board must be staff or teachers proficient in examination procedures, capable of recording minutes and preparing tables and charts for the Board.
d. The Head and Deputy Head of the marking team must be teachers who have taught the final grade class for two years or more and have marked examinations for at least two supplementary cultural completion graduation examinations.
đ. Examiners for each level of the graduation examination (Secondary School Completion or Secondary School Completion) must be teachers who have taught the final grade class of that level.
Article 33
Duties and powers of each member of the Examination Board:
a. Responsibilities and authorities of the Chairperson of the Board:
Directing all activities of the Board;
Preside over meetings of the Board;
Responsible for numbering, cutting, returning, and managing the scoring process;
Review and conclude disciplinary actions against those who violate examination regulations and organizational guidance documents for the examination period;
Propose commendation forms for members with outstanding achievements and candidates who pass the examination with excellent results.
Require examiners to re-mark candidates' papers if they mark incorrectly despite instructions; suspend the marking process of an examiner if they deliberately mark incorrectly despite being instructed to re-mark.
b. The Vice-Chairperson assists the Chairperson in managing some Board tasks and is responsible to the Chairperson for assigned tasks.
c. The Secretary is responsible to the Chairperson for drafting documents, preparing tables and charts as prescribed, and recording minutes of Board meetings.
d. The Head and Deputy Head of the marking team are responsible for:
Studying in advance and organizing for examiners in their team to study the marking guidelines issued by the Examination Board for selecting and setting questions;
Assist the Chairperson in distributing and collecting examination papers among examiners in the grading team.
Supervise the marking process within the marking team and directly mark some candidates' papers.
Assist the Chairman of the Examination Board in inspecting and supervising the marking work of the examiners.
đ. Examiners are responsible for evaluating and grading the examination papers assigned to them according to the marking guidelines. Examiners have the right to request a joint review team if they disagree with the Head and Chairperson; if there is still disagreement after joint review, they should record it and seek the opinion of the Examination Board member responsible for setting questions for that subject.
Article 34
Principles and procedures for the Council's operations:
1. The Chairperson and Vice-Chairperson must be present at the marking venue beforehand to perform certain tasks reserved for Board leadership. The specific time will be determined by the Director of the Department of Education and Training based on the number of examination papers the Board needs to mark.
The Team Leader and Deputy Team Leaders must be present one day before the examiners to study the marking guidelines and prepare for the marking work of their teams.
2. The Head controls the research team and strictly follows the marking guidelines. If there are unresolved questions or errors found in the documents within the team, they should request the Chairperson responsible for setting questions; under no circumstances should they change the marking guidelines and score chart without authorization.
3. Before distributing papers to examiners, the team must jointly mark ten papers to ensure all team members thoroughly understand the marking guidelines. When grading these jointly marked papers, clearly note "jointly marked" along with the signatures of the Head and an examiner.
4. Except for jointly marked papers, each examination paper must be marked by two examiners independently, each recording their own scores according to the paper number. After both examiners have marked a paper, the Head must instruct them to reconcile and record the final score on the paper, both in figures and words, and sign together. Examiners should mark in red ink. If the two examiners wish to change the score, they should cross out the original score, write the new score (both numerically and in words), provide the reason for changing the score, and sign next to it.
5. In case of disagreement, the two examiners should seek the Head's opinion; if they still cannot reach an agreement, they should refer the paper to the joint marking team.
6. In all cases of joint marking, if an examiner disagrees with the majority, their opinion must be recorded in the minutes and referred to the Examination Board responsible for setting questions.
7. Apart from the Examination Board, no one has the authority to alter scores agreed upon by two examiners unless those examiners are disciplined.
8. Paper numbers can only be combined after all examination papers have been marked. It is strictly forbidden for the Examination Board to re-mark papers that have already been combined.
9. The recording of scores on the name and score sheet in each examination room shall be carried out by a panel of examiners, consisting of one person reading, one person recording, and one person checking. In case of errors, the scorer shall cross out the incorrect score and record the new score beside it, with the reason for the correction noted in the margin. At the end of each score sheet, the names of the reader, recorder, and checker, along with the total number of corrected points, must be clearly stated, followed by signatures from all three individuals.
In cases where the name and score sheets are created using computers, there must still be one person reading, one person inserting the floppy disk, and one person checking. At the end of the name and score sheets, the names of all three individuals must be clearly stated, followed by their signatures.
Chapter VIII
||| REVIEW, RECOGNITION OF EXAMINATION RESULTS, APPEALS AND REEXAMINATION
Article 35
The Director of the Department of Education and Training, and the Director of the School Administration Bureau are responsible for reviewing and recognizing the examination results of the Graduation Examination Committee for Secondary Vocational Completion.
The Director of the Department of Education and Training, and the Director of the School Administration Bureau are responsible for reviewing the results of the Graduation Examination Committee for Secondary Vocational Completion and announcing them after they have been approved by the Ministry of Education and Training.
Article 36
The responsibilities and authorities of the Director of the Department of Education and Training in reviewing and recognizing examination results include:
1. Responsibilities:
Verify the list of graduates proposed by the Examination Board.
Signing to recognize the list of successful candidates and issuing graduation certificates to them.
2. Authorities:
Canceling the examination results of a single candidate or examination room.
Canceling the examination results of the entire Graduation Examination Committee for Secondary Vocational Completion.
Proposing that the Ministry of Education and Training cancel the examination results of a Graduation Examination Committee for Secondary Vocational Completion.
Article 37
Examination results must be publicly posted at the District or County Education and Training Office, or at the Center for Continuing Education or Cultural Supplemental School before the twentieth day following the last examination date.
Article 38
Candidates have the right to request a reexamination of their papers if they can present evidence showing that the scoring was inaccurate.
The application for reexamination must be submitted to the Department of Education and Training within ten days from the posting of the examination results and accompanied by an examination fee as prescribed by the Department of Education and Training.
Article 39
The Director of the Department of Education and Training will decide whether to conduct a reexamination based on guidelines from the Ministry and the specific content of the candidate's application. If a reexamination is not conducted, the reasons must be communicated clearly to the applicant.
Article 40
The Department of Education and Training will establish a Reexamination Committee when any of the following conditions exist:
1. There is a valid appeal from a candidate as stipulated in Article 38.
2. The Director of the Department of Education and Training finds irregularities in the marking process that deviate from the marking guidelines established by the Examination Committee and Question Paper Setting Committee.
3. The Inspection Board of the Ministry requests: Depending on the circumstances, the Reexamination Committee may be tasked with reexamining some or all of the candidate's papers.
Article 41
The composition of the Reexamination Committee includes:
1. The Chairperson of the Reexamination Committee is the Director or Deputy Director of the Department of Education and Training.
2. The Vice-Chairperson of the Reexamination Committee is the Chairperson or Deputy Chairperson of the Examination Committee or the Head of the Center for Continuing Education or High School of the Department of Education and Training.
3. The Secretary of the Review Board is a specialist responsible for supplementary education examination work at the Department of Education and Training.
4. The examiners are teachers who are well-versed in the subject matter and consistently demonstrate fairness and accuracy during the marking process.
Individuals who are reported to have violated examination regulations shall not participate in the Reexamination Committee.
Article 42 |||
The Reexamination Committee shall only adjust the recorded scores in the score sheet if the reexamined score differs from the previous score by one point or more.
1. The "Labor Medal" second class shall be awarded or posthumously awarded to individuals meeting one of the following criteria:
The reexamination process must begin before the fifteenth day following the announcement of the examination results and must be completed within ten days. The reexamination results must be publicly posted after being approved by the Ministry of Education and Training.
CHAPTER IX
MANAGEMENT AND DIRECTIVE OF THE EXAMINATION PERIOD
Article 44 |||
The Ministry of Education and Training shall be responsible for:
1. Issuing Examination Regulations and guiding documents for organizing the examination period.
2. To set examination questions and marking guidelines for the Graduation Examination for Secondary Vocational Completion.
3. To direct and inspect the management and organization of examinations by provincial and municipal People's Committees and the General Staff of the Vietnam People's Army.
4. To approve the graduation lists of the Departments of Education and Training and the School Administration Bureau.
Article 45 |||
Provincial and municipal People's Committees; the General Staff of the Vietnam People's Army are responsible for:
1. Directing the Departments of Education and Training and the School Administration Bureau to strictly implement the examination regulations and guidelines issued by the Ministry of Education and Training.
2. Assigning tasks and directing districts, counties, towns, and related sectors to create favorable conditions for the examinations. Approving the examination fee levels for candidates.
3. Issuing decisions to establish the Question Paper Copying Committee, Examination Committee, Marking Committee, Reexamination Committee, and Inspection Board for the Secondary Vocational Completion Examination.
Article 46 |||
The Department of Education and Training is accountable to the provincial and municipal People's Committees and the Ministry of Education and Training for the overall guidance and management of examinations in the locality, specifically including:
1. Directing the Centers for Continuing Education, Cultural Supplemental Schools, and District Education and Training Offices to fulfill their duties: preparing examination files, facilities, equipment, and working conditions for the committees.
2. Submitting proposals to the provincial and municipal People's Committees for decisions to establish the Question Paper Copying Committee, Examination Committee, Marking Committee, Reexamination Committee, and Inspection Board for the Secondary Vocational Completion Examination.
3. Issuing decisions to establish the committees for the Secondary Vocational Completion Examination.
4. Receiving the Secondary Vocational Completion Examination questions from the Ministry, organizing the copying of examination questions to distribute to each candidate during the examination period.
5. Organizing the setting of examination questions, copying, and distribution of examination questions to each candidate during the Graduation Examination for Secondary Vocational Completion.
6. Directing, supervising, and inspecting the Examination Committees.
7. Reviewing and recognizing examination results and issuing graduation certificates to successful candidates in the Secondary Vocational Completion and Vocational Completion Examinations.
8. Sending reports to the Ministry as required and archiving examination files.
The School Administration Bureau is accountable to the General Staff and the Ministry of Education and Training for the overall guidance and management of examinations in the military, similar to a Department of Education and Training.
Article 47 |||
The examination report file sent by the Department of Education and Training to the Ministry includes:
1. For the Graduation Examination for Secondary Vocational Completion, it includes:
A summary report on the examination guidance work of the Department of Education and Training and the School Administration Bureau, accompanied by various statistical data.
Name and score sheets of candidates, along with the list of graduates.
Decisions regarding the organization of the examination, establishment of the Question Paper Copying Committee, Examination Committee, Marking Committee, Reexamination Committee, and Inspection Board.
Minutes of the Examination Supervision Board;
Summary minutes of the Examination Grading Board and minutes of subject grading teams;
Other relevant minutes related to the Graduation Examination for Secondary Vocational Completion.
The re-examination file (if any) includes: decision, summary report, list of graduates after re-examination, and other relevant minutes.
2. For the Secondary School Completion Examination for Supplementary Secondary Education, it includes:
Report on the organization of the examination period and examination results;
Decision on the establishment of the Examination Question Setting Board;
One set of examination questions and marking guidelines;
3. Deadline for submission:
All the above files must be at the Ministry (Department of Continuing Education) no later than twenty-five days from the date of the last subject examination.
All re-examination files (if any) must be at the Ministry (Department of Continuing Education) no later than forty-five days from the date of the last subject examination.
Article 48
Archiving examination files:
1. Departments of Education and Training, Educational Institutions Bureau shall store:
a. Permanently:
Score sheets with names;
List of successful candidates;
Graduation certificate issuance books.
b. For three years:
Decision to establish Supplementary Secondary Education Examination Boards;
Candidates' complaint files;
Record-keeping files. c. For one year:
Decision on the establishment of the Examination Question Setting Board for Secondary School Completion Supplementary Education;
Examination questions and marking guidelines (including envelopes containing examination questions);
Various minutes;
Candidates' examination papers;
Other types of files.
2. Storage time limit: Calculated from the last examination date of each examination period.
3. Candidates' application files for the examination shall be returned to District, County, City Education and Training Offices, Continuing Education Centers, or Supplementary Schools after all examination-related tasks have been completed.
Article 49
District, County, City Education and Training Offices shall be responsible for:
Receiving and examining examination files, confirming candidates' eligibility to take the examination.
Preparing examination venues, facilities, equipment, and working conditions for Examination Boards.
Announcing examination guidance notices and examination results for candidates under their jurisdiction;
Storing part of the Supplementary Secondary Education Completion Examination files transferred by the Department of Education and Training;
Returning examination files and announcing examination results to candidates.
Article 50
Continuing Education Centers, Cultural Supplementary Schools shall be responsible for:
Completing study programs, organizing review sessions for students, and confirming cultural knowledge levels for self-study individuals when assigned by the Department of Education and Training;
Guiding students to prepare examination application files. Receiving and examining examination files of candidates when assigned by the Department of Education and Training;
Collecting examination fees, compiling lists of candidates by category (A, B, C...), submitting them to District Education and Training Offices or Examination Boards;
Organizing training on examination regulations and examination rules for students.
Chapter X
ORGANIZATION OF EXAMINATION SUPERVISION
Article 51
1. Each year, the Ministry of Education and Training will issue a decision to establish an Examination Supervision Board for Supplementary Secondary Education Completion Examinations of the Ministry including:
One Chairperson: to be held by the Director of the Department of Continuing Education;
Several Deputy Chairs: to be held by Deputy Directors of the Department of Continuing Education and some leaders of subordinate agencies related to the Ministry;
Several members: Selected from specialists of the Department of Continuing Education and some related subordinate agencies of the Ministry of Education and Training.
2. The duties and powers of the Examination Supervision Board of the Ministry are:
Inspecting and supervising the organization of examinations in localities and the military. - Suspending examinations at some Examination Boards or localities; recommending cancellation of partial or full examination results in a locality upon discovery of violations of examination regulations and organizational guidelines issued by the Ministry.
Suspending participation in examination work of Examination Board members, examination security and service personnel, and lower-level Examination Supervision Board members if they violate examination regulations and organizational guidelines or lack the capability to perform their duties.
Requesting the Department of Education and Training to establish a re-examination board if the initial marking is found to be inaccurate.
Recommending the Minister to commend units and individuals with outstanding achievements or to impose disciplinary actions on units and individuals who violate examination regulations.
The performance of duties and powers of the Examination Supervision Board in localities or the military may be undertaken by one member or a team consisting of multiple members of the Examination Supervision Board.
Article 52
1. Each year, the Department of Education and Training shall submit to the People's Committee of the province or city for issuance of a decision to establish an Examination Supervision Board of the Department including:
One Chairperson: to be held by the Director or Deputy Director of the Department;
Several Deputy Chairs: to be held by Heads or Deputy Heads of specialized departments or the Inspection Board of the Department;
Several members: Selected from capable and qualified specialists in specialized departments, the Inspection Board of the Department, and some management staff of Continuing Education Centers and Cultural Supplementary Schools.
2. The duties and powers of the Examination Supervision Board for Supplementary Cultural Education in the Department of Education and Training are:
Inspecting the preparation for examinations by District Education and Training Offices, Continuing Education Centers, and Cultural Supplementary Schools; inspecting and supervising Examination Boards' activities regarding the implementation of examination regulations and organizational guidelines.
Advising the Director of the Department to suspend participation in examination work of Examination Board members, examination security and service personnel if they violate examination regulations or lack the capability to perform their duties.
Advising the Director of the Department not to recognize the examination results of some candidates, examination rooms, or Examination Boards if serious violations of examination regulations are discovered.
Recommend the Department Director to commend or impose disciplinary actions on those involved in examination work.
The performance of duties and powers of the Examination Supervision Board may be undertaken by one member or a team consisting of multiple members within the Examination Supervision Board.
Article 53
Examination inspection is the exercise of state supervision over the implementation of policies and examination regulations of the education sector by organizations and individuals related to the examination to ensure its safety, seriousness, accuracy, and fairness. The organization of examination inspection is regulated by the Minister of Education and Training and operates independently from established organizations.
Examination Supervision Boards, Examination Boards, re-examination boards shall cooperate and provide conditions for Examination Inspectors to perform their duties.
CHAPTER XI
REWARD AND DISCIPLINE
Article 54
While completing their tasks, those involved in examination work should overcome difficulties, complete their tasks well, and be commended and rewarded for discovering and preventing violations of examination regulations and organizational guidelines.
Forms of reward include:
1. Commendation certificates and monetary or material rewards shall be granted by the Department of Education and Training, Educational Institutions Bureau.
2. Commendation certificates shall be granted by the People's Committee of the province or city or the General Staff of the Vietnam People's Army.
3. Commendation certificates shall be granted by the Ministry of Education and Training.
Article 55
When performing their duties, those involved in examination work who violate the Examination Regulations, causing adverse effects on the organization of the examination and its results, shall be subject to disciplinary action.
Forms of discipline include:
1. Reprimand.
2. Warning.
3. Demotion in rank, demotion in technical grade, reduction in salary, transfer to other work.
4. Forced termination of employment or prosecution before the law.
Article 56
The application of the form of disciplinary action stipulated in Article 55 depends on the degree of fault and the harm caused by such fault.
1. The form of reprimand is applied in cases where the fault is due to lack of responsibility but has not caused significant harm:
Not being present at the Examination Board at the specified time.
Engaging in personal matters during supervision.
In cases where it is necessary to copy examination questions, if the invigilator copies incorrectly, omits questions, or has the responsibility to check the copying of examination questions but fails to detect errors or omissions, thereby causing difficulties for candidates in answering the questions, but not to the extent that a reserve question paper must be taken.
Allowing candidates to bring prohibited materials into the examination room, looking at others' papers, or copying each other's answers during the examination.
2. The form of warning is applied in cases where the fault causes relatively serious harm to examination results:
Losing examination files, causing a candidate to lose the right to take the examination or losing a candidate's examination paper, making it impossible for the Examination Board to determine the candidate's result.
In places where the method of copying examination questions is still used during the final examination for Secondary Education Completion, if the invigilator copies incorrectly, omits questions, or the person responsible for checking the copying does not detect errors or omissions, forcing candidates to take the reserve question paper.
Removing examination questions from the examination room.
Incorrectly adding up scores, leading to distortion of candidates' examination results.
Refusing to comply with the Examination Board's assignments.
3. The form of demotion in rank or reduction in salary is applied in cases where violating examination regulations and organizing examination documents causes significant harm to the examination period.
Providing answers to candidates during the examination.
Setting examination questions incorrectly or outside the prescribed curriculum, requiring a retake.
Leaking examination questions, causing severe harm to the examination period.
4. The form of disciplinary action of dismissal from service or prosecution under the law shall be applied in cases of intentional violation of the Examination Regulations and other guiding documents for organizing examinations, causing serious harm to the examination results:
Intentionally altering examination scores to allow candidates to graduate.
Accepting bribes to allow candidates to graduate.
Intentionally leaking examination questions, causing severe harm to the examination period.
Assaulting examination staff, causing disorder and security issues in the examination area.
In all these cases, the direct management level of the person violating discipline must immediately suspend their work at the Examination Board and recommend higher authorities to impose disciplinary action.
Article 57
Forms of discipline applicable to candidates include:
1. Invigilators reprimanding candidates in the examination room.
2. Chairman of the Examination Board:
Warning the entire group of candidates in the Examination Board.
Prohibiting candidates from continuing to sit for remaining subjects.
Requesting the Examination Grading Board not to grade the examination paper.
3. Chairperson of the Examination Grading Board decides not to grade the examination paper.
4. Director of the Department of Education and Training decides:
Cancel examination results.
Suspend examination eligibility for one to three years.
Recommending prosecution before the law.
When applying a disciplinary measure of reprimand or higher, the Director of the Department of Education and Training must notify the management agency or unit or the family of the disciplined person.
Article 58
The application of the above disciplinary measures against candidates is based on the degree of fault and the harm caused by such faults. Specifically:
1. Reprimanding candidates in the examination room; Chairperson of the Examination Supervision Board warning the entire group of candidates in the Examination Board in the following cases:
Having been reminded twice but still passing papers or reminding other candidates.
Having been reminded twice but still asking for or copying answers from other candidates.
2. Canceling examination results in the following cases:
Possessing prohibited materials in the examination room during the examination period, even if not used.
Accepting pre-written solutions or scratch paper from others, even if not yet used.
Having identical papers indicating copying from each other during the examination.
Intentionally failing to submit the examination paper, submitting another person's answer sheet or scrap paper as one's own examination paper.
The answer sheet shows a lack of seriousness (containing disrespectful remarks towards examination staff).
3. Suspension of examination eligibility or prosecution under the law:
Disrupting security and order, causing chaos in the examination area, seriously affecting the conduct and results of the examination.
Inciting others to quarrel, threaten, or insult examination staff, causing disorder and disrupting order in the examination area.
Insulting or assaulting examination staff and examination guards.
Engaging in destructive actions that prevent the examination from proceeding.
Falsifying examination registration documents.
Having someone take the examination on one's behalf or taking the examination for someone else.
Article 59
Those responsible for verifying examination results who intentionally falsify graduation results, depending on the degree, nature, and harm caused, the Minister of Education and Training, the Chairman of the People's Committee of the province or city, or the Chief of General Staff of the Vietnam People's Army will decide on disciplinary measures ranging from reprimand to removal from office, or prosecution under the law./.
