DECISION OF THE MINISTER OF AQUATIC RESOURCES

On the application of urgent measures to control chemical residues and banned antibiotics in aquatic products exported to Japan

MINISTER OF AQUATIC RESOURCES AND FISHERIES

Pursuant to Decree No. 43/2003/NĐ-CP dated May 2, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Aquatic Resources;

Pursuant to Directive No. 06/2007/CT-TTg dated March 27, 2007 of the Prime Minister on the implementation of urgent measures to ensure food safety;

Based on the proposal of the Director of the National Fisheries Quality Control, Food Safety and Veterinary Service Bureau (NAFIQAVED) and the Director of the Science and Technology Department.

DECISION:

Article 1. Implementing urgent measures to control chemical residues and antibiotics in aquatic products exported to Japan as follows:

1. Only enterprises meeting the food safety standards of the Ministry of Aquatic Resources shall be permitted to export aquatic products to Japan. These enterprises must conduct state certification testing for chemical residues and banned antibiotics on 100% of crustacean, cephalopod, and processed seafood shipments (hereinafter referred to as crustacean and cephalopod shipments) before exporting them to Japan.

2. After this Decision takes effect, enterprises falling under the following circumstances shall not be permitted to export crustacean and cephalopod shipments to Japan:

a) Enterprises that have had more than two shipments warned about banned antibiotics, and subsequently have another shipment warned by Japan for antibiotic contamination;

b) Enterprises that have had one to two shipments warned about banned antibiotics, and subsequently have two additional shipments warned by Japan for antibiotic contamination;

c) Enterprises that previously had no warnings but subsequently have three shipments warned by Japan for antibiotic contamination.

Enterprises may only resume exporting crustacean and cephalopod shipments to Japan after submitting a report identifying the correct cause, establishing effective corrective measures, and being inspected and recognized by the National Fisheries Quality Control, Food Safety and Veterinary Service Bureau.

3. Exempt from mandatory state certification testing under Clause 1 of this Article for enterprises that have consecutively had ten crustacean and cephalopod shipments without warnings about chemical residues and banned antibiotics from Japanese competent authorities since January 1, 2007. If any subsequent crustacean and cephalopod shipments are found to contain chemical residues and banned antibiotics in Japan, those enterprises will be subject to 100% testing under Clause 1 of this Article.

4. In cases where enterprises produce shipments from imported raw materials, they must conduct testing for chemical residues and antibiotics on 100% of imported aquatic product shipments used as raw materials for processing. They must also clearly indicate the origin of the raw materials in the finished product shipments when exporting and retain full information for traceability purposes upon request.

Article 2. The National Fisheries Quality Control, Food Safety and Veterinary Service Bureau shall be responsible for:

1. Organizing guidance for enterprises and regional Quality Control, Food Safety and Veterinary Service Centers to implement this Decision.

2. Regularly updating and notifying the General Department of Customs of the list of enterprises permitted to export aquatic products to Japan.

3. Enhancing the operational capacity of quality control laboratories at regional Quality Control, Food Safety and Veterinary Service Centers and actively supporting laboratories authorized by NAFIQAVED to analyze residue levels of chemicals and antibiotics for state certification to ensure timely and accurate testing, reporting results, and issuing certificates for shipments.

4. Regularly reporting to the Ministry and announcing groups of aquatic products and types of banned chemicals and antibiotics that require testing under Clause 1 of Article 1.

5. Promptly drafting regulations for the Ministry to issue regarding reduced state inspections of production conditions and reduced sampling for shipment testing for enterprises with a tradition of quality and sufficient capability to self-inspect food safety conditions and self-certify shipments according to regulations.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decision No. 1052/QĐ-BTS dated December 14, 2006 of the Minister of Aquatic Resources on strengthening inspections of aquatic products exported to Japan.

Article 4. The Head of the Office, Heads of subordinate units of the Ministry, Directors of Provincial Fisheries Departments, Provincial Departments of Agriculture and Rural Development managing fisheries, the Vietnam Association of Seafood Exporters and Producers, and seafood processing and exporting enterprises are responsible for implementing this Decision.
