Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on project management for construction investment projects; Decree No. 112/2006/NĐ-CP dated September 29, 2006 of the Government amending and supplementing certain articles of Decree No. 16/2005/NĐ-CP on project management for construction investment projects;
Pursuant to Decree No. 99/2007/NĐ-CP dated June 13, 2007 of the Government on the management of construction investment costs;
Pursuant to Circular No. 33/2007/TT-BTC dated April 9, 2007 of the Ministry of Finance; Circular No. 98/2007/TT-BTC dated August 9, 2007 of the Ministry of Finance amending and supplementing certain points of Circular No. 33/2007/TT-BTC dated April 9, 2007 of the Ministry of Finance guiding the final accounts for completed projects funded from state resources;
On the proposal of the Director of the Finance Department,
DECISION:
Article 1. Delegating to the Directors of the following Departments: Department of Roads of Vietnam, Department of Railways of Vietnam, Department of Inland Waterways of Vietnam, Civil Aviation Authority of Vietnam, Department of Maritime Administration of Vietnam, Department of Technical Inspection of Vietnam, the authority to approve the final accounts for completed projects belonging to Groups B and C funded from state resources, which have been decided to be invested by the Minister of Transport, specifically as follows:
1. The Director of the Department of Roads of Vietnam shall approve the final accounts for completed projects for projects where the Provincial Transport Departments (Provincial Transport and Public Works Departments) and units under the Department of Roads of Vietnam are the investors;
2. The Director of the Department of Railways of Vietnam shall approve the final accounts for completed projects for projects where the Vietnam Railway Corporation, units under the Vietnam Railway Corporation, and units under the Department of Railways of Vietnam are the investors;
3. The Director of the Department of Inland Waterways of Vietnam shall approve the final accounts for completed projects for projects where units under the Department of Inland Waterways of Vietnam are the investors;
4. The Director of the Civil Aviation Authority of Vietnam shall approve the final accounts for completed projects for projects where the Vietnam Airports Corporation, units under the Vietnam Airports Corporation, and units under the Civil Aviation Authority of Vietnam are the investors;
5. The Director of the Department of Maritime Administration of Vietnam shall approve the final accounts for completed projects for projects where the Vietnam Maritime Corporation, units under the Vietnam Maritime Corporation, and units under the Department of Maritime Administration of Vietnam are the investors;
6. The Director of the Department of Technical Inspection of Vietnam shall approve the final accounts for completed projects for projects where units under the Department of Technical Inspection of Vietnam are the investors.
Article 2. The final accounts for completed projects shall be carried out in accordance with Circular No. 33/2007/TT-BTC dated April 9, 2007 of the Ministry of Finance; Circular No. 98/2007/TT-BTC dated August 9, 2007 of the Ministry of Finance amending and supplementing certain points of Circular No. 33/2007/TT-BTC dated April 9, 2007 of the Ministry of Finance guiding the final accounts for completed projects funded from state resources, and other current regulations of the State and the Ministry of Transport.
Article 3. The decision approving the final accounts for completed projects and statistical reports in the field of final accounts for completed projects must be submitted to the Ministry of Transport and relevant agencies and units as prescribed.
Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 14/2004/QĐ-BGTVT dated September 15, 2004 of the Minister of Transport on the delegation of authority to approve the final accounts for completed construction investment projects in the transport sector.
Article 5. The Heads of the Office of the Ministry, the Inspectorate of the Ministry, the Heads of the Departments directly under the Ministry, the Directors of the Departments managing specialized sectors under the Ministry, the General Directors of the Project Management Boards, the Directors of the Provincial Transport Departments (Provincial Transport and Public Works Departments), the Heads of the agencies, units, and individuals concerned are responsible for implementing this Decision./.
