Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decision No. 49/2008/QĐ-BGDĐT dated August 25, 2008 of the Minister of Education and Training promulgating the Regulation on the organization and operation of boarding schools for ethnic minorities;

AT THE REQUEST OF THE HEAD OF THE DEPARTMENT OF GENERAL EDUCATION,

CIRCULAR:

Article 1. Amending and supplementing Article 10 and Article 13 of the Regulation on the organization and operation of boarding schools for ethnic minorities issued together with Decision No. 49/2008/QĐ-BGDĐT dated August 25, 2008 of the Minister of Education and Training, as follows:

"Article 10. Documents, procedures, and formalities for establishing boarding schools for ethnic minorities

1. The documents for establishing a boarding school for ethnic minorities include the documents as prescribed in the Charter of secondary schools and the opinions in writing of relevant agencies.

2. Procedures and formalities for establishing a school:

a) For county-level boarding schools for ethnic minorities: the department of education and training shall take the lead in coordinating with the People's Committee of the district to review the contents stipulated in Article 8 of this Regulation and prepare the documents as prescribed in Clause 1 of this Article to request the People's Committee of the province to issue a decision to establish the school.

b) For provincial-level boarding schools for ethnic minorities and county-level boarding schools for ethnic minorities that offer high school education: the department of education and training shall take the lead in coordinating with relevant agencies at the provincial level to review the contents stipulated in Article 8 of this Regulation and prepare the documents as prescribed in Clause 1 of this Article to request the People's Committee of the province to issue a decision to establish the school.

3. Documents, procedures, and formalities for suspending operations, merging, dividing, splitting, and dissolving boarding schools for ethnic minorities according to the provisions of Clause 1 and Clause 2 of Article 10 of this Regulation and the provisions of the Charter of secondary schools."

Article 13. Management Levels

1. Provincial-level boarding schools for ethnic minorities and county-level boarding schools for ethnic minorities are managed by the department of education and training.

2. Boarding schools for ethnic minorities under the central ministry are managed by the central ministry."

Article 2. This Circular takes effect from May 15, 2009. The provisions of this Circular replace the provisions of Articles 10 and 13 of the Regulation on the organization and operation of boarding schools for ethnic minorities issued together with Decision No. 49/2008/QĐ-BGDĐT dated August 25, 2008 of the Minister of Education and Training.

Article 3. The Director of the Office, the Head of the Department of Secondary Education, the Heads of related units under the Ministry of Education and Training, the Heads of ministries having boarding schools for ethnic minorities, the Chairmen of Provincial People's Committees, the Directors of departments of education and training, and the Principals of boarding schools for ethnic minorities are responsible for implementing this Circular./.
