Guidelines for implementing Decision No. 45/2009/QĐ-TTg dated March 27, 2009 of the Prime Minister on the allowance system for statisticians

Pursuant to Decision No. 45/2009/QĐ-TTg dated March 27, 2009 of the Prime Minister on the allowance system for statisticians:
The Ministry of Planning and Investment, the Ministry of Home Affairs, and the Ministry of Finance provide guidelines for implementing the allowance system for statisticians as follows:
Article 1. Scope of application
The General Statistics Office Director and civil servants who have been assigned salaries according to the Senior Statistician grade (grade code 23.261), Chief Statistician (grade code 23.262), Statistician (grade code 23.263), College-level Statistician (grade code 23.264), and Intermediate-level Statistician (grade code 23.265) in accordance with the joint Circular No. 03/2009/TTLT-BNV-BKH&ĐT dated June 24, 2009 of the Ministry of Home Affairs and the Ministry of Planning and Investment guiding the implementation of grade and salary assignment for civil servants in the statistics sector.
Article 2. Allowance rates
1. The General Statistics Office Director and Senior Statisticians shall receive an occupational allowance equal to 10% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable);
2. Chief Statisticians shall receive an occupational allowance equal to 15% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable);
3. Statisticians and College-level Statisticians shall receive an occupational allowance equal to 20% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable);
4. Intermediate-level Statisticians shall receive an occupational allowance equal to 25% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
2. Industrial emission testing must ensure timeliness, accuracy, objectivity, compliance with procedures, and adherence to legal provisions.
1. The subjects entitled to receive the occupational allowance as stipulated in Article 1 of this Circular are those appointed to positions or grades in the statistics sector by competent authorities in accordance with the law;
2. Civil servants appointed to positions or grades in the statistics sector shall receive the occupational allowance prescribed for such positions or grades;
3. The subjects specified in Article 1 of this Circular shall not be entitled to receive the occupational allowance in the following cases:
a) When transferring to another civil servant grade, retiring, resigning, or taking leave;
b) During periods abroad on official business, working, or studying, receiving 40% of their salary as stipulated in Clause 4, Article 8 of the Government Decree No. 204/2004/NĐ-CP dated December 14, 2004 on the salary system for cadres, civil servants, public officials, and armed forces personnel;
c) During periods of domestic study lasting three months or more continuously;
d) During periods of personal leave without pay lasting one month or more continuously.
e) During periods of sick leave or maternity leave exceeding the time limit prescribed by the Law on Social Insurance;
State Audit officials, civil servants, and staff currently working at the State Audit Office shall be provided uniforms as follows:

In cases where a civil servant is promoted to a higher statistician grade (promotion to a higher grade) and the total amount of salary plus occupational allowance at the new grade is lower than that at the previous grade, the difference between the total amount of salary plus occupational allowance at the previous grade and that at the new grade shall be retained until the civil servant receives the next promotion at the new grade.
Example 1: Mr. Nguyen Van H, Statistician, currently holds Grade 7 with a coefficient of 4.32 in the Statistician grade (code 23.263); the period for the next salary increase is calculated from October 1, 2008.
The total monthly salary plus occupational allowance of Mr. H in the Statistician grade in August 2009 is:
(4.32 x 650,000) + (4.32 x 650,000 x 20%) = 3,369,600 VND/month.
On September 1, 2009, Mr. H was appointed to the Chief Statistician grade (code 23.262), Grade 1 with a coefficient of 4.40; the period for the next salary increase is calculated from October 1, 2008.
The total monthly salary plus occupational allowance of Mr. H in the Chief Statistician grade in September 2009 is:
(4.40 x 650,000) + (4.40 x 650,000 x 15%) = 3,289,000 VND/month.
Since the total amount of salary plus occupational allowance calculated based on the newly appointed grade is lower than that when he was in the previous grade, Mr. H retains the difference of 80,600 VND (3,369,600 VND - 3,289,000 VND) until he receives the next promotion at the newly appointed grade (Grade 2 with a coefficient of 4.74 in the Chief Statistician grade).
Article 4. Method of calculation, payment method, and funding source for implementation
1. Calculation Method
Example 2: Mr. A, a Statistician, currently enjoys a salary coefficient of 3.99 at grade 6 of the Statistician rank (code 23.263). The amount of Mr. A's job-based allowance for one month (August 2009) is: 3.99 x 650,000 VND/month x 20% = 518,700 VND/month.
Example 3: Mr. B, the Head of a Professional Department at the Provincial Statistics Office T, currently enjoys a salary coefficient of 4.74 at grade 2 of the Senior Statistician rank (code 23.262) and receives a leadership position allowance of 0.5. The amount of Mr. B's job-based allowance for one month (August 2009) is: (4.74 + 0.5) x 650,000 VND/month x 15% = 510,900 VND/month.
2. Payment Method for Job-Based Allowance for Officials and Civil Servants Engaged in Statistical Work
a) For officials and civil servants engaged in statistical work who belong to the payroll of which agency, that agency shall be responsible for payment;
b) The job-based allowance for officials and civil servants engaged in statistical work shall be paid concurrently with their monthly salaries and shall not be used to calculate contributions or benefits under social insurance and health insurance schemes.
3. Funding Source
The funding for implementing the job-based allowance system for officials and civil servants engaged in statistical work shall be allocated from the state budget, as stipulated by the State Budget Law and Circulars issued by the Ministry of Finance guiding the determination of needs, sources, and methods of expenditure for salary reform.
Article 5. Effective Date
1. This Circular takes effect forty-five (45) days from the date of issuance.
2. The job-based allowance system for officials and civil servants engaged in statistical work shall take effect from April 1, 2009.
During the implementation process, any difficulties or issues encountered should be reported to the Ministry of Planning and Investment for coordination with the Ministry of Home Affairs and the Ministry of Finance to study and resolve.
