CIRCULAR
Article 1. Procedures and formalities for aquatic animal quarantine and aquatic products quarantine are specified herein.

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/ND-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Animal Health Ordinance dated April 29, 2004;
Pursuant to Decree No. 33/2005/ND-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Animal Health Ordinance;
Pursuant to Decree No. 119/2008/ND-CP dated November 28, 2008 of the Government amending and supplementing certain articles of Decree No. 33/2005/ND-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Animal Health Ordinance;
The Ministry of Agriculture and Rural Development hereby stipulates the procedures and formalities for aquatic animal quarantine and aquatic products quarantine as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular stipulates the procedures and formalities for aquatic animal quarantine and aquatic products quarantine when circulating within the country, exporting, importing, temporarily importing for re-export, temporarily exporting for re-import, transferring customs checkpoints, and transiting through the territory of Vietnam.
2. This Circular applies to organizations and individuals in Vietnam; foreign organizations and individuals engaged in production, business, and transportation of aquatic animals and aquatic products on the territory of Vietnam.
Article 2. Interpretation of Terms
Some terms in this Circular are understood as follows:
1. AquacultureAquatic Animals: Refers to species of animals with a stage or entire life cycle living in water, including fish, crustaceans, mollusks, echinoderms, sea anemones, coelenterates, amphibians, worms, reptiles, and aquatic mammals, including their eggs, sperm, embryos, and larvae.
2. Aquatic Animal Breeding Stock: Refers to aquatic animals used for breeding purposes, serving as breeding stock for commercial farming or ornamental purposes, including their eggs, sperm, embryos, and larvae.Commercial Aquatic Animals: Refers to aquatic animals used for food, food processing raw materials, livestock feed, aquatic animal feed, or other purposes.
3. Aquatic Products: Include dead whole aquatic animals and other products derived from aquatic animals.Food Processing Raw Materials: Refers to aquatic animals and aquatic products used as raw materials for food processing before being put on the market.
4. Quarantine Isolation: Refers to the practice of keeping aquatic animals isolated completely without direct or indirect contact with other aquatic animals for a specific period to conduct quarantine.Quarantine Isolation Facility: Includes quarantine isolation zones; temporary holding tanks at business establishments; nurseries and breeding tanks of aquaculture, production, and breeding establishments used for quarantine isolation.
5. Owner: Refers to the owner of aquatic animals and aquatic products or the manager, representative, escort, transporter, caregiver, and preserver of aquatic animals and aquatic products representing the owner.Article 3. Principles of Aquatic Animal and Aquatic Product Quarantine
6. 1. Aquatic animals and aquatic products must be quarantined once at the place of origin when transported or circulated within the country under the following circumstances:a) Aquatic animal breeding stock;
7. b) Commercial aquatic animals and aquatic products taken out of areas declared as disease-infected regions by competent authorities;c) Aquatic products used as raw materials for livestock feed and aquatic animal feed.
8. Shipper2. Aquatic animals and aquatic products intended for export must be quarantined under the following circumstances:
a) International treaties, bilateral or multilateral agreements that Vietnam has signed or joined which require quarantine;
b) At the request of the consignor or the importing country.
3. Aquatic animals and aquatic products intended for import, temporary import for re-export, temporary export for re-import, transfer of customs checkpoints, and transit through the territory of Vietnam must be registered for quarantine with the Department of Animal Health. The registration for quarantine must be completed before the consignor signs a contract with the exporter.
4. Imported aquatic animal breeding stock must be kept in quarantine isolation at locations meeting veterinary hygiene requirements, approved and supervised by the competent veterinary authority during the quarantine isolation period.
5. The quarantine isolation period for aquatic animals and aquatic products varies depending on the disease and type of aquatic animal but shall not exceed ten days. If the period exceeds this limit, the animal quarantine authority must inform the owner of the reasons.
6. Sampling of aquatic animals and aquatic products for disease testing and veterinary hygiene index checks shall be conducted according to the guidelines set forth in Appendix 1 attached to this Circular.
In cases where imported aquatic animals and aquatic products come from countries with mutual recognition agreements with Vietnam, they are exempt from quarantine isolation and disease testing (except in cases where diseased aquatic animals are detected) and veterinary hygiene indices already recognized mutually.
b) At the request of the consignee or the importing country;
3. Aquatic products and aquatic product imports, temporary imports for re-export, temporary exports for re-import, transfer of customs stations, transit through the territory of Vietnam must be registered for quarantine with the Department of Animal Health. The quarantine registration must be carried out before the consignee enters into a contract with the exporter.
4. Imported aquatic seed must be quarantined in isolation at a location that meets veterinary hygiene requirements, approved and supervised by the competent animal health authority during the quarantine period.
5. The isolation period for quarantine of aquatic animals and aquatic products varies depending on the disease and type of aquatic animal but shall not exceed ten days. If the period exceeds the aforementioned time limit, the animal quarantine agency must notify the consignee of the reasons.
6. Sampling of aquatic animals and aquatic products for disease testing and veterinary hygiene index checks shall be conducted according to the guidelines set forth in Appendix 1 attached to this Circular;
In cases where aquatic animals and aquatic products are imported from countries that have mutual recognition agreements with Vietnam, they are exempted from isolation and sampling for disease testing (except in cases where diseased aquatic animals are detected), and the veterinary hygiene indices have been mutually recognized.
Article 4. Model quarantine documents for aquatic products and aquatic product
The model quarantine documents for aquatic products and aquatic product as prescribed in Appendix 2 issued together with this Circular include:
1. Declaration form for domestic transportation quarantine of aquatic products and aquatic products (Form 1);
2. Declaration form for export and import quarantine of aquatic products and aquatic products (Form 2);
3. Registration form for quarantine (Form 3): Used for exported, imported, temporarily imported for re-exported, transferred customs checkpoints, transiting through Vietnam's territory aquatic products and aquatic products to facilitate customs clearance at border gates (issued together with Circular No. 17/2003/TTLT/BTC-BNN&PTNT-BTS dated March 14, 2003 between the Ministry of Finance - Ministry of Agriculture and Rural Development - Ministry of Fisheries);
4. Certificate of quarantine for domestic transportation of aquatic products and aquatic products
a) Form 4a: Used in cases where the animal quarantine authority does not delegate the quarantine and issue the certificate of quarantine for animals and animal products transported domestically;
b) Form 4b: Used in cases where the animal quarantine authority delegates the quarantine and issues the certificate of quarantine for animals and animal products transported domestically pursuant to Decision No. 126/2008/QD-BNN dated December 30, 2008 of the Minister of Agriculture and Rural Development (hereinafter referred to as Decision No. 126) amending and supplementing Decision No. 86/2005/QD-BNN dated December 26, 2005 of the Minister of Agriculture and Rural Development (hereinafter referred to as Decision No. 86);
5. Certificate of quarantine for exported aquatic products and aquatic products (Form 5): Used for cases of aquatic products and aquatic products not intended for food; as gifts, hand-carried goods, diplomatic bags exported to countries without agreements with competent authorities of Vietnam on the model of certificate of quarantine for aquatic products and aquatic products;
In cases where aquatic products and aquatic products are exported to countries with agreements with competent authorities of Vietnam on the model of certificate of quarantine for aquatic products and aquatic products or the importing country has specific requirements for the model of certificate of quarantine, the corresponding model of certificate of quarantine shall be used.
6. Transport document for imported aquatic products and aquatic products to isolation quarantine place (Form 6);
7. Certificate of quarantine for imported aquatic products and aquatic products (Form 7);
8. Certificate of quarantine for temporarily imported for re-exported, transferred customs checkpoints, transiting through Vietnam's territory aquatic products and aquatic products (Form 8);
9. Models of minutes, decision forms for handling, notification of completion of quarantine isolation period: Use the models issued together with Decision No. 86.
Article 5. Management and use of quarantine document models for aquatic products and aquatic products
1. The certificates of quarantine for aquatic products and aquatic products issued by the animal quarantine authority are printed in black ink on A4 paper, with the Animal Quarantine Logo embossed in light black color in the center, diameter of 12 cm.
For the certificate of quarantine for exported aquatic products and aquatic products used for food, it is issued by the General Department of Quality Inspection of Agricultural and Forestry Products in accordance with the requirements of the importing countries' competent authorities.
2. The certificate of quarantine for domestic transportation of aquatic products and aquatic products is stamped with “ORIGINAL” or “COPY” in red ink at the bottom right corner of “Sample:...” (Stamp according to the provisions of Decision No. 86). The number of certificates of quarantine issued is as follows:
a) Original: 01 copy retained by the animal quarantine authority, 01 copy issued to the consignor;
b) Copy: based on the delivery location during transportation (if any), copies are issued to the consignor, only one copy is issued per delivery location.
3. The certificate of quarantine for exported, imported, temporarily imported for re-exported, transferred customs checkpoints, transiting through Vietnam's territory aquatic products and aquatic products is stamped with “ORIGINAL” or “COPY” at the bottom right corner of “Sample: ...”. The number of certificates of quarantine issued is as follows:
a) Certificate of quarantine for exported and imported aquatic products and aquatic products: 02 originals (01 copy retained by the animal quarantine authority, 01 copy issued to the consignor); 02 copies issued to the consignor.
b) Certificate of quarantine for temporarily imported for re-exported, transferred customs checkpoints, transiting through Vietnam's territory aquatic products and aquatic products: 02 originals (01 copy retained by the animal quarantine authority at the import checkpoint, 01 copy issued to the consignor); 02 copies issued to the consignor (01 copy retained by the animal quarantine authority at the export checkpoint, 01 copy returned to the animal quarantine authority at the import checkpoint when processing quarantine for the next consignment).
4. Competent animal quarantine authorities are responsible for printing and using the quarantine document models for aquatic products and aquatic products in accordance with current regulations.
5. Strictly prohibit the printing, issuance, and use of document models contrary to the provisions of this Circular.
Article 6. Validity period of the aquatic product quarantine certificate
1. The validity period of the aquatic product quarantine certificate for domestic transportation shall be calculated based on the transportation time from the place of origin to the final destination.
2. The validity period of the aquatic product quarantine certificates for export and import shall not exceed 60 days.
3. The validity period of the aquatic product quarantine certificates for temporary import for re-export, transfer of customs checkpoints, and transit through the territory of Vietnam shall be calculated based on the maximum allowable residence time within the territory of Vietnam.
Article 7. Authority to conduct quarantine and issue aquatic product quarantine certificates
1. Authority to conduct quarantine and issue aquatic product quarantine certificates for domestic transportation.
a) The District Animal Health Station shall carry out quarantine and issue aquatic product quarantine certificates when transporting within the province.
b) The Provincial Animal Health Sub-Department shall carry out quarantine and issue aquatic product quarantine certificates when transporting outside the province.
c) The delegation of authority to animal quarantine officers to conduct quarantine and issue aquatic product quarantine certificates for domestic transportation shall be carried out in accordance with Clause 2, Article 1 of Decision No. 126.
2. Animal quarantine agencies under the Department of Animal Health and Provincial Animal Health Sub-Departments authorized by the Department of Animal Health (hereinafter referred to as animal quarantine agencies under the Department of Animal Health) shall carry out quarantine and issue aquatic product quarantine certificates for:
a) Aquatic products for export that are not intended for food (for breeding, ornamental purposes, feed, or disease samples) or as gifts, presents, hand-carried items, diplomatic bags at the request of the consignor or importing country;
b) Imported aquatic products, temporarily imported for re-export, temporarily exported for re-import, transferred between customs checkpoints, bonded warehouses, or transiting through the territory of Vietnam.
3. Quality control agencies under the Department of Quality Control of Agricultural, Forestry, and Fishery Products shall carry out quarantine and issue aquatic product quarantine certificates for exported aquatic products intended for food.
Article 8. Veterinary hygiene requirements for quarantine isolation facilities for aquatic products
1. Quarantine isolation breeding facilities:
a) The location of the quarantine isolation facility must facilitate the delineation and containment of outbreaks when diseases occur;
b) Breeding tanks and ponds must facilitate clinical examination and sampling for testing;
c) There must be barriers or walls to prevent direct or indirect contact with external aquatic animals; minimize the impact of environmental conditions on breeding aquatic animals during quarantine isolation;
d) Ponds and tanks must be treated to prevent leakage and water overflow;
e) They must be convenient for cleaning, disinfection, and sterilization before and after each quarantine isolation period;
2. Water used during quarantine isolation:
a) There must be sufficient water meeting veterinary hygiene standards;
b) There must be a separate water supply and drainage system; water from other breeding tanks or ponds must not be used.
3. Feed used during quarantine isolation:
a) There must be sufficient feed meeting veterinary hygiene standards, quality, and suitability for each species of aquatic animal;
b) There must be a separate storage area for feed.
4. There must be sufficient aquatic animal veterinary drugs, chemicals, and biological preparations available during quarantine isolation.
5. Equipment and tools:
a) Breeding equipment and tools must meet veterinary hygiene requirements;
b) They must be cleaned, disinfected, and sterilized before and after each use;
c) Tools and equipment used during quarantine isolation must not be shared.
6. There must be a complete record-keeping system documenting disease status, feed usage, veterinary drug usage, chemical usage, and biological preparation usage during quarantine isolation.
7. There must be measures to treat wastewater and waste to meet hygiene standards before disposal into the environment.
Chapter II
PROCEDURES AND REQUIREMENTS FOR QUARANTINE OF AQUATIC PRODUCTS AND AQUATIC PRODUCT PRODUCTS
PART 1
QUARANTINE OF AQUATIC PRODUCTS AND AQUATIC PRODUCT PRODUCTS FOR DOMESTIC TRANSPORTATION
Article 9. Declaration for aquatic animal quarantine and transport of aquatic products within the country
1. The consignor must declare to the Animal Health Station when transporting within the province or the Animal Health Sub-Department when transporting out of the province. The declaration time is regulated as follows:
a) For aquatic seedlings, declaration must be made at least three days before shipment;
b) For commercial aquatic animals and aquatic products, declaration must be made at least two days before shipment.
2. The declaration dossier includes:
a) Declaration form for aquatic animal quarantine and transport of aquatic products within the country (Form 1);
b) Copy of the certificate of disease-free area or facility where the aquatic animals originate from (if applicable);
c) Copy of the test result report on aquatic animal diseases (if applicable);
d) Permit from the Forest Protection Authority for aquatic animals and aquatic products belonging to species listed in the Catalogue of Endangered and Precious Wild Fauna and Flora under Vietnamese law or Appendices of the CITES Convention.
3. Confirmation of declaration for quarantine:
a) Immediately upon receipt of the dossier as stipulated in Clause 2 of this Article, the animal quarantine authority shall check the declaration content and related documents; if the dossier is incomplete or invalid, the consignor will be guided to complete it according to regulations;
b) Within one working day from the date of receiving a valid dossier, based on the disease situation at the place of origin, the animal quarantine authority confirms the declaration for quarantine, informs the location and time for conducting quarantine, and prepares conditions for quarantine.
Article 10. Quarantine for aquatic seedlings
1. The quarantine shall be carried out immediately at temporary holding tanks of business establishments; breeding ponds of production and trading establishments of aquatic seedlings.
2. Inspection and supervision during quarantine period.
Within one working day from the time the aquatic animals are gathered at the designated location, the animal quarantine authority must conduct quarantine.
a) Check the quantity, type, size of aquatic animals according to the quarantine declaration dossier;
b) Clinical examination
During the quarantine period, if there is suspicion of infectious disease in aquatic animals, the animal quarantine authority will take samples for testing the causative agent (focusing on suspected individuals) according to the List of Quarantine Objects of Aquatic Animals and Products issued together with Decision No. 110/2008/QĐ-BNN dated November 12, 2008 of the Ministry of Agriculture and Rural Development (hereinafter referred to as the List of Quarantine Objects).
c) Take samples for testing and examining diseases listed in the List of Aquatic Diseases that must be declared as epidemics for cases: Aquatic animals used for producing seedlings; aquatic animals of unknown origin at seedling trading establishments.
Within one working day, the animal quarantine authority must send samples to the laboratory for testing disease indicators.
d) For aquatic animals originating from disease-free areas or facilities, there is no need to test for diseases already recognized as safe.
3. Within no more than three working days from the date of receiving samples, the laboratory must notify the quarantine results to the animal quarantine authority.
In case the test results are suspicious, the animal quarantine authority must inform the consignor to take samples for retesting. Within no more than two working days, the laboratory must notify the quarantine results to the animal quarantine authority.
4. Within one working day from the date of receiving all test results, if the aquatic animals meet the veterinary hygiene standards, the animal quarantine authority shall perform:
a) Inspect the veterinary hygiene conditions of the transportation means and accompanying items;
b) Issue a quarantine certificate (Form 4a or 4b) for aquatic seedlings meeting veterinary hygiene standards within twelve hours before transportation.
The quarantine dossier provided to the consignor includes: Registration form for quarantine (given to the consignor), certificate of quarantine for aquatic animals and aquatic products transported within the country, copy of the test result report (if applicable); copy of the certificate of disease-free area or facility where the aquatic animals originate from (if applicable) and other related documents.
c) Carry out or supervise the cleaning and disinfection of transportation means and accompanying items at least six hours before loading for transportation;
d) The animal quarantine officer conducts clinical examination of aquatic animals before loading; monitors and supervises the process of loading aquatic animals onto transportation means;
đ) Guide the consignor to clean and disinfect the quarantine isolation site and the loading site for aquatic animals.
5. For aquatic seedlings caught in the wild.
a) The consignor must declare quarantine according to point a, clause 2 of Article 9 of this Circular to the Animal Health Station (in case of keeping for local use) or the Animal Health Sub-Department (when transporting out of the province).
b) In case of keeping for local use, the animal quarantine authority shall carry out quarantine according to points b and c of clause 2 of this Article. After completing the quarantine, if the aquatic animals meet the veterinary hygiene standards, the animal quarantine authority issues a quarantine certificate allowing their use.
c) In case of transporting out of the province, the animal quarantine authority shall carry out quarantine according to points b and c of clause 2, clauses 3 and 4 of this Article.
6. In case aquatic animals do not meet the veterinary hygiene requirements, the animal quarantine authority will not issue a quarantine certificate and proceed with handling according to regulations.
Article 11. Inspection of Commercial Aquatic Products
1. Aquatic products harvested from breeding facilities without any declared diseases in the locality where there is an outbreak shall be carried out in accordance with the provisions of Clause 1, Point a, Clause 2, Article 10 of this Circular.
a) Clinical symptom examination;
b) Random sampling for testing the disease that has been declared. The sampling for inspection and testing of the disease shall be carried out in accordance with the provisions of Point c, Clause 2, Clause 3, Article 10 of this Circular.
2. Aquatic products harvested from breeding facilities with a declared disease must be processed (cooked by heat, or specific processing methods depending on the type of disease) before being taken out of the declared outbreak area.
3. After inspection, if aquatic products meet the veterinary hygiene standards, the animal quarantine agency shall carry out in accordance with the provisions of Clause 4, Article 10 of this Circular.
4. In cases where aquatic products do not meet the veterinary hygiene requirements, the animal quarantine agency will not issue a health inspection certificate and will proceed to handle according to regulations.
Article 12. Inspection of Aquatic Product Products
1. The inspection shall be conducted immediately at the preliminary processing and storage facilities of the consignor.
2. Inspection and supervision during quarantine period.
Within one working day from the time when aquatic product products are concentrated at the designated location, the animal quarantine agency must conduct the inspection.
a) Checking the quantity and types of aquatic product products according to the declaration form of the consignor.
b) Checking the implementation of regulations on processing aquatic products before they are taken out of the declared outbreak area.
c) Inspecting the packaging, storage conditions of the products, and sensory inspection of aquatic product products.
3. Within one working day from the time when all inspection results are received, if aquatic product products meet the veterinary hygiene standards, the animal quarantine agency shall carry out:
a) In accordance with the provisions of Point a, c, Clause 4, Article 10 of this Circular;
b) Issue a quarantine certificate (Form 4a or 4b) for aquatic seedlings meeting veterinary hygiene standards within twelve hours before transportation.
The inspection dossier issued to the consignor includes: Health inspection registration form (given to the consignor), aquatic product health inspection certificate, aquatic product transport within the country, and other related documents (if any).
c) Supervising the loading process of aquatic product products onto transportation means; sealing the transportation means; implementing or supervising the cleaning, disinfection, and sterilization of the concentration and loading areas.
4. In cases where aquatic product products do not meet the veterinary hygiene requirements, the animal quarantine agency will not issue a health inspection certificate and will proceed to handle according to regulations.
Article 13. Inspection of Aquatic Seed at the Receiving Localities
1. The animal quarantine agency at the receiving locality shall only conduct inspections of aquatic seed at the destination in the following cases:
a) The consignment does not have a health inspection certificate or the health inspection certificate is invalid;
b) The animal quarantine agency discovers substitution or additional aquatic seed without permission from the animal quarantine agency;
c) The animal quarantine agency discovers or suspects that the aquatic seed is diseased.
2. For consignments requiring inspection, the animal quarantine agency shall establish a record, require the consignor to isolate the consignment, and take samples for testing diseases listed in the quarantine objects.
a) If the test results meet the requirements, the animal quarantine agency allows the consignment to be put into use.
b) If the test results do not meet the requirements, the animal quarantine agency shall take measures to handle according to regulations.
PART 2
INSPECTION OF EXPORTED AQUATIC PRODUCTS AND AQUATIC PRODUCT PRODUCTS
Article 14. Declaration for Exported Aquatic Products and Aquatic Product Inspection
1. The consignor must submit a declaration form to the competent authority for inspection at least 10 days (for aquatic products) or 5 days (for aquatic products) before exporting goods, as follows:
a) For exported aquatic products not intended for food: Declare to the animal quarantine agency under the Department of Animal Health.
b) For exported aquatic products intended for food: Declare to the quality control agency under the Department of Quality Control of Forestry, Agriculture and Aquatic Products.
2. The declaration form includes:
a) An inspection declaration form (Form 2);
b) Other relevant documents as stipulated in point b, c, d of Clause 2, Article 9 of this Circular;
c) A copy of the permit from the competent authority for aquaculture for species listed in the List of Conditionally Exported Aquatic Species or the List of Prohibited Exported Aquatic Species;
d) A copy of the permit from the CITES Vietnam agency for aquatic products belonging to species listed in the List of Wild Fauna and Flora Species in Danger of Extinction, Precious, and Rare according to Vietnamese law or specified in the Appendices of the CITES Convention;
đ) A request for inspection criteria from the importing country's competent authority (if applicable);
e) A sample certificate of inspection as required by the importing country's competent authority (if applicable);
3. Confirmation of the declaration for inspection shall be carried out in accordance with the provisions of Clause 3, Article 9 of this Circular.
Article 15. Inspection of Exported Aquatic Products and Aquatic Products
1. Inspection of exported aquatic products shall be conducted in accordance with the provisions of Clause 1, point a, b of Clause 2, Clause 3, points a, c, d, đ of Clause 4 of Article 10; Clauses 1, 2 of Article 11 of this Circular.
2. Inspection of exported aquatic products shall be conducted in accordance with the provisions of Clauses 1, 2, point a, c of Clause 3 of Article 12 of this Circular.
3. Sampling for testing according to the requirements of the importing country.
4. Within one working day from receiving all test results, if the aquatic products and aquatic products meet the veterinary hygiene standards, the animal quarantine agency will issue an aquatic product inspection certificate (Form 5 or a certificate of inspection suitable for the requirements of the importing country).
5. In cases where the consignor or the importing country does not require export inspection: The consignor must carry out domestic transportation inspection in accordance with Articles 10, 11, 12 for aquatic products and aquatic products specified in Clause 1 of Article 3 of this Circular.
6. At the export border gate:
a) The consignor must declare inspection (Form 3) to the animal quarantine agency at the export border gate;
b) The animal quarantine agency at the border gate will check the inspection declaration form, quantity, type, size of aquatic products, weight of aquatic products according to the inspection certificate; health status of aquatic products, veterinary hygiene conditions of aquatic products;
If the inspection declaration form is valid; aquatic products are healthy; aquatic products meet veterinary hygiene requirements, packaged and stored according to regulations, the animal quarantine agency at the border gate completes the inspection procedures for the customs office at the border gate to process clearance formalities. Only change the inspection certificate issued by the animal quarantine agency under the Department of Animal Health if requested by the consignor or the importing country;
c) In case of discovering diseased aquatic products, suspected infectious diseases; aquatic products that do not meet veterinary hygiene conditions, the animal quarantine agency at the border gate will isolate the consignment and notify the issuing agency to handle it according to regulations;
d) Carry out or supervise cleaning, disinfection, and sterilization of loading areas, transport vehicles, packing materials, waste, and related tools after transportation.
PART 3
INSPECTION OF IMPORTED AQUATIC PRODUCTS AND AQUATIC PRODUCTS
Article 16. Registration and declaration for quarantine of imported aquatic products
1. The consignee who wishes to import aquatic products must register for import quarantine with the Animal Health Department.
2. Contents of the registration documents
a) An application form for import quarantine of aquatic products (the consignee may forecast plans to import goods within three months from the date of submitting the quarantine registration application);
b) A notarized copy of the business registration certificate (for enterprises); Enterprises only need to submit the business registration certificate for the first time or after changes or additions to their business activities;
c) A sample of the health inspection certificate or quality certificate issued by the exporting country (as required);
d) Permit from the competent authority for aquaculture for species listed in the Conditional Import List or not included in the General Import List;
đ) Permit from the CITES Vietnam Authority for aquatic products belonging to species listed in the Appendix of the CITES Convention on endangered, precious, and rare wild animals and plants as prescribed by Vietnamese law;
e) Certificate of veterinary hygiene at isolation quarantine facilities for aquatic seedlings (if applicable);
f) HACCP or equivalent certification from the processing facility in the exporting country for imported aquatic products intended for food or food processing ingredients;
g) Other relevant documents related to the imported consignment (as required by the Animal Health Department for specific entities);
3. Within five working days from receiving a valid dossier, based on the aquatic disease situation in the exporting country and domestically, the Animal Health Department shall respond to the consignee and guide the competent authority to inspect veterinary hygiene at isolation quarantine facilities (for aquatic seedlings); animal quarantine authorities to quarantine imported aquatic products and aquatic product imports.
4. After approval by the Animal Health Department, the consignee must declare to the designated animal quarantine authority at least eight days before the arrival of aquatic products at the border gate and four days for aquatic product products to conduct quarantine.
The declaration dossier for import quarantine includes:
a) Quarantine registration form (Form 3); if necessary, the animal quarantine authority may request the consignee to declare additional forms for aquatic product import and export quarantine (Form 2);
b) Reply letter from the Animal Health Department regarding the quarantine of imported aquatic products;
c) Notarized copy of the health inspection certificate or quality certificate of the exporting country (if available);
Within one working day from receiving a valid dossier, the animal quarantine authority will notify the consignee of the quarantine location and time.
Article 17. Quarantine of imported aquatic products at the border gate    
The animal quarantine authority shall perform:
1. Checking the import quarantine dossier:
a) The import quarantine dossier as stipulated in point a, b, d, clause 4, Article 16 of this Circular;
b) Original health inspection certificate or quality certificate from the exporting country, content matching the details of the consignment (regarding type, quantity, weight, size, packaging).
2. Inspecting the actual condition of the imported goods; comparing with the health inspection certificate or quality certificate from the exporting country regarding type, size, quantity, weight, packaging status, and labeling.
3. Inspecting the sanitary conditions, disinfection, and decontamination of transport vehicles; implementing or supervising the consignee's handling of waste and padding generated during transportation.
4. If the imported goods meet the requirements of veterinary hygiene, the health inspection certificate, and other related documents are valid, the animal quarantine authority at the border gate shall implement:
a) Issuing a transport permit for imported aquatic products to the isolation quarantine location (Form 6), allowing the consignee to move the goods to the isolation quarantine location (in cases requiring isolation quarantine) or the receiving facility to conduct quarantine and food safety testing;
b) Issuing a health inspection certificate for imported aquatic products (Form 7) for consignments that do not require isolation quarantine, sampling for disease testing, and veterinary hygiene inspection;
The transport permit for imported aquatic products to the isolation quarantine location (Form 6) or the health inspection certificate for imported aquatic products (Form 7) serves as the basis for customs clearance procedures at the border gate.
5. Guiding the consignee on necessary requirements during the transportation of goods from the border gate to the isolation quarantine location.
6. For imported aquatic products that do not handle customs formalities at the entry border gate but transfer to another customs port or checkpoint, the animal quarantine authority at the entry border gate shall implement:
a) As stipulated in clauses 1, 2, and 3 of this Article;
b) Supervising the loading process of aquatic products onto transport vehicles;
c) Sealing the transport vehicle carrying aquatic products;
d) Implementing or supervising the cleaning, disinfection, and decontamination of the loading area;
đ) Issuing a transport permit for imported aquatic products to the isolation quarantine location (Form 6) and informing the responsible animal quarantine authority at the destination of necessary information about the consignment;
7. In case the dossier is invalid, or the imported aquatic products do not meet the requirements of veterinary hygiene, the animal quarantine authority shall handle according to regulations.
Article 18. Quarantine of imported aquatic animal breeding stock at isolation quarantine facilities
1. On the day of importing aquatic animals into the isolation quarantine facility, the animal quarantine authority shall perform the following tasks:
a) Guide the consignor to bring the aquatic animal breeding stock into the isolation quarantine facility; clean, disinfect and sterilize the transportation means, related tools, waste, and wastewater during transportation;
b) Check the quarantine records that have been confirmed by the animal quarantine authority at the import border gate;
c) Prepare the means and tools for conducting quarantine.
2. At the latest within one working day from the time when the aquatic animals are concentrated at the designated location, the animal quarantine authority must conduct quarantine:
a) Inspect the quantity, species, and size of aquatic animals according to the import quarantine records;
b) Implement as prescribed in point b, Clause 2, Article 10 of this Circular;
c) Within one working day, the animal quarantine authority must send samples to the laboratory for disease testing. The response to the test results is carried out as prescribed in Clause 3, Article 10 of this Circular.
3. After the quarantine isolation period, within one working day from receiving all inspection results, if the aquatic animals meet the veterinary hygiene standards, the animal quarantine authority shall perform the following tasks:
a) Implement as prescribed in points a, c, d, đ, Clause 4, Article 10 of this Circular;
b) Issue an import aquatic animal quarantine certificate (Form 7) allowing them to be put into production and use within twelve hours before transportation to the receiving location;
c) Notify the receiving veterinary authority about the disease situation of the aquatic animals, the disease testing results, and other relevant information.
4. In cases where aquatic products do not meet the veterinary hygiene requirements, the animal quarantine agency will not issue a health inspection certificate and will proceed to handle according to regulations.
Article 19. Quarantine of imported aquatic animals for purposes other than breeding
1. At the import border gate: After inspection, if the quarantine records are valid, the aquatic animals are healthy without signs of infectious diseases, and the transportation means and related items ensure veterinary hygiene, the animal quarantine authority issues an import aquatic animal quarantine certificate (Form 7) for batches not requiring disease sample testing and veterinary hygiene inspection, allowing the consignor to complete customs procedures and put them into use.
2. In cases where aquatic animals are brought to isolation quarantine facilities or processing establishments for quarantine:
a) Conduct quarantine as prescribed in Clauses 1, 2, and 4 of Article 18 of this Circular;
b) After the quarantine isolation period, if the aquatic animals meet the veterinary hygiene standards, the animal quarantine authority issues an import aquatic animal quarantine certificate (Form 7) allowing the consignor to complete customs procedures and put them into use.
3. Only take samples for disease testing if there is suspicion of disease in the aquatic animals (focusing on individuals suspected of being diseased) according to the List of Quarantinable Objects.
Article 20. Quarantine of imported aquatic products
Aquatic products specified in Section 1 and 3 of Appendix 1 of this Circular must be quarantined as follows:
1. The quarantine shall be conducted immediately at the consignor's storage facility.
2. Inspection and supervision during quarantine period.
Within one working day from the time when aquatic product products are concentrated at the designated location, the animal quarantine agency must conduct the inspection.
a) Check the quarantine records of imported aquatic products.
b) Inspect the number of packages, weight, and types of aquatic products according to the import quarantine records.
c) Inspect the packaging condition and storage of aquatic products; only conduct sensory inspection for aquatic products not intended for food processing.
3. Take samples for disease testing and veterinary hygiene indicators as directed in Appendix 1 issued together with this Circular.
Only take samples for disease testing if there is suspicion that the aquatic products carry pathogens listed in the List of Quarantinable Objects. Sampling and reporting test results are carried out as prescribed in point c, Clause 2, Article 18 of this Circular.
4. Within one working day from receiving all inspection results, if the import quarantine records are valid and consistent with the batch, the aquatic products meet veterinary hygiene requirements, and the storage conditions and related items ensure veterinary hygiene, the animal quarantine authority shall issue an import aquatic product quarantine certificate (Form 7) allowing the consignor to complete customs procedures and put them into use.
5. If the aquatic products do not meet veterinary hygiene requirements, the animal quarantine authority will not issue a quarantine certificate and will handle the situation according to regulations.
PART 4
QUARANTINE OF TEMPORARY IMPORT FOR RE-EXPORT, TEMPORARY EXPORT FOR RE-IMPORT, TRANSFER AT BORDER GATES, AND TRANSPORTATION THROUGH VIETNAM'S TERRITORY
Article 21. Registration and declaration for quarantine of aquatic products temporarily imported for re-export, transferred at border gates, or transiting through Vietnam's territory
1. The consignor who wishes to temporarily import for re-export, transfer at border gates, or transit through Vietnam's territory aquatic products or aquatic product products must register for quarantine with the Department of Animal Health. The registration dossier includes:
a) Relevant documents as prescribed in point a, b, đ clause 2 Article 16 of this Circular;
b) Purchase and sale contracts for aquatic products or aquatic product products, or other service contracts.
2. Within five working days from the date of receiving a valid dossier, based on the situation of aquatic animal diseases in the exporting country and domestically, the Department of Animal Health shall be responsible for responding to the consignor and guiding the animal quarantine agency to conduct quarantine.
3. After being approved by the Department of Animal Health, the consignor must register with the designated animal quarantine agency at least four days before the goods arrive at the border gate.
The declaration dossier for quarantine includes:
a) A quarantine declaration form (Form 3);
b) A reply document from the Department of Animal Health regarding the quarantine of aquatic products or aquatic product products temporarily imported for re-export, transferred at border gates, or transiting through Vietnam's territory;
c) A copy of the export country’s quarantine certificate (if available);
d) A copy of the quarantine certificate for aquatic products or aquatic product products temporarily imported for re-export, transferred at border gates, or transiting through Vietnam's territory, confirmed by the animal quarantine agency at the exit border gate for the previous consignment.
Within one working day from the date of receiving a valid quarantine dossier, the animal quarantine agency will notify the consignor of the location and time for quarantine.
Article 22. Quarantine of aquatic products temporarily exported for re-import
1. Quarantine of aquatic products temporarily exported shall be carried out according to the regulations on the quarantine of aquatic products for export;
2. Quarantine of aquatic products upon re-import shall be carried out according to the regulations on the quarantine of aquatic products for import.
Article 23. Quarantine of aquatic products temporarily imported for re-export or transiting through Vietnam's territory
1. At the entry border gate, the animal quarantine agency shall perform:
a) Checking the quarantine dossier as prescribed in point a, b, d, đ clause 3 Article 21 of this Circular; the original export country’s quarantine certificate or relevant permits related to fishing activities for consignments directly caught from fishing grounds;
b) Performing according to the provisions of clauses 2, 3, and 7 Article 17 of this Circular;
c) If the quarantine dossier is valid and the aquatic products meet the veterinary hygiene requirements, the animal quarantine agency at the border gate shall issue a quarantine certificate (Form 8) for the consignor to complete customs procedures;
d) Supervising the loading process of aquatic products onto transport vehicles;
đ) Sealing the transport vehicle carrying aquatic products;
e) Implementing or supervising the cleaning and disinfection of areas where aquatic products are loaded;
f) Guiding the consignor to comply with veterinary hygiene requirements during transportation within Vietnam.
2. During transportation within Vietnam:
a) The consignor must strictly follow the regulations of the animal quarantine agency during the transportation of aquatic products within Vietnam;
b) Transport vehicles must ensure veterinary hygiene conditions and not spill waste along the route;
c) Without permission from the customs authority and the animal quarantine agency, the consignor may not unload or change transport vehicles arbitrarily;
d) Without permission, the consignor may not alter the route or stop at unauthorized locations;
In case the transport vehicle does not follow the specified route or stops at unauthorized locations, the consignor must keep the goods intact on the vehicle and report to the nearest veterinary authority. Only after the veterinary authority has taken appropriate measures can the transport continue;
đ) Aquatic product carcasses, waste, wastewater, leftover feed, packaging materials, and other waste generated during transportation must be disposed of at designated locations as directed by the competent veterinary authority and not discarded at railway stations, ports, or along the transport route;
3. At the exit border gate:
a) The animal quarantine agency shall perform according to the provisions of point a, c, d clause 6 Article 15 of this Circular;
b) If the quarantine dossier is valid and the aquatic products meet veterinary hygiene requirements, the animal quarantine agency at the border gate shall confirm the quantity of goods exported (Form 8) for the consignor to complete customs procedures and submit back to the entry border gate quarantine agency when importing subsequent consignments.
4. In case the goods are transported in containers or other enclosed means of transport:
a) If the quarantine dossier is valid and the transport vehicle meets veterinary hygiene requirements, the quarantine certificate will be issued and the goods will be allowed to pass through the border gate;
b) In case there is suspicion that the aquatic products are diseased or do not meet veterinary hygiene requirements, the animal quarantine agency will cooperate with the customs authority to request the consignor to open the container or break the seal in the presence of the consignor for inspection. The location for opening the container must meet veterinary hygiene conditions and facilitate cargo handling, as determined by the animal quarantine agency;
c) In case the aquatic products do not meet veterinary hygiene requirements, the animal quarantine agency will take appropriate measures as prescribed.
Article 24. Quarantine of aquatic products and aquatic product consignments transferred at border gates
1. In cases where aquatic products and aquatic product consignments transferred at border gates are stored in bonded warehouses but not transported on Vietnamese territory:
a) Carry out quarantine in accordance with the provisions of points a, c, and e of Clause 1 of Article 23 of this Circular;
b) Carry out quarantine in accordance with the provisions of Clauses 2 and 7 of Article 17 of this Circular;
c) Supervise the loading and unloading process of aquatic products and aquatic products and during their storage time in bonded warehouses;
d) Implement or supervise the cleaning, disinfection, and sterilization of loading areas and aquatic product storage warehouses;
2. In cases where aquatic products and aquatic product consignments transferred at border gates are transported on Vietnamese territory, the animal quarantine authority shall implement in accordance with the provisions of Article 23 of this Circular.
SECTION 5
QUARANTINE OF AQUATIC PRODUCTS AND AQUATIC PRODUCT CONSIGNMENTS SENT BY POST; CARRIED BY PERSONS THROUGH BORDER GATES; RECEIVING AND SENDING SAMPLES
Article 25. Quarantine of aquatic products and aquatic product consignments for export carried by persons or sent by post
1. The consignor must submit a registration form for quarantine to the animal quarantine authority in accordance with the provisions of Article 14 of this Circular;
2. The quarantine procedures are carried out as follows:
a) For aquatic products: Clinical examination; sampling for testing diseases as required by the consignor or the importing country;
b) For aquatic products: Sensory inspection; sampling for testing veterinary hygiene indicators as required by the consignor or the importing country;
c) Guide the consignor to hold aquatic products in quarantine, package aquatic products in accordance with regulations, seal or mark the consignment, and issue a health certificate for aquatic products and aquatic products that meet veterinary hygiene standards;
d) Guide the consignor to handle aquatic products and aquatic products that do not meet veterinary hygiene standards for export.
Article 26. Quarantine of aquatic products and aquatic product consignments for import carried by persons or sent by post
1. When importing aquatic products and aquatic products not for commercial purposes, the consignor must register for import quarantine with the animal quarantine authority at the border gate.
2. The quarantine procedures are carried out as follows:
a) Check the quarantine documentation and health certificates from the exporting country; compare with the types, quantities, and volumes of imported goods;
b) Inspect the actual condition of the consignment; the breeding conditions of aquatic products; packaging and preservation of aquatic products;
c) If species of aquatic products not listed in the list of commonly imported aquatic species, diseased aquatic products, or aquatic products showing signs of deterioration are found, they will be destroyed or returned to the exporting country;
d) After inspection, healthy aquatic products and aquatic products meeting veterinary hygiene requirements will be held in quarantine, packaged, and preserved according to regulations, and the animal quarantine authority will issue an import quarantine certificate (Form 7) for the consignor to complete customs and postal procedures.
3. It is prohibited to carry live aquatic products.
Article 27. Receiving and Sending Disease Samples
1. Consignors who request to send disease samples abroad or import them into Vietnam must register for quarantine with the Department of Animal Health. The registration dossier includes:
a) Application for sending and receiving disease samples;
b) Permit from the CITES Vietnam agency for disease samples originating from aquatic species or aquatic products belonging to species listed in the Vietnam Law's List of Wild Animals and Plants in Danger of Extinction, Precious, and Rare Species or listed in the Appendices of the CITES Convention.
2. Within five working days from receipt of a valid dossier, the Department of Animal Health has the responsibility to respond to the consignor and guide the animal quarantine authority to conduct quarantine.
3. After approval by the Department of Animal Health, the consignor must declare quarantine to the designated animal quarantine authority at least five days before receiving or sending disease samples.
4. Sending disease samples.
The animal quarantine authority shall perform:
a) Check the approval document from the Department of Animal Health and other related documents;
b) Supervise the collection of disease samples; ensure packaging and preservation of disease samples to prevent spillage, breakage, and spread of pathogens during transportation;
c) Seal the containers holding the disease samples before transportation;
d) Issue an export quarantine certificate after the disease samples have been properly packaged and preserved to meet veterinary hygiene requirements.
5. Receiving disease samples.
The animal quarantine authority at the border gate shall perform:
a) Check the dossier in accordance with point a of Clause 4 of this Article;
b) Inspect the actual condition of the packaging and preservation of the disease samples;
c) Issue an import quarantine certificate after checking a valid dossier and ensuring that the disease samples are properly packaged and preserved to meet veterinary hygiene requirements;
d) In case disease samples are imported into Vietnam without approval from the Department of Animal Health or if the packaging and preservation do not meet veterinary hygiene requirements and pose a risk of spreading pathogens and environmental pollution, the animal quarantine authority at the border gate shall prepare a record and destroy all disease samples in the area near the border gate.
Chapter III
IMPLEMENTING PROVISIONS
Article 28. Implementation Organization
1. The Department of Animal Health is responsible for:
a) Guiding the animal quarantine authorities under the Department of Animal Health and provincial Animal Health Centers to organize the implementation of aquatic product and aquatic product quarantine in accordance with this Circular;
b) Providing specific guidance on the procedures for registering quarantine for imported aquatic products and aquatic products, temporary import for re-export, temporary export for re-import, transfer at border gates, bonded warehouses, and transit through Vietnamese territory in accordance with this Circular.
2. Animal quarantine authorities under the Department of Animal Health
a) Organize the implementation of quarantine for imported aquatic products and aquatic products, temporary import for re-export, temporary export for re-import, transfer at border gates, bonded warehouses, and transit through Vietnamese territory in accordance with this Circular.
b) Control quarantine procedures for all types of aquatic products and aquatic products at border gates, airports, seaports, and post offices in accordance with Vietnamese law, international organization regulations, or bilateral agreements with countries.
c) In the case of consignments of aquatic products imported for processing before being put on the market, which are subject to both quarantine inspection and quality testing, the animal quarantine agency under the Department of Animal Health shall notify the quality testing agency under the Department of Quality Management of Forestry, Agriculture, and Aquatic Products to simultaneously take samples for quarantine inspection and quality testing and certification of food safety.
For these consignments, the Customs authority will only process clearance procedures when there are two types of certificates: The quarantine certificate issued by the animal quarantine agency under the Department of Animal Health and the registration for quality testing and certification of food safety hygiene issued by the quality testing agency under the Department of Quality Management of Forestry, Agriculture, and Aquatic Products, with confirmation from said agency.
d) Coordinate with relevant agencies (Customs, Port Authority, Border Guard Force, Police, Market Management, Post Office, etc.) in carrying out the tasks of aquatic product quarantine and product quarantine.
3. Provincial Animal Health Inspection Division:
a) Organize the implementation of aquatic product quarantine and product quarantine during domestic transportation according to this Circular and guidance from the Department of Animal Health.
b) Coordinate with the animal quarantine agency under the Department of Animal Health to inspect the sanitary conditions at isolation facilities for imported aquatic breeding stock.
3. Responsibilities of the Department of Quality Management of Forestry, Agriculture, and Aquatic Products and its affiliated quality testing agencies:
a) The Department of Quality Management of Forestry, Agriculture, and Aquatic Products is responsible for guiding its affiliated quality testing agencies in organizing the implementation of aquatic product quarantine and product quarantine for export as food according to this Circular.
b) The quality testing agencies under the Department of Quality Management of Forestry, Agriculture, and Aquatic Products are responsible for organizing the implementation of aquatic product quarantine and product quarantine for export as food according to this Circular; coordinate with the animal quarantine agencies under the Department of Animal Health to simultaneously take samples for testing and certifying food safety for imported aquatic products and products intended as raw materials for food processing.
3. Responsibilities of the consignor:
a) Comply with laws and regulations on veterinary matters and other related laws in the quarantine of aquatic products and products.
b) Pay fees and charges for quarantine inspections as stipulated by the Ministry of Finance and actual expenses for handling and destroying consignments that fail to meet requirements as stipulated.
Article 29. Effective Date
This Circular shall take effect forty-five days from the date of signature.
During implementation, if any difficulties arise, please report to the Ministry of Agriculture and Rural Development for research and resolution./.
