JOINT CIRCULAR

Regulations on standards, tasks, working conditions, and policies for lecturers at training and development institutions under the Ministry,

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Clause 3, Article 18 of Decree No. 18/2010/NĐ-CP dated March 5, 2010 of the Government on civil servant training and development stipulating that "the Ministry of Home Affairs, the Ministry of Education and Training, and the Ministry of Finance shall provide detailed guidance on standards, working conditions, and policies for lecturers at training and development institutions under ministries, agencies equivalent to ministries, government agencies, provincial political schools directly under the central government, and foreign lecturers";

The Ministry of Home Affairs and the Ministry of Education and Training jointly issue the following detailed guidance:

Chapter 1

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular provides detailed guidance on standards, tasks, working conditions, and policies for lecturers at training and development institutions under ministries, agencies equivalent to ministries, government agencies, provincial political schools directly under the central government (hereinafter referred to collectively as training and development institutions).

2. This Circular applies to lecturers and persons invited to teach under contracts at academies, schools, and centers for cadre and civil servant training and development under ministries, agencies equivalent to ministries, government agencies, provincial political schools directly under the central government.

Article 2. Purpose

1. To enable lecturers to proactively develop teaching plans, scientific research, and further education to improve their professional qualifications and continuously meet job standards.

2. To provide heads of training and development institutions with grounds for recruitment recommendations; assignment, deployment, utilization, assessment, and evaluation of labor to ensure effective performance of tasks and work; enhance management effectiveness and labor quality and efficiency.

3. To ensure transparency, fairness, and democracy in the implementation of policies, rights, and obligations of lecturers.

4. To improve the quality and effectiveness of cadre and civil servant training and development programs to meet the requirements of enhancing the capabilities of the cadre and civil servant workforce.

5. To assist management agencies of training and development institutions in inspection, audit, evaluation, and the development of lecturer training and development programs and systems.

Chapter 2

STANDARDS AND TASKS OF LECTURERS

Article 3. General Standards

1. Loyalty to the Socialist Republic of Vietnam.

2. Firm political qualities and healthy lifestyle.

3. Meeting the educational qualification standards from bachelor's degree upwards as prescribed for the position, suitable to the subject and specialty taught.

4. Possessing theoretical political knowledge, state administration, computer skills, foreign language proficiency, and pedagogical expertise to meet assigned tasks.

5. Having adequate health for the profession.

6. Having a clear personal record meeting political requirements.

Article 4. Specific Standards

1. Lecturer:

a) Holding a bachelor's degree in education or higher, or a bachelor's degree or higher in a relevant field with a certificate of pedagogical training;

b) Having a foreign language proficiency level B or higher;

c) Having computer skills level B or higher;

d) Having a mid-level theoretical political knowledge - administrative certificate or mid-level theoretical political knowledge certificate and a certificate of state administration knowledge training as prescribed.

2. Principal Teacher:

a) Holding a master's degree or higher in a relevant field;

b) Having a foreign language proficiency level C or higher, and computer skills level C or higher;

c) Having the ability to design, develop training and development plans and programs, and compile course materials and reference materials for training and development;

d) Having a research project or topic recognized and applied effectively by a department or training and development institution;

đ) Having a high-level theoretical political knowledge - administrative certificate or high-level theoretical political knowledge certificate and a certificate of state administration knowledge training as prescribed.

3. Senior Lecturer:

a) Holding a doctoral degree;

b) Having a foreign language proficiency level C or higher, and computer skills level C or higher;

c) Having a research project or innovative work recognized by a scientific council and effectively applied at the provincial or ministerial level or higher;

d) Having a high-level theoretical political knowledge - administrative certificate or high-level theoretical political knowledge certificate and a certificate of state administration knowledge training as prescribed.

Article 5. Teaching Duties

1. Teaching Preparation:

- Research to thoroughly understand the objectives, content, curriculum, teaching methods, position, requirements of the assigned subjects, examination regulations, testing, and evaluation results of students;

- Develop teaching plans, course outlines, lectures, and design materials and databases for teaching purposes.

2. Deliver lectures, guide students in self-study skills, scientific discussions, practical activities, writing term papers, graduation internships, and constructing thesis outlines and graduation theses.

3. Understand the level, knowledge, and understanding of students; regularly update information to process, supplement, complete, and improve the content, plans, teaching methods, and databases for teaching purposes.

4. Implementing the process of evaluating student learning outcomes and guiding students to evaluate teaching activities.

5. Attend classes and participate in evaluating the teaching activities of other lecturers according to the training institution's regulations.

Article 6. Scientific and Technological Research Duties

1. Lead or participate in implementing research programs, projects, and topics assigned and achieve specific results recognized by the Science Council as meeting or exceeding requirements.

2. Conduct scientific and technological research to develop training programs and capacity building; participate in developing programs, compiling teaching materials, and reference materials for training and capacity building; improve teaching methods and assessment techniques for assigned courses and topics within the training and capacity building curriculum.

3. Write articles for scientific journals, write special topics, and scientific reports for presentations at conferences and seminars as assigned.

4. Implement the process of evaluating the results of students' scientific research; participate in the quality assessment and accreditation processes for training and development.

5. Participate in international cooperation activities related to scientific research, technological development, and other scientific activities when assigned.

Article 7. Duties in Participating in Training Management, Capacity Building, Scientific Research, Party Work, Mass Organizations, and Other Activities

1. Participating in building, implementing, and monitoring the execution of teaching and learning plans of the training institution.

2. Perform other tasks such as enrollment, admissions, class management, internship supervision, laboratory management; manage departments, rooms, subjects; manage science and technology; party work, mass organizations, social activities at training and capacity building institutions, and other tasks when authorized by competent authorities.

Article 8. Duties in Studying and Enhancing Professional Competence

1. Engage in studying and enhancing professional competence, political theory, state administration, foreign languages, computer skills, and teaching methods to strengthen work capabilities to meet the requirements of reform and improve the quality of training and capacity building for cadres and civil servants, which is a regular task.

2. Have the responsibility to implement when the training and capacity building institution sends them for further education and training to achieve the required qualifications and academic degrees or higher standards for their current positions, ensuring the criteria for appointment to new positions.

3. Annually, the training and capacity building institution organizes them to conduct practical research, supplement practical knowledge into lectures, and enhance leadership and management problem-solving skills.

Chapter 3

WORKING REGIME AND POLICIES FOR TEACHERS

Article 9. Working Regime and Standard Teaching Hours for Teachers, Senior Lecturers, and Professors

1. The working hours of teachers, senior lecturers, and professors follow a weekly 40-hour work schedule; the annual total working hours quota is 1,760 hours.

2. Annual workload standards according to each task, for each specific position are as follows:

Article 10. Standard Teaching Hours, Standard Teaching Hour Quotas, and Conversion to Standard Teaching Hours

1. Standard Teaching Hours: Is the unit of time converted from the number of labor hours necessary to complete a certain amount of work within the teaching duties for each corresponding position, equivalent to one theoretical or practical classroom session, including the necessary labor time before, during, and after the session.

2. The framework for standard teaching hour quotas is converted from the teaching time fund stipulated in Clause 2, Article 9 of this Circular for each specified position as follows:

a) Teacher: 280 standard hours;

b) Senior Lecturer: 300 standard hours;

c) Professor: 320 standard hours.

The head of the training and capacity building institution specifies the standard teaching hour quota for each teacher in accordance with the actual situation of their unit but not exceeding or falling below 15% of the above-mentioned standard teaching hour quota framework.

3. Conversion of time spent on the following tasks to standard hours:

a) One class lecture, guiding situational exercises, discussion, answering questions on a subject, guiding review in class is counted as 1 standard teaching hour;

b) One seminar presentation is counted from 1.0 to 1.5 standard teaching hours;

c) One practical guidance session is counted as 0.5 to 1 standard hour;

d) Guidance for a day's internship is counted as 1.5 to 2 standard hours;

đ) Guidance for a student's final thesis is counted as 12 to 15 standard hours per thesis; guidance for a student's term paper is counted as 2 to 4 standard hours; reading and evaluating a student's final thesis is counted as 4 standard hours;

e) Guidance for a day's practical experience is counted as 3 to 4 standard hours;

f) The head of the training and capacity building institution bases on the framework provisions in Points b, c, d, đ, e, Clause 3, Article 10 of this Circular and according to the requirements of each program to specify the details for each teacher position.

4. Conversion of time spent on other professional tasks to standard hours:

a) Preparing test questions and exam questions:

- One written test question with answers is counted as 1 to 1.5 standard hours;

- One multiple-choice test question with answers is counted as 1.5 to 2 standard hours;

- One oral test question with answers is counted as 1 to 1.5 standard hours.

b) Supervising tests and exams: 1 hour is counted as 0.5 standard hours.

c) Grading tests and exams:

- Each lecturer grades 4 to 6 written test papers or exam papers and counts as 1 standard hour;

- Each lecturer grades 8 to 10 multiple-choice test papers or exam papers and counts as 1 standard hour;

- Each lecturer grades one oral test or practical exam and counts as 0.5 standard hour;

- The Chairman of the Exam Committee grades one session and counts as 2 standard hours; the Vice-Chairman and Secretary of the Exam Committee grade one session and count as 1 standard hour.

d) Based on the above provisions, the head of the training and capacity building institution converts the time spent on preparing test questions and exam questions; grading tests and exams into standard hours for each training and capacity building program to be consistent with the requirements of each program and actual conditions.

Article 11. Management and utilization of working time for performing scientific research tasks and other activities

1. The head of the training and development institution shall assign scientific research tasks commensurate with the lecturers' capabilities, depending on the institution's capacity, conditions, and orientation for scientific and technological activities, and consider it as one of the bases for annual classification of civil servants.

2. In each academic year, each lecturer must complete the assigned scientific research tasks corresponding to their title or position and the time quota specified in Clause 2, Article 9 of this Circular. Lecturers who fail to complete their scientific research tasks will have the time allocated for scientific research converted into standard hours to offset the number of teaching hours or other specialized tasks exceeding the standard hour quota when calculating overtime pay.

3. In cases where lecturers with sufficient capability and conditions need to be mobilized for scientific research work, the head of the training and development institution shall decide to convert the teaching time stipulated in Clause 2, Article 9 of this Circular into scientific research time for those mobilized lecturers; simultaneously, the head of the training and development institution shall specify the conversion of scientific research time into standard teaching hours for application to lecturers not performing scientific research tasks; they must directly teach in class.

Article 12. Application of Standard Hour Quotas

1. Lecturers during their initial employment contract period or probationary period at the training and development institution shall only perform up to 50% of the standard teaching hour quota for their lecturer title as specified in Point a, Clause 2, Article 10 of this Circular.

2. Lecturers who exceed the standard hour quota through teaching, scientific research, and other professional activities shall be entitled to overtime pay for the excess hours, but not more than 200 standard hours per year.

3. Lecturers responsible for class management shall have their standard teaching hours reduced by 5% for each class they manage.

4. Female lecturers with children under 36 months old shall have their standard hour quota reduced by 10%.

Article 13. Policies for Lecturers

1. Lecturers at training and development institutions shall enjoy salary, job incentive allowances, teaching allowances, overtime pay, and other allowances as prescribed by the State for university lecturers; they shall also benefit from training and development programs to enhance their knowledge and professional skills.

2. Annual leave for lecturers includes weekends, holiday breaks, public holidays, and annual leave (or summer break) as prescribed by law. Based on the academic year plan and specific conditions, the head of the training and development institution shall reasonably arrange annual leave (or summer break) for lecturers.

3. They shall be eligible for consideration for the titles "People's Teacher" and "Outstanding Teacher," and for appointment or dismissal of professor and associate professor positions according to State regulations applicable to university lecturers.

Chapter 4

LECTURERS HOLDING LEADERSHIP AND MANAGEMENT POSITIONS, DUAL-DUTY WORK IN PARTY AND YOUTH UNION AFFAIRS, AND GUEST LECTURERS

ORGANIZATIONS AND INVITED LECTURERS

Article 14. Standard teaching hours for lecturers appointed to leadership or management positions or concurrently holding party or mass organization work

1. Lecturers appointed to leadership or management positions or concurrently holding party or mass organization work shall implement teaching according to the following standard hour framework (calculated as a percentage of the annual standard teaching hour quota prescribed for the lecturer position):

2. Those appointed to leadership or management positions without holding a lecturer position shall not be subject to the standard teaching hour quota prescribed in Clause 1 of this Article.

3. If a lecturer holds multiple leadership positions or concurrently holds multiple party or mass organization positions, they shall only implement the lowest teaching hour standard.

Article 15. Domestic Visiting Lecturers

1. Criteria and tasks:

a) Ensuring the general criteria set forth in Article 3 of this Circular;

b) Fulfilling teaching tasks according to the content stipulated in the contract signed with the training or capacity-building institution.

2. Registration, approval, and management of visiting lecturers

The registration, approval, and management of visiting lecturers must comply with the following principles:

a) The training or capacity-building institution publicly announces the need for visiting lecturers and sends a written notice to the competent authority and relevant agencies and organizations so that eligible individuals can register;

b) The head of the training or capacity-building institution approves the list of visiting lecturers based on reviewing the registration files and sends a written report to the competent authority;

c) When there is a need for visiting lecturers, the training or capacity-building institution bases on the approved list of visiting lecturers to invite them to sign contracts;

d) State officials who violate discipline with penalties from warning upwards shall not be allowed to serve as visiting lecturers at training or capacity-building institutions during the period of disciplinary action.

3. Benefits and rights for visiting lecturers:

a) Visiting lecturers are entitled to benefits based on the contract signed with the training or capacity-building institution and in accordance with state regulations;

b) Visiting lecturers are entitled to training and capacity-building programs to enhance their qualifications and pedagogical methods provided by the training or capacity-building institution (if applicable); they may be considered for appointment to associate professor or professor positions if they meet current requirements; they may be nominated for the titles of "People's Teacher" or "Outstanding Teacher."

Article 16. Foreign Visiting Lecturers

1. Training or capacity-building institutions may invite foreign lecturers to meet the needs of improving training quality. Inviting foreign lecturers must be based on practical requirements, be financially feasible for the unit, and comply with state regulations.

2. Foreigners invited to teach must have a political stance consistent with the political system of the Socialist Republic of Vietnam, comply with Vietnamese laws, and possess the capability to meet teaching requirements and improve training quality.

Chapter 5

IMPLEMENTATION

Article 17. Responsibilities of Ministries, Agencies Equivalent to Ministries, Government Agencies, and People's Committees of Provinces and Cities Directly Under the Central Government

1. Implementing this Joint Circular within their respective ministries, agencies, or localities; directing and organizing inspections of the implementation of lecturer standards, systems, and policies at training or capacity-building institutions under their jurisdiction;

2. Specifying detailed management of visiting lecturer teams and the dispatching of civil servants as visiting lecturers at training or capacity-building institutions under their jurisdiction;

3. Based on the provisions of this Joint Circular, the Ministers, Heads of agencies equivalent to ministries, government agencies, and Chairpersons of provincial and city people's committees directly under the central government are responsible for guiding the specific application for other training or capacity-building institutions under the jurisdiction of their departments, sectors, and localities.

Article 18. Responsibilities of training and retraining institutions

The heads of training and retraining institutions shall base on this Circular to issue regulations detailing the implementation of provisions on standards, management principles, working regimes, and converting lecturers' activities into standard hours, in accordance with their specific conditions, and organize the implementation thereof.

Article 19. Implementation Provisions

This Circular takes effect from August 1, 2011.

During the process of implementation, if there are difficulties, obstacles, or suggestions, training and retraining institutions and organizations are requested to report in writing to the Ministry of Home Affairs and the Ministry of Education and Training for consideration and resolution.
