On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Based on the Law on Public Officials dated November 29, 2010;

Pursuant to Decree No. 34/2011/ND-CP dated May 17, 2011 of the Government on disciplinary measures against civil servants;

Based on Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code regarding labor discipline and material responsibility, and Decree No. 33/2003/NĐ-CP dated February 4, 2003 of the Government supplementing certain provisions of Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code regarding labor discipline and material responsibility;

Based on Decree No. 34/2010/NĐ-CP dated April 2, 2010 of the Government on administrative penalties for violations in the field of road traffic;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport issues this Circular to regulate responsibilities and handling of violations in training, examination, and issuance of motor vehicle driver's licenses (hereinafter referred to as training, examination, and issuance of driver's licenses),

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular regulates responsibilities and handling of violations in training, examination, and issuance of driver's licenses that are not subject to administrative penalties or criminal proceedings.

2. This Circular applies to agencies, organizations, and individuals related to training, examination, and issuance of driver's licenses; work related to auditing, inspection, supervision, and examination of training, examination, and issuance of driver's licenses throughout the country.

3. This Circular does not apply to agencies, organizations, and individuals related to training, examination, and issuance of driver's licenses for military and police forces performing national defense and security duties.

Article 2. Agencies, organizations, and individuals related to training, examination, and issuance of driver's licenses

1. Ministry of Transport.

2. Ministries and sectors with driving training facilities.

Article 3. Expenses deductible when determining corporate income taxable income for funds supporting mobile lottery sellers

4. Vietnam Highway Administration; units managing training and examination under the Administration.

5. Departments of Transport of provinces and centrally governed cities; units managing training and examination under the Department.

6. Examination boards, examination teams, and examination supervision teams (hereinafter collectively referred to as examination boards, examination teams, and supervision teams).

7. Direct superior agencies of driving training facilities.

8. Driving training facilities.

9. Driving examination centers.

10. Other organizations and individuals related to training, examination, and issuance of driver's licenses; work related to auditing, inspection, supervision, and examination of training, examination, and issuance of driver's licenses.

Chapter II

RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS RELATED TO

TRAINING, EXAMINATION, AND ISSUANCE OF DRIVER'S LICENSES

Section 1

RESPONSIBILITIES OF AGENCIES AND ORGANIZATIONS

Article 3. Ministry of Transport

Is responsible before the Government for implementing state management over the field of training, examination, and issuance of driver's licenses.

Article 4. People's Committees of provinces and centrally governed cities and other ministries and sectors with driving training facilities

1. People's Committees of centrally governed cities and provinces:

a) Direct the Department of Transport and relevant sectors at the local level to implement training, examination, and issuance of driver's licenses according to regulations;

b) Direct the auditing, inspection of training, examination, and issuance of driver's licenses within their jurisdiction; handle violations within their authority.

2. Other ministries and sectors with driving training facilities:

a) Direct driving training facilities to comply with legal regulations on training, examination, and issuance of driver's licenses;

b) Direct the auditing, inspection of driving training within their jurisdiction; handle violations within their authority.

Article 5. Vietnam Highway Administration

Organizes the management work of training, examination, and issuing driving licenses throughout the country according to the分级授权 of the Ministry of Transport.

Article 6. Training, Examination, and Issuing Driving License Management Units of the Vietnam Highway Administration

1. Develops and reports to the Director of the Vietnam Highway Administration for submission to the Minister of Transport to establish regulations on training, examination, issuance, renewal, and revocation of driving licenses for drivers of road motor vehicles; establishes regulations on issuing certificates of traffic law knowledge enhancement for motorcycle operators participating in traffic and guides the implementation thereof.

2. Develops and reports to the Director of the Vietnam Highway Administration for submission to the Minister of Transport to establish national technical standards for driving examination centers; issues certificates of qualification for driving examination centers to operate according to the provisions of the law and guides, monitors the implementation thereof.

3. Organizes the issuance of new and renewed driving instructor licenses for automobile driving training institutions nationwide according to specified standards.

4. Organize training and issue examiner cards for the national pool of examiners according to established criteria.

6. Organize the inspection of training, examination, issuance of driving licenses, and handling of violations in accordance with regulations.

Article 7. Department of Transport

Organizes the management work of training, organizing examinations, and issuing driving licenses within the province or centrally-administered city according to the stipulated regulations.

Article 8. Training, Examination, and Issuing Driving License Management Units of the Department of Transport

1. Advises the Director of the Department of Transport to organize the management work of training, examination, and issuing driving licenses for relevant subjects at the local level according to the stipulated regulations.

2. Organizes the inspection work of training institutions, driving examination centers; takes measures to prevent violations and corruption in ensuring the content and program of training; collection and expenditure of tuition fees, examination fees for issuing driving licenses; promptly reports to the Director of the Department of Transport to handle violations within the authority or reports to competent authorities for handling.

3. Manage the team of examiners of the Department, promptly report violations of examiners for the Director of the Department of Transport to consider and handle in accordance with regulations.

4. Organizes the issuance of driving instructor licenses from category A1 to A4, adjusts the volume of automobile driving training according to the stipulated regulations.

5. Organizes training and issues certificates of practical driving instructors for teachers managed by the Department of Transport according to the stipulated content and program.

6. Proposes to the Director of the Department of Transport to report to competent authorities and the Vietnam Highway Administration for approval of investment plans for building new automobile driving training institutions and automobile driving examination centers.

7. Stores records and documents related to the management of training, examination, and issuing driving licenses according to the stipulated regulations.

Article 9. Examination Board, Examination Team

1. Organizes driving examinations according to the stipulated regulations.

2. Bears responsibility for violations by members of the examination board and examiners during the examination period.

3. Promptly handles violations by organizations and individuals during the examination period within the authority or reports to competent authorities for handling according to the stipulated regulations.

Article 10. Supervisory Team

1. Monitors the examination boards, examination teams, and examiners in implementing the examination procedures and content according to the stipulated regulations.

2. Monitors the conditions to ensure that the organization and implementation of examinations by examination boards and teams are transparent, fair, and impartial during the examination process.

Article 11. The direct superior administrative body of driving training institutions

1. Shall be responsible for managing the organizational structure and activities of subordinate driving training institutions in accordance with current regulations.

2. Shall create conditions for driving training institutions to invest in enhancing material infrastructure and equipment serving teaching and learning; train the teaching staff and improve management skills related to training at these institutions; regularly instruct the institutions to strictly comply with regulations on driving training.

3. Shall organize inspections of training activities, issuance of vocational certificates, and graduation certificates for learners.

Article 12. Driving Training Institutions

1. Shall organize admissions according to the categories of driver's licenses permitted for training; ensure the conditions stipulated for learners regarding age, health, experience, and safe driving distance.

2. Shall organize new training and upgrading of driver's license categories according to the volume, duration, location, and category of driver's license specified in the driver training permit and prescribed curriculum and textbooks.

3. Shall sign and terminate training contracts with automobile driving learners in accordance with regulations; publicly disclose admission conditions, training programs, tuition fees, examination fees, and license issuance fees; collect and utilize tuition fees for driving training in accordance with current regulations.

4. Shall organize examinations and issue initial vocational certificates or graduation certificates for driving learners; submit reports on driving training, examination registration, and requests to organize examination periods as prescribed.

5. Shall store relevant files and documents in accordance with state regulations on vocational training management and current regulations.

6. Shall ensure technical and professional standards of the driving training institution.

7. Shall ensure the required number and standards of instructors and practice vehicles for each category as specified in the driver training permit.

8. Shall conduct driving training at the locations specified in the driver training permit; engage in joint ventures and collaborations in driving training in compliance with regulations.

Article 13. Driving Examination Centers

1. Shall ensure material infrastructure, equipment, and inspection devices operate accurately as prescribed. Shall promptly report to the Department of Transport, Vietnam Highway Administration when changing or supplementing examination equipment and vehicles.

2. Shall not arbitrarily change or use examination software, scoring devices, or types of examination vehicles without approval from competent state authorities.

3. Shall implement measures and organize to ensure safety during driving examinations at the center; cooperate with related organizations and individuals to address accidents occurring at the center.

4. Shall ensure that examination boards conduct examinations according to plans and safely; ensure safety during driving examinations; coordinate with related units and agencies to resolve incidents.

5. Shall comply with inspection and standardization of driving examination centers in accordance with national technical standards for motor vehicle driving examination centers.

6. Shall publicize examination fee rates and prices for other services as prescribed.

7. Shall implement reporting systems, network information connections with examination management bodies, and store records as prescribed.

Section 2

RESPONSIBILITIES OF INDIVIDUALS

Article 14. Director of the Vietnam Highway Administration

1. Shall be responsible to the Minister of Transport and to the law for organizing the implementation of driver training, examination, and issuance of driving licenses nationwide.

2. Shall be responsible to the Minister of Transport and to the law for issuing permits for automobile driving instruction and certificates for examination centers meeting the required conditions.

3. Shall organize inspections and checks, and take measures to prevent and promptly address violations by agencies, organizations, and individuals in driver training, examination, and issuance of driving licenses within their authority.

Article 15. Heads of units managing driver training, examination, and issuance of driving licenses under the Vietnam Highway Administration

1. Shall be responsible to the Director of the Vietnam Highway Administration and to the law for organizing the implementation of driver training, examination, and issuance of driving licenses according to assigned tasks.

2. Shall study and develop a system of regulatory legal documents on driver training, examination, and issuance of driving licenses to submit to the Director of the Vietnam Highway Administration for submission to competent authorities for promulgation; shall advise the Director of the Vietnam Highway Administration on directing and organizing the implementation of driver training, examination, and issuance of driving licenses nationwide.

Article 16. Director of the Department of Transport

1. Shall be responsible to the Chairman of the People's Committee of the province or centrally governed city, the Minister of Transport, and to the law for organizing the implementation of driver training, examination, and issuance of driving licenses at the local level as prescribed by the Ministry of Transport.

2. Shall be responsible to the Minister of Transport and to the law for issuing permits for motorcycle driving instruction and certificates for examination centers meeting the required conditions.

3. Shall organize inspections and checks, and take measures to prevent and promptly address violations by agencies, organizations, and individuals in driver training, examination, and issuance of driving licenses within their authority.

Article 17. Heads of units managing driver training and examination under the Department of Transport

1. Shall be responsible to the Director of the Department of Transport and to the law for organizing the implementation of driver training, examination, and issuance of driving licenses at the local level as prescribed.

2. Shall organize inspections of local training facilities and examination centers for compliance with regulations on driver training and examination.

Article 18. Chairperson of the Examination Board

1. Shall be responsible to the head of the agency and to the law for organizing the implementation of the content and procedures of driver examinations as prescribed.

2. Shall convene the board, examination teams, and monitoring teams to announce decisions on organizing examination periods, disseminate necessary regulations for organizing examination periods; assign tasks to the examination board.

3. Shall direct and urge the implementation of measures to ensure order and safety during examination periods.

4. Shall handle cases arising during the examination period within their authority.

5. Shall take timely measures to prevent and deter negative behaviors and violations regarding the content and procedures of examinations.

6. Shall create conditions for monitoring activities of the monitoring team during examination periods.

7. Shall be responsible for violations by members of the examination board, examination teams, and monitoring teams during examination periods.

8. Shall have appropriate conduct and behavior while performing duties; shall not engage in corruption.

Article 19. Team Leader of the Examination Team

1. Shall be responsible before the Head of the agency, the examination board, and the law for organizing and implementing the content and procedures of the driving test; shall wear uniforms and insignia when performing duties as prescribed.

2. Shall disseminate internal regulations, examination procedures, and necessary provisions to candidates participating in the examination.

3. Shall assign, urge, and inspect examination officers to perform their tasks during the examination period.

4. Shall organize inspections of examination vehicles, scoring equipment, monitoring devices, and examination grounds before organizing the examination period.

5. Shall implement security plans to ensure order and safety during the examination period.

6. Shall promptly take measures to prevent violations of the examination content and procedures by examination officers; shall not allow unauthorized persons to enter the theoretical examination room, the control room for scoring driving tests, or the examination grounds.

7. Shall not assist students in any form or score inaccurately affecting the examination results.

8. Shall compile candidates' complaints, records of candidates violating regulations, and examination officer violation records to report to the chairman of the examination board for handling.

9. Shall organize inspections and controls to ensure the accuracy of theoretical and practical examination results, candidate result summary records, and examination-related files and documents to report to the chairman of the examination board.

10. Shall maintain appropriate conduct and behavior while performing duties; shall not engage in corruption.

Article 20. Secretariat Member

1. Shall assist the chairman of the board and the team leader of the examination team in preparing records and documents related to the examination period: records of candidates violating regulations, records of examination officer violations, records of assignments for board members, records of team assignments, and summary records of examination results.

2. Shall check examination papers, examination records, and summary records of examination results; shall receive, manage, and store files and documents handed over by the team leader after the examination; shall submit examination-related documents for storage as prescribed.

3. Shall be responsible before the examination board for the accuracy of examination-related files and documents.

4. Shall not undertake tasks not assigned.

5. Shall not assist students in any form during the examination period.

6. Shall maintain appropriate conduct and behavior while performing duties; shall not engage in corruption.

Article 21. Examiner

1. Shall be responsible before the examination board, the examination team, and the law for performing assigned tasks; shall wear uniforms and insignia as prescribed when performing duties.

2. Shall comply with assignments from the team leader of the examination team.

3. Shall inspect and truthfully report necessary conditions for organizing the examination period according to assigned tasks prior to organizing the examination period.

4. Shall promptly prevent, detect, and handle proxy examinees; shall not allow unauthorized persons to enter the theoretical examination room, the control room for scoring driving tests, or the examination grounds.

5. Shall not assist students in any form or score inaccurately affecting the examination results.

6. Shall strictly adhere to the examination content and procedures; shall ensure the accuracy, honesty, and objectivity of examination results.

7. Shall not undertake tasks not assigned.

8. Shall maintain appropriate conduct and behavior while performing duties; shall not engage in corruption.

Article 22. Team Leader of the Monitoring Team

1. Shall be responsible before the Head of the agency, the examination board, and the law for monitoring the examination period; when performing duties, shall wear uniforms as prescribed.

2. Organize the implementation of monitoring the examination board and examination team to ensure that the examination period is conducted openly, objectively, transparently; in accordance with the content and procedures.

3. Assign, urge, and inspect monitoring officers to perform their tasks during the examination period.

4. Have appropriate attitudes and behaviors when performing duties; not to engage in corruption.

Article 23. Monitoring Officers

1. Shall be responsible before the examination board, the team leader of the monitoring team, and the law for performing assigned tasks; when performing duties, shall wear uniforms as prescribed.

2. Comply with assignments from the team leader of the monitoring team.

3. Perform monitoring tasks for the examination board and examination team according to the assignments from the team leader of the monitoring team to ensure that the examination period is conducted openly, objectively, transparently; in accordance with the content and procedures.

4. Have appropriate attitudes and behaviors when performing duties; not to engage in corruption.

Article 24. Staff Involved in Driver's License Issuance, Replacement, and Reissuance

1. Shall implement administrative procedures for issuing, replacing, and reissuing driver's licenses in accordance with regulations.

2. Ensure transparency, honesty, and objectivity; not to cause difficulties or inconvenience for individuals seeking to issue, replace, or reissue driver's licenses.

3. Accept and return files and driver's licenses within the prescribed time; not to lose files or driver's licenses.

4. Have appropriate attitudes and behaviors when performing duties; not to engage in corruption.

Article 25. Other Individuals Participating in Driving Training, Examination, and License Issuance; Appraisal, Inspection, and Supervision of Training, Examination, and License Issuance

1. Shall perform assigned responsibilities, authorities, and tasks accurately.

2. Ensure transparency, honesty, and objectivity; not to cause difficulties or inconvenience for individuals when performing tasks.

3. Have appropriate attitudes and behaviors when performing duties; not to engage in corruption.

Article 26. Heads of Driving Training Institutions and Examination Centers

Shall be responsible before the supervising agencies and the law for all activities of driving training institutions and examination centers in accordance with regulations.

Article 27. Driving Instructors

1. Driving instructors shall be responsible before the Head of the driving training institution and the law for performing assigned teaching tasks; shall wear instructor badges when performing duties.

2. Driving instructors must have complete lesson plans when teaching; update all management records fully; teach the required number of hours according to the training schedule, content, curriculum, and textbooks as prescribed; organize regular inspections and final exams in accordance with regulations.

3. Practical driving instructors must carry all necessary vehicle documents, ensuring that training vehicles meet all conditions for operation; ensure safety during student practical driving lessons; do not allow students to participate in practical driving without wearing "Student Driving Practice" badges.

4. Shall not participate in gambling, using drugs, or other stimulants in any form.

5. Shall not allow students to participate in gambling, using drugs, or other stimulants in any form during class hours.

6. Have appropriate attitudes and behaviors when performing duties; not to engage in corruption.

Chapter III

VIOLATIONS AND HANDLING OF VIOLATIONS

Section 1

VIOLATION HANDLING FOR DRIVING TRAINING INSTITUTIONS

Article 28. Handling Violations Against Driving Training Institutions

1. A training institution shall be given a warning when it violates any one of Clauses 1, 3, 4, 5, or 8 of Article 12 of this Circular.

2. A training institution shall be suspended from enrolling students when it violates two or more of Clauses 1, 3, 4, 5, or 8 of Article 12 of this Circular, or commits repeated violations three times or more of any one of the clauses specified in Clause 1 of this Article.

3. A driving training institution that violates any one of Clauses 2, 6, or 7 of Article 12 of this Circular shall be handled according to the Government's regulations on administrative penalties in the field of road traffic.

Article 29. Handling Violations Against Heads, Staff, and Teachers of Driving Training Institutions

Heads, staff, and teachers of driving training institutions shall be subject to disciplinary measures according to their status and the severity of the violation as stipulated in Decree No. 34/2011/ND-CP dated May 17, 2011 of the Government on disciplinary measures for civil servants; Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code concerning labor discipline and material responsibility; Decree No. 33/2003/ND-CP dated February 4, 2003 of the Government supplementing certain provisions of Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code concerning labor discipline and material responsibility; Decree No. 34/2010/ND-CP dated April 2, 2010 of the Government on administrative penalties in the field of road traffic, and other amended and supplemented decrees.

Section 2

HANDLING VIOLATIONS AGAINST DRIVING TEST CENTERS

Article 30. Handling Violations Against Driving Test Centers

1. A driving test center shall be given a warning when it violates any one of Clauses 2, 3, 4, 5, 6, or 7 of Article 13 of this Circular.

2. A driving test center shall be suspended from conducting tests when it violates two or more of Clauses 2, 3, 4, 5, 6, or 7 of Article 13 of this Circular, or commits repeated violations three times or more of any one of the clauses specified in Clause 1 of this Article.

3. A driving test center that violates Clause 1 of Article 13 of this Circular shall be handled according to the Government's regulations on administrative penalties in the field of road traffic.

Article 31. Handling Violations Against Heads, Staff of Driving Test Centers

HANDLING VIOLATIONS AGAINST OTHER ORGANIZATIONS AND INDIVIDUALS PARTICIPATING IN MANAGEMENT OF TRAINING, TESTING, LICENSE ISSUANCE; AUDITING, INSPECTION, AND MONITORING OF TRAINING, TESTING, AND LICENSE ISSUANCE

Article 32. Handling of violations against training management units, examination units, and license issuance units of the Vietnam Road Administration General Department; training management units, examination units, and license issuance units of the Department of Transport

1. The training management unit, examination unit, and license issuance unit of the Vietnam Road Administration General Department shall be warned when violating any of the clauses stipulated in Article 6 of this Circular or when the directly managed driving training facilities or examination centers are suspended from enrolling students for driver training or suspending examination activities.

2. The training management unit, examination unit, and license issuance unit of the Department of Transport shall be warned when violating any of the clauses stipulated in Article 8 of this Circular or when the directly managed driving training facilities or examination centers are suspended from enrolling students for driver training or suspending examination activities.

Article 33. Handling of violations against other individuals participating in the management of training, examination, and license issuance; appraisal, inspection, and supervision of training, examination, and license issuance

Other individuals participating in the management of training, examination, and license issuance; appraisal, inspection, and supervision of training, examination, and license issuance shall be handled according to their status and degree of violation as prescribed in Decree No. 34/2011/NĐ-CP dated May 17, 2011 of the Government on disciplinary measures for civil servants; Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on labor discipline and material responsibility; and Decree No. 33/2003/NĐ-CP dated February 4, 2003 of the Government supplementing certain provisions of Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on labor discipline and material responsibility.

Article 34. Handling of violations by superiors due to joint liability

Heads of agencies and units directly above the driving training facilities and examination centers mentioned in this Circular shall be handled according to their status and degree of joint liability as prescribed in Decree No. 34/2011/NĐ-CP dated May 17, 2011 of the Government on disciplinary measures for civil servants; Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on labor discipline and material responsibility; and Decree No. 33/2003/NĐ-CP dated February 4, 2003 of the Government supplementing certain provisions of Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on labor discipline and material responsibility.

Section 4

PROCEDURE FOR HANDLING VIOLATIONS

Article 35. Authority to handle violations

1. The Minister of Transport decides on handling violations committed by the Director-General and Deputy Director-General of the Vietnam Road Administration General Department, heads of driving training facilities and examination centers under the Ministry, and other entities within their authority.

2. The Chairman of the People's Committee of provinces and centrally governed cities decides on the handling of violations by the Director and Deputy Director of the Department of Transport and other entities within their authority.

3. The Ministers of relevant ministries and heads of agencies and organizations with driving training facilities and examination centers decide on handling violations committed by the heads of driving training facilities and examination centers within their authority.

4. The Director-General of the Vietnam Road Administration General Department:

a) Decides on handling violations committed by the heads of driving training facilities and examination centers under the General Department; advisory and operational departments and chairpersons of examination boards, examination team leaders, examiners, monitoring team leaders, monitoring officers, and other staff under the General Department's management;

b) Suspends operations and suspends enrollment for driver training when driving training facilities and examination centers have violations;

c) Revokes the examiner’s card.

5. The Director of the Department of Transport:

a) Decides on handling or recommends related agencies to handle violations committed by the heads of driving training facilities and examination centers; advisory and operational departments and chairpersons of examination boards, examination team leaders, examiners, monitoring team leaders, monitoring officers, and other staff under the Department's management;

b) Suspends enrollment for driver training when driving training facilities managed by the Department have violations and reports to the Vietnam Road Administration General Department;

c) Reports to the Vietnam Road Administration General Department and competent authorities about violations by agencies, organizations, and individuals for handling according to regulations.

6. Traffic inspectors within their assigned functions and tasks implement handling of violations according to this Circular and other laws on inspection.

7. The head of the inspection team or person with authority must promptly report in writing about violations by organizations and individuals to the competent authority for handling according to this Circular and current laws.

8. Procedure, process, documentation, and application of suspension of enrollment and suspension of operations for driving training facilities or examination centers:

a) Report of the inspection team or person with authority proposing to handle violations accompanied by the Inspection Record;

b) Suspension notice issued by the Vietnam Road Administration General Department or the Department of Transport according to Clause 4 and Clause 5 of this Article for driving training facilities or examination centers with violations.

9. Procedure, process, and documentation for allowing driving training facilities or examination centers to resume operations after rectifying violations:

a) Request letter from the driving training facility or examination center;

b) Inspection record of the agency or organization tasked with inspecting the rectification of violations at the driving training facility or examination center;

c) Permission letter from the agency or organization tasked with inspecting to allow the driving training facility or examination center to resume operations;

d) Permission letter from the Vietnam Road Administration General Department or the Department of Transport for the driving training facility or examination center to resume operations.

Chapter IV

EFFECTIVE DATE AND IMPLEMENTATION

Article 36. Effective Date

1. This Circular takes effect from May 1, 2012; it abolishes Decision No. 4480/2002/QĐ-BGTVT dated December 31, 2002 of the Minister of Transport on the issuance of regulations on responsibilities and handling violations in the management of driver training, examination, and license issuance.

2. Agencies, organizations, and individuals related to driver training, examination, and license issuance must comply with the provisions of this Circular and other regulatory legal documents concerning the management of driver training, examination, and license issuance.

Article 37. Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Highway Administration, Directors of Provincial Departments of Transport under centrally governed cities, Heads of agencies, organizations, and individuals related to driver training, examination, and license issuance are responsible for implementing this Circular./.
