DECREE
On measures to mobilize the masses to protect national security,
maintain public order and social safety
____________
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the National Security Law dated December 3, 2004;
Pursuant to the Public Security Law dated November 29, 2005;
The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.
The Government promulgates this Decree on measures to mobilize the masses to protect national security and maintain public order and social safety,
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the principles, contents, forms, procedures, conditions for applying measures to mobilize the masses to protect national security and maintain public order and social safety (hereinafter referred to as protecting security and order); the system and policies for agencies, organizations, and individuals participating in security and order work.
Article 2. Applicability
This Decree applies to specialized agencies responsible for protecting security and order; Vietnamese agencies and organizations, foreign agencies and organizations, and international organizations operating within the territory of the Socialist Republic of Vietnam (hereinafter referred to as agencies and organizations); Vietnamese citizens and foreign individuals residing or operating within the territory of the Socialist Republic of Vietnam (hereinafter referred to as individuals). In cases where international treaties to which the Socialist Republic of Vietnam is a party provide different provisions, such treaty provisions shall apply.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. Measures to mobilize the masses to protect security and order refer to the mobilization and utilization of the strength of agencies, organizations, and individuals participating in security and order work.
2. Specialized agencies responsible for protecting security and order are agencies in charge of directing and commanding and units under the People's Public Security Force and the People's Army assigned with the specialized task of providing advice, organizing, and directly implementing tasks related to security and order.
3. Specialized officers responsible for protecting security and order are officers and non-commissioned officers of specialized agencies responsible for protecting security and order under the People's Public Security Force and the People's Army assigned with the specialized task of providing advice, organizing, and directly implementing tasks related to security and order.
Article 4. Principles for applying measures to mobilize the masses to protect security and order
1. Compliance with the Constitution and laws of the Socialist Republic of Vietnam.
2. Close integration between measures to mobilize the masses and other work measures to protect security and order.
3. It is not permissible to exploit measures to mobilize the masses to protect security and order to infringe upon the interests of the State, the rights, and legitimate interests of agencies, organizations, and individuals.
Chapter II
CONTENTS, AUTHORITY, RESPONSIBILITIES, FORMS, PROCEDURES, CONDITIONS FOR APPLYING MEASURES TO MOBILIZE THE MASSES TO PROTECT SECURITY AND ORDER
Article 5. Contents of measures to mobilize the masses to protect security and order
1. Advising and proposing competent authorities to issue or issuing within their authority guidelines, regulations, plans for mobilizing and utilizing the strength of agencies, organizations, and individuals in security and order work; building nationwide movements to protect national security.
2. Propaganda, dissemination, and guidance to agencies, organizations, and individuals to enhance their understanding, compliance with the law, and sense of responsibility in security and order work; building nationwide movements to protect national security.
3. Organizing, mobilizing, and guiding agencies, organizations, and individuals to participate in security and order work; building nationwide movements to protect national security.
4. Directing, guiding, and inspecting the establishment and operation of mass organization models for protecting security and order at the grassroots level.
Article 6. Competence and responsibility of agencies and specialized staff for security and public order when applying mass mobilization measures to protect security and public order
1. Agencies and specialized staff for security and public order when applying mass mobilization measures to protect security and public order have the following competences:
a) Implementing the contents of mass mobilization measures to protect security and public order as stipulated in Article 5 of this Decree;
b) Using necessary work methods as prescribed by law to implement the contents of mass mobilization measures to protect security and public order.
2. Agencies and specialized staff for security and public order when applying mass mobilization measures have the following responsibilities:
a) Implementing necessary measures as prescribed by law to protect the reputation and property of agencies and organizations; the lives, health, reputation, dignity, and property of individuals during the application of mass mobilization measures;
b) Implementing according to their authority or proposing competent authorities to implement systems and policies for agencies, organizations, and individuals with achievements or losses in applying mass mobilization measures to protect security and public order as prescribed by law.
Article 7. Forms, procedures, and processes for applying mass mobilization measures to protect security and public order
1. Mass mobilization to protect security and public order is carried out openly or secretly, widely, collectively, or individually.
2. The forms, procedures, and processes for applying mass mobilization measures in specific areas of work are implemented according to the regulations of the Minister of Public Security, the Minister of National Defense, and relevant laws.
Article 8. Responsibilities of agencies and organizations in applying mass mobilization measures to protect security and public order
1. Cooperating with agencies and specialized staff for security and public order in implementing mass mobilization measures to protect security and public order.
2. Creating conditions for individuals within their agencies and organizations to participate in protecting security and public order as prescribed by law.
Article 9. Responsibilities of individuals in applying mass mobilization measures to protect security and public order
1. Adhering strictly to the requirements of agencies and specialized staff for security and public order in applying mass mobilization measures to protect security and public order as prescribed by law.
2. Enhancing awareness and compliance with the law; proactively preventing, detecting, reporting, and combating crimes and other violations of law concerning security and public order.
3. Participating in grassroots mass organization models for protecting security and public order according to their capacity and conditions; participating in building safe communities, communes, wards, towns, agencies, organizations, enterprises, and schools in terms of security and public order; uniting to build a cultural lifestyle in residential areas as prescribed by law.
Article 10. Systems and policies for agencies, organizations, and individuals participating in security and public order work
1. Agencies and organizations participating in security and public order work are protected regarding their reputation and property; individuals participating in security and public order work are protected regarding their lives, health, reputation, dignity, and property as prescribed by law.
2. Agencies, organizations, and individuals participating in security and public order work who achieve merits are rewarded according to the law on commendation and rewards.
3. Agencies, organizations, and individuals who suffer damage to their reputation due to participation in security and public order work are restored; those who suffer financial loss are compensated; individuals who die directly from participating in security and public order work are considered for recognition as martyrs; if they are injured resulting in a reduction in working capacity of 21% or more, they are considered for benefits equivalent to those of war invalids as prescribed by law on preferential treatment for persons meritorious to the revolution.
Article 11. Funding to ensure the implementation of measures to mobilize the masses for security and public order protection
1. Sources of funding to ensure the implementation of measures to mobilize the masses for security and public order protection:
a) State budget in accordance with the State Budget Law;
b) Contributions and sponsorships from agencies, organizations, and individuals in accordance with the law.
2. The management and utilization of funding to ensure the implementation of measures to mobilize the masses for security and public order protection shall be carried out in accordance with the provisions of the law.
Chapter III
IMPLEMENTING PROVISIONS
Article 12. Effective Date
This Decree takes effect from March 8, 2014.
Article 13. Responsibility for Implementation
This Decree takes effect from March 25, 2014.
2. The Minister of National Defense is responsible for coordinating with the Ministry of Public Security to guide, inspect, and urge the implementation of this Decree within the People's Army.
3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
