CIRCULAR
Provisions on the procedure for conducting a specialized inspection
by the People's Public Security force

Pursuant to the Inspection Law 2010;

Pursuant to Decree No. 86/2011/ND-CP dated September 22, 2011 detailing and guiding the implementation of certain articles of the Inspection Law (hereinafter referred to as Decree No. 86/2011/ND-CP);

Pursuant to Decree No. 41/2014/ND-CP dated May 13, 2014 on organization and operation of inspection in the People's Public Security Force;

Pursuant to Decree No. 106/2014/ND-CP dated November 17, 2014 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Inspector General of the Ministry of Public Security;

The Minister of Public Security issues this Circular prescribing the procedure for conducting a specialized inspection by the People's Public Security force from the issuance of the inspection decision to the conclusion of the inspection and submission of the file to the managing agency.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the principles, forms, authority, procedures for conducting a specialized inspection by the People's Public Security force from the issuance of the inspection decision to the conclusion of the inspection and submission of the file to the managing agency.

Article 2. Applicability

This Circular applies to:

1. Local public security units.

2. Heads of inspection agencies, Heads of Inspection Teams, members of specialized inspection teams.

3. Agencies, organizations, individuals subject to inspection.

4. Agencies, organizations, individuals related to the specialized inspection activities of the People's Public Security force.

Article 3. Principles and Forms of Inspection

1. Specialized inspections conducted by the People's Public Security force must comply with the following principles:

a) Adhering to the provisions of this Circular and other relevant laws;

b) Ensuring accuracy, objectivity, honesty, transparency, democracy, and timeliness;

c) Ensuring compliance with the inspection deadlines, tasks, and authorities assigned;

d) Avoiding overlap in scope, subjects, and content of inspections among agencies performing inspection functions; not hindering the normal operations of agencies, organizations, and individuals subject to inspection.

2. A specialized inspection by the People's Public Security force shall be conducted in the form of planned inspections approved by competent authorities and surprise inspections.

Article 4. Authority to Issue Inspection Decisions According to Plans

1. The Minister of Public Security issues decisions to inspect the responsibilities of Ministries, ministerial-level agencies, agencies under the Government, provincial People's Committees, and municipal People's Committees directly under the central government (hereinafter referred to as provincial People's Committees), and inspections involving multiple levels, sectors, and localities concerning areas within the national administrative management authority of the Ministry of Public Security regarding security and public order.

2. The Inspector General of the Ministry of Public Security issues decisions to inspect areas within the national administrative management authority of the Ministry of Public Security regarding security and public order for agencies under the Ministry, ministerial-level agencies; groups, corporations, enterprises operating nationwide or involving multiple localities; central agencies and organizations; and local agencies and organizations.

3. The Director of the Fire Prevention and Fighting Police Department issues decisions to inspect agencies, organizations, and individuals within the scope of administrative management authority regarding fire prevention and fighting assigned to them.

4. The Director of the Provincial Public Security Department (hereinafter referred to as the Director of the Provincial Public Security Department) issues decisions to inspect areas within the national administrative management authority regarding security and public order for agencies, organizations, and individuals under their jurisdiction when necessary, or upon request of the Inspector General of the Provincial Public Security Department (hereinafter referred to as the Inspector General of the Provincial Public Security Department), to inspect departments, sectors, and agencies under the provincial People's Committee's management and district People's Committees (hereinafter referred to as district People's Committees).

5. The Director of the Provincial Fire Prevention and Fighting Department (hereinafter referred to as the Director of the Provincial Fire Prevention and Fighting Department) issues decisions to inspect areas within the national administrative management authority regarding fire prevention and fighting for agencies, organizations, and individuals under their jurisdiction when necessary, or upon request of the Inspector General of the Provincial Fire Prevention and Fighting Department (hereinafter referred to as the Inspector General of the Provincial Fire Prevention and Fighting Department), to inspect departments, sectors, and agencies under the provincial People's Committee's management and district People's Committees.

6. The Inspector General of the Provincial Public Security Department issues decisions to inspect areas within the national administrative management authority regarding security and public order of the Provincial Public Security Department for agencies, organizations, and individuals under their jurisdiction.

7. The Inspector General of the Provincial Fire Prevention and Fighting Department issues decisions to inspect areas within the national administrative management authority regarding fire prevention and fighting of the Provincial Fire Prevention and Fighting Department for agencies, organizations, and individuals under their jurisdiction.

Article 5. Authority to issue decisions on surprise inspections and re-inspections

Within the scope of state management over security and public order by the Ministry of Public Security, the authority to issue decisions on surprise inspections and re-inspections shall be regulated as follows:

1. The Minister of Public Security shall issue a decision for a surprise inspection when there are signs of violation of laws, when complex complaints and denunciations occur involving multiple levels, sectors, and localities, or when assigned by the National Assembly, the Government, or requested by the State Audit Office; and for re-inspection of cases and matters that have been concluded by the Chairman of the People's Committee of a province or the Inspector General of the Ministry of Public Security but signs of law violations are discovered.

2. The Inspector General of the Ministry of Public Security shall issue a decision for a surprise inspection when there are signs of violation of laws, when complex complaints and denunciations occur within the scope of a province or centrally governed city, a ministry, an agency at the ministerial level, or an agency under the Government, or when assigned by the Minister of Public Security; and for re-inspection of cases and matters concluded by the Director of the Fire Prevention and Fighting Police Department, the Director of Provincial Public Security, or the Director of Provincial Fire Prevention and Fighting Police but signs of law violations are discovered; and for re-inspection of cases and matters under the Ministry of Public Security’s management concluded by the Chairman of the People's Committee of a province but signs of law violations are discovered upon assignment by the Minister of Public Security.

3. The Director of the Fire Prevention and Fighting Police Department shall issue a decision for a surprise inspection when there are signs of violation of fire prevention and fighting laws within their management scope, or when assigned by the Minister of Public Security or the Inspector General of the Ministry of Public Security.

4. Within their authority, the Director of Provincial Public Security, and the Director of Provincial Fire Prevention and Fighting Police shall issue a decision for a surprise inspection when there are signs of violation of laws, when complex complaints and denunciations occur, or when assigned by the Minister of Public Security or the Chairman of the People's Committee of a province, or when requested by the Inspector General of the Ministry of Public Security; and for re-inspection of cases and matters concluded by the Chairman of the People's Committee of a district, the Inspector of Provincial Public Security, or the Inspector of Provincial Fire Prevention and Fighting Police but signs of law violations are discovered.

5. The Inspector of Provincial Public Security shall issue a decision for a surprise inspection when there are signs of violation of laws, when complex complaints and denunciations occur within the scope of Provincial Public Security’s management, or when assigned by the Director of Provincial Public Security; and for re-inspection of cases and matters under Provincial Public Security’s management concluded by the Chairman of the People's Committee of a district but signs of law violations are discovered upon assignment by the Director of Provincial Public Security.

6. The Inspector of Provincial Fire Prevention and Fighting Police shall issue a decision for a surprise inspection when there are signs of violation of laws, when complex complaints and denunciations occur within the scope of Provincial Fire Prevention and Fighting Police’s management, or when assigned by the Director of Provincial Fire Prevention and Fighting Police; and for re-inspection of cases and matters under Provincial Fire Prevention and Fighting Police’s management concluded by the Chairman of the People's Committee of a district but signs of law violations are discovered upon assignment by the Director of Provincial Fire Prevention and Fighting Police.

Article 6Recordkeeping of Inspection Teams

1. Activities of Inspection Teams must be recorded in the Inspection Team's logbook. The head of the Inspection Team is responsible for directly recording the logbook or assigning members of the Inspection Team to record it accurately, objectively, truthfully, clearly, reflecting all activities during the inspection process.

2. The Inspection Team's logbook shall include the following main contents:

a) Time, location, and tasks performed on that day;

b) Guidance opinions and management directives of the person issuing the inspection decision, the Head of the Inspection Team (if applicable);

c) Time, location, and content of meetings and consultations held by the Inspection Team;

d) Difficulties and obstacles arising during the Inspection Team's inspection activities (if any);

d) Other relevant contents related to the activities of the Inspection Team.

3. The head of the Inspection Team is responsible for managing the Inspection Team's logbook. In case the Inspection Team's logbook is lost or damaged, the head of the Inspection Team must report to the person who issued the inspection decision for consideration and resolution.

4. The logbook of the Inspection Team shall be carried out according to a model prescribed by the State Audit Office and kept in the inspection dossier.

Chapter II

PROCEDURE FOR CONDUCTING A SPECIALIZED INSPECTION

Section 1
PREPARATION FOR INSPECTION

Article 7. Decision on Inspection

1. Based on the annual inspection plan that has been signed and issued by the competent authority; when signs of violation of laws are discovered; when complex complaints or denunciations occur, or when assigned by the head of the same-level police force, the Inspectorate of the Ministry, the Inspectorate of the Provincial Police, the Inspectorate of the Fire Prevention and Fighting and Rescue Department, and the Inspectorate of the Fire Prevention and Fighting Department shall establish the inspection decision for each inspection to be submitted for signature and issuance by the competent authority.

2. The specialized inspection decision must include all contents as prescribed in Clause 1, Article 52 of the Inspection Law.

3. Within five days from the date of issuance, the inspection decision must be sent to the inspected entity. In cases of urgent inspection decisions, within three days from the date of issuance of the inspection decision, the decision must be sent according to the following provisions:

a) Sending the inspection decision to the person who assigned the task or requested the inspection decision for reporting;

b) The head of the state inspection agency within the People's Public Security must send the inspection decision to the head of the same-level public security agency for reporting;

c) The Director of the Fire Prevention and Fighting and Rescue Department, the Director of the Provincial Public Security, the Director of the Provincial Fire Prevention and Fighting Department, the Head of the Inspectorate of the Provincial Public Security, and the Head of the Inspectorate of the Provincial Fire Prevention and Fighting Department must send the inspection decision to the Head of the Inspectorate of the Ministry of Public Security for reporting.

Article 8. Building and Approving the Plan to Conduct Inspections

1. Within five days from the date of issuance of the inspection decision, the Chief Inspector must build the plan to conduct inspections and submit it for approval by the person issuing the inspection decision. In cases of urgent inspections, the time for building and submitting the plan to conduct inspections shall be required by the person issuing the inspection decision but not exceeding three days from the date of issuance of the inspection decision.

2. The plan to conduct inspections includes the following main contents:

a) Purpose and requirements of the inspection;

b) Scope, content, and inspected entities;

c) Duration of the inspection;

d) Methods of conducting the inspection;

đ) Progress, information system, and reporting;

e) Means, equipment, budget, and other material conditions serving the activities of the inspection team;

g) Organizing body.

Article 9. Building Guidelines for the Inspected Entity to Report

1. Within three days from the date the plan to conduct inspections is approved by the competent authority, the Chief Inspector must build guidelines for the inspected entity to report.

2. The guidelines for the inspected entity to report must closely follow the plan to conduct inspections and include the following main contents:

a) Situation and characteristics (geography, population, education level, economic and social development, security and order situation), functions, tasks, production and business areas of the inspected entity directly related to the implementation of laws under the inspection content;

b) Current status of law compliance by the inspected entity according to each inspection content;

c) General assessment of strengths, weaknesses, and violations (if any) in the process of implementing laws on the inspection contents;

d) Causes of weaknesses and violations;

đ) Difficulties and obstacles in the process of implementing laws;

e) Proposals and recommendations to competent authorities for measures to resolve difficulties and obstacles (if any).

3. At least five days before announcing the inspection decision, the guidelines for the inspected entity to report must be sent to the inspected entity.

Article 10. Meeting of the Inspection Team to disseminate the decision, inspection plan, unify implementation measures, and assign tasks to each member.

1. After the inspection plan has been approved, the Head of the Inspection Team must organize a meeting of the Inspection Team to disseminate the decision, the inspection plan, discuss implementation measures, and assign tasks to each member of the Inspection Team.

2. Members of the Inspection Team shall discuss methods and ways to conduct inspections, coordination measures among members within the Inspection Team, and the reporting system with the decision-maker for the inspection and the leadership of the Inspection Team during the inspection process. Following the discussion, the Head of the Inspection Team shall adopt opinions and conclude on each discussed content to unify implementation.

3. The meeting of the Inspection Team must be recorded in minutes and kept in the inspection file.

Article 11. Building Implementation Plans for Tasks of Each Member of the Inspection Team

1. Within three days from the date of being assigned tasks, each member of the Inspection Team must build a specific implementation plan for their tasks to report to the Head of the Inspection Team.

2. The implementation plan for assigned tasks includes the following contents:

a) Specific tasks assigned;

b) Objectives and requirements set forth;

c) Methods and ways of conducting;

d) Time of implementation;

d) Proposals (if any).

3. Within one day from receiving the plans of the members of the Inspection Team, the Head of the Inspection Team must review and approve them for the members to implement.

4. The implementation plan can be built for the entire inspection process or separately for each assigned task at the request of the Inspection Team leadership.

Article 12. Notification of the Announcement of the Inspection Decision

At least five days before announcing the inspection decision (except for surprise inspections), the Head of the Inspection Team is responsible for notifying in writing the inspected entity about the announcement of the inspection decision. In necessary cases, the Head of the Inspection Team drafts a document for the decision-maker of the inspection decision to sign and notify about the announcement of the inspection decision to send to the inspected entity. The notification must clearly state the time and place of the inspection decision announcement, and the participants.

Section 2
CONDUCTING INSPECTIONS

Article 13. Announcing the Inspection Decision

1. Within fifteen days from the issuance of the inspection decision, the Head of the Inspection Team must organize the announcement of the inspection decision.

2. Participants at the session for the publication of the inspection decision include:

a) The Inspection Team;

b) Heads of agencies, organizations, and individuals who are the inspected entities;

c) In necessary cases, the Head of the Inspection Team may invite the decision-maker of the inspection decision, heads of superior agencies or organizations directly overseeing the inspected entity, and related agencies, organizations, and individuals to attend the announcement of the inspection decision.

3. The procedure for announcing the inspection decision is as follows:

a) A representative of the leadership of the agency or organization that is the inspected entity declares the reason, introduces the participants, and outlines the agenda of the meeting;

b) The Head of the Inspection Team reads the full text of the inspection decision, clarifies its purpose, requirements, and basic content; the tasks, powers, responsibilities, and methods of conducting the inspection of the Inspection Team; the rights and obligations of the inspected entity and related agencies, organizations, and individuals; and announces the planned schedule of the Inspection Team's work;

c) A representative of the leadership of the agency or organization that is the inspected entity reports on the results of compliance with laws regarding the inspected content according to the guidance outline for the report;

d) Participants in the announcement of the inspection decision exchange views on issues that need to be supplemented or clarified in the report, and agree on the inspection schedule;

đ) The Head of the Inspection Team summarizes the exchanged opinions and if deemed necessary, may require the inspected entity to supplement or complete the report, provide relevant files and materials concerning the inspected content, and the schedule for conducting inspections at the inspected agencies and organizations;

e) The decision-maker of the inspection decision (if present) or the Head of the Inspection Team makes concluding remarks at the end of the announcement of the inspection decision.

4. The announcement of the inspection decision must be recorded in minutes signed by the leadership of the Inspection Team and a representative of the leadership of the inspected agency, organization, or individual, each party keeping a copy.

Article 14. Conducting Inspections

After announcing the inspection decision, the Inspection Team conducts inspections according to the schedule agreed upon at the announcement of the inspection decision. At each inspected agency or organization, the Inspection Team may carry out the following activities:

1. Receiving written reports from the inspected entity and listening to representatives of the leadership of the inspected agencies, organizations, or individuals directly reporting.

2. Requesting the inspected entity to provide files and documents regarding compliance with policies, laws, tasks, and powers related to the content of the inspection for the Inspection Team to study, analyze, and evaluate.

If it is deemed necessary to seize files and documents as a basis for the inspection conclusion, then requesting the inspected entity, agencies, organizations, or individuals related to the content of the inspection to provide them. The handover of files and documents must be recorded in a protocol; if it is not necessary to seize the original, then requesting the entity to provide certified copies or extracts.

3. Directly working with the person handling, resolving cases, managing files and documents, and persons related to the content of the inspection to request reports, explanations, and provision of files and documents. The process of work must be recorded in a protocol signed by all parties involved; if there is no signature, the reason must be clearly stated.

4. Conducting checks, measurements, counts, and direct observations of physical evidence, scenes, facilities, equipment, means, tools, and instruments related to the content of the inspection.

5. Conducting checks and verifications to clarify issues that are not yet sufficiently substantiated. Members of the Inspection Team assigned tasks must report the results of the checks and verifications in writing, accompanied by collected documents and evidence.

6. When discovering administrative violations, a violation record must be established according to the prescribed form. In cases where the administrative violation falls within the authority to impose penalties of the Inspection Team member, Inspector, or Head of the Inspection Team, a penalty decision must be issued according to regulations. If the administrative violation does not fall within the authority to impose penalties, the case file of the administrative violation must be transferred to the authorized person to impose penalties according to the law on handling administrative violations. If the violation has signs of criminal activity, then collecting evidence to serve as a basis for reporting to the person issuing the inspection decision.

7. When conducting inspections at grassroots units of inspected agencies or organizations, the Inspection Team must establish an inspection protocol.

8. When deemed necessary, the Head of the Inspection Team applies measures as provided for in Article 53 of the Inspection Law or proposes the person issuing the inspection decision to apply measures within their authority as provided for in Article 55 of the Inspection Law.

9. Upon completion of the inspection at each inspected agency or organization, the Inspection Team must establish a protocol recording the inspection results. The protocol is made in two copies, signed and confirmed by representatives of the Inspection Team and the inspected agency or organization (each party retains one copy).

Article 15. Handling Unexpected Situations Arising During the Inspection Process

1. Changing or supplementing the Head of the Inspection Team or members of the Inspection Team shall be carried out as follows:

a) The Head of the Inspection Team or members of the Inspection Team may be changed when the Head of the Inspection Team or members of the Inspection Team fail to meet the requirements and tasks of the inspection, violate the law, or due to objective reasons cannot perform the inspection tasks. Members of the Inspection Team may be supplemented when it is necessary to ensure the progress and quality of the inspection or to meet other emerging requirements during the inspection process.

b) Changing or supplementing the Head of the Inspection Team or members of the Inspection Team must be decided in writing by the person issuing the inspection decision.

2. Amending or supplementing the subject, scope, duration, or content of the plan for conducting the inspection shall be carried out as follows:

a) When deemed necessary, the person issuing the inspection decision issues a written request to the Head of the Inspection Team to amend or supplement the subject, scope, duration, or content of the plan for conducting the inspection. Within two days from receiving the written request of the person issuing the inspection decision, the Head of the Inspection Team must make amendments and supplements to report to the person issuing the inspection decision for approval.

b) When deemed necessary, the Head of the Inspection Team must convene a meeting of the Inspection Team to unify the content of the report proposing amendments or supplements to the subject, scope, duration, or content of the plan for conducting the inspection. The content of the meeting must be recorded in a protocol. If the majority of members of the Inspection Team agree, the Head of the Inspection Team completes the proposal for amending or supplementing the inspection plan to report to the person issuing the inspection decision, accompanied by the protocol of the Inspection Team meeting.

Within two days from receiving the report proposing amendments or supplements from the Head of the Inspection Team, the person issuing the inspection decision must review and decide to approve or not approve the amendment or supplementation of the inspection plan.

3. The Head of the Inspection Team must immediately notify the inspected entity about the decision to change or supplement the Head of the Inspection Team or members of the Inspection Team, or to amend or supplement the subject, scope, duration, or content of the plan for conducting the inspection.

Article 16. Report on the Results of Task Execution Inspection

1. Each member of the Inspection Team must submit a written report to the Head of the Inspection Team regarding the results of the assigned tasks upon completion of the tasks at each inspected entity. The report must include the following main contents: Assigned tasks; results achieved; recommendations for handling or subsequent actions (if any).

The Head of the Inspection Team must provide comments on the reports submitted by members of the Inspection Team regarding their assigned tasks. In cases where the content of the report is unclear or incomplete, the Head of the Inspection Team shall request the member of the Inspection Team to supplement it. Reports from members of the Inspection Team on the execution of their assigned tasks must be immediately transferred to the secretary of the Inspection Team for consolidation and retention in the inspection file.

2. The Head of the Inspection Team has the responsibility to report to the decision-maker on the progress of the inspection tasks according to the approved inspection plan or upon the urgent request of the decision-maker; promptly report, propose, and seek guidance from the decision-maker when encountering unexpected situations that exceed the granted authority.

Article 17. Completion and Transfer of Files to Investigative Authorities or Other Competent Authorities

1. During the inspection process or upon its conclusion, if violations by the inspected entity indicate criminal offenses or fall outside the jurisdiction of the Inspection Team, the Head of the Inspection Team must complete the file, report to the decision-maker to transfer the file to the Investigative Authority or other competent authority for resolution. The establishment of a file requesting the initiation of a criminal case shall be carried out in accordance with Article 45 of Decree No. 86/2011/NĐ-CP.

2. Within three days from the date of receiving written instructions on the transfer of files from the decision-maker, the Head of the Inspection Team must complete the transfer procedures. The handover record and the written instructions from the decision-maker must be retained in the inspection file.

PART 3

CONCLUSION OF INSPECTION

Article 18. Notification of the Conclusion of the Inspection

Within two days from the date of concluding the inspection at the inspected location, the Head of the Inspection Team must issue a written notification regarding the time of the conclusion of the inspection at the inspected location and send it to the head of the inspected entity, organization, or individual.

Article 19. Construction of Inspection Result Report

1. Within ten days from the date of completion of inspection at the inspected location, the Head of the Inspection Team must draft the Inspection Result Report to convene a meeting of the Inspection Team to seek opinions from members of the Inspection Team. The meeting must be recorded in minutes to report to the person who issued the inspection decision and kept in the inspection file.

2. Within fifteen days from the date of completion of inspection at the inspected location, the Head of the Inspection Team must complete the Inspection Result Report and submit it to the person who issued the inspection decision, the Chief Inspector of the same level (if the Head of the Inspection Team is not the Chief Inspector).

3. The Inspection Result Report must include the following main contents:

a) An overview of the situation and characteristics of the inspected object that directly affect the content of the inspection and compliance with the inspection decision of the inspected object;

b) Comments and evaluations on the strengths and weaknesses in the implementation of policies, laws, tasks, and authorities of the inspected object according to each content stated in the plan for conducting the inspection;

c) Causes of existing weaknesses, faults, and violations (if any) and the responsibility of agencies, units, and individuals for these existing weaknesses, faults, and violations;

d) Different opinions when commenting and evaluating the compliance with the law of the inspected object among members of the Inspection Team (if any);

đ) Measures that the Inspection Team has applied or proposed the competent authority to apply to handle violations during the inspection process;

e) Proposals and recommendations to the person who issued the inspection decision.

Article 20. Construction ofInspection Conclusion

1. After completing the Inspection Result Report, the Head of the Inspection Team must draft the Inspection Conclusion to present to the person who issued the inspection decision along with the Inspection Result Report.

2. The Inspection Conclusion includes the following main contents:

a) Evaluation of the implementation of policies, laws, tasks, and authorities of the inspected entity within the scope of the inspection;

b) Conclusions on each inspection content in accordance with the sequence stated in the plan for conducting the inspection; clearly identifying strengths, weaknesses, existing issues, and shortcomings; assessing the nature and degree of violations discovered; measures to address violations within the authority already applied;

c) Causes and responsibilities of collectives and individuals for the weaknesses, existing issues, and violations that have been discovered;

d) Recommendations for measures to promote strengths, rectify existing issues and weaknesses, and address violations against the inspected object; recommendations for competent authorities to handle illegal acts, amend, supplement, issue, or abolish regulations to align with state management requirements.

3. Within fifteen days from the date of receipt of the Inspection Result Report and the draft Inspection Conclusion (except in cases where waiting for conclusions from specialized agencies or organizations is necessary), the person who issued the inspection decision must issue the Inspection Conclusion. Before issuing, if deemed necessary, the person who issued the inspection decision may take the following actions:

a) Requesting the Head of the Inspection Team, members of the Inspection Team, and the inspected object to report and explain to clarify additional issues necessary for concluding each inspection content;

b) Seeking opinions from specialized agencies or organizations;

c) Sending the draft Inspection Conclusion to the inspected object for participation in opinions or explanations. The explanation of the inspected object must be made in writing and accompanied by supporting documents;

d) Requesting the Head of the Inspection Team to organize a meeting between the Inspection Team and the heads of agencies, organizations, or individuals who are the inspected objects to review the draft Inspection Conclusion; the meeting will be chaired by the person who issued the inspection decision or their authorized representative. The content of the meeting will be recorded in minutes and confirmed by representatives of the Inspection Team and the inspected object to report to the person who issued the inspection decision (in case the person who issued the inspection decision does not chair the meeting) and kept in the inspection file.

4. The issuance of the Inspection Conclusion (if it does not belong to the list of state secrets) shall be carried out as follows:

a) The Inspection Conclusion signed by the Minister of Public Security must be sent to the General Inspectorate of the Government, the inspected object, the head of the agency or organization directly managing the inspected object (if any), and related agencies and organizations;

b) The Inspection Conclusion signed by the Chief Inspector of the Ministry of Public Security must be sent to the Minister of Public Security, the Deputy Minister of Public Security responsible for inspection, the Deputy Minister of Public Security responsible for the field being inspected, the General Inspectorate of the Government, the inspected object, the head of the agency or organization directly managing the inspected object (if any), and related agencies and organizations;

c) The Inspection Conclusion signed by the Director of the Fire Prevention and Fighting Police Bureau must be sent to the Deputy Minister of Public Security responsible for inspection, the Deputy Minister of Public Security responsible for fire prevention and fighting, the Chief Inspector of the Ministry of Public Security, the inspected object, the head of the agency or organization directly managing the inspected object (if any), and related agencies and organizations;

d) The Inspection Conclusion signed by the Director of Provincial Public Security, the Director of Provincial Fire Prevention and Fighting Police Bureau must be sent to the Chief Inspector of the Ministry of Public Security, the inspected object, the head of the agency or organization directly managing the inspected object (if any), and related agencies and organizations;

đ) The Inspection Conclusion signed by the Chief Inspector of Provincial Public Security, the Chief Inspector of Provincial Fire Prevention and Fighting Police Bureau must be sent to the head of the same-level public security, the Chief Inspector of the Ministry of Public Security, the inspected object, the head of the agency or organization directly managing the inspected object (if any), and related agencies and organizations.

5. If the Inspection Conclusion contains content belonging to the list of state secrets, the Head of the Inspection Team must propose the signatory of the Inspection Conclusion to determine the level of confidentiality and circulation scope in accordance with the law on protecting state secrets.

Article 21. Publicizing the Inspection Conclusion

1. Within five days from the date of issuance of the inspection conclusion, the Head of the Inspection Team must issue a written notice to the inspected entity regarding the organization of publicizing the inspection conclusion in accordance with the instructions of the person issuing the inspection conclusion.

2. Within ten days from the date of issuance, the inspection conclusion must be publicized, except for inspection conclusions containing contents listed in the State Secrets Catalogue.

3. The publicizing of the inspection conclusion shall be carried out in accordance with the provisions of Clause 2 of Article 39 of the Inspection Law, Article 46 of Decree No. 86/2011/NĐ-CP, and the following provisions:

a) Announcing the inspection conclusion at a meeting including the person issuing the inspection conclusion or their authorized representative, the Inspection Team, the inspected entity, relevant agencies, organizations, individuals, or organizing a press conference. The announcement of the inspection conclusion at the meeting must be recorded in a minutes document to be kept in the inspection file and handed over to the inspected entity. If a draft has been approved, the inspection conclusion must be sent to the inspected entity for knowledge and implementation of recommendations stated therein;

b) In addition to publicizing the inspection conclusion as prescribed in point a of this clause, the person signing the inspection conclusion must implement at least one of the following forms if the inspection conclusion does not contain contents listed in the State Secrets Catalogue:

- Announcing on mass media, including: Radio news, television news, print newspapers, online newspapers. The announcement period on radio news and online newspapers must be at least two times; on television news, at least two broadcasts; on print newspapers, at least one issue;

- Announcing on the electronic information website of the inspecting agency or the police agency at the same level for at least five consecutive days;

- Handing over to the inspected entity to post the inspection conclusion at their workplace; the posting period must be at least fifteen consecutive days;

c) Within ten days from the date of issuance, the person issuing the inspection conclusion is responsible for providing part or all of the inspection conclusion to relevant agencies, organizations, or individuals related to the implementation of the inspection conclusion.

4. The organization of announcing the inspection conclusion at a meeting and selecting methods of publicizing the inspection conclusion shall be decided by the person signing the inspection conclusion based on the proposal of the Head of the Inspection Team.

Article 22. Returning Files and Documents

1. After issuing the inspection conclusion, the Head of the Inspection Team is responsible for organizing the return of files and documents that do not need to be seized to the inspected entity.

2. Before issuing the inspection conclusion, the Head of the Inspection Team may decide to return files and documents provided that they do not need to be seized or are no longer related to the content of the inspection conclusion.

3. The return of files and documents must be recorded in a minutes document.

Article 23. TEnding the activities of the Inspection Team

1. After announcing the inspection conclusion, the Head of the Inspection Team is responsible for convening a meeting of the Inspection Team to summarize its activities. The summary includes:

a) Evaluating the inspection results compared to the objectives, requirements, and content of the inspection;

b) Evaluating the performance of the Inspection Team and each member in fulfilling their assigned responsibilities; the implementation of the Inspection Team's operational regulations, specialized inspection procedures, conduct rules for inspectors, and other relevant regulations concerning the activities of the Inspection Team;

c) Experiences drawn from the inspection;

d) Recommendations and proposals of the Inspection Team (if any).

2. Upon completion of summarizing the activities of the Inspection Team, the Head of the Inspection Team must report in writing to the person issuing the inspection decision and the head of the main unit conducting the inspection; simultaneously, send a notification document about the end of the inspection and comments on participating inspectors to the heads of agencies and units that have dispatched personnel to join the Inspection Team.

3. Rewards and disciplinary actions for the Inspection Team:

a) If the Inspection Team completes its tasks excellently and the Head of the Inspection Team and members of the Inspection Team achieve outstanding results during the inspection, they should be proposed for rewards by the person issuing the inspection decision or competent authority. The evaluation and proposal for rewards must be conducted openly, democratically, and objectively in accordance with the law and guidelines of the specialized agency on commendation and reward;

b) During the inspection process, if the Head of the Inspection Team or members of the Inspection Team violate inspection laws or commit other illegal acts, they must be examined and dealt with according to the regulations.

Article 24. Inspection dossier

1. The head of the inspection team shall be responsible for organizing the establishment and management of the inspection dossier in accordance with the regulations on the file system of the People's Public Security.

2. Within fifteen days from the date of completing the public announcement of the inspection conclusion, the head of the inspection team shall be responsible for transferring the dossier to the unit or department managing the archival storage in accordance with the regulations. The transfer of the inspection dossier must be recorded in a protocol.

Chapter III

IMPLEMENTING PROVISIONS

Article 25. Effective Date

This Circular takes effect from March 1, 2015, and replaces Decision No. 45/2007/QĐ-BCA(V24) dated January 17, 2007, issued by the Minister of Public Security on the procedure for a specialized inspection conducted by the People's Public Security force.

Article 26. Responsibility for Implementation

1. The Ministry of Public Security Inspectorate shall be responsible for guiding, urging, and inspecting the implementation of this Circular.

2. The heads of the General Directorates, the heads of units under the Ministry, the Directors of Public Security, the Directors of Fire Prevention and Control Police in provinces and centrally governed cities, and related organizations and individuals shall be responsible for implementing this Circular.

During the implementation process, if there are difficulties or obstacles, local public security agencies, organizations, and individuals shall report to the Ministry of Public Security (through the Ministry of Public Security Inspectorate) for timely guidance.
