Pursuant to the Education Law on 14 20May 19, 2005 and the Law Amending and Supplementing Certain Provisions of the Education Law on November 25, 2009;
Pursuant to the Higher Education Law on June 18, 2012;

The Minister of Education and Training issues this Circular stipulating the determination of admission quotas for vocational training at the intermediate and college levels in teacher training programs; bachelor's, master's, and doctoral levels.
Article 1. Scope of regulation and applicable subjects
Article 1. This Circular stipulates the determination of admission quotas for vocational training at the intermediate and college levels in teacher training programs; bachelor's, master's, and doctoral levels.
Article 2. This Circular applies to universities, academies, university institutions; research institutes permitted to train at the doctoral level; colleges and intermediate schools permitted to train in teacher training programs (hereinafter referred to collectively as educational institutions); organizations and individuals related thereto.
1. Training institutions base their determination and implementation of annual enrollment quotas on the conditions ensuring quality of training and socio-economic development requirements, exercising autonomy and accountability.
Article 3. Creating conditions for educational institutions to base their decisions on quality assurance conditions and the demand for economic and social development of the labor market, to have autonomy and be accountable for determining and implementing annual admission quotas.
Article 4. Publicly and transparently disclose quality assurance conditions, the basis for determining admission quotas, and the employment rate of graduates from educational institutions for state management agencies to inspect, supervise, and for the public to monitor and for students to choose educational institutions for application.
Article 5. Fields and clusters of education and training
Clause 1. The fields of education and training in determining admission quotas shall be defined according to the fourth-level education and training directory as currently prescribed by the Ministry of Education and Training.
Clause 2. Clusters are determined by a set of one or more second-level education and training areas in the national education system's education and training directory issued by the Prime Minister. The division of clusters is specified in Appendix II of this Circular.
Article 6. Full-time lecturers, visiting lecturers
a) Full-time lecturers of public educational institutions are civil servants hired, used, and managed in accordance with the laws on civil servants;
b) Full-time lecturers of private educational institutions are employees under labor contracts with a term of three years or indefinite-term contracts under the Labor Code, not being state officials or civil servants, not working under labor contracts with other employers for a term of three months or more; paid salaries and other benefits in accordance with current regulations by the educational institution.
Clause 2. Full-time lecturers of private educational institutions are employees who sign a labor contract with a term of three years or an indefinite-term contract under the Labor Code, not civil servants or state officials, not working under a labor contract with another employer for a term of three months or longer; paid by the school and provided other benefits under current regulations.
Clause 3. Visiting lecturers in determining admission quotas must have a master's degree or higher, sign a visiting lecturer contract in accordance with the regulations on visiting lecturers in educational institutions and other relevant current regulations, and be paid by the educational institution according to the visiting lecturer contract.

For the arts cluster, artists recognized as People's Artists with a bachelor's degree in the same field as the training program are considered equivalent to lecturers with a doctoral degree; artists recognized as Meritorious Artists with a bachelor's degree in the same field as the training program are considered equivalent to lecturers with a master's degree.
Article 5. Number of converted lecturers by field
1. The number of converted lecturers by field includes: converted permanent lecturers and converted visiting lecturers of that field.
2. The number of converted permanent lecturers by field includes: converted major-specific permanent lecturers and converted common subject permanent lecturers of that field. Among them, the number of converted common subject permanent lecturers of the field is determined as follows:

3. The maximum number of converted visiting lecturers is determined based on the enrollment quota by field as follows:
a) Field I:
- For teacher training majors: not counted to determine the enrollment quota.
- For other majors: calculated at a maximum of 5% of the total number of converted permanent lecturers.
b) Field II: calculated at a maximum of 30% of the total number of converted permanent lecturers.
c) Other fields: calculated at a maximum of 5% of the total number of converted permanent lecturers.
4. In cases where the number of converted visiting lecturers is lower than the maximum allowable ratio under Clause 3 of this Article, the quota shall be determined based on the actual number of converted visiting lecturers.
5. For lecturers teaching multiple fields, they shall only be counted for one field to determine the enrollment quota.
6. Each lecturer can only be counted once at the highest conversion rate.
Article 6. Criteria and method of calculating criteria to determine regular enrollment quotas for educational institutions
1. The criterion of the number of regular students per converted lecturer by each field of the educational institution.
a) Regular students in determining the enrollment quota include: regular university students, regular college students, and regular secondary vocational students in teacher training majors, regular transfer students, and regular second-degree students trained through regular forms.
b) The number of regular university students per converted lecturer by field shall not exceed the following standards:

The number of regular college and secondary vocational teacher training students per converted lecturer does not exceed 25 regular students.
c) Calculation method:
Total regular student scale by field divided by the total number of converted lecturers of that field.
2. The criterion of floor area directly serving education owned by the educational institution per regular student for construction projects and requirements regarding types and minimum quantities of learning materials and equipment according to the training program and scientific research.
a) Floor area directly serving education owned per regular student shall not be less than 2.8 square meters.2;
b) Categories included in the calculation of floor area directly serving education and requirements regarding types and minimum quantities of materials/equipment for each category are as follows:
- Auditoriums, lecture halls, various classrooms, multipurpose rooms, offices of professors, associate professors, permanent lecturers: must have sufficient equipment to serve collective activities (for classrooms) and meet the requirements of the training program and scientific research (desks, chairs, sound equipment, projection, lighting, and other necessary equipment).
- Libraries, learning resource centers: must have sufficient types (textbooks, learning resources, documents, reference books) and quantities of rooms (reading rooms, borrowing rooms, search rooms) to meet the requirements of the training program and scientific research. Types of textbooks, learning resources, documents, reference books are stored in printed form, electronic form, and connected to networks and linked for exploitation and use of documents with other educational institutions; and are regularly updated with new documents.
- Research centers, laboratories, experimental facilities, practical bases, internships, practice rooms: must have sufficient types and quantities of practical, internship, and practice equipment to meet the requirements of the training program and scientific research.
c) Calculation method:
Total floor area of construction projects determined at point b of this clause divided by the total regular student scale of the educational institution.
3. Market labor demand and economic-social development requirements: Educational institutions must base their enrollment quotas on market labor demand and economic-social development requirements of the country, locality, and industry.
Article 7. Determining the Enrollment Quota for Regular University Programs
1. Educational institutions shall determine the enrollment quota for regular university programs in accordance with the provisions of this Circular, publicly announce it, and be responsible for explaining the determined enrollment quota, the criteria for determining the quota, the quality of training, and the commitment to meet the social demand for graduates.
2. The annual enrollment quota for regular university programs shall be determined by the total regular training scale defined according to capacity, meeting simultaneously the criteria stipulated in Article 6 of this Circular, minus the total regular student scale currently being trained at the institution, plus the number of students expected to graduate in the year of admission.
3. For training programs that have been recognized as meeting the quality standards of educational quality assessment organizations as provided for in Article 52 of the Higher Education Law, and which have a resolution approving the policy on determining the enrollment quota adopted by the school council or board of management, such programs may independently determine their enrollment quota based on the quality commitment of the training program and the social demand for the field, but not exceeding 120% of the previous year's training quota; they must publicly announce this in the enrollment plan and be accountable to society and competent authorities.
4. Educational institutions that have not been recognized as meeting the quality standards of educational quality assessment organizations shall not increase their enrollment quota compared to the previous year (except for newly established fields of study in the year of admission).
5. The enrollment quota for regular joint-degree university training programs shall be determined in accordance with the provisions of Article 5 of Decision No. 18/2017/QĐ-TTg dated May 31, 2017, of the Prime Minister on joint-degree programs between intermediate-level and college-level education and university-level education.
Article 8. Determining the Enrollment Quota for Regular Training and Continuing Education Programs in Teacher Training Fields
1. Bases for determining the enrollment quota for regular training programs:
a) The demand for teacher recruitment by level, field of study, and the location of human resource utilization after training by localities and educational organizations.
b) Quality assurance conditions and capacity of teacher training fields of educational institutions as stipulated in Article 6 of this Circular.
2. Bases for determining the enrollment quota for continuing education programs:
The enrollment quota for continuing education programs at each level of training shall not exceed 30% of the enrollment quota for regular training programs at the corresponding level.
3. Based on the provisions of this Circular, educational institutions with teacher training programs shall independently determine and register their annual enrollment quotas with the Ministry of Education and Training. The Ministry of Education and Training will notify the enrollment quotas by field, form, and level of training to educational institutions with teacher training programs.
4. The Minister of Education and Training shall consider and decide on assigning tasks for training in certain special cases.
Article 9. Determining the Enrollment Quota for Regular Continuing Education University Programs
1. The determination of the enrollment quota for university programs combining work and study is regulated as follows:
a) The total enrollment quota for university programs combining work and study includes university programs combining work and study, joint-degree university programs combining work and study, second bachelor's degree university programs combining work and study, and shall not exceed 30% of the total regular enrollment quota of the educational institution;
b) The enrollment quota for joint-degree university programs combining work and study shall be determined in accordance with the provisions of Article 5 of Decision No. 18/2017/QĐ-TTg dated May 31, 2017, of the Prime Minister on joint-degree programs between intermediate-level and college-level education and university-level education;
2. The determination of the enrollment quota for distance learning programs shall be based on the proposal of the educational institution. Distance learning shall not be used to train teachers for obtaining degrees.
Article 10. Determining Admission Quotas for Doctoral and Master's Degrees
1. Admission quotas for doctoral and master's degrees shall be determined according to the field of training for universities, academies, university-level institutions, and scientific research institutes that offer doctoral programs (hereinafter collectively referred to as higher education institutions).
2. The maximum admission quota for doctoral programs by field at higher education institutions shall be calculated based on the maximum scale of doctoral training capacity according to capability, meeting simultaneously the criteria stipulated in Clause 4, Article 10 of this Circular, minus the current scale of doctoral training plus the number of doctoral candidates expected to graduate in the year of admission.
3. The maximum admission quota for master's programs by field at higher education institutions shall be calculated based on the maximum scale of training capacity according to capability, meeting simultaneously the criteria stipulated in Clause 4, Article 10 of this Circular.
4. Criteria for determining the maximum number of doctoral candidates and master's students are as follows:
a) Quantity criterion for the maximum number of doctoral candidates and master's students per full-time faculty member.

b) Infrastructure and equipment criteria: Higher education institutions must ensure sufficient infrastructure, laboratories, practical training equipment, libraries, lecture halls, faculty offices, advisor offices, doctoral candidate and master's student facilities in accordance with the requirements of the field, specialty, and type of training program.
c) Labor market demand and socio-economic development criteria: Higher education institutions must base their admission quotas on labor market demands, national and local socio-economic development requirements, and industry requirements.
5. Admission quotas for teacher training programs at the doctoral and master's levels shall be determined in accordance with the principles set forth in Article 8 of this Circular.
Article 11. Procedures for Determining and Announcing Admission Quotas
1. The procedures for determining and announcing admission quotas shall be carried out as follows:
a) Autonomous higher education institutions shall determine admission quotas in accordance with the provisions of this Circular.
b) Fully and regularly update detailed information and data on criteria for determining admission quotas, determined admission quotas, and results of implementing admission quotas into the management software of the Ministry of Education and Training.
c) Publicly and transparently announce quality assurance conditions, databases, criteria for determining admission quotas, admission quotas, recruitment plans, post-graduation employment rates of students, and other necessary information of the institution on its website and in the management software of the Ministry of Education and Training.
d) Prepare a report on determining admission quotas (according to the model in Appendix 1 of this Circular) and submit it to the Ministry of Education and Training before January 30 each year.
2. For teacher training programs, institutions of education shall follow the guidelines of the Ministry of Education and Training.
Article 12. Responsibilities of educational institutions
1. Implement the correct procedure for determining and announcing quotas.
2. Ensuring the truthfulness and accuracy of reported data and the basis for determining admission quotas, annual implementation results of admission quotas, and being responsible for explaining to state management agencies and society.
3. Providing full information on the determination and implementation of admission quotas when requested for verification, inspection, and audit by the Ministry of Education and Training and competent authorities.
Article 13. Inspection, Audit, and Penalty for Violations
1. The Ministry of Education and Training shall organize regular and surprise inspections and audits of the determination and implementation of admission quotas by educational institutions.
2. Educational institutions violating regulations on the determination of admission quotas and the conduct of admissions shall be subject to administrative penalties depending on the severity of the violation according to current regulations.
Individuals committing violations related to the determination of admission quotas shall be subject to disciplinary and administrative sanctions under current laws.
This Circular takes effect from April 15, 2018;
Article 14. Effective Date
- 2. This Circular replaces Circular No. 57/2011/TT-BGDĐT dated December 2, 2011 on the determination of admission quotas for doctoral, master's, bachelor's, college, and vocational high school levels, Circular No. 20/2012/TT-BGDĐT dated June 12, 2012 amending and supplementing Clause 6 of Circular No. 57/2011/TT-BGDĐT, and Circular No. 32/2015/TT-BGDĐT dated December 16, 2015 on the determination of admission quotas for higher education institutions./.
