certification of aquatic products, crop production, and animal husbandry that are produced and processed in accordance with

 Good Agricultural Practices (GAP).

 Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

The Minister of Agriculture and Rural Development issues this Circular amending Circular No. 48/2012/TT-BNNPTNT dated September 26, 2012 of the Ministry of Agriculture and Rural Development on certification of aquatic products, crop production, and animal husbandry that are produced and processed in accordance with Good Agricultural Practices (GAP).

At the proposal of the Director of the Plant Cultivation Department;

Article 1. Amend Circular No. 48/2012/TT-BNNPTNT dated September 26, 2012 of the Ministry of Agriculture and Rural Development on certification of aquatic products, crop production, and animal husbandry that are produced and processed in accordance with Good Agricultural Practices (GAP) (hereinafter referred to as Circular No. 48/2012/TT-BNNPTNT)

1. The name of Circular No. 48/2012/TT-BNNPTNT shall be amended to read "Circular on certification of aquatic products and animal husbandry that are produced in accordance with Good Agricultural Practices (GAP)."

2. Amend Clause 1 of Circular No. 48/2012/TT-BNNPTNT as follows:

"Article 1. Scope of application and subjects regulated

This Circular stipulates the procedures and formalities for designating and managing the activities of certification organizations; evaluating and certifying; and the responsibilities of agencies, organizations, and individuals in the certification of aquatic products and animal husbandry that are produced in accordance with Good Agricultural Practices (GAP).

This Circular applies to organizations and individuals involved in the certification of aquatic products and animal husbandry that are produced in accordance with Good Agricultural Practices (GAP)."

Article 2. Repeal certain provisions of Circular No. 48/2012/TT-BNNPTNT

1. Repeal the phrase: "crop production," "processing," "and/or processing (production/processing)," "/processing" in Clauses 2, 3, 4, 5, 6, and 8 of Article 2.

2. Repeal Clause 2 of Article 4.

3. Repeal the phrase "crop production, plant protection, agronomy, biology for crop production" in Point a of Clause 1 of Article 6.

4. Repeal the phrase "fresh vegetables, fruits, tea under crop production" in Clause 1 of Article 16.

5. Repeal the phrase "Crop Production Department" in Point b of Clause 4 of Article 17.

6. Repeal Code "CGDG-VietGAP-TT 01" in Appendix I.

7. Repeal the phrase "crop production" in Appendix II.

8. Repeal the phrase "/processing" in Appendix III.

9. Repeal the phrases "Crop Production (CP)" and "The code of the first certified organization VietGAP of 2012 designated by the Crop Production Department is VietGAP-CP-12-01" in Appendix VII.

10. Repeal Appendix IXB.

11. Repeal Section III in Appendix XI.

1. This Circular takes effect from August 6, 2018.

Article 3. Implementation Provisions

2. Repeal Decision No. 379/QĐ-BNN-KHCN dated January 28, 2008 of the Ministry of Agriculture and Rural Development promulgating Good Agricultural Practices (GAP) for fresh vegetables and fruits in Vietnam (VietGAP); Decision No. 1121/QĐ-BNN-KHCN dated April 14, 2008 of the Ministry of Agriculture and Rural Development promulgating Good Agricultural Practices (GAP) for fresh tea leaves in Vietnam (VietGAP); Decision No. 2998/QĐ-BNN-TT dated November 9, 2010 of the Ministry of Agriculture and Rural Development promulgating Good Agricultural Practices (GAP) for rice; Decision No. 2999/QĐ-BNN-TT dated November 9, 2010 of the Ministry of Agriculture and Rural Development promulgating Good Agricultural Practices (GAP) for coffee.

1. Entities that have been issued a VietGAP certificate for crop production in accordance with Circular No. 48/2012/TT-BNNPTNT before the effective date of this Circular may continue to use the VietGAP certificate until its expiration date as stated on the certificate and shall be subject to supervision according to the regulations of the certifying organization.

Article 4. Transitional Provisions

2. VietGAP certifying organizations that have been designated in accordance with Circular No. 48/2012/TT-BNNPTNT before the effective date of this Circular shall continue to conduct supervisory activities for entities that have been issued a VietGAP certificate until the expiration date as stated on the certificate./.

2. The VietGAP farming certification organization designated in accordance with Circular No. 48/2012/TT-BNNPTNT shall continue to carry out monitoring activities for facilities that have been issued a VietGAP Certificate until the expiration date stated on the VietGAP Certificate./.
