Regulations on Code of Conduct in Early Childhood Education Institutions, Primary and Secondary Schools, and Continuing Education Institutions primary general education institutions, regular continuing education institutions
Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Lawdated May 11, 2011, of the Government amending and supplementing certain Articles of Decree No. 75/2006/NĐ-CPdated August 2, 2006, of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CPdated January 9, 2013, of the Government amending Point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CPdated May 11, 2011, of the Government amending and supplementing certain Articles of Decree No. 75/2006/NĐ-CP dated August 2, 2006, of the Government detailing and guiding the implementation of certain provisions of the Education Law;
Pursuant to Decree No. 80/2017/NĐ-CP dated July 17, 2017 of the Government on a safe, healthy, friendly educational environment and prevention and control of school violence;
Pursuant to Decision No. 1299/QĐ-TTg dated October 3, 2018 of the Prime Minister approving the Project "Building School Culture of Behavior for the period 2018-2025";
After receiving the agreement of the Ministry of Labor, Invalids and Social Affairs at Circular No. 1450/LĐTBXH-VP dated April 12, 2019 regarding comments on the draft Circular regulating the Code of Conduct in Early Childhood Education Institutions, Primary and Secondary Schools, and Continuing Education Institutions;
At the proposal of the Director of the Department of Political Education and Student Affairs;
The Minister of Education and Training issues this Circular regulating the Code of Conduct in Early Childhood Education Institutions, Primary and Secondary Schools, and Continuing Education Institutions.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates the code of conduct in Early Childhood Education Institutions, Primary and Secondary Schools, and Continuing Education Institutions (hereinafter referred to collectively as educational institutions).
Article 2. This Circular applies to management staff, teachers, employees, students, and parents of students in these educational institutions, including: Kindergartens, independent nursery groups, independent kindergarten classes, primary schools, secondary schools, high schools, multi-grade schools, specialized schools, boarding schools for ethnic minorities, semi-boarding schools for ethnic minorities, preparatory universities, talent schools, and schools for persons with disabilities (hereinafter referred to collectively as primary and secondary schools); continuing education institutions, and related organizations and individuals.
Article 2. Purpose of Establishing the Code of Conduct in Educational Institutions
1. To regulate the behavior of members within educational institutions according to social moral standards and national customs, suitable to the cultural characteristics of the locality and the practical conditions of the educational institution; to prevent and promptly and effectively handle negative behaviors lacking educational value in educational institutions.
2. To build a school culture; to ensure a safe, healthy, friendly educational environment and to prevent and control school violence.
Article 3. Principles for developing the Code of Conduct in educational institutions
1. Compliance with legal regulations; consistent with moral standards, customs, and cultural traditions of the nation.
2. Reflect core values: benevolence, respect, responsibility, cooperation, and honesty in relationships among members within the educational institution with others, the surrounding environment, and themselves.
3. Ensure guidance on moral education, cultural lifestyle development, personal qualities, and capabilities of learners; enhance professional ethics of management staff, teachers, employees, and leadership responsibility of the educational institution.
4. Easy to understand and implement; suitable for age groups, educational levels, and cultural characteristics of each region.
5. The process of drafting, revising, and supplementing the Code of Conduct must be conducted through democratic, objective, transparent discussions and obtain majority consensus from members within the educational institution.
Chapter II
CONTENT OF THE CODE OF CONDUCT
Article 4. General Code of Conduct
1. Strictly adhere to legal provisions regarding the rights and obligations of citizens, civil servants, public officials, teachers, workers, and learners.
2. Lead a healthy, positive lifestyle; show concern, share, and assist others.
3. Protect and maintain the appearance of the educational institution; create a safe, friendly, green, clean, and beautiful educational environment.
4. Management staff and teachers must wear appropriate attire that is formal and suitable for the educational environment and activities; employees must wear attire suitable for the educational environment and job nature; learners must wear neat and clean attire appropriate for their age and educational activities; parents of learners and visitors to the school must wear attire suitable for the educational environment.
5. Do not wear attire that causes discomfort.
6. Do not smoke, consume alcoholic beverages, or use prohibited substances within the educational institution as stipulated by law; do not engage in social vices.
7. Do not use social media to disseminate, promote, or comment on information or images contrary to customs, Party guidelines, state policies, laws, or negatively impact the educational environment.
8. Do not deceive, defame, provoke conflicts, harass, coerce, threaten, or use violence against others.
9. Do not harm one's own or others' health, reputation, dignity, or the collective's credibility.
Article 5. Conduct of Educational Institution Management Staff
1. Conduct towards learners: Use clear and understandable language; show love, responsibility, tolerance; respect differences, treat fairly, listen, encourage, and motivate learners. Do not insult, coerce, oppress, or abuse.
2. Conduct towards teachers and employees: Use clear and respectful language, encourage and support; be serious, set a good example, collaborate in work; protect the reputation, honor, dignity, and develop the capabilities of teachers and employees; foster unity, democracy, fairness, transparency. Do not be arrogant, create difficulties, insult, hold prejudices, favoritism, seek personal gain, shirk responsibility, or cover up violations or blame others.
3. Conduct towards parents of learners: Use clear and respectful language, provide support, cooperate, share, and be friendly. Do not insult, create difficulties, cause trouble, or seek personal gain.
4. Conduct towards visitors to the educational institution: Use clear and respectful language, be courteous and appropriate. Do not insult, create difficulties, or cause trouble.
1. Conduct with Students: Use standard, understandable language; praise or criticize appropriately based on the individual and circumstances; set a good example, be tolerant, responsible, loving; respect differences, treat fairly, advise, listen, encourage students; actively prevent and combat school violence, build a safe, healthy, friendly educational environment. Do not offend, cause harm, seek personal gain; do not discriminate, abuse, harm; do not ignore, avoid or conceal violations by students.
2. Conduct with Management Staff: Use respectful, honest, humble language; actively provide advice and clearly express opinions; comply with leadership directives, management, and assignments as prescribed. Do not offend, cause division; do not ignore, avoid or conceal misconduct by management staff.
3. Conduct with Colleagues and Employees: Use appropriate, honest, friendly, humble language; share and support; respect differences; protect the reputation, honor, and dignity of colleagues and employees. Do not offend, show indifference, cause division.
4. Conduct with Parents of Students: Use appropriate, honest, respectful, friendly, cooperative, sharing language. Do not offend, impose, seek personal gain.
5. Conduct with Guests at Educational Institutions: Use appropriate, respectful language. Do not offend, cause difficulties, inconvenience.
Article 7. Conduct of Staff Members
1. Conduct with Students: Use standard, respectful, responsible, tolerant language; assist. Do not cause difficulties, inconvenience, offend, use violence.
2. Conduct with Management Staff, Teachers: Use appropriate, honest, respectful, cooperative language; fulfill assigned tasks. Do not shirk responsibility, offend, cause division, seek personal gain.
3. Conduct with Colleagues: Use appropriate, cooperative, friendly language. Do not offend, cause division, shirk responsibility.
4. Conduct with Parents of Students and Guests at Educational Institutions: Use appropriate, respectful language. Do not offend, cause difficulties, inconvenience.
Article 8. Conduct of Students in General Education Schools and Continuous Education Centers
1. Conduct with Management Staff, Teachers, Staff Members: Be respectful, courteous, honest, sharing; comply with requirements as prescribed. Do not fabricate information; do not offend spirit, honor, dignity, use violence.
2. Conduct with Other Students: Use appropriate, friendly, honest, cooperative, helping language; respect differences. Do not curse, insult, offend, cause division; do not fabricate, incite; do not spread information to slander, affect the honor, dignity of other students.
3. Conduct with Parents and Relatives: Be respectful, courteous, honest, loving.
4. Conduct with Guests at Educational Institutions: Be respectful, courteous.
Article 9. Conduct of Parents of Students
1. Conduct with Students: Use appropriate, respectful, sharing, encouraging, friendly, loving language. Do not offend, use violence.
2. Conduct with Management Staff, Teachers, Staff Members: Be respectful, responsible, cooperative, sharing. Do not fabricate information; do not offend spirit, honor, dignity.
Article 10. Conduct of Guests at Educational Institutions
1. Conduct with Students: Use appropriate, respectful, friendly language. Do not offend, use violence.
2. Conduct with Management Staff, Teachers, Staff Members: Be appropriate, respectful. Do not fabricate information. Do not offend spirit, honor, dignity.
Chapter III
IMPLEMENTATION
Article 11. Responsibilities of units under the Ministry
The Department of Political Education and Student Affairs shall take the lead and coordinate with relevant units to guide and inspect the implementation of the provisions of this Circular.
1. Direct educational institutions within their jurisdiction to organize and implement the provisions of this Circular at their respective units.
2. Organize inspections and supervision of the development and implementation of the Code of Conduct at educational institutions within their jurisdiction.
Article 13. Responsibilities of Educational Institutions
1. Based on the provisions of this Circular, the heads of educational institutions shall specify the detailed Code of Conduct for implementation within their institutions.
2. Publicize the Code of Conduct in educational institutions on their websites or post it on bulletin boards; regularly promote and ensure understanding of the Code of Conduct among managers, teachers, staff, students, and related organizations and individuals.
3. Implement, evaluate, revise, supplement, improve, and summarize the results of implementing the Code of Conduct, reporting to the direct management level annually.
4. Carry out commendation and disciplinary actions for individuals and groups involved in the implementation of the Code of Conduct according to regulations.
Article 14. Implementation clause
1. This Circular takes effect from May 28, 2019.
2. All previous regulations issued by the Ministry of Education and Training that conflict with the provisions of this Circular are abolished from the date this Circular takes effect.
3. The Heads of the Office, the Heads of the Department of Political Education and Student Affairs, the Heads of relevant units under the Ministry of Education and Training, the Directors of Departments of Education and Training, the Heads of District Offices of Education and Training, and the Heads of educational institutions are responsible for enforcing this Circular./.
