Circular No. 06/2020/TT-BGTVT amending and supplementing certain Articles of Circular No. 03/2017/TT-BGTVT dated January 20, 2017, issued by the Minister of Transport on the content and training programs for seafarers and inland waterway vessel operators.

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004, and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 78/2016/NĐ-CP dated July 1, 2016 of the Government stipulating conditions for operating the service of training seafarers and inland waterway vessel operators;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Article 1. This Circular stipulates traffic control and restriction to ensure safety, prevent drift and restrict inland waterway traffic.

The Minister of Transport hereby issues this Circular amending and supplementing certain provisions of Circular No. 03/2017/TT-BGTVT dated January 20, 2017 of the Minister of Transport on the content and curriculum of seafarer and inland waterway vessel operator training.

Article 1. Amending and supplementing certain provisions of Circular No. 03/2017/TT-BGTVT dated January 20, 2017 of the Minister of Transport on the content and curriculum of seafarer and inland waterway vessel operator training.

1. AMENDING AND SUPPLEMENTING ARTICLE 3 AS FOLLOWS:

"Article 3. Curriculum for seafarer and inland waterway vessel operator training

1. The curriculum for issuing the seafarer certificate as specified in Appendix I attached hereto.

2. The curriculum for issuing the engine room rating certificate as specified in Appendix II attached hereto.

3. The curriculum for issuing the vessel operator certificate as specified in Appendix III attached hereto."

2. Amending and supplementing Clause 5 as follows:

"Article 5. Curriculum for issuing specialized certificates for seafarers and inland waterway vessel operators

1. The curriculum for issuing the high-speed vessel operation certificate as specified in Appendix XI attached hereto.

2. The curriculum for issuing the coastal navigation vessel operation certificate as specified in Appendix XII attached hereto.

3. The curriculum for issuing the safety work certificate on coastal navigation vessels as specified in Appendix XIII attached hereto.

4. The curriculum for issuing the safety work certificate on oil-carrying vessels as specified in Appendix XIV attached hereto.

5. The curriculum for issuing the safety work certificate on chemical-carrying vessels as specified in Appendix XV attached hereto.

6. The curriculum for issuing the safety work certificate on liquefied gas-carrying vessels as specified in Appendix XVI attached hereto.

7. The curriculum for issuing the certificate of study on inland waterway traffic laws as specified in Appendix XVII attached hereto."

3. Amend the Appendices as follows:

a) Replace Appendices I, II, and III issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendices I, II, and III issued together with this Circular;

b) Replace Appendix XI issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendix XI issued together with this Circular;

c) Replace Appendix XIII issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendix XII issued together with this Circular;

d) Replace Appendix XIV issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendix XIII issued together with this Circular;

đ) Replace Appendix XV issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendix XIV issued together with this Circular;

e) Replace Appendix XVI issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendix XV issued together with this Circular;

g) Replace Appendix XVII issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendix XVI issued together with this Circular;

h) Replace Appendix XXI issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017 with Appendix XVII issued together with this Circular;

i) Repeal Appendices XII, XVIII, XIX, and XX issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017;

k) Repeal the machinery operation, repair, electrical systems operation examination and practical examination form as stipulated in Clause 2 Section IV of Appendices VIII, IX, and X issued together with Circular No. 03/2017/TT-BGTVT dated January 20, 2017.

Article 2. Effective Date

This Circular shall take effect from May 1, 2020.

Article 3. Responsibility for Implementation

The Head of the Ministry's Office, the Inspector General, the Directors of Departments, the Director of the Vietnam Inland Waterway Administration, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
