Amending and supplementing certain articles of Circular No. 01/2011/TT-BNG dated June 20, 2011 of the Ministry of Foreign Affairs on procedures for issuing permits to bring corpses, remains, and ashes into Vietnam; Circular No. 02/2011/TT-BNG dated June 27, 2011 of the Ministry of Foreign Affairs guiding procedures for registering Vietnamese citizens residing abroad; Circular No. 04/2020/TT-BNG dated September 25, 2020 of the Minister of Foreign Affairs guiding the issuance, extension, cancellation of diplomatic passports, official passports, and issuance of letters of request for foreign countries to issue visas

Pursuant to the Law on Residence No. 68/2020/QH14 dated November 13, 2020;
Pursuant to Decree No. 104/2022/NĐ-CP dated December 21, 2022 of the Government amending and supplementing certain articles of decrees related to the submission and presentation of household registration books and temporary residence certificates when performing administrative procedures and providing public services;
Pursuant to Decree No. 81/2022/NĐ-CP dated October 14, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

The Minister of Foreign Affairs issues this Circular amending and supplementing certain articles of Circular No. 01/2011/TT-BNG dated June 20, 2011 of the Ministry of Foreign Affairs on Procedures for Issuing Permits to Bring Corpses, Remains, and Ashes into Vietnam; Circular No. 02/2011/TT-BNG dated June 27, 2011 of the Ministry of Foreign Affairs on Guidelines for Procedures for Registering Vietnamese Citizens Residing Abroad; Circular No. 04/2020/TT-BNG dated September 25, 2020 on Guidelines for Issuing, Extending, and Revoking Diplomatic Passports, Official Passports, and Letters of Request for Visas from Foreign Countries.
Article 1. Amending and supplementing Circular No. 01/2011/TT-BNG dated June 20, 2011 of the Ministry of Foreign Affairs on Procedures for Issuing Permits to Bring Corpses, Remains, and Ashes into Vietnam
"b. Documents proving that the applicant falls within the scope specified in Article 5 of this Circular:
- One copy of the passport or travel document of the applicant;
- One copy of the document proving kinship with the deceased;
- One copy of one of the following documents: citizen identification card, confirmation of residential information, notification of personal identification number and citizen information in the National Population Database in cases where the deceased falls within the scope specified in point b, Clause 1, Article 3 of this Circular;
- One original power of attorney in the case where the applicant falls under Clause 2 of Article 5 of this Circular;
"- One original power of attorney in cases where the applicant is the managing agency of the deceased person as stipulated in Clause 3 Article 5 of this Circular."
2. AMENDING CLAUSE 2 OF ARTICLE 6 AS FOLLOWS:
"The application for a permit may be submitted directly to the diplomatic mission or sent via postal service. The file may be submitted electronically if the technical infrastructure at the diplomatic mission allows it (including connection to the National Population Database)."
Article 2. Amending and supplementing Circular No. 02/2011/TT-BNG dated June 27, 2011 of the Ministry of Foreign Affairs on Guidelines for Procedures for Registering Vietnamese Citizens Residing Abroad
1. Amending Clause 1, Article 4 as follows:
"The applicant for registration submits one set of files including:
- One fully completed Citizen Registration Form (which may be filled out online on the website of the agency);
- One copy of the Vietnamese passport or other documents with equivalent value to a Vietnamese passport for the case mentioned in Clause 1 of Article 2 of this Circular;
- One copy of a document with a personal identification number in cases specified in Clause 2, Article 2 of this Circular. In cases where Vietnamese citizens do not have a personal identification number, they submit One copy of a travel document and one copy of a document proving Vietnamese citizenship as stipulated in Article 11 of the Law on Vietnamese Citizenship 2008, amended and supplemented in 2014 (Birth Certificate; Identity Card; Decision on Granting Vietnamese Citizenship, Decision on Reinstatement of Vietnamese Citizenship, Decision Recognizing Adoption of Foreign Children, Decision on Adoption of Foreign Children by Vietnamese Citizens).
- One envelope with prepaid postage and the recipient's address in cases where the applicant wishes to receive the result via postal service."
2. Supplementing Clause 2, Article 4 as follows:
"2. The application for registration may be submitted directly to the diplomatic mission or sent via postal service.
The file may be submitted electronically if the technical infrastructure at the diplomatic mission allows it (including connection to the National Population Database)."
3. Replacing the Citizen Registration Form (Form 01/NG-ĐKCD) and the Citizen Registration Book (Form 03/NG-ĐKCD) issued together with Circular No. 02/2011/TT-BNG dated June 27, 2011 of the Ministry of Foreign Affairs on Guidelines for Procedures for Registering Vietnamese Citizens Residing Abroad with the Citizen Registration Form (Form 01/LS-ĐKCD) and the Citizen Registration Book (Form 03/LS-ĐKCD) issued together with this Circular.
1. Add Article 11 as follows:
"4. The dossier may be submitted through an electronic environment where the technical infrastructure at the passport-issuing agency within the country allows (including connection to the national database on population).
2. Replace the Application Form for Issuance/Extension of Diplomatic Passports/Official Passports/Letter of Request for Visa Issuance from Foreign Countries (Form 01/2020/NG-XNC) issued together with Circular No. 04/2020/TT-BNG dated September 25, 2020 guiding the issuance, extension, revocation of the validity of diplomatic passports, official passports, and issuance of letters of request for visa issuance from foreign countries with the Application Form for Issuance/Extension of Diplomatic Passports/Official Passports/Letter of Request for Visa Issuance from Foreign Countries (Form 01/2023/LS-XNC) issued together with this Circular.
Article 4. Organization of Implementation
1. The Director of the Consular Department, the Director of the Department of Foreign Affairs of Ho Chi Minh City, the head of Vietnamese representative agencies abroad, and related agencies, organizations, and individuals are responsible for organizing the implementation of this Circular. In the course of implementation, if there are difficulties, they are requested to promptly report to the Ministry of Foreign Affairs for consideration and resolution.
2. Files received before this Circular takes effect shall continue to be processed according to the provisions of relevant Circulars.
Article 5. Effective Date
This Circular takes effect from February 15, 2024.
