REGULATIONS ON THE CLASSIFICATION OF CONSTRUCTION PROJECTS AND GUIDELINES FOR APPLICATION IN THE MANAGEMENT OF INVESTMENT CONSTRUCTION ACTIVITIES
Circular No. 06/2021/TT-BXD dated June 30, 2021, of the Minister of Construction on the classification of construction projects and guidelines for application in the management of investment construction activities has been amended and supplemented by:
1. Circular No. 02/2025/TT-BXD dated March 31, 2025, of the Minister of Construction amending and supplementing certain articles of Circular No. 06/2021/TT-BXD dated June 30, 2021, of the Minister of Construction on the classification of construction projects and guidelines for application in the management of investment construction activities;
2. Circular No. 09/2025/TT-BXD dated June 13, 2025, of the Minister of Construction amending and supplementing certain articles of circulars under the State management of the Ministry of Construction related to organizational restructuring, implementation of two-level local administration, and decentralization to local authorities.
Pursuant to the Law on Construction dated June 18, 2014; the Law Amending and Supplementing Certain Provisions of the Law on Construction dated June 17, 2020;
Pursuant to the Law on Architecture dated June 13, 2019;
Pursuant to the Government Decree No. 06/2021/NĐ-CP dated January 26, 2021 detailing certain provisions on quality management, construction works, and maintenance of construction projects;
Pursuant to Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government detailing certain contents regarding project management of investment construction;
Pursuant to Decree No. 81/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
At the proposal of the Director of the National Construction Quality Supervision Agency;
The Minister of Construction promulgates this Circular on the classification of construction projects and guidelines for applying project classification in the management of investment construction activities.[1]
Article 1. Scope of Regulation and Applicability
1[2]Scope of Application
This Circular provides detailed regulations on the classification of construction projects and guidelines for applying project classification in managing investment construction activities as stipulated in the Construction Law; specifically, Article 5, Clause 4 of the Construction Law 2014, amended and supplemented by Clause 3, Article 1 of the Law Amending and Supplementing Certain Provisions of the Construction Law 2020 and Clause 2, Article 3 of Decree No. 06/2021/NĐ-CP.

This Circular applies to investors, project owners, asset owners, managers, users of construction works, domestic contractors, foreign contractors, state management agencies in construction, and other organizations and individuals related to investment construction activities within the territory of Vietnam.
Article 2. Principles for Determining Project Classification
1. The project classification specified in this Circular shall be determined based on the following criteria:
a) Level of importance, capacity scale: Applied to individual projects or a combination of projects or a production line consisting of multiple components within a construction project investment according to the types of projects specified in Appendix I of this Circular;
b) Structural scale: Applied to individual projects within a construction project investment according to the structural types specified in Appendix II of this Circular.
2. The project classification of an individual project is the highest level determined according to Appendices I and II of this Circular. In cases where an individual project is not specified in Appendix I of this Circular, its project classification shall be determined according to the provisions of Appendix II of this Circular, and vice versa.
3. The project classification of a combination of projects or a production line consisting of multiple components shall be determined as follows:
a) Where a combination of projects or a production line consisting of multiple components is specified in Appendix I of this Circular, the project classification shall be determined according to Appendix I of this Circular;
b) Where a combination of projects or a production line consisting of multiple components is not specified in Appendix I of this Circular, the project classification shall be determined according to the classification of the main project (within the combination of projects or production line) with the highest level. The classification of the main project is determined according to the provisions of Clause 2 of this Article.
4. The project classification of existing projects undergoing repair, renovation, or upgrading shall be determined as follows:
a) Where repair, renovation, or upgrading changes the criteria for determining project classification as stipulated in Clause 1 of this Article, the project classification of the project after repair, renovation, or upgrading shall be determined according to the provisions of this Article;
b) In other cases not covered by point a of this clause, the project classification of the project before and after repair, renovation, or upgrading remains unchanged.
5[3]The project classification of independently constructed new structures that are not part of phased investment projects of existing construction projects shall be determined according to the provisions of Clauses 1, 2, and 3 of this Article.
6[4]In cases where projects belong to phased investment projects, the criteria specified in Clause 1 of this Article corresponding to the completion stage shall be used to determine the project classification.
7[5]The determination of project classification for certain types of projects is guided by Appendix III attached to this Circular.
Article 3. Application of project levels in managing investment construction activities
1. The project levels prescribed in this Circular shall be applied as the basis for managing the following investment construction activities:
a) Determining the authority when reviewing feasibility study reports; reviewing or providing opinions on technology for investment construction projects using restricted transfer technologies or investment construction projects with potential negative environmental impacts using technology as stipulated in the Law on Technology Transfer; reviewing implementation design after basic design; inspecting acceptance work during construction and upon completion of construction works;
b) Classifying the capacity of construction activities of organizations and individuals to issue capacity certificates and practice certificates for construction activities;
c) Determining construction works exempt from building permits;
d) Determining construction works required to hold architectural design competitions as provided for in Clause 2, Article 17 of the Architecture Law;
đ) Determining construction works requiring separate technical guidelines to be established;
e) Determining construction works significantly affecting safety and public interests;
g) Determining construction works requiring mandatory professional liability insurance;
h) Determining construction works that must undergo periodic safety assessments during use;
i) Classifying construction accidents and determining the authority to resolve construction accidents;
k) Managing investment construction costs;
l) Determining the warranty period and amount for construction works;
m) Determining construction works that must establish maintenance procedures;
n) Other contents as prescribed by laws on managing investment construction works.
2. The application of project levels to manage investment construction activities as specified in point a, Clause 1 of this Article is as follows:
a) In cases where an investment construction project consists of only one independent main construction work: Apply the project level determined according to the provisions of Clause 2, Article 2 of this Circular;
b) In cases where an investment construction project includes multiple independent main construction works or is constructed along a route (consisting of multiple construction works arranged consecutively along the route): Apply the level of the highest main construction work determined according to the provisions of Clause 2, Article 2 of this Circular;
c) In cases where an investment construction project comprises a combination of main construction works or a production line consisting of multiple components: Apply the project level determined according to the provisions of Clause 3, Article 2 of this Circular;
d) In cases where an investment construction project includes multiple combinations of main construction works, multiple production lines, or a mixed combination: Apply the level of the highest combination of main construction works or production line determined according to the provisions of Clause 3, Article 2 of this Circular.
3. The principles for applying project levels to manage investment construction activities as specified from point b to point n, Clause 1 of this Article are as follows:
a) In cases where the scope of implementation is for a single independent construction work, apply the project level determined for Clause 2, Article 2 of this Circular that construction work;
b) In cases where the scope of implementation is for several construction works within an investment construction project, apply the project level determined for Clause 2, Article 2 of this Circular each reviewed construction work;
c) In cases where the scope of implementation is for an entire combination of construction works or an entire production line consisting of multiple components, apply the project level determined according to the provisions at Clause 3, Article 2 of this Circular. In cases where an investment construction project is implemented along a route, follow the provisions at point d of this clause;
d) In cases where the scope of implementation is for a single construction work, several construction works, or all construction works within an investment construction project implemented along a route, apply the project level determined for Clause 2, Article 2 of this Circular each construction work along the route.
4[6]. In cases of phased investment projects, use the project level prescribed at Clause 6, Article 2 of this Circular to apply project levels in managing investment construction activities as stipulated in Clauses 1, 2, and 3 of this Article.
5[7]. The application of project levels for certain types of construction works is guided in Appendix III issued together with this Circular.
Article 4. Provisions on Transition[8]
1. Projects for construction works under investment projects that have been decided to invest before this Circular takes effect shall be classified according to the provisions of the law at the time of approving the construction project investment plan.
2. In cases where the design of the construction work is adjusted after this Circular takes effect:
a) The adjustment of the construction design does not change the criteria for determining the classification of the construction work as stipulated in Clause 1 of Article 2 of this Circular, then the classification of the construction work shall be determined according to the provisions of the law at the time of approving the construction project investment plan;
b) The adjustment of the construction design changes the criteria for determining the classification of the construction work as stipulated in Clause 1 of Article 2 of this Circular, then the classification of the construction work shall be determined according to the provisions of this Circular.
Article 5. Effective Date[9]
1. This Circular takes effect from August 15, 2021 and replaces Circular No. 03/2016/TT-BXD dated March 10, 2016 of the Minister of Construction on the classification of construction works and guidance on application in investment construction management activities and Circular No. 07/2019/TT-BXD dated November 7, 2019 of the Minister of Construction on amending, supplementing, and replacing some provisions of Circular No. 03/2016/TT-BXD.
2. During implementation, if there are difficulties, organizations and individuals are requested to send their opinions to the Ministry of Construction for consideration and resolution./.

The class of facilities on the "Energy Line" such as Intake Structure, Conveyance Channel (canal, culvert, tunnel), Pressure Tower, Pressurized Pipeline, Outlet Channel or Tunnel, etc., is determined according to the highest class of the hydroelectric power plant specified in point a of item 1.2.5.3 and the scale classification specified in Appendix II of this Circular for the facility being considered. 3[20]. Note:
1. Determining the project level based on the type and scale of the structure is carried out in the following sequence:
a) Based on the characteristics of the project, determine the type of structure according to the Sections in Table 2;
b) Determine the project level according to all classification criteria specified for the determined type of structure at point a (above). The highest level obtained shall be the project level.
2. Some terms used in the classification criteria of Table 2 are understood as follows:
a) Building, Building-like structure: A constructed structure in a cubic form, with parts above ground, composed of load-bearing structures, enclosures (which may or may not exist), and a roof.
b) Ground level or project ground level: Elevation taken according to approved planning (in areas without planning, take according to design elevation or current ground level with existing structures).
c) Above-ground floor: A floor whose floor level is higher than or equal to the project ground level.
d) Basement floor (or underground floor): A floor where more than half of its height lies below the project ground level.
đ) Half-basement floor (or half-underground floor): A floor where half of its height lies above or at the project ground level.
e) Mezzanine floor: An intermediate floor between floors, where its floor (mezzanine floor) lies between the floors with primary functions or between the roof and the floor directly below with primary function; the mezzanine floor has a smaller floor area than the floor directly below with primary function.
g) Attic floor: A floor within the space of a pitched roof, where the entire or part of its vertical surface is formed by the inclined or folded roof surface, and where standing walls (if any) do not exceed 1.5 m above the floor level.
h)||| Top floor or attic top floor: The topmost floor of a building used for enclosing stairwells, elevator shafts, building equipment (if any), and for access to the roof and rescue operations.
i) Technical floor: A floor used for arranging building technical equipment (may combine with emergency shelter spaces in the technical floor).
k) Underground depth: Depth measured from the project ground level to the upper surface of the deepest basement floor.
l) Largest span of building/structure: The maximum distance between the centers of adjacent columns (pillars, walls) used to support horizontal structures (beams, slab floors without beams, roof trusses, bridge trusses, cable-stayed structures...). For frame structures, the span value is taken as 50% of the value specified in Table 2.
m) Total floor area of the building/project: The total floor area of all floors, including basement floors, semi-basement floors, mezzanine floors, technical floors, attic floors, and penthouse floors. The floor area of a floor is the built-up floor area of that floor, including the enclosing walls (or shared walls belonging to the building) and the plan area of balconies, terraces, staircases, elevator shafts, technical boxes, chimneys.
3. Method of determination Height of the project/structure:
a) For projects/structures under item 2.1: Height is measured from ground level to the highest point of the structure (including the penthouse or pitched roof). For projects/structures placed on ground with different ground levels, height is measured from the lowest ground level. If there are technical equipment such as antenna towers, lightning rods, solar energy devices, metal water tanks, etc., at the top of the structure, the heights of these devices are not included in the height of the structure.
b) For structures under item 2.2: The height of the structure is measured from ground level to the highest point of the structure. For structures with different ground levels, height is measured from the lowest ground level.
The height of the structure in certain specific cases is defined as follows:
+ For structures supporting equipment under item 2.2.1: The height of the structure is calculated as the sum of the height of the supporting column/tower/pole and the equipment placed on the supporting column/tower/pole;
+ For structures installed on existing buildings under item 2.2.2: The height of the structure is measured from the base to the top of the installed structure (for example: a BTS tower 12 meters long, installed on the roof of a three-story existing building, the height of this BTS tower structure is calculated as 12 meters).
c) For structures under item 2.3:
- Height of supporting column: The distance from the top surface of the column foundation (supporting footing) to the top of the column;
- Height above ground/water level: The distance from the cable-stayed structure to the ground or water surface (average annual water level) below;
d) For structures containing items under item 2.4: Height of the containing structure is determined similarly to item 2.1
đ) For structures under item 2.5: Height of bridge pier is the distance from the top surface of the pier foundation (supporting footing) to the top of the pier;
e) For retaining walls and revetments under item 2.7:
- Height of wall: Measured from the lower ground surface to the top of the retaining wall;
- Height of revetment: Calculated as the sum of the sub-water and super-water parts of the structure.
g) For structures under item 2.8:
- Structures under item 2.8.1: Height of dam is measured from the lowest foundation surface after excavation (excluding the toe height) to the top of the dam;
- Structures under item 2.8.2: Height of dam is measured from the lowest toe of the dam to the top of the dam.
h) For structures under item 2.14.2: Height is measured from the ground to the top of the structure/project.
4. Method of determination Number of high floors of the project under item 2.1:
Number of high floors of the project: The total of all floors above ground and half/basement floors but excluding the attic floor. In some specific cases, the penthouse and mezzanine floors are not counted in the number of high floors:
- The penthouse is not counted in the number of high floors of the project when the penthouse roof area does not exceed 30% of the main roof area.
- Mezzanine floors are not counted in the number of high floors of the project in the following cases:
+ Single-family houses, single-family houses combined with other residential purposes: A mezzanine floor with an area not exceeding 65% of the area of the main-use floor directly below it, and only one mezzanine floor can be excluded from the number of high floors of the house.
+ Apartment buildings, mixed-use apartment buildings: Only one mezzanine floor is not counted in the number of high floors of the project when the mezzanine floor is solely used for technical areas (such as the bottom floor of a swimming pool, generator floor, or other equipment floors), with an area not exceeding 10% of the area of the floor directly below it and not exceeding 300 square meters.2.
+ Other projects: Mezzanine floors solely used for technical areas, with an area not exceeding 10% of the area of the main-use floor directly below it.
5. For open drainage channels and ditches (infrastructure works): Determine the project grade according to the reinforced structure of the channel bank or channel slope (choose the appropriate type according to item 2.7 or item 2.9 in Table 2).
6. Refer to examples of determining the project grade according to the type and scale of the structure in Appendix III.
ANNEX III
EXAMPLES OF DETERMINING PROJECT GRADE
(Annexed to Circular No. 06/2021/TT-BXD dated June 30, 2021 issued by the Minister of Construction)
3.1 Example 1: Civil use project (civil construction project) - High School A
The investment project "High School A" has a capacity of 1,500 students. The project includes the following works:
- Building A1 (Administrative Building): 8 stories high, total floor area 4,000 m²2;
- Building A2 (Classroom Building): 6 stories high, total floor area 4,650 m²2;
- Building A3 (Classroom Building): 4 stories high, total floor area 4,000 m²2;
- Building A4 (Classroom Building): 5 stories high, total floor area 5,000 m²2;
- Building A5 (Physical Education Building used for indoor training and competition sports, also used for large gatherings and meetings during school events): 2 stories high (18 m), with a 200-seat grandstand, total floor area 2,400 m²2, largest structural span 30 m, total capacity (when organizing events) 750 people;
- Building A6 (Dormitory): 5 stories high, total floor area 3,000 m²2;
- Building A7 (Cafeteria): 2 stories high, total floor area 600 m²2;
- Garden: Area 2 hectares;
- Internal road system within the school: One lane for walking, bicycles, motorcycles, and cars;
- Security fence: 3 meters high;
- Guard House: 1 story high, floor area 12 m²2.
The project grade is determined as follows:
a) Determination of the grade of the main complex of buildings:
High School A has a main complex of buildings used for educational purposes (including buildings from A1 to A5). The project grade based on capacity is determined according to the provisions at Clause 3, Article 2 of this Circular: Corresponding to item 1.1.1.3 of Table 1.1 in Appendix I and with a capacity of 1,500 students, High School A has a project grade based on capacity of Level II.
b) Determination of the grades of buildings within High School A:
- House A1: Not listed in Appendix I Table 1.1, therefore according to the provisions at Clause 2, Article 2 of this Circular, the level of the construction project is determined based on type and structural scale. According to Appendix II Table 2, this project corresponds to item 2.1.1; the level is determined based on total floor area: Level III, based on number of floors: Level II. The level of the House A1 construction project is Level II (the highest level determined).
- House A2: The method for determining the level is similar to that for House A1. The level of the House A2 construction project determined is: Class III.
- House A3: The method for determining the level is similar to that for House A1. The level of the House A3 construction project determined is: Class III.
- House A4: The method for determining the level is similar to that for House A1. The level of the House A4 construction project determined is: Class III.
- House A5: This project has its own capacity scale, therefore the level of the construction project is determined according to the provisions at Clause 2, Article 2 of this Circular as follows:
+ Determining the level based on capacity scale: Corresponds to item 1.1.3.2 in Appendix I Table 1.1 (type of sports facility): Level III; corresponds to item 1.1.4.1 in Appendix I Table 1.1 (type of facility with concentrated large crowds): Level II. The highest level of the project determined based on capacity scale: Level II;
+ Determining the level based on structural scale: Corresponds to item 2.1.1 in Appendix II Table 2; the level is determined based on height: Level III; based on number of floors: Level III; based on total floor area: Level III, based on largest span: Level III. Therefore, the level of the House A5 construction project is Level II (the highest level determined from capacity scale and structural scale).
- House A6: The method for determining the level is similar to that for House A1. The level of the House A6 construction project determined is: Class III.
- House A7: The method for determining the level is similar to that for House A1. The level of the House A7 construction project determined is: Class III.
- Garden: Corresponds to item 1.3.4 in Appendix I Table 1.3, the level of the construction project is determined based on total floor area as Level IV.
- Internal school road system: Is a dedicated road specified in item 1.4.1.5 of Appendix I Table 1.4. The level of the construction project determined is: Level IV.
- Protective fence: Not listed in Appendix I Table 1.1, therefore according to the provisions at Clause 2, Article 2 of this Circular, the level of the construction project is determined based on type and structural scale. According to Appendix II Table 2, this project corresponds to item 2.14.2; the level of the construction project is determined based on height as Level IV.
- Guard house: The method for determining the level is similar to that for House A1. The level of the guard house construction project determined is: Level IV.
c) Applying the level of the construction project in managing investment construction activities:
- Using the level of the construction project to determine the authority as provided in point a clause 1 Article 3 of this Circular: School A High School has a main set of projects, according to point c clause 2 Article 3 of this Circular, applying the level of the main set of projects (determined in part a Example) is Level II.
- Using the level of the construction project to manage investment construction activities is regulated from point b to point n clause 1 Article 3 of this Circular; example classifying the construction activity capability of organizations and individuals participating in construction activities as follows:
+ In case the scope of implementation covers the entire set of projects: According to point c clause 3 Article 3 of this Circular, applying the level of the main set of projects (determined in part a Example) is Level II;
+ In case the scope of implementation covers some projects within the construction project: According to point b clause 3 Article 3 of this Circular, applying the level of each project under consideration (determined in part b Example); for example: House A1 uses the level of the construction project as Level II to apply; House A3 uses Level III to apply; Garden uses Level IV to apply;

- Building Q1 (Office, Training and Research Center of the hospital): 9 floors high, total floor area 8,000 m²2;
- Building Q2 (Outpatient and Laboratory Center): 3 floors high, total floor area 2,500 m²2;
- Building Q3 (Emergency and Surgery): 2 floors high, total floor area 2,000 m²2;
- Building Q4 (Departments and Post-Surgery Treatment Areas): 22 floors high, total floor area 22,000 m²2;

- Building Q1: Not listed in Appendix I Table 1.1, therefore according to the provisions at Clause 2, Article 2 of this Circular, the level of the construction project is determined based on type and structural scale. According to Appendix II Table 2, this project corresponds to item 2.1.1; the level of the Q1 construction project determined is Level II.
- Building Q2: The method for determining the level is similar to that for building Q1. The level of the Q2 construction project determined is: Class III.

- Building X1: Not included in Table 1.1 Appendix I of this Circular, therefore the construction level is determined based on type and structural scale. According to Table 2 Appendix II, this project corresponds to item 2.1.1; the construction level of Building X1 determined is Level II.
- Building X2: The construction level is determined similarly to Building X1. The construction level of Building X2 determined is: Level II.
- Building X3: The construction level is determined similarly to Building X1. The construction level of Building X3 determined is: Class I.

b) Applying the construction level in managing investment and construction activities:

The construction project "Cement Plant A" with a designed capacity of 2 million tons of cement per year. Raw materials inputs such as clay, limestone, coal, additives are supplied by other companies. The project includes the following projects:
- Projects belonging to the main production line (cement production line): Coal grinding house, Raw material grinding house, Powder silo, Transport from powder silo to heat exchanger tower, Heat exchanger tower, Rotary kiln columns, Clinker cooling house, Clinker silo, Transport from clinker silo to cement grinding house, Cement grinding house, Cement silo...
- Other independent projects in the project: Material warehouse; Mechanical workshop; Control house; Medical station; Drainage channel; Cable tunnel; Weighing station and other projects.
The project grade is determined as follows:
a) Determining the construction level of the main production line:
Cement Plant A project has a main production line, the construction level is determined according to the provisions at Clause 3, Article 2 of this Circular. This production line is determined based on production capacity, corresponding to item 1.2.1.2 Table 1.2 Appendix I for cement plants, the construction level of the main production line is Primary Level.
b) Determining the construction level of projects in Cement Plant A:
Industrial projects in the plant are determined based on the provisions at Clause 2, Article 2 of this Circular. Except for the Cement Grinding House which is included in Table 1.2 Appendix I and determined based on production capacity and structural scale, the remaining projects not included in Table 1.2 Appendix I, therefore the construction level is determined based on type and structural scale using Table 2 Appendix II of this Circular. Below are some examples:
- Coal Warehouse (round warehouse with a closed roof, diameter 120 meters): The project corresponds to item 2.1.1 Table 2 Appendix II; determined based on total floor area 11,300 square meters: Level II, based on the largest span structure 120 meters: Level I, based on height 20 meters: Level III. The construction level of the Heat Exchanger Tower: Class I (the highest level determined).
- Support column for rotary kiln (reinforced concrete pile foundation support system for rotary kiln with a diameter of 5 m. Height of the column itself: H1 = 9 m; height including equipment: H = 9 m + 5 m = 14 m): The corresponding project according to item 2.2.1 Table 2 Appendix II, the level of the project determined based on the structural height is Level III.
- Chim khói (reinforced concrete chimney with a height of 120 m): The corresponding project according to item 2.2.1 Table 2 Appendix II, the level of the project determined based on the height is Primary Level.
- Weighing station (vehicle weighing station): Structure in the form of an underground reinforced concrete tank, weighing equipment placed inside the tank; dimensions of the tank (Length x Width x Depth) = (5 m x 14 m x 4.5 m). According to Table 2 Appendix II, the corresponding project is item 2.4; the level determined based on the depth underground is Level III, according to the volume contained (V = 315 m3): Level IV. The level of the Weighing Station: Class III (the highest level determined).

Hydropower Plant B belongs to a project with a combination of main works (including Reservoir, Main Dam, Hydropower Plant). The level of the combination of main works is determined according to the provisions at Clause 3, Article 2 of this Circular. According to the provisions at point b item 1.2.5.3 Table 1.2 Appendix I, the level of the combination of works is determined as follows:
- Reservoir: Corresponding to point b item 1.2.5.3 Table 1.2 Appendix I, the level of the work is determined based on the volume is Level III;
- Main Dam: Corresponding to point c item 1.2.5.3 Table 1.2 Appendix I, the level of the work is determined based on the height of the concrete dam on rock foundation is Level II;
- Hydropower Plant: Corresponding to point a item 1.2.5.3 Table 1.2 Appendix I, the level of the work is determined based on the capacity is Level III.
Therefore, the level of the combination of main works of Hydropower Plant B is Level II (based on the level of the main dam).

The "Mechanical Factory C" investment and construction project aims to produce small mechanical products according to orders from other enterprises. Products of this factory are quite diverse and depend on customer requirements, so at the time of project planning, specific product types and production volumes cannot be determined. The project includes the following works:
- Warehouse: One floor high, largest span 24 m, total floor area 6,000 m2, height from ground outside the building to the top of the roof 12 m;

Mechanical Factory C has one main work which is the Main Production Building. The level of the main work is determined according to the provisions at Clause 2, Article 2 of this Circular are Level II (the level of the Main Production Building is determined in item b of this example).
b) Determining the level of works belonging to Mechanical Factory C:
- Works of warehouse and main production building in Mechanical Factory C are determined according to the provisions at Clause 2, Article 2 of this Circular. These works do not have significant importance or capacity levels and are not included in Table 1.2 Appendix I of this Circular, therefore their levels are determined based on type and scale of the structure.

The "Hanoi TV Tower" project has a main work being the Main Tower and auxiliary works. Determine the level of the main work according to the provisions at Clause 2, Article 2 of this Circular. The Main Tower does not have a degree of importance or capacity scale, therefore the level of the work is determined based on type and structural scale. The determined level is special level (the level of the Main Tower is determined at point b of this Example).
b) Determine the levels of works belonging to the Hanoi TV Tower project:
- Main Tower: According to Table 2 Appendix II, this work corresponds to item 2.2.2; the determined level of the work is based on height as special level.
- Work P1: Level IV (method for determining the level of the work see Example 1 of this Appendix).

The investment and construction project "Highway A" is 200 km long with a design speed of 120 km/h. Along this route, there are the following projects:

- A2 (Road Bridge): 4 spans, largest span 40 m, height of bridge pier 20 m;
- A3 (Tunnel for Road Traffic): Mountain tunnel with reinforced concrete lining, length 300 m, cross-sectional area of the tunnel 200 m²;2;

The Highway Project A is constructed along a route including several main works directly serving transportation (including works A1, A2, and A3) and auxiliary works (A4 and other minor structures). The classification of these works is determined according to the provisions at Clause 2, Article 2 of this Circular as follows:

Classification of Work A2: Level II (the highest level determined).
- Work A3: Without importance level or capacity scale (not listed in Table 1.4 Appendix I), therefore the work classification is determined based on type and structural scale. According to Table 2 Appendix II, this work corresponds to Group 2.6.1, determining the work classification based on total length: Class II, based on cross-sectional area: Class I, based on tunnel shell structure: Class II. Classification of Work A3: Class I (the highest level determined).
b) Determining the classification of auxiliary works:
- Work A4: Without importance level or capacity scale (not listed in Table 1.4 Appendix I), therefore the work classification is determined based on type and structural scale. According to Table 2 Appendix II, this work corresponds to Section 2.1.3, determining the work classification based on height: Class III, based on the largest span: Class III. Classification of Work A4: Class III (the highest level determined).
- Other minor structures (signpost columns, signpost frames, pedestrian underpasses, guardrails...): Determined according to the provisions at Clause 2, Article 2 of this Circular. If the work does not have (or does not have a suitable type) in Table 1.4 Appendix I, then the classification is determined based on type and structural scale (using Table 2 Appendix II).
c) Applying the level of the construction project in managing investment construction activities:
- Using the level of the construction project to determine the authority as provided in point a clause 1 Article 3 of this Circular: The Highway Project A is constructed along a route including several main works, according to point b clause 2 Article 3 of this Circular, applying the highest classification of the main works is special level (classification of Work A1 - already determined in point a Example here) to implement.
- Using the level of the construction project to manage investment construction activities is regulated from point b to point n clause 1 Article 3 of this Circular: Example of classifying the construction activity capacity of organizations and individuals participating in construction activities for one, some, or all works within the investment construction project along the route carried out according to the provisions at point d clause 3 Article 3 Circular this as follows:
+ In case of implementation scope for one work, for example Work A1, apply the work classification (already determined in point a Example here) of Work A1 is special level;
+ In case of implementation scope for some works, for example Work A2 and A3, apply the work classification (already determined in point a Example here) of Work A2 is Level II (for road bridge) and of Work A3 is Primary Level (for traffic tunnel);
+ In case of implementation scope for all works, apply the work classification (already determined in point a and b Example here) of the works along the route.
3.11 Example 11: Transportation - Lighthouse M
"Lighthouse M" built on an island, 50 m high above ground level outside the construction. The classification of "Lighthouse M" is determined according to the provisions at Clause 2, Article 2 of this Circular as follows:
Work "Lighthouse M" is not listed in Table 1.4 Appendix I, therefore the work classification is determined based on type and structural scale. According to Table 2 Appendix II, this work corresponds to Section 2.2.3; the work classification is determined based on the height of the structure as Level II.
3.12 Example 12 - Agricultural and Rural Development - Farm A
The investment construction project "Farm A", area 30 hectares includes the following works:
- A1: Irrigation water supply system for irrigated area 25 hectares;
- A2: Drainage system for area 29.5 hectares;
- A3 (Greenhouse for seedling cultivation): One-story building, height 12 m, largest span 30 m, total area 4,000 m²2;
and other works: Office building, Workers' accommodation, Internal roads; Substation and power lines; Domestic water supply system (water reservoir and pipelines); Wastewater drainage system; Warehouses; Parking lots, Fence.
The project grade is determined as follows:
The Farm A project includes several main works directly serving irrigation and farming tasks (including works A1, A2, and A3) and other auxiliary works. The classification of these works is determined according to the provisions at Clause 2, Article 2 of this Circular as follows:
a) Determining the classification of main works:
- Work A1: A work with capacity scale and without regulations determining classification based on type and structural scale. According to the provisions at Section 1.5.1.1 Table 1.5 Appendix I, the work classification is determined based on the irrigated area as Level IV.
- Work A2: A work with capacity scale and without regulations determining classification based on type and structural scale. According to the provisions at Section 1.5.1.1 Table 1.5 Appendix I, the work classification is determined based on the drainage area as Level IV.
- Work A3: Without importance level or capacity scale (not listed in Table 1.5 Appendix I), therefore the work classification is determined based on type and structural scale. According to Table 2 Appendix II, this work corresponds to Section 2.1.1; the work classification is determined as Level III.

c) Applying the construction level in managing investment and construction activities: The method of determination see Example 3 of this Appendix.
3.13[39] Example 13: Investment Construction Project Passenger Railway Station C
The project includes the following works:
- A1: Railway within the station, track gauge 1,000 mm and crossover track, track gauge (1,435 - 1,000) mm; design speed 100 km/h;
- A2: Two-story station building, total floor area 500 m²2;
- A3: Warehouse, area 2,000 m²2, because of the truss span 12 m, height 8 m;
- A4: Pedestrian overpass within the station, width of deck 3.5 m, longest span 40 m;
- A4: Passenger shelter, area Sm=1,000 m²2, because of the truss span 9 m, height of roof 4.5 m.
The project grade is determined as follows:
The railway passenger station C construction project includes main works A1 and A2 serving rail transportation and auxiliary works A3, A4, and A5.
a) Determination of the grade of the main complex of buildings:
The main works of this station are not listed in Appendix I Table 1.4, therefore according to the provision at point b clause 3 Article 2 of this Circular, the level of the works is determined based on the highest level of the main works as follows:
- Work A1 corresponds to item 1.4.2.2 of Table 1.4 in Appendix I; the level of the work is determined as Level II (based on design speed);
- Work A2 is not listed in Table 1.4 of Appendix I, therefore the level of the work is determined based on type and scale of structure. According to Table 2 of Appendix II, this work corresponds to item 2.1.1 (Building, Building-like Structure); the level of the work is determined as Level III (the highest level determined based on number of floors);
Thus, the level of the main works of the railway passenger station C is Level II (taken from the level of work A1).
b) Determining the level of works within the station area
- Works A1 and A2 have been determined their levels in section a of this Example;
- Work A3 is not listed in Appendix I, therefore the level of the work is determined based on type and scale of structure. According to Table 2 of Appendix II, this work corresponds to item 2.1.1 (Building, Building-like Structure); the level of the work is determined as Level III (the highest level determined based on height and total floor area);
- Work A4 is not listed in Appendix I, therefore the level of the work is determined based on type and scale of structure. According to Table 2 of Appendix II, this work corresponds to item 2.5.3; the level of the work is determined as Level III (based on the largest span of structure);
- Work A5 is not listed in Appendix I, therefore the level of the work is determined based on type and scale of structure. According to Table 2 of Appendix II, this work corresponds to item 2.1.3 (Large-span Frame Structure); the level of the work is determined as Level IV (the highest level determined based on height and the largest span of structure).

- A5: Constructing the runway area as prescribed;
- A6: Other auxiliary works:
+ Drainage system: Constructing circular drainage pipes with diameter D1000, length 2,000 m;
+ Drainage ditch (canal) system: Constructing ditch M1 with rubble concrete, size Bđ =1 m, Bm =4 m, Htb =1.5 m; ditch M2 with BTXM structure, size Bđ =1 m, Bm =4 m, Htb =1.5 m;
+ Service road: Constructing service roads in the runway area with length 7,000 m, width 3.5 m;

The investment construction project for the Runway Area of International Airport A includes several main works (including works A1, A2, A3, A4, A5) directly serving transportation and auxiliary works (mentioned in section A6 above). The levels of these works are determined according to the provisions at Clause 2, Article 2 of this Circular as follows:
a) Determining the classification of main works:
- Work A1: Important work without specific regulations determining level based on type and scale of structure. According to the provisions at item 1.4.6.2 of Table 1.4 in Appendix I, the level of the work is determined as special level.
- Work A2: Important work without specific regulations determining level based on type and scale of structure. According to the provisions at item 1.4.6.2 of Table 1.4 in Appendix I, the level of the work is determined as special level.
- Work A3: Important work without specific regulations determining level based on type and scale of structure. According to the provisions at item 1.4.6.2 of Table 1.4 in Appendix I, the level of the work is determined as special level.
- Work A4: Important work without specific regulations determining level based on type and scale of structure. According to the provisions at item 1.4.6.2 of Table 1.4 in Appendix I, the level of the work is determined as special level.
- Work A5: Important work without specific regulations determining level based on type and scale of structure. According to the provisions at item 1.4.6.2 of Table 1.4 in Appendix I, the level of the work is determined as special level.

3.15[41] Example 15: Investment Construction Project for Expressway B Route in Two Stages (Phased Investment)
According to the approved investment decision, the investment construction project for Expressway B Route is 200 km long, with a design speed of 120 km/h. On this route, there are the following works:
- Expressway B1: Design speed 120 km/h; pavement width 32.25 m;
- Highway Bridge B2.1: 4 spans, largest span 40 m, bridge pier height 20 m;
- Highway Bridge B2.2: 4 spans, largest span 40 m, bridge pier height 25 m;
- Highway Tunnel B3.1 and B3.2: Mountain tunnel, with concrete lining, each tunnel tube is 300 m long and cross-sectional area 200 m2;
- Toll station B4: Structural frame, with roof, height to top of structure 15 m, maximum span length 40 m.
The investment project for constructing Expressway B Route will be carried out over 60 months in two implementation phases (investment periods):
- Phase 1 of the Expressway B construction project (36 months) includes:
+ Expressway B1 Phase 1 (investment period): Design speed 80 km/h; road base width 17 m; put into operation first.
+ Road bridge B2.1.
+ Traffic tunnel B3.1.
- Phase 2 of the Expressway B construction project (24 months) includes:
+ Expressway B1 Phase 2 (final phase): Design speed 120 km/h; road base width 32.25 m;
+ Road bridge B2.2;
+ Traffic tunnel B3.2;
+ Toll station B4.
The project grade is determined as follows:
a) Determining the level of main works in the Expressway B project:
The Expressway B project is constructed along a route with several main works being invested and constructed in two implementation phases (investment periods), the level of works is determined according to the provisions of Clause 2 and Clause 6 Article 2 of this Circular. as follows:
- Expressway B1 (final phase): Special grade (according to the design speed at item 1.4.1.1 Table 1.4 Appendix I).
- Road bridges B2.1 and B2.2: Level II (highest grade determined according to the height of the bridge pier at item 2.5.1 Table 2 Appendix II).
- Traffic tunnels B3.1 and B3.2: Class I (highest grade determined according to the cross-sectional area of the tunnel based on the clear width at item 2.6.1 Table 2 Appendix II).
b) Determining the level of auxiliary works in the Expressway B project:
- Toll station B4: Class III (highest grade determined according to the height and maximum span length at item 2.1.3 Table 2 Appendix II).
c) Applying the level of works in managing investment and construction activities in Phase 1 of the Expressway B project.
The Expressway B project is invested and constructed in implementation phases (investment periods), therefore, the application of the level of works is as follows:
- Using the level of the construction project to determine the authority as provided in point a clause 1 Article 3 of this Circular: Phase 1 of the Expressway B project is constructed along a route with several main works, according to the provisions of Point b Clause 2 and Clause 4 Article 3 of this Circular,applying the highest level of main works (Expressway B1 final phase, already determined in item a Example above) is special level.
- Using the level of the construction project to manage investment construction activities is regulated from point b to point n clause 1 Article 3 of this Circular; for example, classifying the construction activity capacity of organizations and individuals participating in construction activities for one, some, or all works in Phase 1 of the Expressway B project is implemented according to the provisions of Point d Clause 3 and Clause 4 Article 3 of this Circular as follows:
+ In case the scope of implementation is for one work, such as Expressway B1 Phase 1 (investment period), apply the level of works for Expressway B1 final phase (already determined in item a Example above) is special level;
+ In case the scope of implementation is for some works, such as Works B2.1 and B3.1, apply the level of works (already determined in item a Example above) of Work B2.1 is Grade II (for road bridges) and of Work B3.1 is Grade I (for traffic tunnels);
+ In case the scope of implementation is for all works, apply the level of works (already determined in item a Example above) of the works along the route.
d) Applying the level of works in managing investment and construction activities in Phase 2 of the Expressway B project: Similar to item c/.

[7] This paragraph was added pursuant to Clause 3, Article 1 of Circular No. 02/2025/TT-BXD dated March 31, 2025, issued by the Minister of Construction to amend and supplement certain provisions of Circular No. 06/2021/TT-BXD dated June 30, 2021, issued by the Minister of Construction on classification of construction projects and guidance for application in investment construction management activities, which shall take effect from May 20, 2025.
[8] Clause 5, Article 33 of Circular No. 09/2025/TT-BXD dated June 13, 2025, issued by the Minister of Construction to amend and supplement certain provisions of Circulars under the Ministry of Construction's administrative domain related to organizational restructuring, implementation of two-level local government, and delegation to local governments, which shall take effect from July 1, 2025, provides as follows:
"5. Transitional provisions for the content stipulated in Article 10 of this Circular."
a) The classification level of construction projects within investment construction projects decided upon before July 1, 2025, shall be determined according to the legal provisions at the time of the investment decision.
b) In cases where construction projects have been submitted to specialized agencies for review or reviewed for adjustment of feasibility study reports or design drawings implemented after the basic design before July 1, 2025, and meet the conditions for review, the determination of the project classification level and its application in managing investment construction activities shall be based on the legal provisions at the time of submission for review.
c) In cases where there is an adjustment to the construction design before July 1, 2025, but it does not change the level of importance, capacity scale, or structural scale, the project classification level shall be determined according to the legal provisions at the time of the investment decision; if the adjustment changes the level of importance, capacity scale, or structural scale, the project classification level shall be determined according to the provisions of this Circular./.
[9] Article 2 of Circular No. 02/2025/TT-BXD dated March 31, 2025, issued by the Minister of Construction to amend and supplement certain provisions of Circular No. 06/2021/TT-BXD dated June 30, 2021, issued by the Minister of Construction on classification of construction projects and guidance for application in investment construction management activities, which shall take effect from May 20, 2025, provides as follows:
“Article 2. Implementation clause
1. This Circular shall take effect from May 20, 2025.
2. The classification level of construction projects within investment construction projects decided upon before the effective date of this Circular shall be determined according to the legal provisions at the time of the investment decision.
3. In cases where construction projects have been submitted to specialized agencies for review or reviewed for adjustment of feasibility study reports or design drawings implemented after the basic design before the effective date of this Circular and meet the conditions for review, the determination of the project classification level and its application in managing investment construction activities shall be based on the legal provisions at the time of submission for review.
4. In cases where there is an adjustment to the construction design from the effective date of this Circular:
a) If the adjustment does not change the level of importance, capacity scale, or structural scale, the project classification level shall be determined according to the legal provisions at the time of the investment decision;
b) If the adjustment changes the level of importance, capacity scale, or structural scale, the project classification level shall be determined according to the provisions of Circular No. 06/2021/TT-BXD amended and supplemented by this Circular./.
Article 31 Circular No. 09/2025/TT-BXD dated June 13, 2025, of the Minister of Construction amending and supplementing certain provisions of Circulars under the State management of the Ministry of Construction related to organizational restructuring, implementation of two-level local administration, and decentralization to local authorities, shall take effect from July 1, 2025, is stipulated as follows:
“Article 31. Effective date
1. This Circular shall take effect from July 1, 2025.
[10] This Section has been amended and supplemented according to the provisions at Item 1 of the Appendix issued together with Circular No. 02/2025/TT-BXD dated March 31, 2025, of the Minister of Construction amending and supplementing certain provisions of Circular No. 06/2021/TT-BXD dated June 30, 2021, of the Minister of Construction on classification and guidance for application in construction investment management activities, shall take effect from May 20, 2025.
[11] The phrase "General Bureau and equivalent level" has been abolished according to Clause 2, Article 10 of Circular No. 09/2025/TT-BXD, shall take effect from July 1, 2025.
[12] The phrase "high level" has been abolished according to Clause 2, Article 10 of Circular No. 09/2025/TT-BXD, shall take effect from July 1, 2025.

[21] This Section is amended and supplemented pursuant to the provisions of Section 5 of the Appendix issued together with Circular No. 02/2025/TT-BXD dated March 31, 2025, of the Minister of Construction amending and supplementing certain articles of Circular No. 06/2021/TT-BXD dated June 30, 2021, of the Minister of Construction on classification of construction works and guidance for application in investment construction management activities, which shall take effect from May 20, 2025.
[22] This Section is added pursuant to the provisions of Section 6 of the Appendix issued together with Circular No. 02/2025/TT-BXD dated March 31, 2025, of the Minister of Construction amending and supplementing certain articles of Circular No. 06/2021/TT-BXD dated June 30, 2021, of the Minister of Construction on classification of construction works and guidance for application in investment construction management activities, which shall take effect from May 20, 2025.
