Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;

Pursuant to Decree No. 29/CP dated March 30, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decision No. 43/2000/QĐ-BGDĐT dated September 25, 2000 of the Minister of Education and Training on the issuance of the Regulation on the Organization and Operation of Continuing Education Centers;

At the proposal of the Director of the Department of Continuing Education,

DECISION:

Article 1. This Decision promulgates the Regulations on the organization and form of guided self-study for secondary education remedial programs.

Article 2. This Decision shall take effect fifteen days from the date of signature. All previous regulations that conflict with this Decision are hereby abolished.

Article 3. Chairmen of provincial and centrally-administered city People's Committees, Director of the Office of the Ministry, Heads of the Department of Continuing Education, Heads of units related to the Ministry of Education and Training, Directors of Departments of Education and Training, Directors of the School Service Bureau (Ministry of National Defense) are responsible for implementing this Decision./.

REGULATIONS

On the organization and form of guided self-study for secondary education remedial programs

(Issued together with Decision No. 07/2002/QĐ-BGDĐT dated March 19, 2002)

PART I

GENERAL PROVISIONS

 

Article 1. Guided Self-Study.

Guided self-study is a form of study in non-formal education. Students participating in this form must independently study learning materials and textbooks to acquire knowledge and develop skills under the guidance of teachers.

Article 2. Objectives.

The form of guided self-study is applicable to learners aged eighteen years and above who voluntarily register for self-study at continuing education centers and remedial schools.

Article 3. Curriculum.

The form of guided self-study applies only to compulsory subjects in the remedial secondary school curriculum and the remedial high school curriculum.

Article 4. Conditions for institutions organizing guided self-study.

1. Continuing education centers and remedial schools organizing guided self-study must meet the following conditions:

a) Having sufficient qualified teachers to teach subjects according to the program requirements.

b) Having sufficient classrooms to serve concentrated learning periods for students.

c) Being permitted by the Department of Education and Training and the School Service Bureau (Ministry of National Defense).

2. Secondary schools assigned the task of organizing guided self-study must fulfill their responsibilities in accordance with the provisions of this document.

Article 5. Duties and Rights of Learners.

1. Learners studying through guided self-study have duties and rights as stipulated in Articles 32 and 33 of the Regulation on the Organization and Operation of Continuing Education Centers issued together with Decision No. 43/2000/QĐ-BGDĐT dated September 25, 2000 of the Minister of Education and Training.

2. Learners studying through guided self-study must contribute funds for purchasing learning materials, textbooks, and tuition fees.

The amount of tuition fee contributions for guided self-study is determined by the Department of Education and Training, submitted to the provincial People's Committee for approval based on different levels depending on the number of learners and the management method (as provided in this Regulation) to ensure sufficient funding for teacher compensation and learner management costs.

 

Chapter II

ORGANIZATION AND MANAGEMENT OF GUIDED SELF-STUDY

 

Article 6. Enrollment.

1. Students may register for self-study classes individually or for the entire academic level.

2. The student's self-study registration dossier includes: An application form to register for study under the guided self-study format.

- Primary school graduation certificate (general education or supplementary) for students registering for secondary school supplementary classes; Secondary school graduation certificate (general education or supplementary) for students registering for high school supplementary classes.

School record book of previous classes, for students registering for classes that are not first-level classes.

3. The Center for Continuing Education, supplementary cultural schools shall be responsible for:

- Announcing the enrollment plan and procedures at least 45 days before the start of the academic year.

- Receiving and examining students' self-study registration dossiers.

Listing students with complete valid dossiers as stipulated in Clause 2 of this Article, reporting to the Department of Education and Training, the School Administration Bureau (Ministry of National Defense) at least 15 days before the start of the academic year.

- Posting notices of the list of students approved by the Department of Education and Training, the School Administration Bureau (Ministry of National Defense).

4. The Department of Education and Training, the School Administration Bureau (Ministry of National Defense) shall be responsible for reviewing the list of students eligible to study under the guided self-study format at least 10 days before the start of the academic year.

Article 7. Organization and management of students.

1. Depending on the number of students, residential area, and learning conditions, the Center for Continuing Education, supplementary cultural schools shall apply appropriate student management methods (mentoring, group-based, or class-based). If organizing students into classes, there must be a teacher managing the class to assist the Director and Principal.

2. The Center for Continuing Education, supplementary cultural schools directly manage the student roster and self-study plans of students.

Article 8. Activities guiding students' self-study.

1. For the Center for Continuing Education, supplementary cultural schools:

- Gathering students, opening the academic year.

- Announcing the annual plan (including study time, teachers' guidance plan, examination organization plan, student management method); setting requirements for students during the self-study process.

- Distributing and introducing necessary materials and textbooks for the self-study process.

Assigning teachers to guide students' self-study for each subject and class management teachers (if applicable).

2. For teachers assigned to guide students' self-study:

- Agreeing with students on the subject study plan and the self-study guidance organization plan.

- Guiding students on subject requirements; knowledge acquisition methods through learning materials and textbooks; practice and reinforcement methods.

- Preparing teaching materials, questions, and exercises to serve students' study.

- Answering students' inquiries.

- Evaluating and grading students' study results according to regulations.

- Maintaining a grade book to track students' study results; recording school records.

3. Based on the subject curriculum for each class, the Center for Continuing Education, supplementary cultural schools shall specify regular times to gather students to listen to subject teachers' self-study guidance. The number of gatherings depends on the subject and class, but should not be less than 3 times per subject per academic year, depending on the teaching and learning conditions of the center (school).

Article 9. Self-study activities of students.

1. Students are responsible for planning their self-study for one academic year. Depending on their study conditions, during one academic year, students may simultaneously study courses prescribed for a class or complete one course before moving on to another. The self-study plan must be approved by the center for continuing education or the supplementary cultural school where the student has registered for self-study.

2. Based on the guidance of teachers, students independently research each lesson sequentially as prescribed in the curriculum and textbooks to acquire knowledge.

3. After each lesson, after each chapter specified in the curriculum and textbooks, students must be able to answer questions and complete exercises (if any) requested by the teacher. Solutions must be fully recorded in their notebooks.

4. Students have the right to request teachers to clarify and explain difficult issues that they have not understood.

5. Students must participate in examinations lasting one period or longer, mid-term examinations, and final exams as prescribed.

Article 10. Study Duration.

The time required for students to complete a class curriculum is at least one academic year. Depending on the specific conditions of the learner, the study duration for a class may extend beyond one academic year but shall not exceed three years per class.

Article 11. Change in Study Form, Transfer of Schools.

1. Students studying under guided self-study form may change their study form if they meet the following conditions:

- Completion of the curriculum of one class.

- Academic performance classified as average or higher (eligible for promotion).

A request to change the study form and approval from the Director of the Center for Continuing Education and the Principal of the Supplementary Cultural School are required.

2. Students studying under guided self-study form may transfer schools if the Director of the Center for Continuing Education and the Principal of the Supplementary Cultural School at the new location agree to accept them.

 

Chapter III

EXAMINATION, TESTING, AND EVALUATION OF STUDENT ACADEMIC PERFORMANCE

OF STUDENTS

 

Article 12. Examination Forms.

1. Examinations lasting one period or longer:

- Based on the program's regulations for each subject, the center for continuing education or supplementary cultural school will gather students at the center (school) to conduct the examination.

Subject teachers are responsible for preparing examination questions and grading.

- The number of examinations is as prescribed by the current program.

2. Mid-term examinations:

- Immediately after the end of each semester (as stipulated by the program), the center for continuing education or supplementary cultural school will gather students at the center (school) to conduct mid-term examinations.

- The center for continuing education or supplementary cultural school is responsible for preparing examination questions and organizing grading.

3. Notebook examinations:

Each semester (as stipulated by the program), subject teachers will conduct notebook examinations twice, once midway through the semester and once at the end of the semester.

All examination results of students as specified in Points 1 and 2 of this Article must be fully recorded in the scorebook.

Article 13. Evaluation and Classification of Student Academic Performance and Conduct.

1. At the end of each semester and each academic year, subject teachers will calculate the average score for each subject based on the scores recorded in the scorebook.

2. The mid-term average score for each subject is the sum of all examination scores in that semester. The mid-term examination score is weighted by a factor of two.

3. The annual average score for each subject is the sum of the first semester's average score and the second semester's average score.

4. Based on the average scores of subjects, the center for continuing education or supplementary cultural school will organize evaluations and classify academic performance according to the current regulations for students in continuing education centers and supplementary cultural schools.

5. Academic performance of students is recorded in the academic transcript for each class as generally prescribed.

6. Students studying under guided self-study form are not included in the classification of conduct.

Article 14. Promotion.

1. Students who are classified with an academic performance level of average or higher for the entire year shall be promoted.

2. Students classified with weak academic performance shall retake subjects with an average score below 5.0. The retake scores will replace the subject's average score for promotion consideration. There is no limit to the number of retakes.

Article 15. Graduation Examination.

Students who complete the program of each educational level and meet the conditions stipulated in the Regulations on Graduation Examination for Secondary School Equivalency and High School Equivalency shall participate in the Secondary School Equivalency and High School Equivalency graduation examinations.
