CIRCULAR

Amending and supplementing certain contents of Circular No. 76/2007/TT-BNN dated August 21, 2007 of the Ministry of Agriculture and Rural Development guiding the transfer of forests and forestry land to rubber planting in the Central Highlands.

Regarding the guidance on transferring forests and forestry land to rubber planting in the Central Highlands.

 

 
 

 

Pursuant to the Land Law No. 13/2003/QH11 dated November 26, 2003 of the National Assembly of the 11th term and Decree No. 181/2004/NĐ-CP dated October 29, 2004 of the Government on the implementation of the Land Law;

Pursuant to the Forest Protection and Development Law No. 29/2004/QH11 dated December 25, 2004 of the National Assembly of the 10th term, Decree No. 23/2006/NĐ-CP dated March 3, 2006 of the Government on the implementation of the Forest Protection and Development Law, and Decision No. 186/2006/QĐ-TTg dated August 14, 2006 of the Prime Minister on promulgating the Forest Management Regulations;

Pursuant to Resolution No. 66/2006/NQ-QH11 dated June 29, 2006 of the National Assembly of the 11th term on the State Important Projects submitted to the National Assembly for investment approval;

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 170/2004/NĐ-CP dated September 22, 2004 of the Government on the reorganization, reform, and development of state-owned agricultural farms and Decree No. 200/2004/NĐ-CP dated December 3, 2004 of the Government on the reorganization, reform, and development of state-owned forestry farms;

Pursuant to Notification No. 125/TB-VPCP dated August 14, 2006 of the Government Office on the conclusions of the Prime Minister at the Conference on Economic and Social Development in the Central Highlands Region.

The Ministry of Agriculture and Rural Development amends certain points of Circular No. 76/2007/TT-BNN dated August 21, 2007 of the Ministry of Agriculture and Rural Development on guiding the transfer of forests and forestry land to rubber planting in the Central Highlands as follows:

1. Paragraph b, Clause 2, Section II is amended as follows:

"Natural poor forests, young recovering forests, lotus forests, bamboo and rattan forests (collectively referred to as bamboo and rattan forests); poorly performing planted forests."

Poor forests and young recovering forests mentioned in this Circular shall be determined according to the criteria of sub-type IIIA2, RIIIA2 belonging to the condition of forest type group 3; young recovering forests shall be determined according to the criteria of the condition of forest belonging to type group 2 as prescribed in Decision No. 682B/QĐKT dated August 1, 1984 of the Ministry of Forestry (now the Ministry of Agriculture and Rural Development) on issuing the Forest Business Design Standards.

In cases where patches of forests in other conditions with an area of up to 1.0 (one) hectare intermixed within a block of poor forests or young recovering forests within the planned rubber planting area, they may be transferred together with that area of poor forest to avoid patchwork situations and ensure contiguous areas.

2. Paragraph d, Clause 5, Section II is amended as follows:

"The Department of Agriculture and Rural Development shall take the lead and coordinate with relevant provincial agencies to review projects submitted by investors and submit them to the Provincial People's Committee for approval."

3. Paragraph đ, Clause 5, Section II is amended as follows:

"The Forest Service shall take the lead and coordinate with the Forest Inspection Service and related units to inspect the process of changing the purpose of forest use to rubber planting in localities, and propose timely solutions to address difficulties encountered during implementation to the leadership of the Ministry of Agriculture and Rural Development."

This Circular takes effect fifteen days from the date of publication in the Official Gazette.

Provisions in Circular No. 76/2007/TT-BNN dated August 21, 2007 of the Ministry of Agriculture and Rural Development which are not contrary to the provisions of this Circular remain valid.

During implementation, if there are difficulties or obstacles, please report them to the Ministry of Agriculture and Rural Development for timely amendment and supplementation./.
