Guidelines for awarding the Commemorative Medal "For the Population Cause"

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to the Law on Competition and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005;

Pursuant to Decree No. 121/2005/NĐ-CP dated September 30, 2005 of the Government detailing and guiding the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards;

Pursuant to Circular No. 01/2007/TT-VPCP dated July 31, 2007 of the Government Office guiding the implementation of Decree No. 121/2005/NĐ-CP dated September 30, 2005 of the Government detailing and guiding the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards;

After reaching consensus with the Central Steering Committee for Competition and Rewards, the Ministry of Health provides guidelines for awarding the Commemorative Medal "For the Population Cause" as follows:

Article 1. Scope of Regulation and Applicability

Article 1. The Commemorative Medal "For the Population Cause" (including the "Commemorative Medal," "Certificate of the Commemorative Medal" (attached model), and a monetary reward or tangible item as prescribed) is a form of reward by the Minister of Health to recognize the contributions of individuals who have made significant achievements for the Population and Family Planning cause (hereinafter referred to as DS-KHHGĐ).

Article 2. This Circular guides the application subjects, principles, criteria, files, preparation of files, proposal review, and presentation of the Commemorative Medal "For the Population Cause."

Article 3. This Circular applies to:

a) Individuals who are Vietnamese citizens residing within the country, including: Individuals who are civil servants, public officials, and employees (CBCCVC) working in organizations and administrative bodies engaged in population and family planning work; CBCCVC concurrently performing population and family planning work; leaders and managers of population and family planning work, and individuals not involved in population and family planning work;

b) Individuals who are Vietnamese citizens residing abroad;

c) Individuals who are foreign nationals.

Individuals who have been awarded the Medal "For the Population Cause," the Commemorative Medal "For the Population Cause, Family, and Children," or those currently under disciplinary action from a warning level upwards are not eligible subjects under this Circular.

Article 4. Principles for Awarding

Clause 1. The awarding of the Commemorative Medal must ensure accuracy, transparency, fairness, and timeliness.

Clause 2. Each individual can only be considered for the award once.

Article 5. Criteria for Awarding

Clause 1. For civil servants, public officials, and employees working in organizations and administrative bodies engaged in population and family planning work:

a) Civil servants, public officials, and employees at districts, counties, towns, cities directly under provinces/cities; provinces/cities directly under the central government, and at the central level must have worked in population and family planning for ten consecutive years or more;

b) Full-time staff in population and family planning at communes, wards, towns; volunteers in villages, hamlets, ethnic groups, and communities must have worked in population and family planning for seven consecutive years or more; if in mountainous, remote, border, and island areas according to current regulations of the Government, they must have worked in population and family planning for five consecutive years or more.

Clause 2. For civil servants, public officials, and employees concurrently performing population and family planning work: Must have performed concurrent population and family planning work for fifteen years or more.

Clause 3. For leaders and managers of population and family planning work: Must have made significant contributions to achieving population and family planning goals during at least one term of office.

Clause 4. For individuals not involved in population and family planning work: Must have made substantial material or spiritual contributions or have innovative ideas or projects of practical value for the population and family planning cause, highly evaluated by the Minister of Health.

Clause 5. For Vietnamese citizens residing abroad, follow the provisions set out in Clause 3 of this Article.

Clause 6. For foreign nationals, must meet one of the following criteria:

a) Meet the criteria specified in Clause 4 of this Article.

b) Have served one term in agencies, organizations, or projects related to population and family planning in Vietnam, highly evaluated by the Minister of Health.

Clause 7. For individuals whose time in population and family planning work was interrupted due to job rotation or organizational restructuring, the years of service will be cumulatively counted.

Article 4. Documents

The application documents for the award of the Commendation Medal "For Population Cause" shall be established in three sets (originals), each set including:

1. A report or proposal for the award (Form 1);

2. A list of nominees for the award (Form 2);

3. An individual achievement statement with confirmation from the Head of the unit (Form 3). If the nominee is a Vietnamese citizen residing abroad or a foreigner, the achievement statement shall be confirmed by the recommending unit and kept by the Standing Board of the Competition and Reward Council of the General Department of Population and Family Planning.

Article 5. Preparation, submission, receipt of documents and consideration of proposals for the award of the Commendation Medal "For Population Cause"

1. Preparation, submission, receipt of documents and consideration of proposals for the award of the Commendation Medal "For Population Cause":

a) Agencies, units, organizations under the management of districts/cities/counties/provincial cities shall prepare and submit the documents to the Population and Family Planning Center of the district/city/county/provincial city;

b) The Director of the Population and Family Planning Center of the district/city/county/provincial city shall collect the documents and prepare the documents of individuals meeting the criteria to be submitted to the Provincial Population and Family Planning Service;

c) Heads of agencies under provincial cities/directly governed municipalities shall prepare the documents of individuals meeting the criteria within their agencies to be submitted to the Provincial Population and Family Planning Service;

d) The Head of the Provincial Population and Family Planning Service of provincial cities/directly governed municipalities shall be responsible for guiding the preparation of documents, collecting documents, and reviewing individuals meeting the criteria for the award at the provincial level to be submitted to the Competition and Reward Council of the General Department of Population and Family Planning;

đ) Heads of units under the General Department of Population and Family Planning shall prepare the documents of individuals within their units and those outside the General Department of Population and Family Planning working with their units who meet the criteria to be submitted to the Competition and Reward Council of the General Department of Population and Family Planning;

e) The Head of the Population Division or the staff member responsible for population work of central ministries, sectors, and mass organizations shall prepare the documents of individuals meeting the criteria to be submitted to the Competition and Reward Council of the General Department of Population and Family Planning;

f) For individuals working in the field of population and family planning who have retired from agencies or organizations, the Head of the agency or organization shall prepare the documents and send them to the agency or organization receiving the documents as stipulated in points a, b, c, d, đ, e above;

g) In cases where individuals worked in agencies or organizations that have now been dissolved, the agency or organization succeeding the functions and tasks of the dissolved agency or organization shall prepare the documents and propose the award;

h) Vietnamese diplomatic missions abroad shall prepare and submit the documents to the Competition and Reward Council of the General Department of Population and Family Planning for cases meeting the criteria of Vietnamese citizens residing abroad or foreigners not living and working in Vietnam;

i) For foreign individuals working in Vietnam: Foreign individuals working with which agency or organization shall have the Head of the agency or organization prepare the documents and submit them to the Competition and Reward Council of the General Department of Population and Family Planning;

k) The Competition and Reward Council of the General Department of Population and Family Planning is the final entity to receive and review the documents for the General Department Head to submit to the Minister of Health for consideration and decision (through the Standing Board of the Competition and Reward Council of the Ministry of Health).

2. Time for submission of documents: Agencies and units shall submit the application documents for the award of the Commendation Medal to the General Department of Population and Family Planning in two rounds as follows, except in cases of special awards:

a) On World Population Day on July 11: submit to the Competition and Reward Council of the General Department of Population and Family Planning before April 30; the General Department of Population and Family Planning shall submit to the Standing Board of the Competition and Reward Council of the Ministry of Health before May 30 each year;

b) On Vietnam Population Day on December 26: submit to the Competition and Reward Council of the General Department of Population and Family Planning before September 30; the General Department of Population and Family Planning shall submit to the Standing Board of the Competition and Reward Council of the Ministry of Health before October 30 each year; .

Article 6. Organization of awarding Commendation Medals

The awarding of the Commendation Medal "For the Population Cause" is an occasion to honor individuals who have made significant contributions to the population cause; therefore, it must be organized solemnly, ensuring effectiveness, sincerity, avoiding ostentatious formalism and waste. When organizing, it should be combined with other contents of the unit to save time and costs.

Article 7. Effective Date

This Circular takes effect 45 days from the date of signature and issuance. Decree No. 07/2004/QĐ-DSGĐTE dated December 10, 2004, issued by the Minister and Head of the National Committee for Population, Family and Children on the issuance of the "Commendation Medal" and the Regulations on awarding the Commendation Medal "For the Population and Family Cause" is hereby abolished. In the course of implementation, if there are difficulties, they are requested to be reported to the General Department of Population and Family Health for consideration and submission to the Minister of Health for appropriate amendments and supplements./.
