PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the load capacity and width limits of roads; announces the load capacity and width limits of national highways; regulates the operation of overloaded vehicles, vehicles exceeding width limits, tracked vehicles on roads; transportation of oversized and overweight cargo and limits for loading goods on road transport vehicles when participating in road traffic on roads.
Article 2. Applicability
This Circular applies to organizations and individuals related to the announcement of the load capacity and width limits of national highways; the operation of overloaded vehicles, vehicles exceeding width limits, tracked vehicles on roads; transportation of oversized and overweight cargo and limits for loading goods on road transport vehicles when participating in road traffic on roads.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1. The total weight of the vehicle includes the weight of the vehicle itself plus the weight of the cargo loaded onto the vehicle (if any).
2. Axle load of the vehicle is the total weight of the vehicle distributed on each axle (single axle, dual tandem axle, triple tandem axle).
3. The maximum permissible dimensions of motor vehicles on roads are the external dimensions including the width, height, and length of the vehicle and the cargo loaded onto it (if any), which are allowed to participate in road traffic.
4. Tracked vehicle is a self-propelled machine moving on tracks, when participating in road traffic, the teeth of the tracks may cause damage to the road surface and shoulders.
5. Combination of a vehicle with a trailer or semi-trailer is a towing vehicle pulling a trailer or a combination of a tractor unit with a semi-trailer.
6. Non-detachable cargo (non-divisible cargo) is cargo in a consignment still sealed with lead seals or security seals by customs, security, defense authorities, or a combination of components and machinery if disassembled or divided will be damaged or change their functionality.
7. Vehicle owner is an organization or individual registered as the owner of the vehicle.
Chapter II
PROVISIONS ON LOAD CAPACITY AND WIDTH LIMITS OF ROADS;
ANNOUNCEMENT OF LOAD CAPACITY AND WIDTH LIMITS OF NATIONAL HIGHWAYS
Article 4. Load Capacity of Roadways
1. Road load capacity is the ability of bridges and roads to bear loads during exploitation to ensure the design life of the works.
2. The load-bearing capacity of bridges is determined according to the bridge design documents and the actual technical condition of the bridge, announced by the competent authority or indicated by the "weight limit" warning sign.
3. The load-bearing capacity of roads is determined according to the road surface design documents and the actual technical condition of the road, announced by the competent authority or indicated by the "axle weight limit" warning sign.
Article 5. Width Limit of Roadways
1. The width limit of roads is the space with limited height and width dimensions of roads, bridges, ferry terminals, and road tunnels that allow vehicles, including cargo loaded onto them, to pass safely.
2. The height limit of roads is 4.75 meters for expressways, first, second, and third-class roads; 4.5 meters for fourth-class roads and below;
3. The width limit of roads is the lane width limit, depending on the technical grade of the road and the terrain of the road construction route.
Article 6. Announcing the Load Capacity and Width Limit of National Highways
1. Announce the load capacity on certain sections of national highways that have been renovated, upgraded, or newly constructed to be consistent with the design load capacity for single axle trucks of 10 tons/axle and bridge design load capacity simulated according to the H30-XB80 or HL93 load diagram as attached in Appendix 1a of this Circular.
2. Announce the width limit of national highways based on the technical grade of the road and the construction terrain of the highway as specified in Appendix 1b of this Circular for certain sections of national highways listed in Appendix 1a.
3. For bridges on the sections of national highways listed in Appendix 1a that have not yet been renovated or upgraded to meet the announced load capacity and width limit as stipulated in Clauses 1 and 2 of this Article, the road management agency must organize the placement of signs indicating the actual load capacity and width limit of the bridge.
Article 7. Adjusting the Announcement of the Load Capacity and Width Limit of National Highways
Annually, the General Department of Roads of Vietnam shall be responsible for updating new sections of national highways that have been newly constructed, upgraded, or renovated, or sections of national highways that have deteriorated due to road surface damage or poor technical condition of works on the national highway, to announce additional or adjusted load capacity and width limit of national highways as stipulated in Clauses 1 and 2 of Article 6 of this Circular.
Article 8. Circulation of motorized vehicles on roads
1. Motor vehicles satisfying the conditions of load capacity and width limit of the road as announced and the regulations on cargo stacking limits as stipulated in Articles 16, 17, and 18 of this Circular may operate on the sections of national highways specified in Appendix 1a.
Motor vehicles operating through bridges with signs indicating "weight restriction" and actual bridge width limit as stipulated in Clause 3 of Article 6 of this Circular must comply with the weight restriction signs, bridge width limit, speed, and safe distance between vehicles when crossing the bridge.
2. On other sections of roads outside the list announced in Appendix 1a, the vehicle owner, transport lessee, or driver must comply with the local road load capacity and width limit regulations announced by the provincial People's Committee or signs indicating "weight restriction," permitted road width limit, speed, and safe distance between vehicles when operating on the road, and the regulations on cargo stacking limits on motor vehicles.
3. In cases where it is necessary to transport indivisible goods or operate vehicles with total weight or dimensions exceeding the road load capacity or width limit, the vehicle owner, transport lessee, or driver must apply for a permit from the competent road management authority before participating in road traffic.
Chapter III
REGULATIONS ON OVERLOAD VEHICLES, OVERWIDTH VEHICLES,
TRACK-LAYING VEHICLES CIRCULATING ON ROADS
Article 9. Regulations on Overloaded Vehicles and Oversized Vehicles Permitted to Operate on Roads
1. An overloaded vehicle (hereinafter referred to as an overloaded vehicle) is a motor vehicle whose total weight exceeds the load-bearing capacity of the bridge or whose axle load exceeds the load-bearing capacity of the road.
2. An oversized vehicle permitted to operate on roads (hereinafter referred to as an oversized vehicle) is a motor vehicle whose external dimensions including cargo on the vehicle (if any) exceed the maximum allowable dimensions for motor vehicles when participating in road traffic.
3. Special purpose vehicles with total weight or axle load exceeding the operational load capacity of the road, or external dimensions exceeding the maximum allowable dimensions for motor vehicles when participating in road traffic are also considered overloaded vehicles or oversized vehicles.
4. In addition to the above provisions, other cases shall be decided by the Minister of Transport.
Article 10. Provisions on Track-Laying Vehicles Participating in Traffic on Roadways
Wheeled vehicles participating in road traffic must implement mandatory measures such as installing track shoes, laying mats, or other measures to protect the road surface. If these mandatory measures are not implemented, wheeled vehicles must be transported on other carriers.
Article 11. Circulation of Overloaded Vehicles, Vehicles Exceeding Size Limits, and Track-Laying Vehicles on Roadways
1. The circulation of overloaded vehicles, vehicles exceeding size limits, and track-laying vehicles on roadways must ensure traffic safety and the safety of road infrastructure.
2. Organizations and individuals who are vehicle owners, transporters, transport lessees, or drivers operating overloaded vehicles, oversized vehicles, or wheeled vehicles on roads must comply with the following regulations:
a) Possess a permit for operating overloaded vehicles, oversized vehicles, or wheeled vehicles on roads issued by the competent authority as stipulated in Article 21. The permit for each type of vehicle shall be in the form prescribed in Appendices 2 and 3 of this Circular.
b) Comply with the regulations stated in the vehicle operation permit.
3. Vehicles carrying cargo exceeding the permissible load capacity of the vehicle as designed by the manufacturer or exceeding the permissible load capacity determined by the inspection agency after design modification, or oversized vehicles of the road are not allowed to operate on the road.
Chapter IV
TRANSPORTATION OF OVERSIZE AND OVERWEIGHT CARGO ON ROADS
Article 12. Provisions on Super-Dimensional and Overweight Cargo
1. Super-dimensional cargo is indivisible cargo, when loaded onto a conveyance vehicle, has one of the following external dimensions (of the combination of conveyance vehicle and cargo loaded on it):
a) Length greater than twenty meters;
b) Width greater than two point five meters;
c) Height measured from the highest point of the vehicle's running surface exceeds 4.2 meters, for container-carrying vehicles, as stipulated in Clause 3 of Article 17 of this Circular.
2. Overweight cargo is indivisible cargo with a weight exceeding 32 tons.
Article 13. Conveyance Vehicles for Transporting Super-Dimensional and Overweight Cargo
Oversize and overweight cargo transport vehicles are specialized vehicles designed and manufactured to transport oversize and overweight cargo with dimensions and load capacity suitable for the type of cargo being transported and must comply with the conditions stipulated in the vehicle operation permit.
In necessary cases, oversize and overweight cargo transport vehicles can be modified according to the design documents approved by the competent authority.
Article 14. Circulation of vehicles transporting oversized and overweight cargo on roads
Oversize and overweight cargo transport vehicles operating on roads must comply with the regulations on operating overloaded vehicles, oversized vehicles, and wheeled vehicles on roads as stipulated in Chapter III of this Circular. The permit for oversize and overweight cargo transport vehicles shall be in the form prescribed in Appendix 2 of this Circular.
Chapter V
LIMITS FOR LOADING CARGO ON ROAD TRANSPORT VEHICLES
WHEN PARTICIPATING IN ROAD TRAFFIC
Article 15. Limits for loading cargo on road transport vehicles when participating in road traffic
The loading of goods on road transport vehicles when participating in road traffic must comply with the provisions on the total weight of the vehicle, axle load of the vehicle, permissible height, width, and length of loaded goods as stipulated in Articles 16, 17, and 18 of this Circular, and shall not exceed the design load capacity of the vehicle as recorded in the vehicle registration certificate.
Goods loaded on the vehicle must be neat, securely fastened, and shall not fall off along the way, drag on the road surface, or obstruct the control of the vehicle.
Article 16. Axle Load and Total Weight of the Vehicle
1. Axle Load:
a) Single axle: Axle load of the vehicle ≤ 10 tons/axle.
b) Dual axle set (two axles), depending on the distance (d) between the two axle centers:
- In case d < 1.0 meters, axle load of the dual axle set ≤ 11 tons;
- In case 1.0 meters ≤ d < 1.3 meters, axle load of the dual axle set ≤ 16 tons;
- In case d ≥ 1.3 meters, axle load of the dual axle set ≤ 18 tons.
c) Triple axle set (three axles), depending on the distance (d) between adjacent axle centers:
- In case d ≤ 1.3 meters, axle load of the triple axle set ≤ 21 tons;
- In case d > 1.3 meters, axle load of the triple axle set ≤ 24 tons.
2. Total Weight of the Vehicle:
a) For integral body vehicles:
- With a total number of axles equal to two, the total weight of the vehicle ≤ 16 tons;
- With a total number of axles equal to three, the total weight of the vehicle ≤ 24 tons;
- With a total number of axles equal to four, the total weight of the vehicle ≤ 30 tons;
- With a total number of axles equal to five or more, the total weight of the vehicle ≤ 34 tons;
b) For tractor-trailer combinations with trailers or semi-trailers:
- With a total number of axles equal to three, the total weight of the vehicle ≤ 26 tons;
- With a total number of axles equal to four, the total weight of the vehicle ≤ 34 tons;
- With a total number of axles equal to five or more, the total weight of the vehicle ≤ 40 tons;
c) For integral body vehicles towing trailers or semi-trailers: The total weight of the combination includes the total weight of the integral body vehicle (corresponding to the total weight of the vehicles specified in point a of this clause) and the total axle loads of the trailer or semi-trailer being towed (corresponding to the axle loads specified in Clause 1 of this Article), but shall not exceed 45 tons.
Article 17. Height of Loaded Goods on Road Transport Vehicles
1. For closed-body cargo trucks (with a roof), the permissible height of loaded goods is the height limit within the truck bed according to the manufacturer's design or according to the approved modified design by the competent authority.
2. For open-body cargo trucks (without a roof), goods loaded on the vehicle that exceed the height of the truck bed (according to the manufacturer's design or according to the approved modified design by the competent authority) must be securely fastened, supported, and braced to ensure safety during road traffic. The permissible height of loaded goods shall not exceed the following height limits measured from the highest point of the road surface up:
a) Trucks with a design load capacity for carrying goods of 5 tons or more (recorded in the vehicle registration certificate). The height of loaded goods shall not exceed 4.2 meters;
b) Trucks with a design load capacity for carrying goods of 2.5 tons to less than 5 tons (recorded in the vehicle registration certificate): The height of loaded goods shall not exceed 3.5 meters;
c) Trucks with a design load capacity for carrying goods of less than 2.5 tons (recorded in the vehicle registration certificate): The height of loaded goods shall not exceed 2.8 meters.
3. Special purpose vehicles and container-carrying vehicles: The height of loaded goods (measured from the highest point of the road surface up) shall be implemented as follows:
a) Not exceeding 4.35 meters until December 31, 2010; when passing under bridges or overpasses, the vehicle is only allowed to travel at a speed not exceeding 30 kilometers per hour.
b) Not exceeding 4.2 meters from January 1, 2011.
4. In the case of vehicles carrying loose cargo such as earth, stone, sand, gravel, coal, ore, or similar materials: The height of loaded goods shall not exceed the height of the truck bed according to the manufacturer's design or according to the approved modified design by the competent authority.
Article 18. Width and Length for Loading Goods on Road Transport Vehicles
1. The permissible width for loading goods on road motor vehicles is the width of the cargo box according to the manufacturer's design or the approved modified design by the competent authority.
2. The permissible length for loading goods on road motor vehicles must not exceed 1.1 times the total length of the vehicle according to the manufacturer's design or the approved modified design by the competent authority, and must not exceed 20.0 meters. When transporting goods longer than the cargo box length, warning signals must be provided as prescribed and the goods must be securely fastened to ensure safety when traveling on roads.
3. Passenger vehicles are not allowed to stack cargo or luggage that protrudes beyond the outer dimensions of the vehicle.
4. Motorcycles and motorbikes may not load goods or luggage exceeding 0.30 meters on each side beyond the cargo rack width according to the manufacturer's design, and 0.50 meters behind the cargo rack. The height for loading goods measured from the road surface is 2.0 meters.
5. Simple vehicles may not load goods exceeding one-third of the body length in front and behind; may not exceed 0.4 meters on each side of the wheels, and may not exceed 1.0 meter in front and behind the vehicle.
Chapter VI
ISSUING PERMITS FOR OVERWEIGHT VEHICLES, OVERSIZE VEHICLES,
TRACK VEHICLES, SUPER-LENGTH AND SUPER-WEIGHT VEHICLE TRANSPORT ON ROADS
Article 19. General Provisions on Issuing Permits for Overweight Vehicles, Oversize Vehicles, Track Vehicles, Super-Length and Super-Weight Vehicle Transport on Roads.
1. Permits for overweight vehicles, oversize vehicles, track vehicles, and super-length and super-weight vehicle transport shall only be issued for specific road sections and under special circumstances when there are no other suitable transportation options available or when it is impossible to use other types of road motor vehicles for transportation on those road sections.
2. Permits for oversize vehicles shall not be issued for cases where goods can be disassembled (divided) or for track vehicles that do not implement mandatory measures when participating in road traffic.
3. Permits for vehicles shall not be issued to organizations or individuals who are the owners of the vehicles, transporters, or transport lessees causing damage to road infrastructure due to the operation of overweight vehicles, oversize vehicles, track vehicles, and super-length and super-weight vehicle transport on roads without completing repair and damage remediation work on the road infrastructure.
4. The competent authority issuing permits for vehicles must select the most reasonable route for allowing overweight vehicles, oversize vehicles, track vehicles, and super-length and super-weight vehicle transport based on ensuring safe operation for the transport vehicles and safety for the roads. Strictly prohibit issuing permits for vehicles when they carry goods exceeding the permissible weight according to the manufacturer's design or exceeding the permissible weight determined by the inspection agency after the modified design and specified in the certificate of technical safety and environmental protection for road motor vehicles.
5. In cases where overweight vehicles, track vehicles, and super-heavy vehicle transport exceed the operational load capacity of the road, the organizations or individuals who are the owners of the vehicles, transporters, or transport lessees wishing to operate such vehicles on roads must bear the responsibility for paying the costs of surveying, designing, and implementing reinforcement works, and the costs of inspecting the quality of reinforced roads (if necessary). The competent authority may only issue vehicle permits after the reinforcement work has been completed and a report on the results of the quality inspection of the reinforced road (if applicable) meets the load-bearing capacity caused by the operation of overweight vehicles, track vehicles, and super-heavy vehicle transport.
6. Validity period of the vehicle permit:
a) For overweight vehicles and oversize vehicles operating without having to comply with mandatory conditions such as driving in designated lanes, having escort vehicles, or reinforcing the road or complying with other mandatory traffic safety regulations:
- In cases of operating on newly upgraded and synchronized road sections: The validity period of the vehicle permit is the duration of each individual transport trip or each transport batch but does not exceed 60 days;
- In cases of operating on un-upgraded or incompletely upgraded road sections: The validity period of the vehicle permit is the duration of each individual transport trip or each transport batch but does not exceed 30 days.
b) For overweight vehicles, oversize vehicles, and super-length and super-weight vehicle transport operating while having to comply with mandatory conditions such as driving in designated lanes, having escort vehicles, or reinforcing the road or complying with other mandatory traffic safety regulations: The validity period of the vehicle permit is the duration of each individual transport trip or each transport batch but does not exceed 30 days.
c) For self-propelled track vehicles operating on roads: The validity period of the vehicle permit is the duration of each trip from departure to destination.
d) The validity period of permits for overweight vehicles, oversize vehicles, track vehicles, and super-length and super-weight vehicle transport as stipulated in points a, b, and c of this clause must fall within the validity period of the certificate of technical safety and environmental protection for road motor vehicles.
In cases where the validity period of the certificate of technical safety and environmental protection is shorter than the periods specified in points a, b, and c of this clause, the validity period of the vehicle permit will be equal to the remaining validity period of the certificate of technical safety and environmental protection.
Article 20. Documents, time limit, and procedure for issuing circulation permits for vehicles
1. Documents for requesting issuance of circulation permits for vehicles:
a) Application form for over-weight vehicle circulation permit, oversized vehicle circulation permit, crawler vehicle circulation permit, and extra-long and extra-heavy cargo transport vehicle circulation permit on roads according to the model attached as Appendix 4 and Appendix 5 to this Circular. The application form must be accompanied by a diagram of the vehicle indicating all external dimensions accurately (if the vehicle carries goods, it must indicate all external dimensions accurately when the goods are loaded onto the vehicle or trailer: height, width, length), distance between axles, and tail length.
The application form for circulation permit must be original, clear, complete, without erasures; the organization or individual requesting must be the owner of the means of transport, the transporter, or the person hiring transportation services. The organization or individual requesting must sign, write their full name, and affix their seal (if it is an organization). In cases where the application form for circulation permit does not have a seal, the applicant must personally come to handle the procedures and must present their national identity card.
b) A copy of the vehicle registration certificate or temporary vehicle registration certificate for the towing vehicle, trailer, or semi-trailer (for newly received means of transport).
c) Certified copies of pages detailing the characteristics of the means of transport and the results of the most recent technical safety inspection and environmental protection inspection of the road traffic motor vehicle safety and environmental protection certificate still in effect. For newly received means of transport, only a copy of the technical specifications of the vehicle (sent by the manufacturer along with the vehicle) is required.
d) A commitment letter from the owner of the means of transport regarding ownership of the means of transport at the time of requesting the circulation permit.
Organizations or individuals coming to handle the procedures for requesting issuance of circulation permits for vehicles must bring the original or certified copies of the above-mentioned copies for verification.
2. The time limit for reviewing and issuing circulation permits for vehicles shall not exceed two working days from the date of receipt of complete and valid documents.
In cases where a road test is required to determine the capability to set traffic conditions or reinforce the road, within two working days from the date of receipt of complete and valid documents as stipulated in Clause 1 of this Article, the competent authority issuing circulation permits for vehicles must issue a written request to organizations or individuals requiring circulation of over-weight vehicles, oversized vehicles, crawler vehicles, and extra-long and extra-heavy cargo transport vehicles on roads to conduct a road test or reinforce the road.
The time limit for reviewing and issuing circulation permits for vehicles shall not exceed two working days from the date of receipt of the report on the results of the road test or the report on the completion of road reinforcement work from a consulting organization meeting the conditions for ensuring safe vehicle operation.
3. Procedure for issuing circulation permits for vehicles:
a) Organizations or individuals requiring circulation of over-weight vehicles, oversized vehicles, crawler vehicles, and extra-long and extra-heavy cargo transport vehicles on roads must follow the following procedure:
- Prepare the application documents for circulation permits in accordance with the provisions of Clause 1 of this Article;
- Submit one set of application documents for circulation permits and pay related fees and charges as prescribed by the Ministry of Finance to the competent authority issuing circulation permits for vehicles;
- Conduct and prepare a report on the road test or perform road reinforcement work (if necessary) upon receiving a written request from the competent authority issuing circulation permits for vehicles. Submit one copy of the report on the results of the road test or the report on the completion of road reinforcement work to the competent authority issuing circulation permits for vehicles.
b) The competent authority issuing circulation permits for vehicles will accept and examine the documents. If the conditions are met, they will issue circulation permits for vehicles to organizations or individuals within the time limit specified in Clause 2 of this Article.
Article 21. Authority to Issue Vehicle Circulation Permits
1. The General Directors of Highway Management Zones shall issue circulation permits for vehicles exceeding weight limits, vehicles exceeding dimensional limits, tracked vehicles, and vehicles transporting oversized and overweight cargo operating on the national road network, except for those specified in Clause 3 of this Article.
2. The Directors of Provincial Departments of Transport shall issue circulation permits for vehicles exceeding weight limits, vehicles exceeding dimensional limits, tracked vehicles, and vehicles transporting oversized and overweight cargo operating on the local road network under their management, except for those specified in Clause 3 of this Article.
3. The Director-General of the Vietnam Highway Corporation shall issue circulation permits for cases where vehicles exceeding weight limits, vehicles exceeding dimensional limits, and vehicles transporting oversized and overweight cargo must comply with mandatory conditions such as traveling in designated lanes with escort vehicles or strengthening the roads when circulating.
Article 22. Responsibilities of the Permit Issuing Authorities
1. The authority issuing circulation permits shall be responsible for issuing circulation permits, ensuring that they are issued to the appropriate entities and that the solutions for vehicle circulation are suitable for the condition of the road network, transport means, and traffic safety.
2. The authority issuing circulation permits has the right to temporarily suspend or revoke circulation permits for vehicles exceeding weight limits, vehicles exceeding dimensional limits, tracked vehicles, and vehicles transporting oversized and overweight cargo if they violate the conditions stipulated in the circulation permit or cause damage to road infrastructure without completing repair work.
Article 23. Vehicle Weight Inspection
1. Equipment used for vehicle weight inspection must be regularly inspected and certified according to the law on measurement. Vehicle weight inspection equipment must have a valid certification.
2. The axle load inspection method shall only be applied when it is not possible to inspect the total vehicle weight (at weigh stations). For vehicles with multiple axle groups, the axle with the highest load should be selected for axle load inspection. The total vehicle weight is determined by summing the weights of all axles.
3. A vehicle is considered to exceed the maximum allowable weight for circulation on public roads if it violates either of the following two conditions:
a) The total weight of the vehicle exceeds the maximum allowable weight for circulation on public roads as prescribed in Clause 2 of Article 16 of this Circular;
b) The total weight of the vehicle is less than the maximum allowable weight for circulation on public roads, but the axle load exceeds 1.1 times the maximum allowable axle load for circulation on public roads as prescribed in Clause 1 of Article 16 of this Circular.
Chapter VII
IMPLEMENTATION
Article 24. Inspection, examination, handling of violations, and compensation for damages
1. The inspection, examination, and handling of violations of this Circular shall be carried out in accordance with the current laws on inspection, examination, and handling of violations.
2. In cases where road infrastructure damage occurs due to the circulation of vehicles exceeding weight limits, vehicles exceeding dimensional limits, tracked vehicles, and vehicles transporting oversized and overweight cargo on public roads without complying with the provisions of this Circular, the violating organizations and individuals must bear responsibility for compensation according to the law.
Article 25. Implementation organization
1. The Vietnam Highway Corporation shall uniformly manage, organize, and supervise the issuance of circulation permits for vehicles exceeding weight limits, vehicles exceeding dimensional limits, tracked vehicles, and vehicles transporting oversized and overweight cargo on public roads; and report annually to the Ministry of Transport before December 31 each year on the issuance of circulation permits by the authorities authorized under Article 21 of this Circular.
2. Provincial Departments of Transport shall be responsible for:
a) Regularly inspecting and reporting road conditions within their jurisdiction while informing the Vietnam Highway Corporation so that the Corporation can promptly instruct the permit issuing authorities to issue permits in accordance with the dimensional limits and load capacity of the roads;
b) Issuing circulation permits according to the classification and quarterly reporting to the Vietnam Highway Corporation on the situation of issuing circulation permits for vehicles exceeding weight limits, vehicles exceeding dimensional limits, tracked vehicles, and vehicles transporting oversized and overweight cargo, using the templates at Appendix 6a, Appendix 6b, Appendix 6c, and Appendix 7 attached to this Circular for the Vietnam Highway Corporation to compile and report to the Ministry of Transport.
3. The authorities issuing circulation permits for vehicles exceeding weight limits, vehicles exceeding dimensional limits, tracked vehicles, and vehicles transporting oversized and overweight cargo may collect and use part of the fee for issuing circulation permits according to the regulations of the Ministry of Finance.
Article 26. Implementation Provisions
1. This Circular takes effect 45 days from the date of issuance. Decisions No. 63/2007/QĐ-BGTVT dated December 28, 2007, of the Minister of Transport regarding "Regulations on the transportation of oversized and overweight cargo and the circulation of tracked vehicles causing road surface damage, vehicles exceeding weight limits, and vehicles exceeding dimensional limits on public roads," and Decision No. 60/2007/QĐ-BGTVT dated December 7, 2007, of the Minister of Transport regarding "Regulations on the loading limit of trucks participating in road traffic and the announcement of road load capacity" are hereby abolished.
2. The Heads of the Ministry's Office, the Inspectorate, the Department Heads, the Director-General of the Vietnam Highway Corporation, the Directors of Provincial Departments of Transport, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular.
3. During implementation, agencies, organizations, and individuals should promptly reflect any arising issues to the Ministry of Transport for consideration and resolution./.
