Guidelines for planning the development of agricultural production at the commune level according to National Criteria for New Rural Areas

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on the establishment, approval, and management of overall socio-economic development plans;

Pursuant to Decision No. 491/QĐ-TTg dated April 16, 2009 of the Prime Minister on the issuance of National Criteria for New Rural Areas;

The Ministry of Agriculture and Rural Development guides the planning of agricultural production at the commune level according to National Criteria for New Rural Areas as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability.

Article 1. This Circular stipulates the procedures for establishing, reviewing, approving, and managing agricultural production planning within the administrative boundaries of a commune or equivalent area.

Article 2. The subjects of agricultural production planning at the commune level include: planning for the development of agricultural, forestry, aquaculture, and salt production; land allocation for agricultural production and infrastructure planning to serve agricultural, forestry, aquaculture, and salt production; planning for the development of key varieties, crops, and livestock suitable for local natural conditions, economic and social circumstances, and environmental factors.

Article 3. Organizations and individuals involved in the establishment, review, approval, and management of agricultural production planning at the commune level must comply with the provisions of this Circular and other relevant legal documents.

Article 2. Interpretation of Terms

Point 1. Agricultural production in a broad sense includes sub-sectors such as agriculture (crop cultivation and animal husbandry), forestry, aquaculture, and salt production.

Point 2. Agricultural production planning includes determining production schemes for each stage in the future, spatial arrangement, and appropriate technical infrastructure.

Point 3. Infrastructure planning to serve agricultural production includes determining directions, routes, locations, and developing transportation, irrigation, and power facilities to support agricultural production planning.

Point 4. Land allocation planning for agricultural production includes allocating land funds for various forms of agricultural, forestry, fishery, and salt production development that are suitable for local natural conditions, economic and social circumstances, and environmental factors.

Point 5. Rural areas refer to territories outside the inner city or town areas of cities, towns, and wards managed by the commune-level People's Committee.

Article 3. Establishment of tasks for agricultural production planning at the commune level

Clause 1. Basis for establishing tasks for agricultural production planning.

The People's Committee of the commune sets requirements for agricultural production planning based on the following grounds:

- Grounds for overall socio-economic development planning, industry and sector development planning of the province and district.

- Grounds for government policies, industry, and locality policies.

- Grounds for the goals of agricultural production development, infrastructure construction requirements, and technical facilities serving production in each locality.

- Grounds for land use planning of the province and region, avoiding disruption to overall general planning.

- Grounds for assessing the impact of climate change in the area to minimize risks from natural disasters (floods, landslides, droughts, etc.) on production and living conditions.

Clause 2. Content of establishing tasks for agricultural production planning.

- Determining the boundaries and scale of land for agricultural production; constructing production service facilities.

- Determining the boundaries and scale of land and water bodies for the development of major crops and livestock in the area.

- Planning the network of technical infrastructure facilities and technical facilities serving production.

Chapter II

COMMUNE LEVEL AGRICULTURAL PRODUCTION PLANNING

Article 4. Agricultural production planning

1. Crop cultivation: Arranging the structure of areas for major crop production within the commune: scale and location of each type of short-term and long-term crops.

- Forecasting the production capacity and harvest volume of various crops and livestock within the commune at different stages. Directing the development of market outlets for products.

- Establishing concentrated production zones to invest in intensive, semi-intensive, and extensive farming.

2. Livestock breeding:

- Identifying main and advantageous livestock breeds within the commune, planning the development of farm-scale and industrial-scale breeding operations suitable in size and located away from residential areas to control diseases, reduce product costs, and improve ecological conditions.

- Forecasting the production capacity and harvest volume of various livestock within the commune at different stages. Directing the development of market outlets for products.

3. Land allocation:

- Designing the division of plots and parcels for production: sizes must be convenient and suitable for the development of crops and livestock; for production management and must be compatible with the terrain of the production area.

- Protective forest belt system: Meeting the requirements for protection and safety of related facilities, combining with ditches, embankments, and parcel roads to save land and combine protective benefits with other economic uses.

4. Determining capital needs for production and basic construction investment serving agricultural production for the period 2010-2015 and estimating for the period 2016-2020.

5. Implementation solutions for the plan:

- Solutions on consolidating and reallocating agricultural land.

- Solutions on agricultural extension, science and technology, and technology transfer: methods for promoting and expanding agricultural extension models; techniques for planting, caring for - seeds, feed, cultivation, plant protection, veterinary care; organizational forms - agricultural extension clubs.

- Solutions on developing seed sources, plant protection chemicals, and veterinary drugs.

- Solutions on organizing cooperation for production and consumption of products: groups of farmers with common interests, linkages...

- Solutions on building community services for marketing agricultural products and agricultural supplies.

- Capital solutions: creating capital through mobilizing participation from residents, organizations, and communities, loans, and other support sources to develop production.

- Solutions on constructing essential infrastructure projects serving medium and small-scale production: mobilizing community participation...

Article 5. Forestry production planning

1. Inventory and clearly define the area of various types of forests within the commune, the area of land capable of growing forests, forest management situation. The area of forests allocated to individuals, the area of forests managed by economic and social organizations.

- Specificizing the planning of protective and special-use forests within the commune as a basis for forest owners to establish boundary markers and manage according to current forest management regulations.

- For planned production forest areas: Developing plans and short-term (annual), medium-term, and long-term development programs for each plot and compartment belonging to different owners. Directing the development of market outlets for products from production forests.

2. Land allocation: Designing the division of compartments, plots, and parcels for production: sizes must be convenient and suitable for the development of forest trees, for production management, and must be compatible with the terrain of the production area.

3. Determining capital needs for production and basic construction investment serving forestry production for the period 2010-2015 and estimating for the period 2016-2020.

4. Implementation solutions for the plan:

- Organizational solutions: for communes with more than 5,000 hectares of forest land, there should be a dedicated forestry staff member and a commune forestry board established.

- Land policy solutions: including reviewing the planning of three types of forests, allocating land and forests to individuals and organizations for stable long-term use.

- Capital and credit solutions: creating capital through mobilizing own capital, loans, state budget, international projects, and other support sources for forestry development.

- Market and product consumption solutions: joint ventures to build raw material zones for processing plants, cooperation and development of markets for wood and non-wood forest product consumption.

- Science and technology solutions: researching and applying effective forest management solutions, applying new technologies, high-intensity cultivation techniques, using new high-yield and quality seeds in forestry production through the development of extension systems at all levels.

- Infrastructure development solutions: including essential infrastructure serving forestry development.

- Promoting awareness among the community and residents about forest protection and development.

Article 6. Aquaculture Production Planning

1. Inventory and assess the area of water surfaces and land used for aquaculture and those with potential for aquaculture such as small ponds, natural lakes, tidal flats, bays, marshes, saline paddy fields, sandy coastal lands, and alluvial plains... which have the potential for developing aquaculture.

2. Forecast the production capacity and harvest volume of various aquatic products on the commune's territory at each stage. Provide guidance on developing market outlets for products.

3. Allocate and utilize land and water areas for aquaculture production:

- Plan the scale of cultivation area for each type of aquatic product linked to each farming method and conditions on each site, with indicators for the period 2010-2015 and orientation towards 2020.

- Establish intensive aquaculture zones that strictly comply with regulations on safe farming areas and national standards for industrial farming.

- Design parcel division for production plots and water retention, sedimentation, and treatment systems: dimensions must be convenient and suitable for development of the farming area, management of production, and must match the terrain of the farming area.

- Parcel design must facilitate service provision and product consumption; water source treatment and environmental protection.

4. Determine capital requirements for production and basic construction investment for aquaculture and seed production for the period 2010-2015 and estimate for the period 2016-2020.

5. Implementation solutions for planning:

- Solutions regarding land allocation, land leasing, and water surface areas.

- Solutions for developing seed sources, feed, and veterinary drugs for aquatic animals.

- Organizational cooperation for production and product consumption.

- Capital solutions: create capital through mobilizing own funds, loans, and other support sources to develop production.

- Infrastructure construction solutions for essential facilities serving medium and small-scale aquaculture development: mobilize community participation.

Article 7. Salt Industry Development Planning

1. Plan the scale of salt production area, forecast the salt harvest volume for each production season in a year. Plan annual production for the period 2010-2015 and orientation towards 2020 with all key production and consumption indicators.

2. Land utilization:

- Design parcel division for production plots: dimensions must be convenient for production development and fit the production area's terrain.

- Parcel design must facilitate service provision and product consumption; water source treatment and environmental protection.

3. Determine capital requirements for production, processing, preservation, and consumption of salt for the period 2010-2015 and estimate for the period 2016-2020.

4. Implementation solutions for the plan:

- Solutions regarding land allocation and leasing;

- Organize cooperative production;

- Construct essential infrastructure serving production, processing, preservation, and consumption of salt;

- Develop sales plans, market consumption orientation.

- Capital solutions: create capital through mobilizing own funds, loans, and other support sources to develop production.

- Infrastructure construction solutions for essential facilities serving medium and small-scale production, processing, preservation, and consumption of salt: mobilize community participation.

Article 8. Arrangement of Infrastructure Facilities Serving Agricultural Production

1. Based on agricultural, forestry, aquaculture, and salt industry development planning, including land utilization arrangements to implement infrastructure facility arrangements for production.

2. Intra-field roads: part of the rural road system designed according to the technical standard TCVN 4454/1987 of the Ministry of Construction. The arrangement must ensure a complete and rational intra-field road system to facilitate transportation of materials and agricultural products, promote mechanization of production stages. When designing, note:

- Select short routes with few slopes.

- Utilize existing roads (if suitable).

- Closely integrate road arrangement with irrigation system arrangement.

- Connect production bases and socio-economic facilities within the production area via a rational network of roads suitable for current and future transport means.

3. Intra-field irrigation and drainage system, including irrigation ditches, drainage ditches, embankments, ponds; determine necessary improvements, upgrades, or new constructions to meet irrigation, drainage, and salinity prevention requirements.

4. Electrical system: consider electricity needs for production to arrange appropriate substations and power lines ensuring sufficient supply, safety, and energy efficiency.

5. Implementation solutions: for medium and small-scale projects, mobilize active community participation, with state support for a portion.

Article 9. Adjusting the planning

1. During the process of implementing existing plans, when new requirements not foreseen in previous forecasts and planning schemes appear, and every five years, it is necessary to review and adjust the plan to be consistent with new requirements and circumstances. The authority responsible for approving agricultural production planning decides on the time frame and content of adjusting the rural construction planning.

2. Implementing adjustments to agricultural production planning must ensure continuity, and the requirements and principles that need adjustment must be consistent with the development requirements of agricultural production until 2020, and the list of documents to be adjusted.

3. During the process of formulating planning schemes for agricultural production, if the content of the current agricultural production planning does not align with the approved agricultural production planning tasks but does not change the boundaries, area, or purpose of the planning zone, there is no need to re-establish the planning task. The authority only approves the planning task again to ensure consistency in the planning scheme.

Article 10. Soliciting Opinions on Planning

1. During the process of formulating planning schemes for agricultural production, consulting organizations are responsible for coordinating with local authorities to solicit opinions from organizations and individuals in the planning area through meetings, direct exchanges, or distributing questionnaires regarding the content of the planning scheme to facilitate public access and feedback. All contributions must be fully compiled and reported to the competent authority for consideration before approval.

2. Based on the results of soliciting opinions and the files of planning tasks and schemes, the authority responsible for approving the plan decides on selecting the agricultural production planning scheme.

Article 11. Submitting for Review and Approval of Planning

1. The agency submitting for approval: The People's Committee of the commune is the agency submitting to the People's Committee of the district for approval of planning tasks and schemes for agricultural production.

2. The reviewing agency: The Department of Agriculture and Rural Development of the district or equivalent functional units are responsible for reviewing planning tasks and schemes for agricultural production.

3. The approving agency: The People's Committee of the district is the agency approving planning tasks and schemes for agricultural production.

Article 12. Products of Planning

1. The products of planning are compiled in the planning dossier approved by the People's Committee of the district, including:

- Planning report;

- Illustrative maps.

2. The planning report reflects the current status and potential; development orientation; planning scheme for development and implementation measures for the plan.

2. Main illustrative maps: Soil map, current status and development planning map for agricultural production, current status and development planning map for infrastructure serving agricultural production at scales of 1/5,000 to 1/25,000.

Article 13. Management of Commune-level Agricultural Production Planning

1. The authority responsible for approving commune-level agricultural production planning bases on the approved construction planning project to issue regulations on managing commune-level agricultural production planning.

2. The People's Committee of the commune organizes the announcement and public disclosure of commune-level agricultural production planning with the following contents:

a) The contents of announcing and publicly disclosing commune-level agricultural production planning include:

- Map of the current status of agricultural production in the commune;

- Map of the development planning for agricultural production in the commune;

- Map of the development planning for infrastructure serving agricultural production.

b) During the implementation of the approved commune-level agricultural production planning, ongoing investment projects need to be updated and promptly disclosed in full so that organizations and individuals can know and monitor the implementation.

Chapter III

IMPLEMENTING PROVISIONS

Article 14. This Circular takes effect 45 days from the date of signature.

During the implementation process, if there are emerging issues or difficulties, localities should reflect them to the Ministry of Agriculture and Rural Development for timely supplementation and amendment./.
