CIRCULAR
Amending and supplementing some articles of the Regulation on standards, tasks, responsibilities, authorities, rewards, and disciplinary measures for motor vehicle inspection officers at motor vehicle inspection units issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, which has been amended and supplemented according to Decision No. 3165/2002/QĐ-BGTVT dated October 2, 2002 of the Minister of the Ministry of Transport disciplinary measures for motor vehicle inspection officers at motor vehicle inspection units issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, which has been amended and supplemented pursuant to Decision No. 3165/2002/QĐ-BGTVT dated October 2, 2002 of the Minister of Transport
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Transport,
The Minister of the Ministry of Transport hereby promulgates as follows:
Article 1. Amending and supplementing some articles of the Regulation on standards, tasks, responsibilities, authorities, rewards, and disciplinary measures for motor vehicle inspection officers at motor vehicle inspection units issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, which has been amended and supplemented according to Decision No. 3165/2002/QĐ-BGTVT of the Minister of the Ministry of Transport:
1. Supplement Article 4a after Article 4 of the Regulation issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, as follows:
"Article 4a. Procedures for recognizing motor vehicle inspectors
a) Application form for issuance of a certificate confirming eligibility to operate electronic authentication services according to Model XT01 attached to this Decree;
a) The request for recognition of a motor vehicle inspector from the inspection unit (original);
b) The scientific curriculum vitae form for appointing a motor vehicle inspector according to the model attached to this Regulation (original);
c) University diploma (certified copy or photocopy with original for verification);
d) Training certificate for motor vehicle inspector (certified copy or photocopy with original for verification);
đ) Language certificate: English level A minimum for Class III inspectors; English level B minimum for Class II and Class I inspectors (certified copy or photocopy with original for verification).
2. Procedures and methods of implementation:
a) Organizations and individuals complete the dossier in accordance with Clause 1 of this Article and submit one set of documents directly or through the postal service to the Vietnam Motor Vehicle Inspection Bureau;
b) The Vietnam Motor Vehicle Inspection Bureau receives and checks the dossier components: If the dossier is incomplete, it guides organizations and individuals to complete it; if the dossier is complete, it issues a notice of the time to deliver the result;
c) The Vietnam Motor Vehicle Inspection Bureau evaluates the dossier: If the dossier does not meet the requirements, it informs organizations and individuals; if the dossier meets the requirements, it issues a decision to recognize the motor vehicle inspector.
3. Time limit for resolution:
a) Within five working days from the date of receiving and checking the dossier, the Director of the Vietnam Motor Vehicle Inspection Bureau issues a written response to organizations and individuals if the dossier does not meet the requirements;
b) Within fifteen working days from the date of receiving and checking the dossier, the Director of the Vietnam Motor Vehicle Inspection Bureau issues a decision to recognize the motor vehicle inspector if the dossier meets the requirements."
2. Supplement the Appendix containing the Model Scientific Curriculum Vitae for Appointing a Motor Vehicle Inspector to the Regulation issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998.
Article 2. This Circular takes effect forty-five days from the date of signature.
Article 3. The Head of the Office of the Ministry, the Inspector General, the Heads of the Departments under the Ministry, the Director of the Vietnam Motor Vehicle Inspection Bureau, the Heads of motor vehicle inspection units, and related organizations and individuals are responsible for implementing this Circular.
