THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;
Considering the proposal of the Director of the Vietnam Motor Vehicle Inspection Department at Document No. 636/2002ĐK dated September 20, 2002, regarding the issuance of a decision to amend and supplement Article 4 and Article 18 of the regulations promulgated together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, by the Minister of Transport;
To ensure the professional qualifications of motor vehicle inspection officers on roadways are consistent with advanced scientific and technological investments and mechanization in inspection work;
At the request of the Heads of the Personnel and Labor Department and the Legal Affairs and Transportation Department,
DECISION:
Article 1. Amending and supplementing Article 4 and Article 18 of the Regulations on Standards, Tasks, Responsibilities, Authorities, Rewards, and Disciplinary Actions for Inspection Officers at motor vehicle inspection units on roadways issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, by the Minister of Transport.
1. Article 4 is amended and supplemented as follows:
"Article 4: For inspection officers
Motor vehicle inspection officers on roadways are classified into three categories: Category I, Category II, and Category III. The specific criteria for inspection officers are as follows:
1- They must be engineers specializing in mechanical engineering for vehicles and motorcycles on roadways, including automotive mechanics; automobile repair mechanics; automotive power mechanics; internal combustion engine mechanics; agricultural tractor mechanics; forestry tractor mechanics; specialized automotive mechanics; transportation machinery mechanics; self-propelled military motorcycle mechanics; construction motorcycle mechanics.
2- They must have continuously worked for three years in the field of their training as specified in Clause 1 of this Article if they work outside the Inspection sector.
3- They must hold a minimum English language certificate level A.
4- They must have completed specialized vocational training courses and obtained a certificate of completion from the Vietnam Motor Vehicle Inspection Department according to its training regulations.
5- For newly graduated university officers assigned to work in the Inspection sector, in addition to meeting the criteria stipulated in Clauses 1 and 3 of this Article, they must also complete an internship program as prescribed by law and have a minimum of six months of internship in inspection work from the date of obtaining the certificate of completion of the vocational training course.
6- They must be recognized, appointed, and issued an inspection officer card by the Vietnam Motor Vehicle Inspection Department."
2- Article 18 is amended and supplemented as follows:
"Article 18: For inspection officers (excluding vocational staff) with college, secondary technical school, or worker grade 5/7 qualifications who were previously accepted, the following measures will be taken:
1- For inspection officers under 45 years old (as of the effective date of this decision), the inspection units shall create conditions and provide financial support as prescribed by law for these officers to participate in university-level specialized training programs as stipulated in Clause 1 of Article 4 of these regulations.
2- These inspection officers as stipulated in Clause 1 of this Article must complete the training program and obtain a relevant bachelor's degree within six years from the effective date of this decision. If they fail to obtain the required bachelor's degree within this period, they will be relieved of their inspection officer position and not be assigned to work in the inspection chain.
3- For inspection officers aged 45 or older (as of the effective date of this decision) who cannot participate in training programs to meet the specified criteria but have practical experience and good practical skills, the inspection unit will plan appropriate job transfers. During the interim period before transfer or during periods between training sessions, the inspection unit will continue to assign them to work in the inspection chain, but not in positions directly affecting the technical safety features of the vehicle (braking system and steering system).
4- The inspection unit is responsible for assigning and allocating sufficient numbers of inspection officers to ensure the quality of inspections during the period when inspection officers are participating in the training programs mentioned in Clause 1 of this Article."
Article 2. This Decision takes effect 15 days after the date of signature and revokes Article 4 and Article 18 of the Regulations on Standards, Tasks, Responsibilities, Authorities, Rewards, and Disciplinary Actions for Inspection Officers at motor vehicle inspection units on roadways issued together with Decision No. 1643/1998/QĐ-BGTVT dated July 6, 1998, by the Minister of Transport.
Article 3. The Heads of the Ministry’s Office, the Personnel and Labor Department, the Legal Affairs and Transportation Department, the Director of the Vietnam Motor Vehicle Inspection Department, the Directors of Provincial Departments of Transport and Public Works, the Heads of central city departments, and the heads of agencies, units, and individuals concerned are responsible for implementing this Decision.
