Announcing the port waters within the jurisdiction of Thai Binh Province and
the management area of Thai Binh Marine Port Authority

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;
On the basis of the opinions of the People's Committee of Thai Binh Province at Circular No. 2990/UBND-CN dated December 18, 2012 and Circular No. 680/SGTVT-VT dated September 5, 2012 of the Department of Transport of Thai Binh Province;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,
The Minister of Transport issues this Circular to announce the port waters within the jurisdiction of Thai Binh Province and the management area of Thai Binh Marine Port Authority.
Article 1. Announcing the port waters within the jurisdiction of Thai Binh Province
Now announcing the port waters of Thai Binh Port within the jurisdiction of Thai Binh Province including Berth No. 1, Berth No. 2, and Berth No. 3.
Article 2. Scope of the port waters within the jurisdiction of Thai Binh Province
The scope of the port waters within the jurisdiction of Thai Binh Province, measured according to the highest tidal water level, is defined as follows:
1. Seaward boundary: limited by straight lines connecting points A1, A2, A3, A4, and A5, with the following coordinates:
A1: 20°33'48''N, 106°34'30''E;
A2: 20°30'00''N, 106°44'15''E;
A3: 20°24'30''N, 106°44'15''E;
A4: 20°24'30''N, 106°39'35''E;
A5: 20°28'00''N, 106°35'37''E.
2. Landward boundary: limited from point A1 running along the right bank of the Dien Dien River (from the sea inward) to 100 meters downstream of the Dien Dian Bridge, then crossing the river along the left bank to the mouth of the Dien Dien River (including Dien Dian Canal and Quang Lang Canal), from the mouth of the Dien Dien River running along the coast to the mouth of the Tra Ly River, crossing the Tra Ly River to the left bank of the Tra Ly River to point A5.
3. Coordinates of points A1, A2, A3, A4, A5 apply according to the VN-2000 coordinate system and are converted to corresponding coordinate systems as follows:

Article 3. Pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer areas, storm shelters, water areas, and other related water zones
The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception and delivery zones, quarantine zones, anchorage areas, transshipment areas, and storm shelters for vessels entering and leaving the Thai Binh Port and other water areas and zones as prescribed.
Article 4. Responsibilities of Thai Binh Marine Port Authority
1. Implementing tasks and powers as stipulated in the Vietnam Maritime Code and relevant laws concerning maritime activities in the port waters within the jurisdiction of Thai Binh Province.
2. Based on regulations and actual conditions regarding meteorological and hydrological conditions, draft depth, vessel tonnage, and cargo characteristics, designating specific positions for vessels to receive and deliver pilots, undergo quarantine, anchor, transship, and avoid storms in accordance with regulations, ensuring maritime safety, maritime security, and prevention of environmental pollution.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Jurisdiction of Thai Binh Province
Outside the scope of the port waters specified in Article 2 of this Circular, Thai Binh Marine Port Authority is responsible for state management of maritime safety, maritime security, and prevention of environmental pollution in the sea area within the jurisdiction of Thai Binh Province.
Article 6. Effectiveness
1. This Circular takes effect from June 1, 2014. Decree No. 07/2007/QĐ-BGTVT dated February 23, 2007 of the Minister of Transport announcing the port waters within the jurisdiction of Thai Binh Province and the management area of Thai Binh Marine Port Authority is hereby repealed.
2. The boundaries of the port waters specified in this Circular are determined on Chart IA-100-03 reprinted in 2009 of the Vietnam Navy.
Article 7. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Director of the Department of Transport of Thai Binh Province, the Director of Thai Binh Marine Port Authority, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
