CIRCULAR

Regulations on job titles, grade codes, and professional standards for grades of civil servants specializing in agriculture and rural development

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government stipulating recruitment, utilization and management of civil servants;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, public officials, and armed forces personnel;Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, public officials, and armed forces personnel; Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for officials, civil servants, public employees, and armed forces personnel;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Based on the proposal of the Minister of Agriculture and Rural Development in Circular No. 7193/BNN-TCCB dated September 3, 2015 regarding regulations on job titles, grade codes, and professional standards for grades of civil servants specializing in agriculture and rural development;

Considering the proposal of the Director of the Civil Servant and Public Official Department;

The Minister of Home Affairs hereby promulgates regulations on job titles, grade codes, and professional standards for grades of civil servants specializing in agriculture and rural development as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates job titles, grade codes, and professional standards for grades of civil servants specializing in agriculture and rural development.

Article 2. Applicability

This Circular applies to civil servants performing specialized agricultural and rural development tasks.

Article 3. Job titles, grade codes of civil servants specializing in agriculture and rural development include:

1. Animal quarantine:

a) Senior animal quarantine officer Grade code: 09.315

b) Animal quarantine officer Grade code: 09.316

c) Animal quarantine technical officer Grade code: 09.317

2. Plant quarantine:

a) Senior plant quarantine officer Grade code: 09.318

b) Plant quarantine officer Grade code: 09.319

c) Plant quarantine technical officer Grade code: 09.320

3. Dyke control:

PROFESSIONAL STANDARDS FOR GRADES OF CIVIL SERVANTS IN ANIMAL QUARANTINE

Article 4. General Standards on Moral Qualities

1. Firm political conviction, unwavering in the face of difficulties and challenges, always adhering to Marxism-Leninism and Ho Chi Minh's thought; always prioritizing the interests of the country, the Party, and the people over personal interests.

2. High sense of responsibility, always complying with laws and being cautious in performing official duties.

3. Not exploiting official positions or powers for personal gain.

4. Adhering to internal regulations of the agency and following assignments from superiors.

5. Continuously studying and enhancing professional knowledge to fulfill assigned tasks.

6. Living a clean and healthy lifestyle, maintaining discipline and setting a good example; not engaging in bureaucracy, corruption, or waste, and firmly combating such practices.

7. Being honest, impartial, fair, democratic, respectful when interacting with the public.

Article 5. Animal quarantine officer grade (code number: 09.315)

1. Responsibilities

Is a specialized civil servant assisting the leadership in organizing and implementing animal quarantine, animal products quarantine before export, import, temporary export, re-import, transfer of border gates, transit through Vietnam, and domestic consumption, controlling animal slaughter, hygiene inspection, and food safety inspection for animal origin products.

2. Tasks

a) Lead in organizing and implementing procedures for animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products;

b) Organize the development of technical procedures to ensure accuracy and speed for each animal quarantine object, animal product quarantine, animal slaughter control, hygiene inspection, and food safety for animal origin products;

c) Lead in coordinating between related sectors and veterinary agencies to summarize experiences for animal quarantine, animal product quarantine, hygiene management, and food safety for animal origin products;

d) Summarize, analyze, evaluate, and draw lessons from the processes of animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products; propose amendments and supplements to improve procedures and standards for animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products;

e) Guide, monitor, inspect, and recommend measures for animal quarantine, animal product quarantine, and animal slaughter control;

f) Participate in providing technical guidance and training for lower-grade civil servants;

g) Direct and build a unified technical management system for animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products;

h) Lead or participate in scientific research topics at the sector level concerning animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products;

3. Professional Qualification Standards

a) Master laws on veterinary science and state policies related to animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products;

b) Be proficient in techniques involved in animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products;

c) Master technical standards to assess testing results serving animal quarantine, slaughter control, and hygiene inspections;

d) Understand veterinary techniques and veterinary laws of countries with international cooperation with Vietnam;

e) Stay informed about new information in the field of animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products both domestically and internationally;

f) Have the ability to quickly synthesize. Be proficient in organizing and implementing animal quarantine, animal product quarantine, animal slaughter control, hygiene management, and food safety for animal origin products; have the ability to attract collaborators;

g) Lead or participate in projects, topics, programs recognized and effectively implemented by the Ministry-level or Provincial-level Science Council;

h) Have experience in administrative, public service fields related to animal quarantine or in leadership and management activities. Civil servants applying for promotion to the animal quarantine officer grade must have held the animal quarantine officer grade or equivalent grade for at least 5 years (60 months), including at least 3 years (36 months) as an animal quarantine officer.

4. Educational and Training Standards

a) Hold a bachelor's degree or higher in veterinary science, aquatic animal pathology, livestock farming, veterinary science, or other relevant majors suitable for the job position;

b) Hold a certificate for training in state management procedures for the animal quarantine officer grade;

c) Have a foreign language proficiency level of Grade 3 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language proficiency framework for Vietnam;

d) Have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the standard for information technology usage.

Article 6. Animal quarantine officer grade (code: 09.316)

1. Responsibilities

Is a specialized civil servant assisting leadership in implementing animal quarantine, animal product quarantine, pre-export and import slaughter control, temporary import for re-export, temporary export for re-import, inter-port transfer, transit through Vietnam, domestic consumption, veterinary hygiene management, and food safety for animal-origin products.

2. Tasks

a) Analyze and evaluate testing and trial results to serve quarantine work, slaughter control, and veterinary hygiene inspection.

b) Carry out animal and animal product quarantine according to regulations.

c) Inspect the technical implementation procedures of animal quarantine technicians and be responsible for the results of animal and animal product quarantine.

d) Implement slaughter control processes and supervise veterinary hygiene at slaughterhouses, preliminary processing, and storage facilities for animals and animal products.

đ) Coordinate with relevant agencies and units to handle violations of laws related to animal quarantine, animal product quarantine, slaughter control, veterinary hygiene inspection, and food safety for animal-origin products as prescribed by law.

e) Promote and guide the enforcement of Vietnam's veterinary laws for cargo owners.

g) Participate in scientific research topics on animal quarantine and product quarantine, slaughter control, veterinary hygiene management, and food safety for animal-origin products.

h) Collect samples of animals and animal products to serve animal quarantine, product quarantine, slaughter control, veterinary hygiene inspection, and food safety for animal-origin products.

i) Analyze and evaluate testing and trial results to serve quarantine work, slaughter control, and veterinary hygiene inspection.

3. Professional Qualification Standards

a) Master basic knowledge of veterinary science.

b) Master current veterinary laws.

c) Understand veterinary laws of some countries in the region.

d) Understand social psychology and state laws to accurately and efficiently resolve assigned professional tasks.

đ) Know how to organize, direct, guide, inspect, and have the ability to coordinate with related sectors to implement tasks effectively.

Civil servants applying for promotion to the animal quarantine officer grade must have held the animal quarantine technician grade or equivalent for a minimum of three years (36 months).

4. Training and Development Standards:

a) Hold a bachelor's degree or higher in veterinary science, aquatic pathology, animal husbandry, or other relevant fields meeting job requirements.

b) Possess a certificate for training in state administrative management for the animal quarantine officer grade.

c) Have a foreign language proficiency level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competency framework for Vietnam.

d) Have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the standard for information technology usage.

Article 7. Animal quarantine technician grade (code: 09.317)

1. Responsibilities

Is a specialized civil servant directly implementing animal quarantine, animal product quarantine, slaughter control, veterinary hygiene inspection, and food safety for animal-origin products according to established regulations.

2. Tasks

a) Assist animal quarantine officers in checking and evaluating animal quarantine documentation, animal product quarantine documentation, and slaughter control.

b) Check and monitor clinical conditions of animals, actual goods status, and sensory characteristics of animal products.

c) Implement disease prevention and treatment for animals during quarantine isolation or isolation due to illness at slaughterhouses.

d) Collect samples of animals and animal products to serve animal quarantine, product quarantine, slaughter control, veterinary hygiene inspection, and food safety for animal-origin products.

đ) Supervise the implementation of veterinary hygiene measures during quarantine isolation; during the slaughter process or preliminary processing and preparation of animal products.

e) Guide and supervise the preparation and application of disinfectant solutions as directed.

3. Professional Qualification Standards

a) Master the basic content of current veterinary laws in the field of responsibility.

b) Understand technical procedures to perform assigned tasks.

c) Recognize common diseases and unusual symptoms in animal products.

d) Understand the nature and effects of different types of preventive and therapeutic drugs, disinfectants, and decontaminants.

đ) Know how to supervise quarantine isolation, record results, and maintain test logs.

e) Be able to treat common animal diseases.

4. Educational and Training Standards

a) Hold a college diploma or higher in veterinary science, aquatic pathology, animal husbandry, or other relevant fields meeting job requirements.

b) Have a foreign language proficiency level 1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competency framework for Vietnam.

c) Have computer skills meeting the basic information technology usage standards as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding IT skill standards.

Chapter III

PROFESSIONAL STANDARDS FOR THE GRADES OF PLANT QUARANTINE CIVIL SERVANTS

Article 8. General standards for quality

1. Firm political conviction, unwavering in the face of difficulties and challenges, always adhering to Marxism-Leninism and Ho Chi Minh's thought; always prioritizing the interests of the country, the Party, and the people over personal interests.

2. High sense of responsibility, always complying with laws and being cautious in performing official duties.

3. Not exploiting official positions or powers for personal gain.

4. Adhering to internal regulations of the agency and following assignments from superiors.

5. Continuously studying and enhancing professional knowledge to fulfill assigned tasks.

6. Living a clean and healthy lifestyle, maintaining discipline and setting a good example; not engaging in bureaucracy, corruption, or waste, and firmly combating such practices.

7. Being honest, impartial, fair, democratic, respectful when interacting with the public.

Article 9. Main Plant Quarantine Officer Rank (code: 09.318)

1. Responsibilities

Is a specialized civil servant assisting leadership in organizing and implementing plant quarantine work for export, import, transit, and domestic purposes at provincial, regional, and central state organizations responsible for plant quarantine.

2. Tasks

a) Develop plans, schemes, and organize the implementation of plant quarantine for export, import, transit, and domestic purposes within the assigned field;

b) Identify plant quarantine objects and control subjects, verify suspected cases of newly discovered pests;

c) Investigate, collect data and information; compile and analyze such data and information, assess the situation, draw lessons from plant quarantine activities in the assigned area or field, and on this basis propose supplementary or amended procedures, standards, technical regulations, and operational norms for plant quarantine;

d) Elaborate general technical and operational regulations for plant quarantine to suit local conditions;

đ) Participate in drafting, supplementing, and amending legal provisions on plant quarantine. Lead the organization and implementation of the dissemination and guidance of legal provisions on plant quarantine, the detection, prevention, and handling of violations within authority or proposing higher authorities to handle such violations;

e) Participate in drafting standards, procedures, and regulations on plant quarantine and apply international standards and practices in the assigned field;

g) Lead or participate in inspecting the implementation of state regulations on managing fumigation, irradiation, and other treatment measures in the field of plant protection and quarantine;

h) Lead or participate in conducting scientific research projects on plant quarantine at the sectoral level and participate in national-level projects in the assigned field;

i) Participate in professional inspections related to plant quarantine activities in the assigned field when required;

k) Participate in developing objectives, programs, contents, compiling materials, and organizing training for lower-ranking civil servants in plant quarantine;

l) Summarize situations, evaluate, and draw lessons from professional activities in plant quarantine work;

3. Professional Qualification Standards

a) Master the Party's policies and State laws relevant to assigned tasks, and industry policies on plant protection and quarantine;

b) Master legal provisions on plant protection and quarantine, and other relevant laws both domestically and internationally;

c) Understand the biological characteristics of regulated pests;

d) Understand the relationship between plant quarantine work and plant protection work, export, import, transit, transportation, and the economic, political, and social situation domestically related to plant quarantine work;

đ) Master procedures, standards, technical regulations, and operational norms for plant quarantine, and related scientific and technical information both domestically and internationally;

e) Master administrative procedures and principles related to assigned plant quarantine activities;

g) Lead or participate in projects, topics, programs recognized and effectively implemented by the Ministry-level or Provincial-level Science Council;

h) Have experience in the administrative and public service field of plant quarantine or in leadership and management activities. Civil servants applying for promotion to the rank of Main Plant Quarantine Officer must have held the rank of Plant Quarantine Officer or equivalent for at least five years (60 months), including at least three years (36 months) as a Plant Quarantine Officer;

4. Educational and Training Standards

a) Hold a bachelor's degree or higher in one of the following majors: plant protection, agriculture, crop production, plant science, biology, or another relevant major meeting job requirements;

b) Hold a certificate in training for state management at the rank of Main Plant Quarantine Officer;

c) Possess a foreign language proficiency level of Grade 3 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-grade foreign language competence framework for Vietnam.

d) Have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the standard for information technology usage.

Article 10. Plant quarantine officer rank (code: 09.319)

1. Responsibilities

Is a specialized civil servant assisting leadership in organizing and implementing plant quarantine work for export, import, transit, and domestic transport at state organizations at provincial, regional, and central levels with quarantine responsibilities.

2. Tasks

a) Develop plans, propose solutions, implement, and organize the implementation of plant quarantine work for export, import, transit, and domestic transport within the assigned field;

b) Detect regulated pests and verify suspected cases of common plant quarantine pests;

c) Conduct multiple stages or the entire process of inspecting objects subject to plant quarantine or export, import, and transit;

d) Decide, supervise, confirm the implementation of measures to handle infected objects (based on classification) and be personally responsible for their decisions;

đ) Promote, disseminate, and guide on plant quarantine laws; detect, prevent, and handle violations within authority or propose handling of such violations;

e) Lead research topics and experimental surveys of the unit and participate in implementing sector-level research topics on plant quarantine. Propose additional or amended regulations within the assigned technical and professional field;

g) Participate in inspecting the implementation of state regulations on managing fumigation activities and other treatment measures in the plant protection and quarantine field;

h) Guide and train technical and professional skills for lower-ranking civil servants;

3. Professional Qualification Standards

a) Understand the Party's policies and state laws related to assigned tasks and the industry's policies on plant protection and quarantine;

b) Understand regulations on plant protection and quarantine and other relevant laws. Be familiar with international practices and standards on plant quarantine in the assigned field;

c) Understand procedures, standards, technical specifications, quarantine norms, and related scientific and technical information;

d) Understand administrative procedures and principles related to assigned quarantine activities;

đ) Understand economic, social, and political conditions related to assigned quarantine activities;

Civil servants applying to advance to the plant quarantine officer rank must have held the plant quarantine technician rank or equivalent for a minimum of three years (36 months);

4. Educational and Training Standards

a) Hold a bachelor's degree or higher in one of the following majors: plant protection, agriculture, crop production, plant science, biology, or another relevant major meeting job requirements;

b) Hold a certificate in state management training for the plant quarantine officer rank;

Article 11. Plant quarantine technician rank (code: 09.320)

1. Responsibilities

Is a specialized civil servant implementing plant quarantine work for export, import, transit, and domestic transport according to procedures and norms at state organizations with quarantine responsibilities from station level upwards.

2. Tasks

a) Carry out one or more stages of the investigation and inspection process to detect regulated pests;

b) Collect samples of objects, establish various types of samples of harmful organisms, prepare specimens for preservation, transfer, and analysis of these samples and specimens;

c) Carry out one or more stages of the analysis and testing process in the plant quarantine field;

d) Prepare tools and chemicals for investigation, inspection, analysis, testing, or experimentation in the plant quarantine field;

đ) Record and initially process data from investigations, inspections, analyses, tests, or experiments. Establish plant quarantine records;

e) Use, maintain, and service plant quarantine equipment and be personally responsible for such equipment;

g) Guide workers in performing simple technical operations;

3. Professional Qualification Standards

a) Understand the industry's policies on plant quarantine and relevant laws on plant protection and quarantine related to assigned tasks;

b) Understand procedural techniques and technical operations for assigned investigations, inspections, analyses, tests, and experiments;

c) Understand the morphological characteristics of harmful organisms and signs of damage and infection related to detecting common regulated pests;

d) Understand the properties, effects, and usage methods of chemicals and tools for assigned investigations, inspections, analyses, tests, and experiments;

4. Educational and Training Standards

a) Graduated from a secondary level or higher in one of the following majors: plant protection, agronomy, crop production, plant science, biology, or another major as required by the job position;

b) Have a foreign language proficiency level 1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competency framework for Vietnam.

c) Have computer skills meeting the basic information technology usage standards as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding IT skill standards.

Chapter IV

TECHNICAL STANDARDS FOR THE SPECIALIZED RANKS OF CONTROL AND REGULATION OFFICERS

Article 12. General Qualification Standards

1. Firm political conviction, unwavering in the face of difficulties and challenges, always adhering to Marxism-Leninism and Ho Chi Minh's thought; always prioritizing the interests of the country, the Party, and the people over personal interests.

2. High sense of responsibility, always complying with laws and being cautious in performing official duties.

3. Not exploiting official positions or powers for personal gain.

4. Adhering to internal regulations of the agency and following assignments from superiors.

5. Continuously studying and enhancing professional knowledge to fulfill assigned tasks.

6. Living a clean and healthy lifestyle, maintaining discipline and setting a good example; not engaging in bureaucracy, corruption, or waste, and firmly combating such practices.

7. Being honest, impartial, fair, democratic, respectful when interacting with the public.

Article 13. Main Inspector Grade for Dike and Flood Control (Code: 11.081)

1. Responsibilities: As a specialized civil servant in the water resources sector, assist the Director of the Department in supervising and urging the implementation of complex technical issues in dike and flood control management within the assigned area.

2. Tasks

a) Review the compilation of records, dike history files, embankment, sluice gate files, and the evolution process of riverbeds or beaches carried out by the Dike Management Unit.

b) Review the results of analyzing and assessing the current state of dikes, embankments, sluices, and proposals for reinforcement and repair measures. Propose technical solutions and appropriate plans for reinforcing and repairing dikes within the managed unit.

c) Review protection plans for critical points against floods and storms established by counties. Lead the establishment of protection plans for critical points under their own unit's responsibility.

d) Lead in determining causes, proposing measures, and participating in technical guidance to handle complex incidents involving dikes, embankments, and sluices according to the division of labor by the Unit Head.

g) Have experience in administrative and public service fields related to dike inspection or leadership and management activities. Article 14. Dike Inspector Grade (Code: 11.082)

1. Responsibilities

As a specialized civil servant in the water resources sector, assist the Leader of the Dike Management Unit in organizing and supervising the implementation of the Law on Dikes and other systems and regulations related to dike management and protection within the assigned area.

2. Tasks

a) Establish, compile, and regularly supplement dike history files, embankment, sluice gate files, and the evolution process of riverbeds or beaches within the assigned scope.

b) Timely detect changes in dikes, embankments, sluices, river flow, riverbanks, and beaches, determine causes, propose solutions, and directly organize the handling of incidents.

c) Detect, prevent, record, and report to competent authorities for handling any acts that infringe upon the safety of dikes, embankments, and sluices.

d) Analyze and assess the current state of dikes, embankments, and sluices, identify unstable conditions, propose reinforcement and repair measures, participate in supervising construction and inspecting completed works within the assigned area.

2. Tasks

a) Collecting materials to supplement the levee dossier, revetment, sluice and the process of development of the riverbed or beach within the assigned scope;

b) Detecting and promptly reporting to superiors all developments of levees, revetments, sluices, flow, riverbanks, beaches. Directly guiding the levee protection force to handle common levee, revetment, sluice incidents within the assigned area and participating in guiding the handling of complex incidents according to the division of labor from superiors;

c) Inspecting, preventing, detecting, recording in a report and recommending competent authorities to handle acts infringing upon the safety of levees, revetments, sluices;

1. Responsibilities

Is a professional civil servant of the forestry inspection sector, assisting the leadership of the central or local forestry inspection agency to organize the implementation of one or more specialized fields of forestry management, protection, and development, and forest product management nationwide and at provincial level.

2. Tasks

a) Leading or participating in organizing and implementing one or more areas in professional work related to forestry management, protection, and development, and forest product management;

d) Proficient in the activities of fishing vessels and occupations in the maritime areas under inspection duties.

đ) Proficient in all operational characteristics of fisheries inspection vessels and effectively utilize modern equipment installed on the vessel.

e) Have sea experience; able to analyze and assess weather and hydro-meteorological conditions for professional purposes.

đ) Lead or participate in technical improvement projects or research topics related to fisheries inspection that are effectively applied in practice.

e) Have experience in administrative and public service fields related to fisheries inspection vessels or in leadership and management activities. Civil servants applying for promotion to the rank of Senior Fisheries Inspector must have held the rank of Fisheries Inspector or equivalent for at least 5 years (60 months), including at least 3 years (36 months) as a Fisheries Inspector.

4. Educational and Training Standards

a) Hold a bachelor’s degree or higher, with a major suitable for the job requirements;

b) Have completed specialized training for Fisheries Inspectors.

c) Have a foreign language proficiency level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competency framework for Vietnam.

d) Have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the standard for information technology usage.

Article 26. Rank of Fisheries Inspector (code: 25.313)

1. Responsibilities

As a specialized civil servant in fisheries inspection agencies, assisting agency leadership to carry out patrol, inspection, supervision, detection, and prevention of violations of laws in the field of aquatic products, and ensure the safe and effective use of fisheries inspection vessels.

2. Tasks

a) Participate in developing vessel operation plans, repair plans; propose measures for safe and efficient vessel usage and crew management.

b) Participate in carrying out patrol, inspection, supervision, detection, and prevention of violations of laws related to aquatic products in Vietnam's maritime areas.

c) Command fisheries inspection vessels safely and efficiently; manage weapons and auxiliary equipment equipped on the vessel.

d) Apply scientific and technological advancements to vessel operations.

đ) Participate in flood and storm prevention, search and rescue operations.

3. Professional Qualification Standards

a) Understand the Party's policies and guidelines, state laws; be proficient in the development direction of the industry in management and related specialized tasks;

b) Understand patrol, inspection, supervision, detection, prevention, and handling of violations of laws related to aquatic products.

c) Understand knowledge related to maritime security and defense concerning vessel and crew activities authorized by competent authorities.

d) Proficient in the activities of fishing vessels and occupations in the maritime areas under inspection duties.

đ) Proficient in all operational characteristics of fisheries inspection vessels.

e) Have sea experience; able to analyze and assess weather and hydro-meteorological conditions for professional purposes.

g) Civil servants applying for promotion to the rank of Fisheries Inspector must have held the intermediate rank of Fisheries Inspector for at least 3 years (36 months).

4. Educational and Training Standards

a) Hold a bachelor’s degree or higher, with a major suitable for the job requirements;

b) Have completed specialized training for Fisheries Inspectors.

c) Have a foreign language proficiency level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competency framework for Vietnam.

d) Have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the standard for information technology usage.

Article 27. Junior Fisheries Inspector Rank (code: 25.314)

1. Responsibilities

Is a specialized civil servant in fisheries agencies, assisting agency leadership in performing certain tasks during the operation of fisheries patrol vessels participating in patrols, inspections, control, and the detection of violations of laws related to aquatic resources in Vietnam's maritime areas.

2. Tasks

a) Execute direct leadership orders;

b) Participate in implementing patrol, inspection, control, and specialized supervision tasks for the protection of aquatic resource benefits;

c) Participate in flood prevention and search and rescue operations;

d) Apply scientific and technological advancements to vessel operations.

d) Properly use and maintain equipment on board according to technical procedures;

e) Perform other assigned tasks.

3. Professional Qualification Standards

a) Understand the Party's policies, guidelines, and state laws; understand the development direction of the sector in management and related vocational fields;

b) Understand patrol, inspection, control, and specialized supervision procedures for aquatic resources;

c) Possess knowledge about maritime security and defense related to vessel activities and crew members;

d) Be proficient with the operational characteristics of fisheries patrol vessels;

đ) Have the ability to sail at sea.

4. Educational and Training Standards

a) Graduated from a college level or higher, with a major suitable for the job requirements;

b) Having completed junior fisheries inspector vocational training;

c) Having worked on a vessel for six months or more;

b) Have a foreign language proficiency level 1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training regarding the six-level foreign language competency framework for Vietnam.

c) Have computer skills meeting the basic information technology usage standards as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding IT skill standards.

Chapter VIII

TRANSITION AND IMPLEMENTATION PROVISIONS

Article 28. Transitional provisions for animal and plant quarantine officer ranks

Current specialized animal and plant quarantine officers holding the ranks of senior animal and plant quarantine officer (code 09.067), animal and plant quarantine officer (code 09.068), and animal and plant technician (code 09.069) will be transferred to the following new ranks:

- The senior animal and plant quarantine officer rank (code 09.067) will be transferred to either the senior animal quarantine officer rank (code 09.315) or the senior plant quarantine officer rank (code 09.318);

- The animal and plant quarantine officer rank (code 09.068) will be transferred to either the animal quarantine officer rank (code 09.316) or the plant quarantine officer rank (code 09.319);

- The animal and plant technician rank (code 09.069) will be transferred to either the animal technician rank (code 09.317) or the plant technician rank (code 09.320).

Article 29. Transitional provisions for forestry officer ranks

1. Current forestry officers holding the associate-level forestry officer rank (code 10.227) will be transferred to the junior forestry officer rank (code 10.228).

2. Current forestry officers holding the primary-level forestry officer rank (code 10.229) will be transferred as follows:

a) Forestry officers with a diploma or higher degree who meet the criteria and conditions for the junior forestry officer rank (code 10.228) will be appointed to that rank. In cases where they have a bachelor's degree or higher and meet the criteria and conditions for the forestry officer rank, they may be exempted from the tenure requirement stipulated in Point e Clause 3 Article 18 of this Circular when taking the examination to advance to the forestry officer rank.

b) Forestry officers currently holding the primary-level forestry officer rank (code 10.229) without a relevant professional degree will retain their current policies and benefits for five years from the date this Circular takes effect. Within five years from the date this Circular takes effect, the employing agency must arrange for these officers to undergo training to meet the criteria for forestry officer ranks as specified in this Circular, specifically:

- For officers under 55 years old for males and under 50 years old for females, the employing agency must arrange for them to undergo training to meet the criteria for the junior forestry officer rank or higher. If an officer sent for training does not participate in the training or fails to meet the training requirements, the employing agency must report to the personnel management agency to implement staff reduction measures. If an officer completes training and graduates with a diploma or higher, they will be appointed to a new rank as stipulated in this Point.

- For officers aged 55 or older for males and 50 or older for females who do not wish to or are not selected for training, they will retain the benefits and policies of the primary-level forestry officer rank until retirement age.

3. Agencies managing and employing forestry officers will not recruit primary-level forestry officers from the date this Circular takes effect.

Article 30. Salary Classification

1. The salary classification for specialized civil servants in agriculture and rural development, including animal quarantine officers, plant quarantine officers, dike supervisors, forest rangers, fishery inspectors, and fisheries patrol vessel crew members as stipulated in this Circular shall apply the Professional and Technical Staff Salary Scale for officials and civil servants in state agencies (Scale 2) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for officials, civil servants, public employees, and armed forces personnel, and amended by Decree No. 17/2013/NĐ-CP dated February 19, 2013 of the Government as follows:

a) The senior forest ranger, senior fisheries inspector, and senior fisheries patrol vessel crew positions shall apply the A2 grade civil servant salary coefficient, group A2.1, from coefficient 4.40 to coefficient 6.78;

b) The senior animal quarantine officer, senior plant quarantine officer, and senior dike supervisor positions shall apply the A2 grade civil servant salary coefficient, group A2.2, from coefficient 4.00 to coefficient 6.38;

c) The animal quarantine officer, plant quarantine officer, dike supervisor, forest ranger, fisheries inspector, and fisheries patrol vessel crew positions shall apply the Al grade civil servant salary coefficient, from coefficient 2.34 to coefficient 4.98;

d) The animal quarantine technician, plant quarantine technician, intermediate dike supervisor, intermediate forest ranger, intermediate fisheries inspector, and intermediate fisheries patrol vessel crew positions shall apply the B grade civil servant salary coefficient, from coefficient 1.86 to coefficient 4.06;

2. Salary Classification After Probationary Period and Appointment to Civil Service Position Upon completion of the probationary period as prescribed and appointment to a civil service position by the competent authority managing civil servants, the following salary classification shall be implemented:

a) In cases where the individual has a doctoral degree in a relevant field corresponding to the job position, they shall be classified at level 3, coefficient 3.00 of the civil service positions specified in Point c Clause 1 of this Article;

b) In cases where the individual has a master's degree in a relevant field corresponding to the job position, they shall be classified at level 2, coefficient 2.67 of the civil service positions specified in Point c Clause 1 of this Article;

c) In cases where the individual has a college degree in a relevant field corresponding to the job position, they shall be classified at level 2, coefficient 2.06 of the civil service positions specified in Point d Clause 1 of this Article;

3. Salary Classification for Agricultural Civil Servants, Including Animal Quarantine Officers, Plant Quarantine Officers, Dike Supervisors, Forest Rangersons, Fisheries Inspectors, and Fisheries Patrol Vessel Crew Members who have been classified into civil service positions as stipulated in Decision No. 413/TCCP-VC dated May 29, 1993 of the Government Organizational Structure - Civil Servant Board regarding the professional standards of civil service positions in the Water Resources sector; Decision No. 417/TCCP-VC dated May 29, 1993 of the Government Organizational Structure - Civil Servant Board regarding the professional standards of civil service positions in the Agriculture - Food Industry sector; Decision No. 09/2006/QĐ-BNV dated October 5, 2006 of the Ministry of Home Affairs regarding the titles, codes, and professional standards of civil service positions in the Forest Ranger sector; Circular No. 02/2014/TT-BNV dated April 1, 2014 of the Ministry of Home Affairs regarding the titles, codes, and professional standards of civil service positions for fisheries inspectors and fisheries patrol vessel crew members, and Decree No. 204/2004/NĐ-CP shall be implemented as follows:

a) In cases where the individual meets the conditions for appointment to a civil service position with the same grade salary coefficient as the previous position, the grade salary and percentage of seniority allowance exceeding the ceiling (if applicable) currently enjoyed in the previous position (including time considered for the next salary grade increase or seniority allowance exceeding the ceiling if applicable in the previous position) shall be maintained in the newly appointed civil service position.

Example 1: Mr. Nguyen Van A was classified as a forest ranger (position code 10.226), grade 5, coefficient 3.66 since January 1, 2013. Now, having met the conditions and been appointed by the competent authority to the forest ranger position (position code 10.226), he shall be classified at grade 5, coefficient 3.66 of the forest ranger position (position code 10.226) from the date of the decision; the time for the next salary grade increase shall be calculated from January 1, 2013.

b) In cases where a civil servant with a college degree in a relevant field corresponding to the job position at recruitment has been classified under the A0 grade civil service position according to Decree No. 204/2004/NĐ-CP and is now appointed to a B grade civil service position, the salary grade classification for these civil service positions shall be based on the years of work contributing to mandatory social insurance according to the national salary scale (excluding the probationary period) as follows:

Starting from grade 2 of the B grade civil service position, every two years (24 months), the individual will be promoted to the next salary grade (if there are interrupted periods without enjoying social insurance benefits, they will be accumulated). If during the working period, there is a year when the assigned tasks are not completed or disciplinary action is taken, the promotion period will be extended according to the regular salary grade increase system.

After transferring to the salary classification for the agricultural civil service positions mentioned above, if the salary coefficient obtained in these positions plus the seniority allowance exceeding the ceiling (if applicable) is lower than the salary coefficient previously enjoyed in the old position, the difference in the salary coefficient (including seniority allowance exceeding the ceiling, if applicable) shall be retained to equalize the salary coefficient previously enjoyed in the old position. This retained salary coefficient difference shall be enjoyed throughout the entire period the civil servant is classified in the newly appointed position. If the civil servant is later promoted to a higher position, this retained salary coefficient difference shall be added to the current salary coefficient (including seniority allowance exceeding the ceiling, if applicable) to classify the salary in the newly appointed position upon promotion and cease to enjoy the retained salary coefficient difference from the date of receiving the new salary.

Example 2: Mr. Nguyen Van B, with a college degree in forestry, was recruited as a civil servant, contributed to mandatory social insurance from January 1, 2008, and was classified at grade 3, coefficient 2.72 of the A0 civil servant position since July 1, 2014, and consistently completed assigned tasks without being disciplined during his tenure. Now, having been appointed by the competent authority to the intermediate forest ranger position, the salary grade classification for the intermediate forest ranger position shall be as follows:

The period of service for Mr. Nguyen Van B started on January 1, 2008, excluding the probationary period of six months, and was classified at level 2 of the mid-level forest rangers rank with a salary coefficient of 2.66 (code 10.228). Every two years, he was promoted to a higher level, and on July 1, 2014, he was classified at level 5 with a salary coefficient of 2.66 of the mid-level forest rangers rank (code 10.228). The time for enjoying the new salary grade at the mid-level forest rangers rank (code 10.228) shall be counted from the date of signing the decision. The time for considering the next salary increase shall be counted from July 1, 2014. At the same time, he shall enjoy a retention differential coefficient of 0.06 (2.72 - 2.66).

By July 1, 2016 (after two years), Mr. Nguyen Van B met the conditions for a regular promotion to level 6 with a salary coefficient of 2.86 of the mid-level forest rangers rank (code 10.228) and continued to enjoy a salary differential retention coefficient of 0.06 (total salary coefficient enjoyed is 2.92).

4. The promotion of ranks for agricultural and rural development civil servants mentioned above shall be implemented after being appointed to the civil servant rank by the competent authority as stipulated in this Circular and implementing salary classification according to the guidance provided in Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs on salary classification when promoting ranks, transferring ranks, and changing types of civil servants and public officials.

Article 31. Implementation Organization

Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities, and related agencies and organizations shall implement the recruitment, utilization, and management of the agricultural and rural development civil servant workforce based on the provisions of this Circular.

Article 32. Effectiveness

1. This Circular takes effect from January 24, 2016.

2. Abolish the following documents: Decision No. 413/TCCP-VC dated May 29, 1993, of the Government Organizational Structure - Civil Service Board (now the Ministry of Home Affairs) regarding the professional standards of civil servant ranks in the Water Resources sector; Decision No. 417/TCCP-VC dated May 29, 1993, of the Government Organizational Structure - Civil Service Board (now the Ministry of Home Affairs) regarding the issuance of professional standards of civil servant ranks in the Agriculture-Food Industry sector; Decision No. 09/2006/QĐ-BNV dated October 5, 2006, of the Ministry of Home Affairs on job titles, codes, and professional standards of civil servant ranks in the Forest Protection sector; Circular No. 02/2014/TT-BNV dated April 1, 2014, of the Ministry of Home Affairs on job titles, rank codes, and standards of civil servant ranks for fisheries officers and patrol boat crew members.

Article 33. Responsibility for Implementation

1. Ministers, heads of agencies equivalent to ministries, agencies under the Government; Chairpersons of People's Committees of provinces and centrally-administered cities, and related agencies, organizations, and individuals are responsible for enforcing the provisions of this Circular.

2. In the course of implementation, if there are any difficulties, please report to the Ministry of Home Affairs for guidance or consideration and resolution./
