Issuing Rules for Accommodation Facilities

Pursuant to the Law on Handling Administrative Offenses dated June 20, 2012;

Pursuant to the Law on Entry into, Exit from, and Transit through Vietnam and Residence of Foreigners in Vietnam dated June 16, 2014;June 2024; cảnh, cư trú. của người nước ngoài tại Việt Nam ngày 16 tháng 6 năm 2014;

Pursuant to the Criminal Enforcement Law dated June 14, 2019;

Pursuant to the Law amending and supplementing some articles of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated November 25, 2019;

Pursuant to the Decree No. 112/2013/NĐ-CP dated October 2, 2013 of the Government stipulating forms of administrative expulsion penalties, temporary detention measures, and management of foreigners violating Vietnamese laws during the administrative expulsion process; June 2024;p giải người vi phạm theo thủ tục hành chính và quản lý người nước ngoài vi phạm pháp luật Việt Nam trong thời gian làm thủ tục trục xuất;

Pursuant to the Decree No. 17/2016/NĐ-CP dated March 17, 2016 of the Government amending and supplementing certain articles of the Decree No. 112/2013/NĐ-CP dated October 2, 2013 stipulating forms of administrative expulsion penalties, temporary detention measures, and management of foreigners violating Vietnamese laws during the administrative expulsion process; June 2024;p giải người vi phạm theo thủ tục hành chính và quản lý người nước ngoài vi phạm pháp luật Việt Nam trong thời gian làm thủ tục trục xuất;

January 01Pursuant to the Decree No. 13/2018/NĐ-CP dated August 6, 2018 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to the Decree No. 65/2020/NĐ-CP dated June 10, 2020 of the Government stipulating organization of management and regimes for persons staying at accommodation facilities during the waiting period for exit;

Considering the proposal of the Director of the Department of Prison Management, Compulsory Education Institutions, and Rehabilitation Schools;June 2024;o dưỡng;

The Minister of Public Security issues this Circular on the Rules for Accommodation Facilities.

Article 1. Issuance of the Circular

The Rules for Accommodation Facilities are hereby issued together with this Circular.

Article 2. Scope of Application

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

This Circular shall be applicable within the scope of accommodation facilities under the Ministry of Public Security.

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

a) Persons staying at accommodation facilities under the Ministry of Public Security.

b) Officers, soldiers, workers, and staff members of the People's Public Security.

c) Relevant agencies, organizations, and individuals.

Article 3. Effectiveness

This Circular shall take effect from March 5, 2021. The Circular No. 54/2016/TT-BCA dated December 28, 2016 of the Minister of Public Security on the Rules for Accommodation Facilities shall cease to be effective from the date this Circular takes effect.

Article 4. Responsibilities for Implementation

1. The Directors of Departments, Commanders of Forces, Heads of Units directly under the Ministry of Public Security; Provincial Police Chiefs, Chiefs of Police in centrally governed cities; Heads of criminal enforcement agencies, Heads of criminal enforcement agencies at all levels in the People's Public Security, and Heads of accommodation facilities under the Department of Prison Management, Compulsory Education Institutions, and Rehabilitation Schools, Ministry of Public Security shall be responsible for implementing this Circular.

2. The Department of Prison Management, Compulsory Education Institutions, and Rehabilitation Schools shall be responsible for monitoring, guiding, and inspecting the implementation of this Circular.

3. In the course of implementing this Circular, if there are any difficulties, local police units shall report to the Ministry of Public Security (through the Department of Prison Management, Compulsory Education Institutions, and Rehabilitation Schools) for timely guidance./.
