Regulations on issuing press releases regarding regulatory legal documents

issued by the Government and the Prime Minister

Pursuant to the Law on Popularizing and Educating about Laws dated June 20, 2012;

Pursuant to the Law on Issuing Regulatory Legal Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Issuing Regulatory Legal Documents dated June 18, 2020;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Issuing Regulatory Legal Documents;

Pursuant to Decree No. 09/2017/NĐ-CP dated February 9, 2017 of the Government detailing the issuance of statements and provision of information to the press by administrative state agencies;

At the proposal of the Director of the Office,

The Minister of Justice issues this Circular regulations on issuing press releases regarding regulatory legal documents issued by the Government and the Prime Minister.

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the construction and issuance of press releases regarding regulatory legal documents issued by the Government,

2. This Circular applies to the Ministry of Justice, the Office of the Government, and the agencies primarily drafting regulatory legal documents issued by the Government,

Article 2. Implementation Principles

1. The agency primarily drafting the regulatory legal document issued by the Government,

2. Ensuring regular, continuous, and close coordination among relevant agencies and units in constructing the press release.

3. Promoting initiative, positivity, and enhancing responsibility of the agency primarily drafting the regulatory legal document issued by the Government,

Article 3. Provision of Information for Constructing Press Releases

1. The agency primarily drafting has the responsibility to provide information about the regulatory legal document drafted by its own agency and approved by the Government,

2. The content of the information must clearly specify: name of the document, date of issuance; issuing authority; effective date; necessity and purpose of issuance; main contents of the regulatory legal document.

3. The Ministry of Justice shall take the lead and coordinate with the Office of the Government to monitor and urge the provision of information for constructing the press release.

Article 4. Construction, Issuance, and Publication of Press Releases

1. Based on the information provided by the agency primarily drafting, the Ministry of Justice shall be responsible for compiling, editing the content, constructing, and issuing the press release regarding the regulatory legal document issued by the Government,

2. The Ministry of Justice shall publish the press release on the Ministry of Justice's electronic portal and the Vietnam Law Electronic Newspaper immediately after signing and issuing it.

3. The Office of the Government shall publish the press release on the Government's electronic portal and the Government's Electronic Newspaper immediately upon receipt of the press release from the Ministry of Justice.

Article 5. Correction of Press Releases

1. In case of discovering errors in the content of the issued press release, the agency primarily drafting shall promptly cooperate to provide accurate information either on its own initiative or at the request of the Ministry of Justice for the Ministry of Justice to issue a correction notice. The document providing corrected information from the agency primarily drafting shall be sent to the Ministry of Justice within two working days from the date of receiving the request document from the Ministry of Justice or from the date the agency primarily drafting discovers the error in the press release.

2. Within two working days from the date of receiving the document providing corrected information from the agency primarily drafting, the Ministry of Justice shall issue a correction notice.

3. The correction notice shall be published on the electronic newspaper and the electronic portal according to the provisions of Clause 2 and 3, Article 4 of this Circular.

Article 6. Implementation Provisions

1. This Circular takes effect from January 1, 2022.

2. This Circular replaces Circular No. 12/2013/TT-BTP dated August 7, 2013 of the Minister of Justice on the procedure for issuing press releases regarding regulatory legal documents issued by the Government,/.
