Amending and supplementing certain Articles of Circular No. 38/2018/TT-NHNN

dated December 25, 2018 of the Governor of the State Bank of Vietnam on the importation of goods for the purpose of printing and minting money of the State Bank of VietnamPrinting and minting money of the State Bank of Vietnam

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing some provisions of the Law on Foreign Trade Management;

Pursuant to Decree No. 134/2016/NĐ-CP dated September 1, 2016 of the Government detailing some provisions and measures to implement the Law on Export Tax and Import Tax; and Decree No. 18/2021/NĐ-CP dated March 11, 2021 of the Government amending and supplementing some Articles of Decree No. 134/2016/NĐ-CP dated September 1, 2016 of the Government detailing some provisions and measures to implement the Law on Export Tax and Import Tax;

Pursuant to Decree No. 102/2022/NĐ-CP dated December 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Currency Issuance and Treasury Department;

The Governor of the State Bank of Vietnam issues this Circular to amend and supplement certain Articles of Circular No. 38/2018/TT-NHNN dated December 25, 2018 of the Governor of the State Bank of Vietnam on the importation of goods for the purpose of printing and minting money of the State Bank of Vietnam (hereinafter referred to as Circular No. 38/2018/TT-NHNN).

Article 1. Amending and supplementing certain Articles of Circular No. 38/2018/TT-NHNN

Amend and supplement Article 4 as follows:
"Article 4. Importation of Goods
1. Based on the designation document and permission for the printing and minting facility to import goods for the purpose of printing and minting money as stipulated in Clause 2, Article 3 of this Circular, the printing and minting facility shall carry out the importation of goods for the purpose of printing and minting money as specified in the Appendix List of Goods Designated for Import by the Printing and Minting Facility for the Purpose of Printing and Minting Money of the State Bank of Vietnam issued together with this Circular as follows:
a) For goods under items numbered 1, 2, 3, and 5: The printing and minting facility shall base itself on the printing and minting contract between the printing and minting facility and the State Bank to carry out the importation of goods;
b) For goods under items numbered 4, 6, and 7: The printing and minting facility shall base itself on the approval document for investment policy and investment decision of the competent authority as stipulated in Article 4 of Circular No. 07/2020/TT-NHNN dated June 30, 2020 of the Governor of the State Bank of Vietnam on investment and procurement of goods for the purpose of printing and minting money of the State Bank of Vietnam to carry out the importation of goods.
2. The Governor of the State Bank of Vietnam authorizes the Director of the Issuance and Treasury Department to issue a confirmation document regarding the printing and minting facility's importation of goods for the purpose of printing and minting money of the State Bank according to the sales contract or other forms of documents between the printing and minting facility and the supplier. 3. When handling the import procedures, the printing and minting facility shall submit to the Customs Authority one original copy of the confirmation document of the State Bank along with the customs declaration dossier in accordance with the law."

Article 2. Replacing the Appendix issued together with Circular No. 38/2018/TT-NHNN with the Appendix List of Goods Designated for Import by the Printing and Minting Facility for the Purpose of Printing and Minting Money of the State Bank of Vietnam issued together with this Circular.

This Circular takes effect from December 25, 2025/.

The Head of the Office; the Director of the Issuance and Treasury Department; the Heads of units under the State Bank of Vietnam, the printing and minting facilities are responsible for organizing the implementation of this Circular.

Article 4. Implementation provisions

1. This Circular takes effect from August 14, 2023.

2. Replace the phrase "Tariff code" with "HS Code" as defined in the List of Machinery, Equipment, Raw Materials, Components, Parts, and Accessories Imported for the Purpose of Printing and Minting Money of the State Bank of Vietnam issued together with Circular No. 01/2017/TT-NHNN dated February 7, 2017 of the Governor of the State Bank of Vietnam issuing the List of Machinery, Equipment, Raw Materials, Components, Parts, and Accessories Imported for the Purpose of Printing and Minting Money of the State Bank of Vietnam./.
