Pursuant to the Law on Government Organization 2025;

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;

Pursuant to Decree No. 132/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the determination of authority of local administration at two levels in the field of state management under the Ministry of Science and Technology;

Pursuant to Decree No. 133/2025/NĐ-CP dated June 12, 2025 of the Government stipulating decentralization and delegation of authority in the field of state management by the Ministry of Science and Technology;

Decree No. 55/2025Decree No. 02 dated 3 day5 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Chairman of the National Standardization, Measurement, and Quality Control Committee; The Minister of Science and Technology issues this Circular stipulating the delegation and determination of authority when organizing local administration at two levels in the field of standards, measurement, and quality under the state management responsibility of the Ministry of Science and Technology

Article 1. This Circular stipulates the delegation and determination of authority of local administration at two levels in the field of standards, measurement, and quality under the state management responsibility of the Ministry of Science and Technology; the procedures and formalities for implementation when delegating and determining authority..

 PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 2. This Circular applies to local administration at two levels, relevant agencies, organizations, and individuals related to the field of standards, measurement, and quality under the state management responsibility of the Ministry of Science and Technology.

Article 3. Principles of Delegation and Determination of Authority

Clause 1. Ensuring compliance with the Constitution, consistent with the principles and regulations on delegation and determination of authority stipulated in the Law on the Organization of the Government 2025, the Law on Local Administration 2025, Decree No. 132/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the determination of authority of local administration at two levels in the field of state management under the Ministry of Science and Technology, and Decree No. 133/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the delegation and decentralization in the field of state management under the Ministry of Science and Technology.

Clause 2. Ensuring the determination of tasks and powers among agencies and levels of local administration consistent with the tasks, powers, and capabilities of the agencies and persons authorized to perform delegated and determined tasks and powers.

Clause 3. The budget for implementing tasks shall be guaranteed by the state budget according to regulations.

DETERMINATION OF AUTHORITY IN THE FIELD OF STANDARDS, MEASUREMENT, AND QUALITY

Chapter II

Article 3. State Inspection Responsibilities for Measurement

Clause 1. People's Committees at commune level shall exercise the authority to conduct state inspection for measurement within their administrative areas in accordance with Clause 3, Article 18 and Article 37 of Circular No. 28/2013/TT-BKHCN dated December 17, 2013 of the Minister of Science and Technology stipulating state inspection for measurement; Clause 1, Article 4 of Decree No. 132/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the determination of authority of local administration at two levels in the field of state management under the Ministry of Science and Technology.

Clause 2. The procedures and formalities for inspection shall be carried out in accordance with the Appendix attached to Decree No. 132/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the determination of authority of local administration at two levels in the field of state management under the Ministry of Science and Technology.

DECENTRALIZATION IN THE FIELD OF STANDARDS, MEASUREMENT, AND QUALITY

Chapter III

CLASSIFICATION IN THE FIELD OF STANDARDS, MEASUREMENTS, AND QUALITY

1. The People's Committee of the province shall organize the receipt, processing, and handling of certification application files for measurement standards directly used for calibrating group 2 measuring instruments in accordance with Article 23 of Circular No. 24/2013/TT-BKHCN dated September 30, 2013, issued by the Minister of Science and Technology on activities related to calibration, verification, and testing of measuring instruments and measurement standards.

2. The procedures and formalities for certifying measurement standards directly used for calibrating group 2 measuring instruments are stipulated in Section I Part A of the Appendix attached to this Circular.

1. The People's Committee of the province shall organize the receipt, processing, and handling of amendment application files for the certification decision for measurement standards directly used for calibrating group 2 measuring instruments in accordance with Article 26 of Circular No. 24/2013/TT-BKHCN dated September 30, 2013, issued by the Minister of Science and Technology on activities related to calibration, verification, and testing of measuring instruments and measurement standards.

2. The procedures and formalities for amending the certification decision for measurement standards directly used for calibrating group 2 measuring instruments are stipulated in Section II Part A of the Appendix attached to this Circular.

1. The People's Committee of the province shall organize the receipt, processing, and handling of revocation application files for the validity of the certification decision for measurement standards in accordance with Article 28 of Circular No. 24/2013/TT-BKHCN dated September 30, 2013, issued by the Minister of Science and Technology on activities related to calibration, verification, and testing of measuring instruments and measurement standards.

2. The procedures and formalities for revoking the validity of the certification decision for measurement standards are stipulated in Section III Part A of the Appendix attached to this Circular.

1. The People's Committee of the province shall organize the receipt, processing, and handling of certification and issuance application files for metrology inspector cards in accordance with Article 31 of Circular No. 24/2013/TT-BKHCN dated September 30, 2013, issued by the Minister of Science and Technology on activities related to calibration, verification, and testing of measuring instruments and measurement standards.

2. The procedures and formalities for certifying and issuing metrology inspector cards are stipulated in Section IV Part A of the Appendix attached to this Circular.

1. The People's Committee of the province shall organize the receipt, processing, and handling of amendment application files for the certification and issuance decision for metrology inspector cards in accordance with Article 35 of Circular No. 24/2013/TT-BKHCN dated September 30, 2013, issued by the Minister of Science and Technology on activities related to calibration, verification, and testing of measuring instruments and measurement standards.

2. The procedures and formalities for amending the content of the certification and issuance decision for metrology inspector cards, reissuance of cards are stipulated in Section V Part A of the Appendix I attached to this Circular.

1. The provincial People's Committee shall organize the receipt, processing, and handling of files for revoking the validity of certification decisions and issuance of verification officer identification cards as prescribed in Article 37 of Circular No. 24/2013/TT-BKHCN dated September 30, 2013, issued by the Minister of Science and Technology on verification, calibration, and testing activities of measuring instruments and measurement standards.

2. The procedures and formalities for revoking the validity of certification decisions and issuance of verification officer identification cards are stipulated in Section VI Part A of the Appendix attached to this Circular.

Article 10. Issuance of Certificate Confirming Registration for Organizing Quality Product and Goods Awards

1. The provincial People's Committee and the municipal People's Committee under the central government shall organize the receipt, processing, and handling of registration files and issuance of certificates confirming registration for organizing quality product and goods awards for awards organized by state agencies, political organizations, socio-political organizations, socio-professional organizations, social organizations, socio-professional organizations, Associations at the central level, and Provincial Departments of Science and Technology under the central government, as prescribed in Point 3.1 Clause 3 Section II of Circular No. 06/2009/TT-BKHCN dated April 3, 2009, issued by the Minister of Science and Technology guiding conditions and procedures for awarding quality product and goods awards to organizations and individuals (hereinafter referred to as Circular No. 06/2009/TT-BKHCN), amended and supplemented by Circular No. 07/2024/TT-BKHCN dated October 8, 2024, issued by the Minister of Science and Technology amending and supplementing certain articles in legal documents within the jurisdiction of the Ministry of Science and Technology related to the National Standardization, Metrology, and Quality Control Committee (hereinafter referred to as Circular No. 07/2024/TT-BKHCN).

2. The procedures and formalities for implementing Clause 1 of this Article are provided in Part B Section I of the Appendix attached to this Circular.

3. The provincial People's Committee and the municipal People's Committee under the central government shall organize the implementation of management tasks of the National Standardization, Metrology, and Quality Control Committee as prescribed in Clause 3 Section III of Circular No. 06/2009/TT-BKHCN, amended and supplemented by Circular No. 07/2024/TT-BKHCN.

Article 11. Issuance of Certificate Confirming Eligibility for Consulting and Evaluating Quality Management System According to National Standard TCVN ISO 9001 for Administrative State Agencies; Supplemental Issuance of Consultant Expert Card and Evaluation Expert Card for Consulting Organizations and Certification Organizations; Issuance of Certificate Confirming Eligibility for Training in Consulting and Evaluating Quality Management System According to National Standard TCVN ISO 9001 for Independent Consultants and Evaluators Conducting Consulting and Evaluation Activities at Administrative State Agencies

1. The provincial People's Committee and the municipal People's Committee under the central government shall organize the receipt, processing, and handling of registration files and issuance of certificates confirming eligibility for consulting and evaluating quality management systems according to national standard TCVN ISO 9001 for administrative state agencies for consulting organizations, independent consultants, and certification organizations; supplemental issuance of consultant expert cards and evaluation expert cards for consulting organizations and certification organizations; issuance of certificates confirming eligibility for training in consulting and evaluating quality management systems according to national standard TCVN ISO 9001 for consultants and evaluators conducting consulting and evaluation activities at administrative state agencies as prescribed in Chapters III and IV of Circular No. 26/2014/TT-BKHCN dated October 10, 2014, issued by the Minister of Science and Technology detailing the implementation of Decision No. 19/2014/QĐ-TTg dated March 5, 2014, of the Prime Minister on applying the quality management system according to national standard TCVN ISO 9001:2008 in the operations of administrative state agencies (hereinafter referred to as Circular No. 26/2014/TT-BKHCN), amended and supplemented by Circular No. 07/2024/TT-BKHCN.

2. The procedures and formalities for implementing Clause 1 of this Article are provided in Part B Sections II, III, IV, V, VI, and VII of the Appendix attached to this Circular.

3. The provincial People's Committee and the municipal People's Committee under the central government shall organize the implementation of tasks prescribed in Article 43 of Circular No. 26/2014/TT-BKHCN, amended and supplemented by Circular No. 07/2024/TT-BKHCN, specifically as follows:

a) Management and guidance on registration activities for consulting and evaluating quality management systems for administrative state agencies; training activities for consultants and evaluators according to Circular No. 26/2014/TT-BKHCN and this Circular;

b) Announcing on the website of the provincial People's Committee and the municipal People's Committee under the central government the list of consulting organizations, independent consultants, and certification organizations that have been issued or had their certificates revoked; the list of consultants and evaluators who have been issued or had their expert cards revoked; the list of training institutions that have been issued or had their certificates revoked;

c) Taking the lead and coordinating with relevant agencies and organizations to inspect consulting activities and quality management system evaluation activities of consulting organizations, independent consultants, and certification organizations; training activities for consultants and evaluators conducted by training institutions, and handling violations according to their authority as prescribed in Circular No. 26/2014/TT-BKHCN, this Circular, and other relevant laws.

Article 12. Issuing Notification of Acceptance of Sufficient Capacity to Conduct Training Activities Announcement

1. The People's Committee of provinces and centrally governed cities shall organize the acceptance, processing, and handling of announcements and issuance of Notifications of Acceptance of Sufficient Capacity to Conduct Training Activities as prescribed in Chapter II of Circular No. 36/2014/TT-BKHCN dated December 12, 2014, issued by the Minister of Science and Technology on training activities for system management assessment experts and product certification assessment experts of conformity assessment organizations (hereinafter referred to as Circular No. 36/2014/TT-BKHCN), amended and supplemented by some articles in Circular No. 07/2024/TT-BKHCN.

2. The procedures and formalities for implementing this provision are stipulated in Part B, Section VIII of the Appendix attached to this Circular.

3. The People's Committee of provinces and centrally governed cities shall implement the management tasks of the National Standardization, Metrology, and Quality Control Committee as prescribed in Article 10 of Circular No. 36/2014/TT-BKHCN, amended and supplemented by some articles in Circular No. 07/2024/TT-BKHCN.

Chapter IV

IMPLEMENTING PROVISIONS

Article 13. Effective Date

This Circular takes effect from July 1, 2025.

Article 14. Transitional Provisions

1. Documents and papers that have been issued and granted by competent authorities before the effective date of this Circular and which remain valid or within their validity period shall continue to be applied and used according to the provisions of the law until their expiration or replacement, amendment, supplementation, substitution, abolition, revocation, or recovery by the authority receiving the functions, duties, and powers or by the competent authority.

2. For applications and files accepted by competent authorities before the effective date of this Circular but not yet resolved, such authorities shall continue to process them according to the legal provisions at the time of accepting the file.

Article 15. Implementation Organization

1. The Director of the Office of the Ministry of Science and Technology, the National Standardization, Metrology, and Quality Control Committee, relevant state agencies, organizations, and individuals shall be responsible for guiding the implementation of this Circular.

2. In case of difficulties or obstacles during the implementation process, it is recommended that agencies, organizations, and individuals report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements to ensure compliance.
