Article 2. Effectiveness of enforcement national standard TCVN ISO 9001:2008 to activities
of agencies and organizations under the administrative state system

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. Agencies that must construct and apply the Quality Management System:
Article 2. Applicability
a) Ministries, ministerial-level agencies, Vietnam Social Security (hereinafter referred to as ministries and sectors);
b) People's Committees of provinces and centrally governed cities (hereinafter referred to as provincial People's Committees), People's Committees of districts, counties, towns, and cities directly governed by provinces (hereinafter referred to as district-level People's Committees);
c) Specialized agencies under provincial People's Committees, specialized agencies under district-level People's Committees.
Article 2. Encouragement for agencies and units to construct and apply the Quality Management System as prescribed in this Decision:
a) Diplomatic and consular agencies of Vietnam abroad;
b) Vietnam Policy Bank, Vietnam Development Bank;
c) Publicly funded institutions.
c) People's Committees of communes, wards, towns;
Article 3. Requirements for constructing and applying the Quality Management System
1. Must construct and apply the Quality Management System for activities related to the implementation of administrative procedures for organizations and individuals.
2. Ensure the participation of leaders, units, and relevant individuals during the process of constructing and applying the Quality Management System.
3. Comply with legal regulations on protecting state secrets during the process of constructing and applying the Quality Management System.
CONSTRUCTION AND APPLICATION OF THE QUALITY MANAGEMENT SYSTEM
Chapter II
Article 4. Steps for constructing and applying the Quality Management System
The construction and application of the Quality Management System shall be carried out through four basic steps as follows:
1. Constructing the Quality Management System:
Based on National Standard TCVN ISO 9001:2008 and the Quality Management System framework model, the agency specified in Article 2 of this Decision shall establish a set of documents, procedures, and work processes that are reasonable to perform its assigned functions, tasks, and authorities.
2. Applying the Quality Management System:
a) Apply the system of documents, procedures, and processes in practice upon approval by the Head of the agency;
b) Conduct internal audits and address non-conformities;
c) Review by leadership, improve the Quality Management System to ensure compliance with the requirements of National Standard TCVN ISO 9001:2008, legal provisions, and actual conditions at the agency;
d) The Head of the agency confirms the effectiveness of the Quality Management System.
3. Announcing the Quality Management System in accordance with National Standard TCVN ISO 9001:2008:
The agency applying the Quality Management System announces the Quality Management System in accordance with National Standard TCVN ISO 9001:2008 (in the format prescribed in Appendix I attached to this Decision) and notifies in writing to the unit responsible as stipulated in Clause 3 or Clause 4 of Article 12 of this Decision for monitoring and summarizing; post it at the agency's headquarters and publish it on the agency's electronic information website (if available).
4. Maintaining and improving the Quality Management System:
a) Update changes in relevant regulatory documents affecting work handling procedures into the Quality Management System for application within three months from the date the regulatory document comes into effect;
b) Conduct internal audits and review by leadership at least once a year to ensure the Quality Management System complies with the requirements of National Standard TCVN ISO 9001:2008, legal provisions, and actual work conditions at the agency;
c) Reannounce in accordance with the provisions of Clause 3 of this Article when there are adjustments, expansions, reductions in the scope of application of the Quality Management System.
During the process of constructing, applying, maintaining, and improving the Quality Management System, the agency applying the Quality Management System shall not hire independent certification organizations to evaluate (certify, monitor, adjust, expand, reduce the scope of application, recertify).
In case National Standard TCVN ISO 9001:2008 is reviewed, changed, and announced by the Ministry of Science and Technology, it shall be applied in accordance with the guidance of the Ministry of Science and Technology.
In the case where the National Standard TCVN ISO 9001:2008 is reviewed, amended, and promulgated by the Ministry of Science and Technology, it shall be implemented in accordance with the guidance of the Ministry of Science and Technology.
Article 5. Quality Management System Framework Model
1. The Quality Management System framework model includes: Sample documentation system, guidance on determining the list of administrative procedures (if any) and sample work processing procedures within the agency.
2. Ministries and sectors shall be responsible for establishing, amending, supplementing, and announcing the Quality Management System framework model for agencies organized under vertical systems.
3. The Ministry of Science and Technology shall be responsible for establishing, amending, supplementing, and announcing the Quality Management System framework model for local agencies.
4. Previously published Quality Management System framework models that do not contravene the provisions of this Decision shall continue to be implemented.
Article 6. Implementation Plan
Ministries, sectors, and provincial People's Committees shall review the implementation situation, establish, amend, supplement, and approve the implementation plan, budget for expenses to carry out activities: Consulting, building, applying, maintaining, and improving the Quality Management System at agencies and units under ministries, sectors, and localities; propaganda, training; inspection (at least once a year) regarding the construction, application, maintenance, and improvement of the Quality Management System at agencies and units under ministries, sectors, and localities; hiring certification organizations (if necessary) to cooperate in inspections and other related activities.
Article 7. Hiring Consulting Organizations and Independent Consultants
1. Agencies applying the Quality Management System may hire consulting organizations or independent consultants to guide and advise on the construction and application of the Quality Management System.
2. Consulting organizations can only provide consultancy when meeting the following conditions:
a) Established according to the provisions of the law, having functions to operate in the field of quality management system consultancy;
b) Having a Quality Management System conforming to current standards;
c) Having experience in the field of quality management system consultancy;
d) Having at least five consultants meeting the conditions stipulated in Clause 3 of this Article;
đ) Having registered to participate in consultancy activities according to the regulations of the Ministry of Science and Technology and been issued a Certificate confirming eligibility for consultancy.
3. Consultants can only provide consultancy when meeting the following conditions:
a) Graduated from university;
b) Received training and obtained a certificate for quality management system consultancy;
c) Received training and obtained a certificate for public administration management;
d) Having good morals and full capacity for civil acts;
đ) Having at least three years of work experience and consultancy experience in quality management system construction.
Consultants meeting the above conditions will be issued a Consultant Card.
4. Independent consultants can only provide consultancy when meeting the conditions stipulated in Clause 3 of this Article, having registered to participate in consultancy activities according to the regulations of the Ministry of Science and Technology and been issued a Certificate confirming eligibility for consultancy, and an Independent Consultant Card.
Article 8. Hiring Certification Organizations
1. Ministries, sectors, and provincial People's Committees may hire certification organizations to cooperate in inspecting the construction, application, maintenance, and improvement of the Quality Management System at agencies and units under ministries, sectors, and localities (in cases where it is necessary), aiming to systematically and objectively assess compliance with requirements specified in the National Standard TCVN ISO 9001:2008.
2. Certification organizations can only conduct evaluations when meeting the following conditions:
a) Established according to the provisions of the law, having functions to operate in the field of certification;
b) Registered the scope of certification activities according to the law;
c) Having experience in the field of quality management system certification evaluation;
d) Having at least five evaluators meeting the conditions stipulated in Clause 3 of this Article.
đ) Having registered to participate in evaluation activities according to the regulations of the Ministry of Science and Technology and been issued a Certificate confirming eligibility for evaluation.
3. Evaluators can only conduct evaluations when meeting the following conditions:
a) Graduated from university;
b) Received training and obtained a certificate for quality management system evaluation;
c) Received training and obtained a certificate for public administration management;
d) Having good morals and full capacity for civil acts;
đ) Having at least five years of work experience and evaluation experience in quality management systems.
Evaluators meeting the above conditions will be issued an Evaluator Card.
Article 9. Inspection of Construction, Implementation, Maintenance, and Improvement of the Quality Management System
Ministries, sectors, Provincial People's Committees shall carry out inspections of construction, implementation, maintenance, and improvement of the Quality Management System at agencies and units under their ministries, sectors, and localities in accordance with the provisions of this Decision, the National Standard TCVN ISO 9001:2008, and other relevant laws to ensure the effectiveness and efficiency of the construction and implementation of the Quality Management System.
Chapter III
IMPLEMENTATION
Article 10. Funding for Construction and Implementation of the Quality Management System
Funding for construction and implementation of the Quality Management System includes sources such as the State budget annually, sponsorship, aid, and other lawful revenues (if any) of ministries, sectors, and localities in accordance with the regulations of the Ministry of Finance.
Article 11. Responsibilities of Heads of Agencies Constructing and Implementing the Quality Management System
1. Construct, implement, maintain, and improve the Quality Management System in agency activities and be responsible for the results of implementation.
2. Agencies constructing and implementing the Quality Management System shall apply it to internal activities and other activities of the agency if deemed necessary to enhance the efficiency of the agency's work.
3. Organize training for officials, civil servants, employees, and workers on the construction and implementation of the Quality Management System.
4. Research and apply information technology to activities related to the construction, implementation, maintenance, and improvement of the Quality Management System.
Article 12. Responsibilities of Ministries, Sectors, and Provincial People's Committees
1. Organize the construction and implementation of the Quality Management System in accordance with the provisions of this Decision; be responsible for the results of implementation and ensure the effectiveness and efficiency of the construction, implementation, and maintenance of the Quality Management System at ministries, sectors, and localities.
2. Urge, inspect the implementation of this Decision at agencies and units under ministries, sectors, and localities; commend or submit to competent authorities for commendation collectives and individuals with outstanding achievements during the implementation of this Decision according to the law on competition and rewards, and handle violations of this Decision according to the law.
3. Ministries and sectors assign a main unit to assist in organizing the implementation of this Decision. The main unit shall perform the following tasks:
a) Draft, amend, and supplement plans for implementation and budget estimates for implementing this Decision in accordance with the regulations of the Ministry of Finance, and submit them for approval by the leadership of the ministry or sector;
b) Monitor, urge, and inspect the progress of construction and implementation of the Quality Management System by agencies and units under the ministry or sector according to the approved plan;
c) Develop plans and organize training courses on the construction, implementation, maintenance, and improvement of the Quality Management System and inspection procedures for officials, civil servants, employees, and workers at agencies and units under the ministry or sector;
d) Annually, organize inspections of the construction, implementation, maintenance, and improvement of the Quality Management System at agencies and units under the ministry or sector according to the approved plan; compile and report the inspection results to the ministry or sector.
4. The Department of Science and Technology is the main unit assisting the Provincial People's Committee in organizing the implementation of this Decision.
a) Tasks of the Department of Science and Technology:
Draft, amend, and supplement plans for implementation and coordinate with the Department of Finance to estimate the budget for implementing this Decision in accordance with the regulations of the Ministry of Finance, and submit them for approval by the Chairman of the Provincial People's Committee;
Monitor, urge, and inspect the progress of construction and implementation of the Quality Management System by agencies and units according to the approved plan.
b) The Standards Measurement Quality Control Agency advises and assists the Department of Science and Technology in performing the following tasks:
Develop plans and organize training courses on the construction, implementation, maintenance, and improvement of the Quality Management System and inspection procedures for officials, civil servants, employees, and workers at agencies and units;
Annually, organize inspections of the construction, implementation, maintenance, and improvement of the Quality Management System at agencies and units according to the approved plan; compile and submit the inspection results to the Department of Science and Technology for reporting to the Provincial People's Committee.
5. Take the lead and cooperate with the Ministry of Information and Communications, Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency, and other mass media organizations to organize publicity about the implementation of this Decision to raise awareness about the construction and implementation of the Quality Management System in the activities of agencies and units under ministries, sectors, and localities.
6. Report to the Ministry of Science and Technology on a regular basis in December each year or at any time when required, to compile and report to the Prime Minister on the situation of construction and implementation of the Quality Management System at agencies and units under ministries, sectors, and localities (in accordance with the form prescribed in Appendix II issued together with this Decision).
Article 13. Tasks of the Ministry of Science and Technology
1. Issuing and organizing the implementation of guiding documents for the implementation of this Decision.
2. Specifying in detail the following: Conditions for the operation of consulting organizations, consulting experts, independent consulting experts, certification organizations, evaluation experts; procedures for issuing, suspending, and revoking Certificates, Consulting Expert Cards, Independent Consulting Expert Cards, Evaluation Expert Cards; training activities for consulting experts, evaluation experts, and related organizations and individuals; rights and obligations of consulting organizations, consulting experts, certification organizations, evaluation experts, and related organizations and individuals.
3. Guiding the leading units to inspect the construction, application, maintenance, and improvement of Quality Management Systems according to National Standard TCVN ISO 9001:2008.
4. Leading and coordinating with the Ministry of Information and Communications, Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency, other mass media agencies, and relevant ministries, sectors, and localities to implement publicity work on the implementation of this Decision to enhance awareness about applying Quality Management Systems in the operations of agencies and units nationwide.
5. Inspecting the activities of consulting organizations, independent consulting experts, certification organizations; promptly correcting and handling violations within its authority.
6. In cases deemed necessary, leading and coordinating with relevant agencies to organize inspections of the implementation of this Decision at agencies and units nationwide.
7. Annually reporting to the Prime Minister on the situation of implementing this Decision and proposing policies and measures necessary to improve the effectiveness of building and applying Quality Management Systems in ministries, sectors, and localities.
Article 14. Tasks of the Ministry of Finance
Leading and coordinating with the Ministry of Science and Technology to develop and issue documents regulating financial management for the following activities: Consulting, constructing, applying, maintaining, and improving Quality Management Systems; publicity, training, inspection, hiring certification organizations to cooperate in inspection, and other related activities.
Chapter IV
EFFECTIVENESS AND RESPONSIBILITY FOR IMPLEMENTATION
Article 15. Effective Date
This Decision takes effect from May 18, 2014, and replaces Decision No. 144/2006/QĐ-TTg dated June 20, 2006, of the Government on the application of Quality Management Systems according to National Standard TCVN ISO 9001:2000 in the operations of administrative state agencies and Decision No. 118/2009/QĐ-TTg dated September 30, 2009, of the Government on amending and supplementing certain provisions of Decision No. 144/2006/QĐ-TTg.
Article 16. Transitional Provisions
1. Agencies and units that have constructed and applied Quality Management Systems for all publicized administrative procedures in accordance with the law and have been issued Certificates of Quality Management System conformity to National Standard TCVN ISO 9001:2008.
Implementing the publication as prescribed in Clause 3, Article 4 of this Decision and having the responsibility to apply, maintain, and improve the Quality Management System as prescribed in Clause 4, Article 4 of this Decision.
2. Agencies and units that have constructed and applied Quality Management Systems and have been issued Certificates of Quality Management System conformity to National Standard TCVN ISO 9001:2008 but the scope of application does not include all publicized administrative procedures in accordance with the law:
Implementing the publication as prescribed in Clause 3, Article 4 of this Decision and expanding the scope of application of the Quality Management System to ensure that all publicized administrative procedures are included in the Quality Management System and re-publishing after completing the expansion. The agency or unit has the responsibility to apply, maintain, and improve the Quality Management System as prescribed in Clause 4, Article 4 of this Decision.
3. Current regulations of the Ministry of Finance regarding the construction, application, and maintenance of quality management systems according to national standard TCVN ISO 9001:2008 in the operations of administrative state agencies that are not contrary to this decision shall continue to be implemented until new regulations of the Ministry of Finance on these issues are issued and take effect.
4. Current regulations of the Ministry of Science and Technology regarding the issuance of certificates, cards for experts; training knowledge on administrative state management for consulting experts, evaluation experts; construction and application of quality management systems in ministries, sectors, provincial People's Committees, district People's Committees, specialized agencies under provincial and district People's Committees that are not contrary to this decision shall continue to be implemented until new regulations of the Ministry of Science and Technology on these issues are issued and take effect.
Article 17. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees directly under the Central Government, and related agencies, organizations, and individuals are responsible for enforcing this Decision./.
