Specifies the list of main forest plantation species;

Circular No. 22/2021/TT-BNNPTNT dated December 29, 2021, issued by the Minister of Agriculture and Rural Development, specifies the list of main forest plantation species; recognizes varieties and sources of forest plantation species, effective from February 12, 2022, amended and supplemented by:

Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, effective from February 1, 2023.

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Forestry Law dated November 15, 2017;

Based on Decree No. 27/2021/NĐ-CP dated March 25, 2021, issued by the Government, regarding the management of forest plantation varieties;

At the proposal of the General Director of the Forest Administration;

The Minister of Agriculture and Rural Development issues this Circular to specify the list of main forest plantation species; recognize varieties and sources of forest plantation species.[1]

 

Chapter I. GENERAL PROVISIONS

 

Article 1. Scope of Regulation

This Circular stipulates the list of main forest plantation species; procedures and formalities for recognizing varieties and sources of forest plantation species.

Article 2. Applicability

This Circular applies to organizations and individuals involved in activities related to the provisions set out in Article 1 of this Circular.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. Forestry planting trees These are tree species and non-timber forest products planted on special-use forests, protective forests, production forests, and scattered plantations.

2. . This is a breeding material supply site including: Selected forest compartments, converted seedling forests, planted seedling forests, nurseries, superior trees, parent trees, and parent tree orchards.

3. Selected forest section This is a natural or planted forest selected without applying silvicultural techniques and recognized to provide breeding materials.

4. Converted seedling forest This is a natural or planted forest selected with silvicultural techniques applied according to regulations and recognized to provide breeding materials.

5. Planted seedling forest This is a forest planted randomly using seeds from superior trees, recognized to provide breeding materials.

6. Seedling garden This is a forest planted according to a specific plan using vegetative clones (clonal nurseries) or seeds (seedling nurseries) from selected superior trees, recognized to provide breeding materials.

7. Superior tree This is a tree selected from natural forests, planted forests, converted seedling forests, planted seedling forests, nurseries, scattered plantations, recognized to provide breeding materials.

8. of perennial industrial crops and fruit trees is a tree with higher productivity, quality, and resistance compared to other trees within the same variety population that has been selected and recognized for vegetative propagation (except for durian...). This is a tree evaluated and recognized from a population of a forest plantation variety, to provide vegetative breeding materials.

9. Clonal garden This is an orchard planted with vegetative clones derived from parent trees or vegetatively propagated from original varieties, recognized to provide materials for producing vegetative breeding materials.

10. Trial Planting This is the activity of planting, monitoring, and evaluating the yield, quality, disease resistance, or other adverse conditions of trial planting varieties.

11. Fast-growing tree species This is a tree species with average diameter growth of at least 2 cm/year or average productivity in one business cycle of at least 15 m³.3/ha/year or more.

12. Slow-growing tree species This is a tree species with average diameter growth of less than 2 cm/year or average productivity in one business cycle of less than 15 m³.3/HA/YEAR.

13. Forestry Ecological Zone This is an area characterized by climate (rainfall, temperature), topography, soil, and distinctive forest vegetation; divided into eight ecological zones detailed in Appendix I attached to this Circular.

 

Chapter II. MAIN FOREST PLANTATION SPECIES; RECOGNITION AND REVOCATION OF RECOGNITION OF VARIETIES AND SOURCES OF FOREST PLANTATION SPECIES

 

Section 1. LIST OF MAIN FOREST PLANTATION SPECIES AND VARIETIES[2]

 

Article 4. List of main forest plantation species

1. Criteria for selecting main forest plantation species

a) For special-purpose forest plantation species: for national parks, nature reserves, and species conservation areas - it is the native species distributed within that special-purpose forest area; for scenic protection zones, botanical gardens, research and experimental scientific forests, it is the native species or species naturally distributed outside the area suitable for the planting site's conditions.

b) For protective forest plantation species: they are native species distributed in the ecological region; native species from other ecological regions adapted to the local soil and climate conditions; introduced species that have been planted for a long time and are compatible with the local ecosystem.

Select species having one or more of the following characteristics: multi-use trees; trees with dense foliage, evergreen, well-developed root systems; long-lived trees; trees resistant to windstorms and pests; trees growing and developing well, adaptable to harsh environmental and site conditions.

c) For production forest plantation species: they are native or introduced species with high yield, quality, and economic value, meeting production and business purposes, and suitable for the planting site's conditions.

2. Based on the criteria stipulated in Clause 1 of this Article, the Department of Agriculture and Rural Development shall submit to the Chairman of the People's Committee of the province or centrally-administered city for promulgation to supplement the main forest plantation species list for planting in the locality outside the main forest plantation species list prescribed in Clause 1 of Article 5 of this Circular.

Article 5. Provisions on Developing Main Forest Plantation Species Seedlings

1. The seedlings of main forest plantation species are those of the species listed in the main forest plantation species list prescribed in Appendix II attached to this Circular.

2. The addition of a species to the main forest plantation species list prescribed in Clause 1 of this Article must meet the following criteria:

a) Having a recognized seed source or seedling source by the competent authority;

b) Having at least 500 hectares of planted forest in two or more forestry ecological regions;

c) Meeting the provisions of Clause 4 of Article 3 of Decree No. 27/2021/NĐ-CP dated March 25, 2021 of the Government on managing forest plantation species seeds.

3. The removal of a species from the main forest plantation species list prescribed in Clause 1 of this Article when it does not meet one of the criteria stipulated in Clause 2 of this Article.

4. The Forestry Department shall submit to the Ministry of Agriculture and Rural Development for consideration to add or remove species from the main forest plantation species list according to the provisions of Clauses 2 and 3 of this Article.

5. The management of seed quality of species listed in the main forest plantation species list prescribed in Clause 1 of this Article shall be carried out in accordance with the provisions of Decree No. 27/2021/NĐ-CP dated March 25, 2021 of the Government on managing forest plantation species seeds.

 

||| Section 2. RECOGNITION AND REVOCATION OF FOREST PLANTATION SEEDLING RECOGNITION

 

Article 6. Criteria for Recognizing Forest Plantation Seedlings

The criteria for recognizing forest plantation seedlings include:

1. The seedlings have been tested in accordance with Article 13 of Decree No. 27/2021/NĐ-CP or have been trial-planted in accordance with Article 7 of this Circular.

2. The test results or trial planting results meet the requirements of the national standard for recognized forest plantation seedlings, having equivalent or higher yield and quality compared to recognized seedlings of the same species or group of species planted in the same forestry ecological region.

Article 7. Planting trials for forestry tree varieties

1. Subjects for planting trials: Local indigenous forestry tree varieties; forestry tree varieties that have been recognized and planted in trial in other forest ecological zones; imported forestry tree varieties for the first time with high productivity and quality at the exporting country, with clear origin and suitable for the ecological conditions of the trial planting area.

2. The minimum trial planting area is two hectares, and the maximum is ten hectares.

3. Trial planting methods shall be carried out according to national standards on trial planting. In cases where there are no national standards, the basic standards shall be applied.

4. Timeframe for evaluating trial planting results: For fast-growing tree species, thirty-six months; for slow-growing tree species, seventy-two months; for non-timber forest products tree species, the harvest of target variety products must be stable over two consecutive seasons.

Article 8. Procedures and formalities for recognizing forestry tree varieties

1. Competent authority: The Forestry Department[3] recognizes forestry tree varieties.

2. Documents for requesting recognition of forestry tree varieties from organizations and individuals include:

a) Request document for recognizing forestry tree varieties according to Model No. 01 of Appendix III issued together with this Circular (original);

b) Report on the results of field testing or trial planting of forestry tree varieties according to Model No. 02 of Appendix III issued together with this Circular (original);

c) Documentation for imported forestry tree varieties including information about productivity, quality, and ecological conditions of the seed source country (copy).

3. Methods of submitting documents: Organizations and individuals may submit directly, send via postal service, send through public postal services, or submit online.

4. Procedure for implementation:

a) Organizations and individuals requesting recognition of forestry tree varieties shall submit one set of documents as stipulated in Clause 2 of this Article to the Forestry Department[4]. If the documents are not valid, within three working days from the date of receipt, the Forestry Department[5] shall directly guide or provide written guidance to organizations and individuals to complete the documents and specify the reasons;

b) Within fifteen working days from the date of receiving valid documents, the Forestry Department shall establish an Appraisal Board, conduct an appraisal of the documents, perform on-site inspections, prepare an appraisal record, and issue an appraisal report. The inspection content and methods follow the national standard for recognized forestry tree varieties. The operational regulations of the Appraisal Board are issued by the Forestry Department[6] :

c) Within three working days from the date of receiving the appraisal record and report, the Director of the Forestry Department[7] decides to recognize forestry tree varieties according to Model No. 03 of Appendix III and Section A of Appendix IV issued together with this Circular; deliver the result to organizations and individuals and announce it on the Forestry Department's electronic portal[8]; if the forestry tree variety is not recognized, notify in writing and specify the reasons.

Article 9. Revocation of recognition of forestry tree varieties

1. Revocation of decisions recognizing forestry tree varieties in the following cases:

a) The recognized forestry tree variety has degenerated, decreased in productivity and quality, or suffered severe pest damage compared to the national standard for recognized forestry tree varieties;

b) There is no material left for propagating the recognized forestry tree variety.

2. Within twenty working days from the date of discovery or receipt of information from organizations and individuals regarding the condition of forestry tree varieties falling under any of the cases stipulated in Clause 1 of this Article, the Forestry Department[9] shall organize inspections, verify, and decide to revoke the recognition of forestry tree varieties according to Model No. 03 of Appendix III and Section A of Appendix IV issued together with this Circular and announce it on the Forestry Department's portal[10]; if the recognition of the forestry tree variety is not revoked, notify in writing to organizations and individuals.

 

Section 3. RECOGNITION AND REVOCATION OF RECOGNITION OF FORESTRY TREE VARIETY SOURCES

 

Article 10. Criteria for Recognizing Forestry Planting Seed Sources

1. A forestry planting seed source shall be recognized when it meets the requirements of the national standard on recognized forestry planting seed sources. In cases where there is no national standard, the basic standard shall apply.

2. Recognized forestry planting seed sources include: Selected forest parts; converted seedling forests; planted seedling forests; seedling gardens; primary tree gardens; superior trees providing materials to produce seedlings for afforestation purposes; primary trees supplying cuttings, grafting branches, and grafting buds.

Superior trees shall not be recognized for obtaining materials to build seedling forests and seedling gardens; nor shall they be recognized for rejuvenating varieties.

Article 11. Procedures and Formalities for Recognizing Forestry Planting Seed Sources

1. Competent Authority: The Forest Protection Service or the Forestry Service at the local level shall recognize forestry planting seed sources. In cases where the local area does not have a Forest Protection Service or a Forestry Service, the authority to recognize forestry planting seed sources shall be decided by the Department of Agriculture and Rural Development (hereinafter referred to as the Local Competent Authority).

2. Documents for Requesting Recognition of Forestry Planting Seed Sources from Organizations and Individuals Include:

a) A request document for recognizing forestry planting seed sources according to Model No. 04 in Appendix III issued together with this Circular (original copy);

b) A technical report on forestry planting seed sources according to Model No. 05 in Appendix III issued together with this Circular (original copy).

3. Methods of submitting documents: Organizations and individuals may submit directly, send via postal service, send through public postal services, or submit online.

4. Procedure for implementation:

a) Organizations and individuals requesting recognition of forestry planting seed sources shall submit one set of documents as stipulated in Clause 2 of this Article to the Local Competent Authority. In cases where the submitted documents are not valid, within three working days from the date of receiving the documents, the Local Competent Authority shall directly guide or provide written guidance to organizations and individuals to complete the documents and clearly state the reasons;

b) Within fifteen working days from the date of receiving valid documents, the Local Competent Authority shall establish an Appraisal Board, conduct an appraisal of the documents, carry out field inspections, prepare an appraisal record, and issue an appraisal report. The content and method of inspection shall follow the national standard on recognized forestry planting seed sources. The operational regulations of the Appraisal Board shall be issued by the Local Competent Authority;

c) Within three working days from the date of receiving the appraisal record and the appraisal report, the Head of the Local Competent Authority shall decide on recognizing forestry planting seed sources according to Model No. 06 in Appendix III and Section B of Appendix IV issued together with this Circular; deliver the result to the organization or individual and announce it on the website of the Forest Protection Service or the Forestry Service and the Department of Agriculture and Rural Development; in cases where recognition is not granted, notify in writing and clearly state the reasons.

5. Duration of the Decision on Recognizing Forestry Planting Seed Sources:

a) Seedling gardens: fifteen years;

b) Planted seedling forests: seven years;

c) Converted seedling forests and selected forest parts: five years;

d) Primary tree gardens supplying cuttings of fast-growing tree species: three years;

e) Superior trees: ten years;

f) Primary trees, primary tree gardens of slow-growing timber tree species and non-timber forest products trees supplying cuttings, grafting branches, and grafting buds: ten years.

6. To continue using a forestry planting seed source, it must be re-evaluated and recognized again. The procedures, formalities, and duration of the decision on re-recognizing forestry planting seed sources shall be implemented according to the provisions of Clauses 1, 2, 3, 4, and 5 of this Article. Re-recognition shall not be carried out for primary tree gardens supplying cuttings of fast-growing tree species.

Article 12. Revocation of Recognition of Forestry Tree Seed Sources

1. The recognition decision of forestry tree seed sources shall be revoked in the following cases:

a) The forestry tree seed source is currently within its usage period and has degenerated, decreased in yield and quality, failing to meet the requirements of recognized forestry tree seed source standards;

b) The forestry tree seed source no longer exists, having been destroyed by natural disasters or epidemics; the forestry tree seed source of a recognized forestry tree seed source that has been revoked.

2. Within twenty working days from the date of discovery or receipt of information reflecting the status of forestry tree seed sources falling under any of the circumstances specified in Clause 1 of this Article, the local competent authority shall organize inspections, verify, and decide to revoke the recognition of forestry tree seed sources according to Model No. 06 Appendix III and Section B Appendix IV issued together with this Circular; publish on the electronic portal of the Forest Protection Service or the Forestry Service and Department of Agriculture and Rural Development; if not revoking the recognition of forestry tree seed sources, notify in writing the organization or individual.

 

Chapter III. IMPLEMENTATION[11]

 

Article 13. Responsibilities for Implementation

1. The Forestry Department[12]:

a) Regularly review, compile, update, and announce the list of recognized or revoked forestry tree seed sources on the electronic portal of the Forestry Department;[13];

b) Inspect and audit the management activities of production and trade of forestry tree seeds in localities as prescribed by law;

c) Resolve complaints, denunciations, and handle violations concerning the management of production and trade of forestry tree seeds nationwide within its jurisdiction.

2. Departments of Agriculture and Rural Development of provinces and centrally governed cities:

a) Guide the management, exploitation, and effective use of recognized forestry tree seeds and seed sources;

b) Direct and guide the implementation of standards for forestry tree seeds;

c) Regularly review, compile, update, and publicly announce the list of recognized or revoked forestry tree seed sources on the electronic portal of the Department of Agriculture and Rural Development; notify the Forestry Department immediately after issuing the decision on recognition or revocation of recognition of forestry tree seed sources;[14] d) Inspect, audit, resolve complaints, denunciations, and handle violations concerning the management of production and trade of forestry tree seeds in the locality as prescribed by law;

e) Before December 31 each year, report to the Forestry Department

on the situation of production, trade, and use of forestry tree seeds in the locality (including plantation areas by species).[15] 3. Responsibilities of organizations and individuals:

a) Strictly comply with legal regulations on forestry tree seeds during production and trade, ensuring the quality of forestry tree seeds as prescribed;

b) Adhere to inspection, audit, and violation handling by state agencies with competent authority as prescribed by law.

1. For forestry tree seed sources recognized by competent authorities before the effectiveness of this Circular shall continue to be used until the end of their usage period as decided upon recognition.

Article 14. Transitional Provisions

2. In cases where applications for recognition of forestry tree seeds and seed sources were submitted before the effectiveness of this Circular but have not yet been recognized, they shall be processed in accordance with this Circular.

1. This Circular takes effect from February 12, 2022.

Article 15. Effective Date

2. This Circular replaces Circular No. 30/2018/TT-BNNPTNT dated November 16, 2018, issued by the Minister of Agriculture and Rural Development on the List of Major Forestry Tree Species; Recognition of Varieties and Seed Sources; Management of Major Forestry Tree Seed Materials.

3. Where national standards cited in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replaced versions shall apply.

4. During the implementation of this Circular, if there are difficulties, agencies, organizations, and individuals shall promptly reflect them to the Ministry of Agriculture and Rural Development for consideration, amendment, and supplementation./.

REGULATIONS ON CODES OF RECOGNIZED FORESTRY PLANTING SEEDS AND SEED SOURCES
Ecoregion

A. Codes of recognized forestry planting seeds

The code of recognized forestry planting seeds consists of four parts:

1. First part:

Consists of the first letters of the species name in Vietnamese (Example: Acacia is AC; Leucaena is LE...). In case of hybrid trees, the first letter of the species name in Vietnamese and the next letter is H (Example: Hybrid Acacia is AH; Hybrid Leucaena is LH).

2. Second part:

Consists of two uppercase letters representing the first letters of the name of the commune where the seed planting has been successfully tested or experimented.

3. Third part:

Consists of the last two digits of the year when the seed planting was recognized.

4. Fourth part:

Consists of two digits, which is the serial number of the recognized forestry planting seed according to chronological order.

Example:

1.[18] A successful Acacia auriculiformis seed test at Cam Linh Commune (Ba Vi - Hanoi) recognized first by the Forest Administration in 2021 will have the following code:

2.[19] A hybrid tree between Melaleuca cajuputi and Melaleuca leucadendron created through artificial hybridization between these two species, successfully tested or experimented for the first time at Cam Linh Commune (Ba Vi - Hanoi) and recognized by the Forest Administration in 2021 as the fourth recognized will have the following code:

3. Regulations on establishing codes for recognized forestry planting seed sources:

The code for recognized forestry planting seed sources nationwide is established as follows:

The code consists of one letter and four digits

- The letter represents the type of recognized forestry planting seed source (9 types). The code for the type of recognized forestry planting seed source is recorded according to Clause 2, Section B of the Appendix.

- The next two digits represent the province code where the recognized forestry planting seed source is located. The province code is recorded according to Clause 1, Section B of the Appendix.

- The last two digits represent the serial number of the recognized forestry planting seed source according to chronological order.

Example:

1. Asexual Seedling Nursery of the So tree species at Nghia Dan Forestry Station in Nghe An Province, which is the 18th recognized forestry planting seed source evaluated and recognized by the Forestry Inspection Branch of Nghe An Province, will be assigned the following code:

2. Seedling Forest converted from planted forest of the Tram tree species at Thach Thanh Forestry Station in Thanh Hoa Province, which is the 5th recognized forestry planting seed source evaluated and recognized by the Forestry Inspection Branch of Thanh Hoa Province, will be assigned the following code:

3. Asexual Seedling Nursery of the Hybrid Keo tree species at the Agricultural and Forestry Seed Center in Binh Dinh Province, which is the 2nd recognized forestry planting seed source organized for evaluation and recognition by the Forestry Inspection Branch of Binh Dinh Province, will be assigned the following code:

[1] Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023 of the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Articles of Circulars in the Forestry Sector is hereby issued as follows:

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Forestry Law dated November 15, 2017;

At the proposal of the Director of the Forest Management Department;

The Minister of Agriculture and Rural Development issues the Circular amending and supplementing certain articles of Circulars in the forestry sector.

[2] This Section has been amended and supplemented pursuant to Clause 1, Article 3 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which took effect from February 1, 2023.

[3] The phrase "Forest Protection Agency" shall be replaced with the phrase "Forest Management Bureau" as provided for in Clause 2, Article 3 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which took effect from February 1, 2023.

[4] The phrase "Forest Protection Agency" shall be replaced with the phrase "Forest Management Bureau" as provided for in Clause 2, Article 3 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which took effect from February 1, 2023.

[11] This Chapter has been amended and supplemented pursuant to Article 14 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development amending and supplementing certain provisions of Circulars in the Forestry Sector, which took effect from February 1, 2024.

[12] The phrase "Forest Protection Agency" shall be replaced with the phrase "Forest Management Bureau" as provided for in Clause 2, Article 3 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which took effect from February 1, 2023.

[16] Form No. 01 Appendix III promulgated together with Circular No. 22/2021 dated December 29, 2021, has been replaced by Form No. 01 Appendix IV promulgated together with Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, as stipulated in Clause 3, Article 3 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which took effect from February 1, 2023.

[17] Form No. 03 Appendix III promulgated together with Circular No. 22/2021 dated December 29, 2021, has been replaced by Form No. 03 Appendix IV promulgated together with Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, as stipulated in Clause 3, Article 3 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which took effect from February 1, 2023.

[18] This Section has been amended and supplemented pursuant to Clause 2, Article 3 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development on Amending and Supplementing Certain Provisions of Circulars in the Forestry Sector, which took effect from February 1, 2023.
