Article 1. Scope of Regulation and Applicability

THIS CIRCULAR GUIDES THE IMPLEMENTATION OF MONTHLY SUBSIDY, ONE-TIME SUBSIDY, HEALTH INSURANCE REGIME, FUNERAL EXPENSES FOR CERTAIN PERSONS DIRECTLY PARTICIPATING IN THE WAR TO DEFEND THE COUNTRY IN THE WESTERN FRONTIER, THE NORTHERN FRONTIER, PERFORMING INTERNATIONAL TASKS IN CAMBODIA, AND ASSISTING LAOS (HEREINAFTER REFERRED TO AS PERSONS DIRECTLY PARTICIPATING IN THE WAR TO DEFEND THE COUNTRY AND PERFORMING INTERNATIONAL TASKS) AFTER APRIL 30, 1975 WITHIN THE AREA AND TIME PERIOD SPECIFIED IN ARTICLE 3 OF RESOLUTION NO. 62/2011/QĐ-TTg, WHO HAVE BEEN DISCHARGED, COMMISSIONED OUT, OR RETIRED.

a) OFFICERS, PROFESSIONAL SOLDIERS, NON-COMMISSIONED OFFICERS, SOLDIERS, INCLUDING THE ARMED POPULAR POLICE FORCE, BORDER GUARD FORCES THROUGHOUT DIFFERENT PERIODS (COLLECTIVELY REFERRED TO AS MILITARY PERSONNEL), PERSONS ENGAGED IN SECRETARY WORK WITH MILITARY PAY, ENLISTED OR RECRUITED AFTER APRIL 30, 1975 DIRECTLY PARTICIPATING IN THE WAR TO DEFEND THE COUNTRY AND PERFORMING INTERNATIONAL TASKS, WITH LESS THAN 20 YEARS OF SERVICE IN THE MILITARY, SECRETARY WORK, CURRENTLY NOT ELIGIBLE FOR RETIREMENT BENEFITS, DISABILITY BENEFITS, MONTHLY DISABLED SOLDIER BENEFITS, FALLING INTO ANY OF THE FOLLOWING CASES:
- DISCHARGED, COMMISSIONED OUT, OR RETIRED BEFORE APRIL 1, 2000;
- WOUNDED SOLDIERS WHO HAVE BEEN DISCHARGED, COMMISSIONED OUT BEFORE APRIL 1, 2000; SEVERELY WOUNDED SOLDIERS CURRENTLY UNDER MEDICAL CARE AT WOUNDED SOLDIERS REHABILITATION UNITS MANAGED BY THE LABOR, INVALIDS AND SOCIAL AFFAIRS DEPARTMENT OR ALREADY RETURNED HOME;
- TRANSFERRED TO ANOTHER FIELD OR TRANSFERRED TO NATIONAL DEFENSE CIVIL SERVANTS THEN DISCHARGED BEFORE JANUARY 1, 1995; HAD A TRANSFER DECISION BEFORE APRIL 1, 2000 BUT DID NOT IMPLEMENT IT OR RETURNED TO THE LOCALITY WITHOUT HAVING THEIR BENEFITS PROCESSED;
- DISCHARGED, COMMISSIONED OUT TO PARTICIPATE IN INTERNATIONAL COOPERATIVE LABOR OR SENT TO PARTICIPATE IN INTERNATIONAL COOPERATIVE LABOR AND RETURNED HOME BEFORE APRIL 1, 2000.
b) NATIONAL DEFENSE CIVIL SERVANTS, STATE CIVIL SERVANTS, SPECIALISTS FROM VARIOUS INDUSTRIES (COLLECTIVELY REFERRED TO AS OFFICIALS AND CIVIL SERVANTS) DIRECTLY PARTICIPATING IN THE WAR TO DEFEND THE COUNTRY AND PERFORMING INTERNATIONAL TASKS WHO HAVE BEEN DISCHARGED BEFORE JANUARY 1, 1995, CURRENTLY NOT ELIGIBLE FOR RETIREMENT BENEFITS, MONTHLY DISABILITY BENEFITS.
c) COMMUNE, WARD, TOWN OFFICIALS (HEREINAFTER COLLECTIVELY REFERRED TO AS COMMUNE OFFICIALS) DIRECTLY PARTICIPATING IN THE WAR TO DEFEND THE COUNTRY WHO HAVE BEEN DISCHARGED, CURRENTLY NOT ELIGIBLE FOR RETIREMENT BENEFITS, MONTHLY DISABILITY BENEFITS.
d) SELF-DEFENSE FORCES, COMMUNE POLICE ORGANIZED AND MANAGED BY COMMUNE AUTHORITIES (INCLUDING VILLAGE, HAMLET IN BORDER COMMUNES) DIRECTLY PARTICIPATING IN THE WAR TO DEFEND THE COUNTRY WHO HAVE RETURNED HOME, CURRENTLY NOT ELIGIBLE FOR RETIREMENT BENEFITS, MONTHLY DISABILITY BENEFITS.
đ) YOUTH VOLUNTEERS ENROLLED AFTER APRIL 30, 1975 DIRECTLY PARTICIPATING IN THE WAR TO DEFEND THE COUNTRY AND PERFORMING INTERNATIONAL TASKS WHO HAVE RETURNED HOME, CURRENTLY NOT ELIGIBLE FOR RETIREMENT BENEFITS, MONTHLY DISABILITY BENEFITS.
3. Subjects not applicable
IMPLEMENT AS CLAUSE 2, ARTICLE 2 OF RESOLUTION NO. 62/2011/QĐ-TTg.
Article 2. Calculation of Time for Entitlement to Benefits
1. The time for entitlement to benefits for the subjects specified in point a, Clause 2, Article 1 of this Circular shall be the actual working time in the military and cryptographic services, including the time as officers, professional soldiers, non-commissioned officers, privates, and cryptographic personnel (including working time in the People's Public Security force) plus the time directly participating in wars to protect the country and international missions as specified in points b, c, d, and đ, Clause 2, Article 1 of this Circular (if applicable); if there is interruption, it will be accumulated.
For cases where individuals have changed careers and stopped working, or have been demobilized or discharged from the military for a period of time before continuing to work at agencies, units, or organizations outside the military or engaged in international labor cooperation, then were demobilized, discharged, or stopped working again, or severely wounded veterans undergoing rehabilitation at veteran rehabilitation centers managed by the Ministry of Labor, Invalids, and Social Affairs, the working time outside the military and cryptographic services (not directly participating in wars to protect the country or international missions), the time spent on international labor cooperation, and the time spent in rehabilitation at veteran rehabilitation centers managed by the Ministry of Labor, Invalids, and Social Affairs shall not be counted as time for entitlement to benefits.
2. The time for entitlement to benefits for the subjects specified in points b, c, d, and đ, Clause 2, Article 1 of this Circular is the time directly participating in wars to protect the country and international missions.
In cases where the subjects mentioned above have participated in wars to protect the country and international missions belonging to different groups of subjects or with interruptions, such time will be accumulated.
3. If the months of service are odd, the time for entitlement to a one-time allowance from six months to twelve months will be calculated as a full year; less than six months will be calculated as half (1/2) year; the monthly allowance will be calculated as a full year (twelve months).
Article 3. Allowance System
1. Monthly Allowance
a) Subjects specified in point a, Clause 2, Article 1 of this Circular, having worked for at least fifteen years but less than twenty years, shall enjoy the monthly allowance according to the guidance provided in Article 2 of this Circular (including those who were demobilized or discharged after December 15, 1993, and are currently working in communes that participate in mandatory social insurance and do not meet the conditions to enjoy retirement benefits upon leaving their jobs, or those whose time served in the military or cryptographic services has not been counted towards a one-time social insurance benefit due to insufficient conditions for retirement benefits when leaving their jobs in communes) shall enjoy a monthly allowance based on the number of years of service counted towards the benefit as stipulated above; the specific amount is as follows:
- From fifteen to less than sixteen years, the allowance is 925,000 VND/month;
- From sixteen to less than seventeen years, the allowance is 971,000 VND/month;
- From seventeen to less than eighteen years, the allowance is 1,018,000 VND/month;
- From eighteen to less than nineteen years, the allowance is 1,064,000 VND/month;
- From nineteen to less than twenty years, the allowance is 1,110,000 VND/month.
b) When the Government adjusts pensions, social insurance allowances, and monthly allowances, the aforementioned allowances will also be adjusted accordingly; the adjustment date will be implemented according to the Government's regulations starting from January 1, 2012.
c) When a subject receiving a monthly allowance passes away, they will stop receiving the allowance from the following month; the surviving relatives of the deceased subject will receive a one-time allowance equal to three months of the current monthly allowance of the deceased subject.
Refer to examples 1, 2, 3, and 4 at ANNEX 1 Enterprises importing tobacco raw materials and cigarette paper for producing tobacco products for export or processing tobacco products for export shall submit registration applications according to Form
2. One-Time Allowance
a) Subjects specified in point a, Clause 2, Article 1 of this Circular, having worked for less than fifteen years, shall enjoy a one-time allowance according to the guidance provided in Article 2 of this Circular (including those who were demobilized, discharged, or stopped working and are currently working in communes that participate in mandatory social insurance, or those who have worked for less than twenty years in the military or cryptographic services and then worked in communes and have retired but whose time served in the military or cryptographic services was not combined with their time working in communes to calculate social insurance benefits) shall enjoy a one-time allowance based on the number of years of service counted towards the benefit as stipulated above; the specific amount is as follows:
- For two years or less, the one-time allowance is 2,500,000 VND;
- For more than two years, each additional year from the third year onwards adds 800,000 VND.
b) Subjects specified in points b, c, d, and đ, Clause 2, Article 1 of this Circular shall enjoy a one-time allowance based on the number of years directly participating in wars to protect the country and international missions, specifically as follows:
- For two years or less, the one-time allowance is 2,500,000 VND
- For more than two years, each additional year from the third year onwards adds 800,000 VND.
c) The one-time allowance specified in point a and b of this clause shall be calculated using the following formula:
Allowance Amount = 2,500,000 VND + [(number of years counted towards the benefit - 2 years) x 800,000 VND].
Refer to examples 5 and 6 at ANNEX 1 promulgated together with this Circular.
d) Subjects specified in Clause 2, Article 1 of this Circular who passed away before January 1, 2012 (including those who passed away while still serving or working) shall have one of the following relatives of the subject eligible to receive a one-time allowance of 3,600,000 VND: spouse; biological or adopted children; biological father or mother or legal guardian.
Article 4. Health insurance and funeral expenses regime
For the subjects regulated in Clause 2, Article 1 of this Circular if they have not yet enjoyed the health insurance benefits, they shall enjoy such benefits according to the laws on health insurance. When the subject passes away, the person handling the funeral shall be entitled to funeral expenses allowance according to the current laws on social insurance.
Article 5. Source of funds for implementation
1. The funds for monthly allowance and one-time allowance for the subjects regulated in Article 3 of this Circular shall be guaranteed by the central budget. The funds for monthly allowances shall be provided by the Ministry of Finance to the Ministry of Labor, Invalids and Social Affairs to delegate local Departments of Labor, Invalids and Social Affairs to pay out; the funds for one-time allowance shall be provided by the Ministry of Finance according to the proposal of the Ministry of Defense and the Ministry of Labor, Invalids and Social Affairs, transferred to units and localities for payment.
2. The funds for purchasing health insurance and implementing funeral expenses regime regulated in Article 4 of this Circular, shall be guaranteed by the local budget.
3. The funds ensuring the work of reviewing and paying out one-time allowance as regulated in Clause 2, Article 3 of this Circular shall be 4% of the total funds paid out for the subjects guaranteed by the central budget; the funds for monthly allowances shall be implemented according to the regulations on preferential allowances for persons with meritorious service.
The contents of the funds ensuring the work of payment include: Propaganda and dissemination of policies; training and vocational upgrading; review and examination of files; summary and finalization; printing and materials; office supplies; minor repairs of equipment serving management and review; payment ... The expenditure level shall be implemented according to the current regulations of the State.
Article 6. Documents for reviewing entitlement to benefits
The file for reviewing entitlement to the benefits prescribed in Clause 1, Article 7 of Decision No. 62/2011/QĐ-TTg is guided as follows:
1. Documents serving the basis for review of entitlement to benefits
a) Original documents or documents considered as original ones, including:
- Discharge decision, demobilization, transfer, resignation or completion of duty or transfer to defense civil servants then resignation, decision of competent authority sending to international labor cooperation;
- Registration form for discharge allowance, demobilization, transfer;
- Decision on issuance of disability certificate and allowance or extract from disability file;
- Military personnel record, cadre and civil servant record, cadre record or extract 63 for officers, military personnel registration form; overseas labor record; party member record; social insurance book (if any);
These original documents include the original or certified copy issued by the competent authority.
- Confirmation of work history by the former agency or unit before the subject's discharge, demobilization, transfer, resignation (Form 7, original), directly signed and stamped by the head of the agency or unit at the level of brigade and above managing the subject before discharge, demobilization, resignation, termination of work or sending to international labor cooperation, transfer or transfer to defense civil servants then resignation, attached with a photocopied file of the subject or list registered and managed by the agency or unit currently storing to serve as confirmation basis. In case the former agency or unit has been merged or dissolved, it shall be confirmed by the newly established agency or unit after merger or the direct superior of the dissolved agency or unit.
b) Related documents, including:
- Recruitment decision, promotion of rank, salary increase; job transfer, appointment; assignment of tasks;
- Certificate of participation in Volunteer Youth Corps; military reserve registration certificate; health check-up form, casualty transfer, hospital transfer;
- Medals and commendations for participating in wars to protect the country and other forms of reward;
- File for enjoying policies for persons with meritorious service, enjoying one-time social insurance;
- Death certificate; soldier death report;
- Other related documents, if any.
2. Files for reviewing entitlement to allowance for each subject
a) The file for reviewing entitlement to monthly allowance is established in one set (stored at the Military Region 1 Command Department or the Policy Bureau, for subjects whose decisions are made by the Policy Bureau)[2], each set includes:
- One personal declaration form of the subject (Form 1A), original;
- Each or some documents serving the basis for review as regulated in Clause 1 of this Article (original or certified copy issued by the competent authority) sufficient to prove the correct subject, conditions for enjoying the benefit and the working period of the subject as regulated in Article 1, 2 and Clause 1 of Article 3 of this Circular;
- 01 Record of Review by the Village Policy Council (Model 2), original.
- 01 Letter of Review and Recommendation of the Military Command of the Province or City (Model 4), original.
). Each report period, all levels shall attach the Letter of Recommendation (Model 3A); list of beneficiaries (Model 3B), original.
The handover dossier for the Department of Labor, Invalids and Social Affairs to disburse benefits includes:
- Personal declaration form of the beneficiary;
- Review and recommendation letter of the Military Command of the province or the Political Department of the Hanoi Military Command;
- Decision and Introduction Letter for monthly allowance issued by the Military Region Command or the Policy Department - General Political Department (for beneficiaries under the decision of the Policy Department - General Political Department).
b) The dossier for one-time allowance benefit is established in 01 set (for beneficiaries within the jurisdiction of the Provincial People's Committee: retain 01 set at the Provincial People's Committee; for beneficiaries under the jurisdiction of the Ministry of Defense: retain 01 set at the Military Region Command or the Hanoi Capital Military Command).[3], each set includes:
- 01 personal declaration form of the beneficiary or their relative (in case of deceased beneficiary), Model 1B send a text message 1C, original;
- 01 death certificate or soldier death notice (in case of deceased beneficiary), original or copy;
- One or several documents serving as the basis for review as stipulated in Clause 1 of this Article (if available);
- 01 Record of Review by the Village Policy Council (Model 2), original.
). Each report period, all levels shall attach the Letter of Recommendation (Model 3A); list of beneficiaries (Model 3C), original.
Article 7. Responsibilities and Implementation Procedures
1. For beneficiaries or relatives of beneficiaries (in case of deceased beneficiaries)
- Fill out the declaration form according to the prescribed model;
- Submit to the Village Head where they reside the following documents:[4] + For beneficiaries eligible for monthly allowance, including: 01 personal declaration form (
original); one or several documents serving as the basis for review as stipulated in Form 1A (original or copy from the competent authority), sufficient to prove the correct beneficiary, eligibility for the benefit, and service time. Clause 1, Article 6 of this Circular + For beneficiaries eligible for one-time allowance, including: 01 declaration form (
original or copy from the competent authority, if applicable). Model 1B send a text message 1C (original or copy from the competent authority), sufficient to prove the correct beneficiary, eligibility for the benefit, and service time. Clause 1, Article 6 of this Circular - Receive notification of the result of administrative procedures at the Commune People's Committee (hereinafter referred to as the commune level) where they reside within the specified timeframe.
2. For the Commune People's Committee
a) Establish a Village Policy Council chaired by the Chairman (or Vice-Chairman) of the People's Committee, the Village Chief, and the Labor, Invalids and Social Affairs Officer as the permanent member, and other members including representatives from the Party Committee (or branch party committee for places without a party committee), the Fatherland Front, the Association of Former Combatants, and the Association of Former Youth Volunteers. The Village Policy Council is responsible for organizing meetings to review and recommend benefits for each beneficiary, in batches reported by the Village Heads.
When organizing review meetings, the Village Policy Council invites the Village Head, the Branch Party Secretary with beneficiaries, the Association of Former Combatants, the Association of Former Youth Volunteers, and some representatives of former cadres who were responsible for the local party committee and military office during wartime; representatives of beneficiaries who have received benefits under Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of the Prime Minister to participate together.
b) Guide the Village Head to accept the dossier of beneficiaries or relatives of beneficiaries residing in the locality and beneficiaries residing elsewhere in the locality requesting confirmation of the dossier to receive benefits; check, review, and compile reports to the Commune People's Committee (through the Village Policy Council).
c) Direct the Village Policy Council to accept dossiers reported by the Village Heads, classify dossiers into two types: beneficiaries receiving monthly allowance and beneficiaries receiving one-time allowance; organize democratic, transparent, thorough, and accurate review meetings as follows:[5] - Organize the review of dossiers for beneficiaries receiving one-time allowance in three stages:
+ Stage 1: Review the group of beneficiaries with original documents or documents considered equivalent to originals;
+ Stage 2: Review the group of beneficiaries with related documents;
+ Stage 3: Review the group of beneficiaries without documents.
(During the review process, combine the review of dossiers for beneficiaries receiving one-time allowance with the review of dossiers for beneficiaries receiving monthly allowance).
- Within 5 working days from the date of receipt of dossiers reported by the Village Heads in batches, the Commune People's Committee completes the review, establishes, and confirms dossiers for each beneficiary
; report to the District People's Committee (hereinafter referred to as the district level): through the Military Command of the district for beneficiaries under the jurisdiction of the Ministry of Defense, including military personnel, cryptographers, defense civil servants, self-defense militia; through the Labor, Invalids and Social Affairs Office of the district for beneficiaries under the jurisdiction of the provincial-level People's Committee, including state civil servants, experts from various sectors; village cadres; village police; youth volunteers.
In cases where the beneficiary is unclear, the time for benefit calculation or there are complaints and accusations, leave them for verification and clarification, if eligible, report later.[6]d) Coordinate with the Military Command and the Labor, Invalids and Social Affairs Office of the district to organize the payment of benefits to beneficiaries; ensure transparency, thoroughness, accuracy, and promptness.
đ) For cases where the beneficiary was born in the locality but currently resides elsewhere and requests confirmation of the dossier, after the Village Policy Council reviews and finds them eligible, the Commune People's Committee will confirm and request the local government where the beneficiary currently resides to consider and recommend benefits according to regulations.
3. For the District People's Committee
a) Direct relevant agencies to complete the review, cross-check, compile, and report recommendations to higher authorities within 10 working days from the date of receipt of complete dossiers reported by the Commune People's Committee (in batches) as follows:
3. With respect to the People's Committee at the district level
a) Direct relevant agencies to complete within ten working days from the date of receipt of all required documents reported by the People's Committee at the commune level (in each batch) the review, verification, consolidation, and reporting upwards in accordance with the following provisions:
- Military Command Board of the district: Receive files of subjects within the jurisdiction of the Ministry of National Defense reported by the People's Committee at the commune level; conduct review, comparison, consolidation, and report to the People's Committee at the provincial level through the Provincial Military Command Board, accompanied by the file and list of subjects (Model 3B, 3C)[7].
- Department of Labor - War Invalids and Social Affairs of the district: Receive files of subjects within the jurisdiction of the People's Committee at the provincial level reported by the People's Committee at the commune level; conduct review, comparison, consolidation, and report to the People's Committee at the provincial level (through the Provincial Department of Labor - War Invalids and Social Affairs), accompanied by the file of each subject (one set of file per subject) and the list of subjects (Model 3C);
b) Direct the Military Command Board and the Department of Labor - War Invalids and Social Affairs of the district to promptly pay the one-time allowance to the subjects upon the decision of the competent authority, ensuring timeliness, transparency, strictness, and accuracy; implement the storage of files according to regulations.
c) Take the lead in inspecting the implementation and resolving any difficulties and issues arising locally.
4. For the People's Committee at the provincial level
a) Direct the functional agencies of the province to receive files reported by the People's Committee at the district level; within 10 working days from the date of receiving complete files as prescribed (in each batch), complete the examination, consolidation, and reporting to the competent authority for approval as follows:
- Provincial Military Command Board: Receive files of subjects reported by the Military Command Board of the district; organize examination, consolidation, reporting, and propose the Military Zone Command to review (through the Policy Office), accompanied by the file of the subject[8] and the list of subjects (Model 3B, 3C);
Political Bureau - Command of the Capital City of Hanoi: Receive files of subjects reported by the Military Command Board of the district; organize examination, consolidation, and propose the Command of the Capital City of Hanoi to issue the decision on the one-time allowance; review, consolidate, and complete the file of subjects entitled to monthly allowances, report to the Command, and propose the Policy Bureau - General Political Department to review and issue the decision.
- Department of Labor - War Invalids and Social Affairs of the province: Receive files of subjects reported by the Department of Labor - War Invalids and Social Affairs of the district; organize examination, consolidation, reporting, and propose the People's Committee at the provincial level to issue the decision as prescribed and store one set of file per subject.
b) Direct the Provincial Military Command Board and the Political Bureau of the Command of the Capital City of Hanoi to transfer files of subjects entitled to monthly allowances; decisions and lists of subjects entitled to one-time allowances to the Department of Labor - War Invalids and Social Affairs of the province for management, payment of monthly allowances, and implementation of health insurance and funeral expenses for the subjects as prescribed.
c) Direct the Department of Labor - War Invalids and Social Affairs to base on the decision on monthly allowances; decisions and lists of subjects entitled to one-time allowances of the competent authority as prescribed in Decision No. 62/2011/QĐ-TTg, guide and implement health insurance and funeral expenses for the subjects according to current laws on health insurance and social insurance.
d) Issue the decision on one-time allowances (model 5) for subjects within the jurisdiction of the decision-making authority based on the proposal of the Department of Labor - War Invalids and Social Affairs of the province.
đ) Consolidate and prepare the budget estimate to ensure payment of allowances for subjects within the jurisdiction of the decision-making authority, report to the Ministry of Labor - War Invalids and Social Affairs to request the Ministry of Finance to ensure funding.
e) Direct the Department of Labor - War Invalids and Social Affairs to receive files for monthly allowances; decisions and lists of subjects entitled to one-time allowances transferred by the Provincial Military Command Board or the Political Bureau of the Command of the Capital City of Hanoi, promptly pay monthly allowances and implement health insurance and funeral expenses for the subjects as prescribed.
g) Take the lead in inspecting the implementation and resolving any difficulties and issues arising locally.
5. For the Military Zone Commands and the Command of the Capital City of Hanoi
a) Direct and guide subordinate agencies and units to implement.
b) Within no more than 10 working days from the date of receiving complete files as prescribed (in each batch), the Military Zone Commands and the Command of the Capital City of Hanoi complete the review and issuance of the decision on one-time allowances (model 5)[9]; the Military Zone Commands issue the decision on monthly allowances (five original copies, model 6A) for subjects under their jurisdiction after obtaining the review opinion of the Policy Bureau - General Political Department, issue introduction letters (three original copies, model 6B).
c) Consolidate and report to the Ministry of National Defense (through the Policy Bureau - General Political Department) the list of monthly allowances (in each batch); decisions and lists of subjects entitled to one-time allowances[10].
d) Store files of subjects entitled to allowances (one set per subject); transfer one set of files of subjects entitled to monthly allowances back to the Provincial Military Command Board (or the Political Bureau of the Command of the Capital City of Hanoi) and the decision with the list of subjects entitled to one-time allowances for transfer to the Department of Labor - War Invalids and Social Affairs of the province.
đ) Direct and implement the return of original documents, documents considered as original documents, and related documents (original copies) to the subjects.
6. For subordinate units of the Ministry of National Defense
Direct subordinate units to be responsible for confirming the work history of subjects within the unit's management scope (Form 7) upon request of the subjects or local military authorities, ensuring accuracy, truthfulness, and bearing responsibility under the law for such confirmation.
7. For functional agencies of the Ministry of National Defense
a) Policy Bureau - General Political Department
- Coordinate and direct propaganda and dissemination of the support regime and policies; provide guidance on implementation;
- Organize the review of files for monthly allowances proposed by the Military Zone Command and the Command of the Capital City of Hanoi. Within no more than 10 working days from the date of receiving complete files as prescribed (in each batch report), complete the review, issue the decision, and issue introduction letters for subjects entitled to monthly allowances as proposed by the Command of the Capital City of Hanoi.[11] - Store the decision with the list of subjects entitled to one-time allowances;

- Retain the decision along with the list of beneficiaries entitled to one-time allowance benefits; list of subjects entitled to monthly subsistence allowance reported by Military Regions and the Command of Hanoi Capital; monthly benefit dossier (one set per subject) within the authority to review and issue decisions; take the lead, coordinate to resolve difficulties and issues arising;
b) Financial Department - Ministry of National Defense
Announce and allocate funds for Military Regions and the Command of Hanoi Capital; simultaneously manage and direct settlement of expenses according to current regulations; coordinate to direct, inspect, and resolve difficulties and issues arising in implementation;
c) Cadre Department - Political General Department; Force Department - General Staff Department
Direct agencies and units under their management to confirm work history in the military for subjects as required, ensuring strictness and accuracy; coordinate to direct, inspect, and resolve difficulties and issues arising in implementation;
Article 8. Implementation organization
1. The Ministry of National Defense
a) Coordinate with relevant Ministries and sectors to direct, guide, and inspect agencies, units, and localities in implementing the guidance regimes stipulated in this Circular; authorize the Political General Department to sign a letter requesting the Ministry of Finance to ensure funding for one-time allowances for subjects within the Ministry of National Defense's jurisdiction;
Direct agencies and units under their control to organize examination, review, and issuance of decisions on monthly subsistence allowance benefits; examine, review, issue decisions, and pay one-time allowances strictly, promptly, and settle accounts according to current regulations;
proposal, guidelines for adjusting the monthly subsistence allowance level of subjects when the Government adjusts pensions and monthly allowances as directed at point b clause 1 Article 3 of this Circular.
b) Take the lead in coordinating to resolve difficulties and issues arising in implementation within the Ministry of National Defense's management scope;
2. Ministry of Labor, Invalids and Social Affairs
a) Direct the Labor - Invalids and Social Affairs sector to coordinate with local departments, organizations, and mass organizations in examining and disbursing one-time allowance benefits for subjects within the People's Committee's jurisdiction and implement medical insurance and funeral expense regimes as prescribed;
b) Aggregate budget estimates for implementing the regime based on the People's Committee's request, propose the Ministry of Finance to ensure funding. Allocate and transfer budget estimates to provinces for disbursement of benefits to subjects and direct settlement according to current regulations;
c) Direct the adjustment of the monthly subsistence allowance level of subjects when the Government adjusts pensions and monthly allowances as directed at point b clause 1 Article 3 of this Circular.
3. Ministry of Finance
a) Based on the financial allocation requests from the Ministry of National Defense and the Ministry of Labor - Invalids and Social Affairs, ensure funding for the implementation of monthly subsistence allowance and one-time allowance regimes as prescribed by the State Budget Law and review settlement according to current regulations;
b) Take the lead in coordinating with relevant agencies to periodically and spot-check the use of funds for implementing the regimes for subjects as prescribed by law;
4. Central Vietnam Veterans Association
Direct the Veterans Associations at all levels to nominate representatives to join the Steering Committee and Village Policy Council; coordinate with local agencies and mass organizations to review and identify subjects, participate in examining subjects entitled to benefits and policies as directed in this Circular;
5. Vietnam War Service Youth Association
Direct the War Service Youth Associations at all levels to nominate representatives to join the Steering Committee and Village Policy Council; coordinate with local agencies and mass organizations to review and identify subjects, participate in examining subjects entitled to benefits and policies as directed in this Circular.
Article 9. Effective Date of Implementation
1. This Circular shall take effect from March 1, 2012.
2. The monthly allowance regime stipulated at point a clause 1 Article 3 of this Circular shall be implemented from January 1, 2012.
3. From January 1, 2012, military personnel who participated in the resistance war against America to save the country, have been demobilized, discharged, or retired, and belong to the category entitled to receive a one-time allowance under Decision No. 142/2008/QĐ-TTg dated October 27, 2008, and Decision No. 38/2010/QĐ-TTg dated May 6, 2010 of the Government, but have not yet received a decision on the one-time allowance from the competent authority, shall be entitled to the allowance level prescribed at Point a and Point d Clause 2 Article 3 of this Circular..
4. In cases where the subject has served directly in wars for national defense and international missions in different agencies and units, the Ministries and sectors shall base their actions on the last agency or unit where the subject worked to implement their responsibility in resolving the allowance regime for the subject according to Article 9 of Decision No. 62/2011/QĐ-TTg.
5. Those who falsify or forge documents to receive allowances shall be disciplined or criminally prosecuted depending on the nature and severity of the violation, and must return the amount received and compensate for any losses (if any) as prescribed by law.
During implementation, if there are any difficulties, agencies, units, and localities should report them to the Joint Department (through the Ministry of National Defense) for review and resolution./.

SOME EXAMPLES FOR ILLUSTRATION

Example 1. Mr. Nguyen Van A was conscripted in May 1975, participated in combat and service in the Southwest border from 1978, and was demobilized (discharged) in September 1992.
The calculation of the allowance regime for Mr. Nguyen Van A is as follows:
His actual working time in the military from May 1975 to September 1992 is 17 years and 5 months. The level of the monthly allowance is 1,018,000 VND.
Example 2. Mr. Tran Van B was conscripted in October 1975, performed international duties in Cambodia in January 1979, transferred out of the military in October 1991, and retired in 1993.
The calculation of the allowance regime for Mr. Tran Van B is as follows:
His actual working time in the military from October 1975 to October 1991 is 16 years and 1 month. The level of the monthly allowance is 971,000 VND (time spent working outside the military is not counted towards the allowance).
Example 3. Mr. Hoang Van C was conscripted in May 1975 and participated in combat in the Southwest border, due to poor health, he was discharged in January 1978; in January 1979, he worked in a northern border commune and directly participated in combat and service from February 1979 to January 1981, then re-enlisted in the military in February 1982 and was demobilized in January 1993.
The calculation of the allowance regime for Mr. Hoang Van C is as follows:
His actual working time in the military is 13 years and 9 months (including: First period from May 1975 to January 1978 is 2 years and 9 months; second period from February 1982 to January 1993 is 11 years). Time as a commune cadre directly participating in combat and service in the northern border from February 1979 to January 1981 is 2 years. Total working time counted for the allowance is 15 years and 9 months. Mr. C qualifies for the monthly allowance regime. The level of the monthly allowance is 925,000 VND.
Example 4. Mr. Tran Dinh K received the monthly allowance from January 2012 with a level of 925,000 VND/month, in May 2012, Mr. Nguyen Dinh K passed away, his family continued to receive the allowance until the end of May 2012, and his relatives were entitled to a one-time allowance of:
3 months x 925,000 VND/month = 2,775,000 VND.
Example 5. Mr. Hoang Van D was conscripted in April 1977, participated in combat and service in the Southwest border in 1978, due to poor health, he was discharged in September 1980. His actual working time in the military is 3 years and 6 months, counted as 4 years (from April 1977 to September 1980).
The one-time allowance that Mr. Hoang Van D is entitled to is:
2,500,000 VND + [(4 years - 2 years) x 800,000 VND] = 4,100,000 VND.
Example 6. Ms. Nguyen Thi Q joined the Volunteer Corps in February 1979, from May 1979 to October 1982 she directly participated in combat and service in Vị Xuyên District, Ha Giang Province, and returned to her locality in January 1998.
The calculation of the one-time allowance for Ms. Q is as follows:
Her direct participation in the war for national defense from May 1979 to October 1982 is 3 years and 5 months, counted as 3.5 years. The allowance regime is:
2,500,000 VND + [(3.5 years - 2 years) x 800,000 VND] = 3,700,000 VND.

[1] Circular No. 104/2024/TT-BQP replaces and abolishes certain provisions and forms in joint circulars issued by the Ministry of National Defense, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Finance related to personal information declaration when implementing administrative procedures, is based on the following:
"Pursuant to the Law on Legislative Activities dated June 22, 2015;
Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;
Pursuant to the Law on Identity Cards dated November 27, 2023;
Based on the Residence Law dated November 13, 2020;
Pursuant to Resolution No. 142/2024/QH15 dated June 29, 2024 of the seventh session of the 15th National Assembly;
Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;

[7] The phrase “(monthly allowance for each subject 03 copies, one-time allowance for each subject 02 copies)” and the phrase “; retain each subject 01 copy of the file and list of subjects” are abolished as stipulated in point c, Clause 3, Article 4 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars issued by the Ministry of National Defense, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Finance related to personal information declaration when implementing administrative procedures, effective from November 27, 2024.
[8] The phrase “(monthly allowance for each subject 02 copies of the file, including 01 copy with original documents as basis for review; one-time allowance for each subject 01 copy of the file);” “retain each case 01 copy of the file and list of subjects” and the phrase “(each subject 02 copies of the file, including 01 copy with original documents as basis for review)” are abolished as stipulated in point d Clause 3, Article 4 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars issued by the Ministry of National Defense, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Finance related to personal information declaration when implementing administrative procedures, effective from November 27, 2024.
[9] The phrase "before or after obtaining the review opinion of the Policy Department - General Political Department" is abolished pursuant to Point d, Clause 3, Article 4 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance related to the declaration of personal information when performing administrative procedures, which shall take effect from November 27, 2024.
[10] The phrase "(five copies each) for consolidation, requesting the Ministry of Finance to ensure funding" is abolished pursuant to Point e, Clause 3, Article 4 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance related to the declaration of personal information when performing administrative procedures, which shall take effect from November 27, 2024.
[11] The phrase "one-time allowance and" is abolished pursuant to Point g, Clause 3, Article 4 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance related to the declaration of personal information when performing administrative procedures, which shall take effect from November 27, 2024.
[12] Article 24The provision "- Consolidate the funds for paying one-time allowances proposed by military regions and the Command of the Hanoi Capital Military Region, report to the head of the General Political Department, request the Ministry of Finance to allocate funds, coordinate with the Financial Department of the Ministry of National Defense to allocate the budget for units to implement;" is abolished pursuant to Point g, Clause 3, Article 4 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance related to the declaration of personal information when performing administrative procedures, which shall take effect from November 27, 2024.
[13] Articles 7 and 8 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance related to the declaration of personal information when performing administrative procedures, which shall take effect from November 27, 2024, are stipulated as follows:
“Article 7. Effective Date
1. This Circular takes effect from November 27, 2024.
2. Forms of documents that are part of the administrative procedure files received by agencies, units, and localities from beneficiaries before this Circular takes effect but have not yet been resolved shall continue to be processed according to the provisions of Joint Circular No. 191/2005/TTLT-BQP-BLDTBXH-BTC, Joint Circular No. 21/2008/TTLT-BQP-BLDTBXH-BTC, Joint Circular No. 144/2008/TTLT-BQP-BLDTBXH-BTC, Joint Circular No. 190/2011/TTLT-BQP-BLDTBXH-BTC, Joint Circular No. 01/2012/TTLT-BQP-BLDTBXH-BTC, Joint Circular No. 102/2012/TTLT-BQP-BLDTBXH-BTC, and Joint Circular No. 138/2015/TTLT-BQP-BLDTBXH-BTC.
Article 8. Responsibility for Implementation
The Chief of the General Staff, the Director of the General Political Department, commanders of agencies and units under the Ministry of National Defense, and relevant organizations and individuals are responsible for implementing this Circular./.
[14] This Appendix is replaced pursuant to Clause 1, Article 4 of Circular No. 104/2024/TT-BQP replacing and abolishing certain provisions and forms in joint circulars of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance related to the declaration of personal information when performing administrative procedures, which shall take effect from November 27, 2024.
