DECISION OF THE MINISTER OF INDUSTRY
On issuing the Model Electricity Purchase and Sale Contract for Domestic Purposes
for residential purposes
THE MINISTER OF INDUSTRY
Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Based on the Civil Code dated June 14, 2005;
Pursuant to the Electricity Law dated December 3, 2004;
Pursuant to Decree No. 105/2005/NĐ-CP dated August 17, 2005 of the Government detailing and guiding the implementation of certain provisions of the Electricity Law;
Based on the proposal of the Director of the Legal Affairs Department and the Director of the Industrial Safety Technology Bureau,
DECISION:
Article 1. This Decision promulgates the Model Electricity Purchase and Sale Contract for Domestic Purposes (hereinafter referred to as the Contract) to be applied to electricity purchase and sale contracts between retail electricity suppliers (hereinafter referred to as the Seller) and electricity consumers for domestic purposes (hereinafter referred to as the Buyer).
Article 2. The language used in the Contract shall be Vietnamese.
The term of the Contract shall be agreed upon by both parties, with a maximum duration of five years and may be extended if neither party requests termination of the contract.
Article 3. The Seller shall be responsible for publicly announcing the Model Electricity Purchase and Sale Contract at its transaction offices, organizing the printing of contracts according to the model, re-signing existing domestic electricity purchase and sale contracts signed before this Decision takes effect, and completing these actions by June 30, 2007.
In cases where the Buyer wishes to re-sign the contract earlier than planned by the Seller, the Seller shall be responsible for negotiating to implement the re-signing of the contract. During the period before the contract is re-signed, all parties involved in the electricity purchase and sale must continue to comply with the provisions of the Electricity Law and Decree No. 105/2005/NĐ-CP dated August 17, 2005 of the Government detailing and guiding the implementation of certain provisions of the Electricity Law.
Article 4. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 53/2001/QĐ-BCN dated November 14, 2001 of the Minister of Industry on issuing the Model Electricity Purchase and Sale Contract for Domestic Purposes.
Article 5. The Heads of the Ministry's Office, Inspectorate, Departments, Bureaus under the Ministry, General Directors of Vietnam Electricity Corporation, Directors of Provincial Industry Departments under centrally governed cities and provinces, Directors of retail electricity suppliers, and Heads of relevant agencies and units shall be responsible for implementing this Decision.
