Guidelines on declaration, issuance of permits for radiation work and issuance of radiation worker certificates

Pursuant to the Atomic Energy Law dated June 3, 2008;

Pursuant to Decree No. 07/2010/NĐ-CP dated January 25, 2010 of the Government detailing and guiding the implementation of certain provisions of the Atomic Energy Law;

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology,

The Ministry of Science and Technology hereby provides guidelines on declaration, issuance of permits for radiation work and issuance of radiation worker certificates as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides on:

1. Declaration of radioactive materials, radioactive waste, nuclear source material, nuclear material, radiation equipment, and nuclear equipment.

2. Issuance, extension, amendment, supplementation, and reissuance of permits for conducting the following radiation works:

a) Operation of irradiation equipment;

b) Use of radiation equipment;

c) Use of radioactive materials;

d) Production of radioactive materials;

đ) Processing of radioactive materials;

e) Storage of radioactive materials;

g) Treatment, storage of radioactive waste, used sources;

h) Export of radioactive materials, nuclear source material, nuclear material, nuclear equipment;

i) Import of radioactive materials, nuclear source material, nuclear material, nuclear equipment;

k) Packaging, transport of radioactive materials, nuclear source material, nuclear material;

l) Transport of radioactive materials, nuclear source material, nuclear material through Vietnam's territory;

m) Construction of radiation facilities;

n) Change in scale and scope of operation of radiation facilities;

o) Termination of radiation facility operations.

3. Issuance of radiation worker certificates for performing the works specified in Clause 1, Article 28 of the Atomic Energy Law.

Article 2. Applicability

This Circular applies to organizations and individuals related to activities prescribed in Article 1 of this Circular.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Use of radioactive materials means the use of unsealed radioactive sources and separate sealed radioactive sources not incorporated into equipment.

2. Operation of irradiation equipment means the use of accelerators, radiotherapy equipment, or irradiation equipment for sterilization and material processing.

3. Use of radiation equipment means the use of radiation equipment incorporating radioactive sources or X-ray emitting devices, excluding accelerators, radiotherapy equipment, irradiation equipment for sterilization and material processing.

4. Use of diagnostic X-ray equipment in medicine means the use of X-ray emitting devices in medical diagnosis, including fluoroscopy, conventional radiography, X-ray television fluoroscopy, dental X-ray, mammography, mobile X-ray, computed tomography (CT) scanner, bone densitometry X-ray, interventional and vascular X-ray, veterinary X-ray.

5. Storage of radioactive materials means temporary storage of radioactive materials from receipt until use or transfer to another organization or individual.

6. Change in scale and scope of radiation facility operations means changing the location of installed fixed radiation sources, altering operational limits from those specified in the permit, modifying technical parameters of radiation equipment affecting safety, or changing the structure of radiation safety systems.

Article 4. Provisions on declaration

1. Organizations and individuals must declare to the competent authority specified in Article 8 of this Circular within seven working days from the date they have radioactive materials, radioactive waste, radiation equipment not exempted, or nuclear source material, nuclear material, nuclear equipment.

2. In cases where organizations and individuals apply for a permit to conduct radiation work within the time limit specified in Clause 1 of this Article, they are exempted from the declaration procedure.

3. Organizations and individuals operating national radioactive waste treatment and storage facilities, service facilities for treatment and storage of radioactive waste, used sources, must declare to the competent authority each time they receive radioactive waste or used sources, in accordance with Clause 1 of this Article.

Article 5. Provisions on the issuance of permits for radiation work

1. Organizations and individuals conducting radiation works as specified in Clause 2, Article 1 of this Circular must complete procedures to request a permit before commencing such work.

2. Organizations and individuals possessing radioactive materials that have not been put into use or transferred to other organizations or individuals within one month must complete procedures to request a permit for storing radioactive materials.

3. Organizations and individuals must complete procedures to request a permit for conducting radiation work before putting into operation facilities after completing construction, changing scale, and scope of activities.

4. Organizations and individuals with used radiation sources from previously permitted radiation work must complete procedures to request a permit for handling and storing used radiation sources each time they handle or store them. This provision does not apply to national radioactive waste storage facilities, service facilities for processing and storing radioactive waste, and used radiation sources.

5. Organizations and individuals requesting permits for simultaneously conducting multiple radiation works using multiple radiation sources may be issued a single general permit.

Article 6. General requirements for application files for permit issuance and radiation worker certification

1. Information in the file must be accurate. Certificates, licenses, or other documents with validity periods must remain valid during the processing period. Foreign language documents must be translated into Vietnamese. Copies and translations must be notarized or certified by the organization requesting the permit.

2. The file can be submitted directly at the competent authority's office or sent via postal mail.

Article 7. Conditions for issuing permits and radiation worker certificates

1. Organizations and individuals will be issued permits for conducting radiation work if they meet the following conditions:

a) Submitting a complete file as prescribed in this Circular;

b) Paying the radiation safety assessment fee and permit issuance fee as stipulated by law;

c) Meeting the conditions set forth in Article 75 of the Atomic Energy Law;

d) Radiation workers having proof of radiation safety training.

2. Individuals will be issued radiation worker certificates if they meet the following conditions:

a) Submitting a complete file as prescribed in this Circular;

b) Paying the certificate issuance fee as stipulated by law;

c) Meeting the conditions set forth in Clause 2, Article 28 of the Atomic Energy Law.

Chapter II

APPLICATION PROCEDURES

Article 8. Classification of Reporting

1. Organizations and individuals possessing radioactive materials, radioactive waste, nuclear source materials, nuclear materials, nuclear equipment, and radiation equipment except those specified in Clauses 2 and 3 of this Article shall report to the Radiation and Nuclear Safety Administration.

2. Organizations and individuals possessing mobile medical X-ray diagnostic equipment operating across two or more provinces (hereinafter referred to as province) shall report to the Department of Science and Technology of the province where their main office is located.

3. Organizations and individuals possessing medical X-ray diagnostic equipment not covered under Clause 2 of this Article shall report to the Department of Science and Technology of the province where the equipment is installed and used.

Article 9. Reporting Procedures

1. Organizations and individuals must report to the competent authority for each radioactive source, radiation equipment, type of nuclear source material, nuclear material, and radioactive waste according to the corresponding reporting form as specified in Appendix I attached to this Circular.

2. Within five working days from the date of receipt of the reporting form, the competent authority is responsible for issuing a confirmation of receipt of the report according to the model specified in Appendix IV attached to this Circular.

Chapter III

APPLICATION FILES FOR PERMIT ISSUANCE FOR RADIATION WORK AND RADIATION WORKER CERTIFICATES

Article 10. Documents for Application to Obtain a Permit for Operating Radiation Emitting Equipment, Using Radiation Devices, and Using Radioactive Materials

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. A radiation worker declaration form and safety officer declaration form according to Model 01-I/ATBXHN as prescribed in Appendix I issued together with this Circular;

3. Declaration forms for sealed radioactive sources, unsealed radioactive sources, accelerators, X-ray emitting devices, neutron generators according to corresponding models as prescribed in Appendix I issued together with this Circular;

4. A safety assessment report on operating radiation emitting equipment, using radiation devices, or using radioactive materials according to Model 01-III/ATBXHN as prescribed in Appendix III issued together with this Circular;

5. Copies of establishment decision, business registration certificate, investment certificate, or practice registration certificate. In case these documents are lost, confirmation from the issuing authority must be provided;

6. Copies of manufacturer's documentation providing information as declared in the sealed radioactive source declaration form, unsealed radioactive source declaration form, accelerator declaration form, X-ray emitting device declaration form, neutron generator declaration form. In case there is no manufacturer's documentation for such information, the applicant organization or individual must re-determine the activity, radionuclide name of sealed radioactive sources, unsealed radioactive sources, and technical parameters of accelerators, X-ray emitting devices, neutron generators;

7. Copies of service contracts for personal dose measurement with organizations or individuals holding a registration certificate for personal dose measurement services;

8. Copies of radiation worker certificates of the safety officer and personnel responsible for the work as stipulated in Clause 1, Article 28 of the Atomic Energy Law. In case there is no certificate, the application for issuance of a radiation worker certificate according to Article 22 of this Circular and the application for issuance of a permit to conduct radiation work must be submitted;

9. Translations of foreign language documents;

The provisions of this Article do not apply to applications for permits to use X-ray diagnostic equipment in healthcare;

Article 11. Documents for Application to Obtain a Permit to Use X-ray Diagnostic Equipment in Healthcare

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. A radiation worker declaration form and safety officer declaration form according to Model 01-I/ATBXHN as prescribed in Appendix I issued together with this Circular;

3. A declaration form for X-ray diagnostic equipment in healthcare according to Model 06-I/ATBXHN as prescribed in Appendix I issued together with this Circular;

4. A safety assessment report on using X-ray diagnostic equipment in healthcare according to Model 02-III/ATBXHN as prescribed in Appendix III issued together with this Circular;

5. Copies of establishment decision, business registration certificate, investment certificate, or practice registration certificate. In case these documents are lost, confirmation from the issuing authority must be provided;

6. Copies of manufacturer's documentation providing information as declared in the X-ray diagnostic equipment in healthcare declaration form. In case there is no manufacturer's documentation for the declared information, the applicant organization or individual must re-determine the technical parameters of the X-ray diagnostic equipment in healthcare;

7. Copies of service contracts for personal dose measurement with organizations or individuals holding a registration certificate for personal dose measurement services;

8. Copies of radiation worker certificates of the safety officer. In case there is no certificate, the application for issuance of a radiation worker certificate according to Article 22 of this Circular and the application for issuance of a permit to conduct radiation work must be submitted;

9. Translations of foreign language documents;

Article 12. Documents for application to obtain a permit for production and processing of radioactive materials

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. A radiation worker declaration form and safety officer declaration form according to Model 01-I/ATBXHN as prescribed in Appendix I issued together with this Circular;

3. Safety assessment report for the work of producing and processing radioactive materials according to model 03-III/ATBXHN as prescribed in Appendix III issued together with this Circular;

4. A copy of the decision on establishment of the organization, business registration certificate, investment certificate, or practice registration certificate. In case these documents are lost, confirmation from the authority issuing the establishment decision or business registration certificate, investment certificate, or practice registration certificate must be provided;

5. A copy of the service contract for determining individual radiation dose with organizations or individuals holding a registration certificate for radiation dose measurement services;

6. A copy of the radiation worker certificate of the person responsible for safety and staff performing the work as stipulated in Clause 1, Article 28 of the Atomic Energy Law. In case there is no certificate, an application for issuance of a radiation worker certificate as prescribed in Article 22 of this Circular must be submitted along with the application for a permit to conduct radiation work;

Article 13. Documents for application to obtain a permit for storage of radioactive materials

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. Declaration form for sealed radioactive sources and unsealed radioactive sources according to the corresponding models as prescribed in Appendix I issued together with this Circular;

3. Safety assessment report for the work of storing radioactive materials according to model 04-III/ATBXHN as prescribed in Appendix III issued together with this Circular.

Article 14. Documents for application to obtain a permit for self-processing and storage of used radioactive sources

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. Declaration form for sealed radioactive sources according to model 04-I/ATBXHN as prescribed in Appendix I issued together with this Circular;

3. Safety assessment report for the storage of used radioactive sources according to model 04-III/ATBXHN as prescribed in Appendix III issued together with this Circular.

Article 15. Documents for application to obtain a permit for disposal and storage of radioactive waste, used radioactive sources at the national radioactive waste storage facility or a service facility for disposal and storage of radioactive waste, used radioactive sources

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. Declaration form for radiation workers and radiation safety supervisors according to model 01-I/ATBXHN as prescribed in Appendix I issued together with this Circular.

3. Safety assessment report for the disposal and storage of radioactive waste, used radioactive sources at the national radioactive waste storage facility or a service facility for disposal and storage of radioactive waste, used radioactive sources according to model 05-III/ATBXHN as prescribed in Appendix III issued together with this Circular.

4. A copy of the decision on establishment of the organization, business registration certificate, investment certificate, or practice registration certificate. In case these documents are lost, confirmation from the authority issuing the establishment decision or business registration certificate, investment certificate, or practice registration certificate must be provided;

5. A copy of the service contract for determining individual radiation dose with organizations or individuals holding a registration certificate for radiation dose measurement services;

6. A copy of the radiation worker certificate of the person responsible for safety and staff performing the work as stipulated in Clause 1, Article 28 of the Atomic Energy Law. In case there is no certificate, an application for issuance of a radiation worker certificate as prescribed in Article 22 of this Circular must be submitted along with the application for a permit to conduct radiation work;

Article 16. Documents for application to obtain a permit for export of radioactive materials, nuclear source materials, nuclear materials, and nuclear equipment

1. Application form for obtaining a permit to conduct radiation work according to model 02-II/ATBXHN as prescribed in Appendix II issued together with this Circular.

2. Declaration forms for sealed radioactive sources, unsealed radioactive sources, nuclear source materials, nuclear materials, and nuclear equipment according to the corresponding models as prescribed in Appendix I issued together with this Circular;

3. Safety assessment report for the export of radioactive materials, nuclear source materials, nuclear materials, and nuclear equipment according to model 06-III/ATBXHN as prescribed in Appendix III issued together with this Circular;

4. A copy of the decision on establishment of the organization, business registration certificate, investment certificate, or practice registration certificate. In case these documents are lost, confirmation from the authority issuing the establishment decision or business registration certificate, investment certificate, or practice registration certificate must be provided;

5. A copy of the manufacturer's documentation providing information as declared in the declaration forms for sealed radioactive sources, unsealed radioactive sources, nuclear source materials, nuclear materials, and nuclear equipment. In case there is no manufacturer's documentation for the declared information, the organization or individual applying for the permit must re-determine the activity, radionuclide name of sealed radioactive sources and unsealed radioactive sources, type and chemical composition of nuclear source materials and nuclear materials, and technical specifications of nuclear equipment;

6. A copy of the purchase contract and agreement on transfer and acceptance of radioactive sources between the exporting organization or individual in Vietnam and the accepting organization or individual abroad;

7. A copy of the import permit issued by the competent authority of the importing country for the organization or individual importing high-risk nuclear materials and radioactive materials;

8. Translation of foreign language documents

Article 17. Documents for Application to Obtain a Permit for Importing Radioactive Materials, Nuclear Source Materials, Nuclear Materials, and Nuclear Equipment

1. An application form for obtaining a permit to conduct radiation work according to Model 02-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. Declaration forms for sealed radioactive sources, unsealed radioactive sources, nuclear source materials, nuclear materials, and nuclear equipment according to the corresponding models as prescribed in Appendix I issued together with this Circular;

3. A safety assessment report on the importation of radioactive materials, nuclear source materials, nuclear materials, and nuclear equipment according to Model 06-III/ATBXHN as prescribed in Appendix III issued together with this Circular;

4. A copy of the decision on establishment of the organization, business registration certificate, investment certificate, or practice registration certificate. In case these documents are lost, confirmation from the authority issuing the establishment decision or business registration certificate, investment certificate, or practice registration certificate must be provided;

5. A copy of the manufacturer's documentation providing information as declared in the declaration form for sealed radioactive sources, unsealed radioactive sources, nuclear source materials, nuclear materials, and nuclear equipment;

6. A copy of the purchase and sale contract or transfer agreement for radioactive sources between the importing organization or individual in Vietnam and the exporting organization or individual abroad;

7. A copy of the consignment import contract between the entrusting organization or individual and the entrusted organization or individual in cases of consignment imports;

8. Translation of foreign language documents.

Article 18. Documents for Application to Obtain a Permit for Packaging, Transporting, and Transit Transport of Radioactive Materials, Radioactive Waste, Nuclear Source Materials, and Nuclear Materials

1. An application form for obtaining a permit to conduct radiation work according to Model 03-II/ATBXHN or Model 04-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. Declaration forms for sealed radioactive sources, unsealed radioactive sources, radioactive waste, nuclear source materials, and nuclear materials according to corresponding models as prescribed in Appendix I issued together with this Circular;

3. Declaration forms for escort personnel according to Model 02-I/ATBXHN as prescribed in Appendix I issued together with this Circular;

4. A safety assessment report on packaging, transporting, or transit transport of radioactive materials, radioactive waste, nuclear source materials, and nuclear materials according to Model 07-III/ATBXHN as prescribed in Appendix III issued together with this Circular;

5. Transportation contract if the sender is different from the transporter;

6. A copy of the radiation worker certificate of the person responsible for emergency response. If there is no certificate, an application for issuance of a radiation worker certificate must be submitted according to Article 22 of this Circular along with the application for a permit to conduct radiation work.

Article 19. Documents for Application to Obtain a Permit for Constructing a Radiation Facility

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. A safety analysis report on constructing a radiation facility according to Model 08-III/ATBXHN as prescribed in Appendix III issued together with this Circular.

Article 20. Documents for Application to Obtain a Permit for Changing the Scale or Scope of Operation of a Radiation Facility

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. A safety analysis report on changing the scale or scope of operation of a radiation facility according to Model 09-III/ATBXHN as prescribed in Appendix III issued together with this Circular.

Article 21. Documents for Application to Obtain a Permit to Cease Operations at a Radiation Facility

1. An application form for obtaining a permit to conduct radiation work according to Model 01-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. A safety analysis report on ceasing operations at a radiation facility according to Model 10-III/ATBXHN as prescribed in Appendix III issued together with this Circular.

Article 22. Documents for Application to Obtain a Radiation Worker Certificate

1. An application form for obtaining a radiation worker certificate with attached photograph according to Model 05-II/ATBXHN as prescribed in Appendix II issued together with this Circular;

2. A copy of the certificate of radiation safety training from a training institution approved by the Ministry of Science and Technology;

3. A copy of relevant professional certificates or qualifications suitable for the job responsibilities;

4. A health examination report from a medical facility at the county level or higher, issued within six months prior to the date of submission of the application for a radiation worker certificate;

5. Three photographs measuring 3 x 4 cm.

Chapter IV

ISSUANCE OF PERMITS FOR CONDUCTING RADIATION WORK AND RADIATION WORKER CERTIFICATES

Article 23. Competence to Issue Radiation Work Permits and Radiation Worker Certificates

1. The Ministry of Science and Technology shall issue the following types of radiation work permits and radiation worker certificates:

a) Permit for operating irradiation equipment;

b) Permit for producing radioactive materials;

c) Permit for processing radioactive materials;

d) Permit for transit transport of radioactive materials, nuclear source materials, and nuclear materials;

đ) Permit for packaging and transporting nuclear source materials and nuclear materials;

e) Permit for exporting and importing nuclear source materials, nuclear materials, and nuclear equipment;

g) Radiation worker certificate for the head nuclear reactor engineer, the head of the nuclear reactor operation shift, the nuclear fuel manager, and the nuclear reactor operator.

2. The Radiation and Nuclear Safety Agency shall issue the types of radiation work permits and radiation worker certificates, except for the cases specified in Clauses 1 and 3 of this Article;

3. The Provincial Department of Science and Technology shall issue permits for using medical X-ray diagnostic equipment and radiation worker certificates for the safety officer at medical X-ray diagnostic facilities operating within the province.

In the case where the medical X-ray diagnostic equipment of an organization or individual with its main office in Province A is installed and used in Province B, the Provincial Department of Science and Technology of Province B shall issue the permit for using medical X-ray diagnostic equipment and the radiation worker certificate for the safety officer.

In the case where mobile medical X-ray diagnostic equipment is used in different provinces, the Provincial Department of Science and Technology of the province where the organization or individual owning the X-ray equipment has its main office shall issue the permit for using medical X-ray diagnostic equipment and the radiation worker certificate for the safety officer.

4. In the case where a healthcare facility conducts multiple radiation works, including the use of medical X-ray diagnostic equipment while simultaneously using radioactive materials (nuclear medicine) or operating irradiation equipment (radiation therapy), it may request the Radiation and Nuclear Safety Agency or the local Provincial Department of Science and Technology to issue a radiation worker certificate for the safety officer.

Article 24. Procedures for Issuing Radiation Work Permits and Radiation Worker Certificates

1. Organizations and individuals requesting radiation work permits and radiation worker certificates as stipulated in Clauses 1, 2, and 4 of Article 23 of this Circular shall submit their application to the Radiation and Nuclear Safety Agency and pay the fees for issuing the permits and certificates as prescribed by law.

Organizations and individuals requesting permits for using medical X-ray diagnostic equipment and radiation worker certificates as stipulated in Clauses 3 and 4 of Article 23 of this Circular shall submit their application to the Provincial Department of Science and Technology and pay the fees for issuing the permits and certificates as prescribed by law.

2. Within the time limit specified in point a and point c, Clause 2, Article 77 of the Atomic Energy Law, the Radiation and Nuclear Safety Agency shall be responsible for reviewing the application and issuing radiation work permits for the cases specified in Clause 2 of Article 23 of this Circular or submitting to the Ministry of Science and Technology for the cases specified in Clause 1 of Article 23 of this Circular. The permit issued by the Ministry of Science and Technology shall be in accordance with Form 01-V/ATBXHN attached as Appendix V to this Circular. The permit issued by the Radiation and Nuclear Safety Agency shall be in accordance with Form 02-V/ATBXHN attached as Appendix V to this Circular.

Within the time limit specified in point b, Clause 2, Article 77 of the Atomic Energy Law, the Provincial Department of Science and Technology shall be responsible for reviewing the application and issuing permits for using medical X-ray diagnostic equipment in accordance with Form 03-V/ATBXHN attached as Appendix V to this Circular.

3. Within ten working days from the date of receiving a complete and valid application, the competent authority shall be responsible for reviewing the application and issuing the radiation worker certificate, except for the cases specified in Clause 4 of this Article. The radiation worker certificate shall be issued in accordance with the form specified in Appendix VI attached to this Circular.

4. In the case where the application for a radiation worker certificate is submitted together with the application for a radiation work permit, the review period for the application and issuance of the radiation worker certificate shall follow the processing time for the radiation work permit application.

5. In the case where the issuance of a permit or a radiation worker certificate is not approved, the competent authority issuing the permit or certificate must respond in writing and specify the reasons within the time limits specified in Clauses 2, 3, and 4 of this Article.

Article 25. Term of Radiation Work Permit and Radiation Worker Certificate

1. The permit for exporting, importing open radioactive sources used in nuclear medicine and radioactive isotope applications has a term of 12 months and is issued for multiple shipments. The permit for exporting, importing nuclear source materials, nuclear materials, nuclear equipment, and other radioactive substances has a term of 6 months and is issued for each shipment.

2. The permit for transporting radioactive substances, nuclear source materials, and nuclear materials through Vietnam's territory has a term of 6 months.

3. The permit for operating radiation emitting devices has a term of 5 years.

4. The permit for conducting other radiation work not specified in Clauses 1, 2, and 3 of this Article has a term of 3 years.

5. The radiation worker certificate has a term of 5 years.

Chapter V

EXTENSION, AMENDMENT, SUPPLEMENTATION, REISSUANCE OF PERMITS AND REISSUANCE OF RADIATION WORKER CERTIFICATES

Article 26. Extension of Permits

1. Organizations and individuals continuing to conduct radiation work beyond the term recorded on the permit must submit an extension application to the competent authority at least 60 days before the permit expires. After this time, organizations and individuals must submit the application and pay the fees as if applying for a new permit.

2. The extension application file includes:

a) An application for permit extension according to Form 06-II/ATBXHN prescribed in Appendix II attached to this Circular;

b) A declaration form for new radiation workers or radiation safety supervisors compared to the previous permit application or extension;

c) A radiation safety assessment report according to the corresponding form prescribed in Appendix III attached to this Circular;

d) A copy of the previously issued permit that is about to expire.

3. The application for permit extension shall be submitted to the competent authority as stipulated in Clause 1 of Article 24 of this Circular.

4. Within the time limit set out in Clause 2 of Article 77 of the Atomic Energy Law, the competent authority is responsible for issuing an extended permit or rejecting it in writing with clear reasons.

5. The term of the extended permit starts from the expiration date of the original permit.

Article 27. Amendment and Supplement to Permits

1. Organizations and individuals must request amendments and supplements to permits in the following cases:

a) Changing information about the organization or individual recorded in the permit including name, address, phone number, fax number;

b) Changing information about the export/import customs checkpoint for export/import permits, transit transport permits; transport route for transport permits, transit transport permits;

c) Reducing the quantity of radioactive sources or radiation devices already permitted due to transfer, export, or loss.

2. Documents for requesting amendment and supplement to permits include:

a) An application for amendment and supplement to the permit according to Form 07-II/ATBXHN prescribed in Appendix II attached to this Circular;

b) The original permit requiring amendment;

c) Confirmation documents for changed information such as name, address, phone number, fax number;

d) A copy of the transfer contract for reducing the quantity of radioactive sources or radiation devices due to transfer; a copy of the export permit with customs declaration for reducing the quantity of radioactive sources due to export; confirmation document for lost radioactive sources in case of loss.

3. Documents for requesting amendment and supplement to permits shall be submitted to the competent authority as stipulated in Clause 1 of Article 24 of this Circular.

4. Within 10 working days from the date of receiving complete and valid documents, the competent authority is responsible for issuing the amended and supplemented permit or rejecting it in writing with clear reasons.

5. The term of the amended and supplemented permit is the same as the original permit.

Article 28. Reissuing Licenses

1. Organizations and individuals may request reissuance of licenses when they are torn, damaged, or lost.

In case of loss, organizations and individuals must report to the police at the place where the license was lost and announce the loss on mass media. After thirty days from the date of announcement, if the lost license cannot be found, organizations and individuals may request the competent authority to reissue it.

2. The application for reissuing a license shall include:

a) An application form for reissuing a license according to Model 08-II/ATBXHN prescribed in Appendix II issued together with this Circular;

b) Confirmation from the police regarding the declaration of loss of the license and receipt from the press or broadcasting station regarding acceptance of the announcement of the loss of the license when requesting reissuance due to loss;

c) Original copy of the license when requesting reissuance due to tearing or damage.

3. The application for reissuing a license shall be submitted to the competent authority as stipulated in Clause 1 of Article 24 of this Circular.

4. Within ten working days from the date of receiving complete valid applications, the competent authority shall have the responsibility to reissue the license or reject it in writing with clear reasons.

5. The reissued license shall have the same validity period as the original license.

Article 29. Reissuing Radiation Worker Certificates

1. Radiation workers must go through the procedure for reissuing radiation worker certificates when their certificates expire or are torn, damaged, or lost.

2. The application procedures, issuance process, and validity period of radiation worker certificates in cases of reissuance shall be carried out as for new issuance.

Chapter VI

IMPLEMENTATION

Article 30. Forward Processing

In cases where applications for radiation work permits have been submitted but not yet issued before the effective date of this Circular, organizations and individuals requesting permits shall be responsible for submitting additional documents and materials in accordance with the new provisions of this Circular. Within thirty days from the date of receiving complete supplementary documents and materials, the competent authority shall be responsible for reviewing the application and issuing the permit in accordance with this Circular.

Article 31. Effective Date

1. This Circular takes effect forty-five days from the date of signature. This Circular replaces Circular No. 05/2006/TT-BKHCN dated January 11, 2006, of the Ministry of Science and Technology guiding procedures for declaration, registration, and issuance of permits for activities related to radiation.

2. During implementation, if there are any difficulties, they should be promptly reported in writing to the Ministry of Science and Technology for consideration and resolution./.
