CIRCULAR

Guidelines for sample documents on nationality and sample record books for receiving matters related to nationality

The Ministry of Justice issues guidelines for sample documents on nationality and sample record books for receiving matters related to nationality as follows,

Pursuant to Decree No. 78/2009/NĐ-CP dated September 22, 2009 of the Government detailing and guiding the implementation of certain provisions of the Law on Vietnamese Nationality;

Pursuant to Decree No. 158/2005/NĐ-CP dated December 27, 2005 of the Government on registration and management of civil status records;

Pursuant to Decree No. 93/2008/NĐ-CP dated August 22, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

This Circular provides guidelines for sample documents on nationality and sample record books for receiving matters related to nationality; the subjects using these samples; guidance on the use and management of sample documents on nationality and sample record books for receiving matters related to nationality.

This Circular promulgates 11 types of sample documents on nationality with the following symbols:

2. Vietnamese representative offices abroad;

1. Vietnamese citizens and foreigners who have needs to request resolution of matters related to nationality;

3. Departments of Justice of provinces and centrally governed cities;

4. People's Committees of provinces and centrally governed cities;

5. Ministry of Foreign Affairs;

6. Ministry of Justice.

1. Individuals who need to resolve matters related to nationality may obtain sample documents on nationality from Vietnamese representative offices abroad or provincial Departments of Justice, or they can access the sample documents on nationality on the Ministry of Justice's electronic portal (www.moj.gov.vn Administrative Procedures page) to print and use them.

2. Sample documents on nationality must be printed or photocopied on A4 paper and used strictly according to the format and content specified in Article 2 of this Circular.

The Application for Vietnamese Nationality (for persons applying for Vietnamese nationality under Article 22 of the Law on Nationality 2008), symbol TP/QT-2010-ĐXNQT.2 will be valid until December 31, 2012.

The Declaration of Registration to Maintain Vietnamese Nationality, symbol TP/QT-2010-TKĐKGQT and the Certificate of Registration to Maintain Vietnamese Nationality, symbol TP/QT-2010-GXNĐKGQT will be valid until July 1, 2014.

3. Sample record books for receiving matters related to nationality may be printed or photocopied and bound into volumes on A3 paper or designed on computers using word processing programs strictly according to the format and content specified in Article 3 of this Circular.

The Record Book for Receiving Registration to Maintain Vietnamese Nationality, symbol TP/QT-2010-SĐKGQT will be valid until July 1, 2014.

The model of the Register for receiving applications to retain Vietnamese citizenship, designated TP/QT-2010-SĐKGQT, shall be used until July 1, 2014.

Article 6. Management of registers for receiving matters related to nationality

Registers for receiving matters related to nationality must be stored in accordance with legal regulations on archiving to serve the resolution, management, monitoring, searching, statistics, and consolidation of matters related to nationality.

Article 7. Effective Date

This Circular takes effect from May 10, 2010, and replaces Decision No. 60/1999/QĐ-TP-QT dated April 7, 1999, issued by the Minister of Justice regarding the issuance of forms related to Vietnamese nationality./.
