 Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of the Prime Minister promulgating the Regulation on the establishment, organization, and operation of inter-sectoral coordination organizations;

Implementing Decision No. 197/QĐ-TTg dated January 25, 2014 of the Prime Minister regarding the reinforcement of the National Committee for the Elderly of Vietnam;

At the proposal of the Director of the Department of Non-Governmental Organizations;

The Minister of Home Affairs issues this Circular regulating the Elderly Work Committee at the provincial level, centrally governed cities, and the Elderly Work Committee at the district, city district, town, and provincial city levels.

Article 1. General Provisions

1. Elderly Work Committee at the provincial level, centrally governed cities (hereinafter referred to collectively as the provincial level)

b) The Elderly Work Committee at the provincial level shall be established and operate in a collective manner with majority voting as decided by the Chairman of the People's Committee at the provincial level.

c) The Head of the Elderly Work Committee at the provincial level shall submit to the Chairman of the People's Committee at the provincial level for issuance of the operational regulations of the Elderly Work Committee at the provincial level; and assign specific tasks to members participating in the Committee.

d) Members of the Elderly Work Committee at the provincial level shall serve in兼任职务。

d) The Provincial Senior Citizens' Work Committee does not have its own account and seal. The Chairman and the Deputy Chairman in charge of the Provincial Senior Citizens' Work Committee record their positions (titles) and sign documents of the Provincial Senior Citizens' Work Committee in accordance with Point b Clause 2 Article 12 Circular No. 01/2011/TT-BNV dated January 19, 2011 of the Ministry of Home Affairs guiding the format and technical presentation of administrative documents.

e) The operating budget of the Provincial Senior Citizens' Work Committee shall be implemented in accordance with Article 19 Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of the Prime Minister on the issuance of regulations on establishment, organization, and operation of inter-sectoral coordination organizations.

a) The Senior Citizens' Work Committee at the district level is an inter-sectoral coordinating organization assisting the Chairman of the People's Committee at the district level in directing and coordinating among specialized agencies under the People's Committee at the district level, People's Committees at the commune level, and related organizations in addressing issues regarding mechanisms and policies to implement senior citizens' work.

b) The Senior Citizens' Work Committee at the district level is established by the Chairman of the People's Committee at the district level and operates under a collective system with majority voting.

c) The Chairman of the Senior Citizens' Work Committee at the district level submits to the Chairman of the People's Committee at the district level for promulgation of the operational regulations of the Committee; assigns specific tasks to members participating in the Senior Citizens' Work Committee.

d) Members of the Senior Citizens' Work Committee at the district level operate on a part-time basis.

d) The Senior Citizens' Work Committee at the district level does not have its own account and seal. The Chairman and the Deputy Chairman in charge record their positions (titles) when signing documents of the Senior Citizens' Work Committee at the district level in accordance with Point b Clause 2 Article 12 Circular No. 01/2011/TT-BNV dated January 19, 2011 of the Ministry of Home Affairs guiding the format and technical presentation of administrative documents.

e) The operating budget of the Senior Citizens' Work Committee at the district level shall be implemented in accordance with Article 19 Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of the Prime Minister on the issuance of regulations on establishment, organization, and operation of inter-sectoral coordination organizations.

Article 2. Tasks of the Provincial Elderly Work Board and the District Elderly Work Board

1. The Provincial Elderly Work Board assists the Chairman of the Provincial People's Committee:

a) To study and propose directions, five-year plans and annual plans, tasks, and measures to implement elderly care work and promote the role of the elderly;

c) To direct the implementation of international cooperation activities regarding elderly care work and promoting the role of the elderly within the local area;

a) To implement five-year plans and annual plans, tasks, and measures to carry out elderly care work and promote the role of the elderly;

b) To direct and coordinate activities among specialized agencies under the District People's Committee and commune people's committees, and related organizations in building plans and implementing elderly work and the National Action Program on the Elderly for each stage;

c) To coordinate with relevant agencies in implementing international cooperation activities regarding elderly care work and promoting the role of the elderly within the local area;

d) To urge, inspect, and evaluate the activities of agencies under the District People's Committee and commune people's committees, and related organizations in implementing legal regulations and support policies for the elderly. To summarize, conclude, and regularly report to the Chairman of the District People's Committee and the Provincial Elderly Work Board on the implementation of elderly care work and promoting the role of the elderly.

Article 3. Members of the Provincial Elderly Work Board and the District Elderly Work Board

1. Members of the Provincial Elderly Work Board:

a) Chair: Deputy Chairman of the Provincial People's Committee;

b) Vice-Chairman in charge: Director of the Department of Labor, Invalids, and Social Affairs;

c) Vice-Chairman: Head of the Provincial Association of the Elderly Representative Board;

d) Other members are representatives from the following agencies:

- Department of Civil Service Management;

- Office of the People's Committee;

- Department of Finance;

- Department of Health;

- Department of Planning and Investment;

- Department of Culture, Sports, and Tourism;

- Department of Information and Communications;

- Department of Agriculture and Rural Development;

- Department of Transportation;

- Department of Education and Training;

- Department of Justice;

- Department of Construction;

- Ethnic Minority Affairs Board (for provinces that have established such a board);

- Provincial Social Insurance;

- Related organizations at the provincial level, including: Provincial Vietnam Fatherland Front Committee; Provincial Farmers' Union; Provincial Veterans' Association; Provincial Trade Union; Provincial Women's Union; Provincial Communist Youth Union.

a) Chair: Deputy Chairman of the District People's Committee;

b) Vice-Chairman in charge: Head of the Labor, Invalids, and Social Affairs Section;

c) Vice-Chairman: Head of the District Association of the Elderly Representative Board;

d) Other members are representatives from the following agencies:

- Civil Service Management Section;

- Office of the People's Council and People's Committee or People's Committee Office where there is no People's Council;

- Financial and Planning Section;

- Health Section;

- Culture and Information Section;

- Education and Training Section;

- Justice Section;

- Economic and Infrastructure Section and Agricultural and Rural Development Section for districts, or Economic Section and Urban Management Section for towns and cities under the province;

- Ethnic Minority Section (for districts that have established such a section);

- District Social Insurance;

- Related organizations at the district level, including: District Vietnam Fatherland Front Committee; District Farmers' Union; District Veterans' Association; District Trade Union; District Women's Union; District Communist Youth Union.

Article 4. The Standing Office and Working Group of the Provincial Senior Citizens' Work Board and the County Senior Citizens' Work Board

1. The Standing Office and Working Group of the Provincial Senior Citizens' Work Board

a) The Standing Office of the Provincial Senior Citizens' Work Board is the Department of Labor, Invalids and Social Affairs.

b) The Working Group of the Provincial Senior Citizens' Work Board (referred to as the Working Group) is located at the Department of Labor, Invalids and Social Affairs, headed by one civil servant from the Department of Labor, Invalids and Social Affairs, one civil servant from the People's Committee Office of the provincial level, and one member of the Provincial Senior Citizens' Association Council. The members of the Working Group work on a part-time basis.

c) The Working Group operates according to regulations issued by the Head of the Provincial Senior Citizens' Work Board.

a) The Standing Office of the County Senior Citizens' Work Board is the Labor, Invalids and Social Affairs Office.

b) The Working Group of the County Senior Citizens' Work Board (referred to as the Working Group) is located at the Labor, Invalids and Social Affairs Office, headed by one civil servant from the Labor, Invalids and Social Affairs Office, one civil servant from the People's Council and People's Committee Office of the county level or the People's Committee Office of the county where the People's Council is not organized, and one member of the County Senior Citizens' Association Council. The members of the Working Group work on a part-time basis.

c) The Working Group operates according to regulations issued by the Head of the County Senior Citizens' Work Board.

Article 5. Effective Date

1. This Circular takes effect from November 14, 2014.

2. This Circular replaces Circular No. 08/2009/TT-BNV dated September 8, 2009, of the Ministry of Home Affairs guiding the establishment of the Provincial Senior Citizens' Work Board.

Article 6. Responsibility for Implementation

1. The provincial and county People's Committees, specialized agencies under the provincial and county People's Committees, and relevant agencies and organizations shall, based on their functions and responsibilities, be responsible for disseminating information, mobilizing support, coordinating, organizing, and implementing senior citizens' work.

2. The Chairman of the provincial People's Committee shall reorganize the Provincial Senior Citizens' Work Board established according to Circular No. 08/2009/TT-BNV dated September 8, 2009, of the Ministry of Home Affairs in accordance with this Circular.

3. In the course of implementation, if there are difficulties or obstacles, they should be reported to the Ministry of Home Affairs for study and timely revision and supplementation.
